These transboundary movements of waste for recovery or disposal operations, and may consist of an: • “Exit”, where Portugal is the country of dispatch; • an “Entry”, where Portugal is the country of destination; or • “Transit”, with dispatch and destination in a third country, in which a shipment of waste passes by Portugal. In this context the MTR-LL Module of SILiAmb platform, allows the fulfillment of reporting obligations to this competent authority (APA) in relation to: prior information regarding the actual start of waste movement and the written confirmation of its reception, interim and/or final disposal or recovery operation, in compliance with the provisions of articles 15 and 16 of Regulation (EC) No 1013/2006. In short, the MTR-LL aims the partial dematerialization of notification procedures through the dematerialization of movement report to Portuguese Environment Agency. 3 Transboundary Movements of Wastes – “Amber List” SILiAmb – MTR-LL Module – What it is and what it’s for The MTR-LL Module consists in 2 tabs: Notificação and Movimentos (Notification and Movement) After its authorization, APA inserts the data on the platform, according to the Notification document for transboundary shipment of waste (Annex I-A of Regulation (EC) No 1013/2006). Only then it’s possible to fill the tab Movimentos (movements). 4 Transboundary Movements of Wastes – “Amber List” SILiAmb Users – MTR-LL Module Users involved in notification processes that can submit certificates of reception and/or recovery/disposal: • Notifier • Consignee • Disposal/recovery Facility 5 Transboundary Movements of Wastes – “Amber List” Access to SILiAmb – MTR-LL Module Access to SILiAmb – MTR module, is done using the VAT number of the Organization (NIF/NIPC) and a password. These access credentials should be requested to the Portuguese Environment Agency. 6 Transboundary Movements of Wastes – “Amber List” How to create movements 1/11 Select the icon Resíduos (Waste) indicated in 1, and subsequently select the icon MTR – Lista Laranja (MTR – “Amber List”) indicated in 2. 1 2 7 Transboundary Movements of Wastes – “Amber List” How to create movements 2/11 After selecting the icon MTR – Lista Laranja, it becomes visible the list of notifications associated with the user. As mentioned, the user can be the Notifier, the Consignee or the disposal/recovery facility. By default SiliAmb use the current day as limit to show the notifications in course, and only shows the notifications that are in analysis (“Estado”: “Em análise” = State: in analysis) and the notifications whose shipments starts before the current day (which corresponds in the image below to March 9th). March 9th In analysis First Departure 8 Transboundary Movements of Wastes – “Amber List” How to create movements 3/11 Therefore, to see a notification that has its beginning (first departure) for example at March 11th, the user have to change the Date filter, for example to March 15th, as visible in the image below, or change to another day, but it has to be greater than March 11th. March 11th Date filter 9 Transboundary Movements of Wastes – “Amber List” How to create movements 4/11 You can only create a movement, for the notifications that have indicated in the column “Estado”: “Movimentos” (State: Movements) and in the column “Decisão”: “Autorizado” (Decision: Authorized). Then select the notification for which you want to create a movement (1). Note that the tab “Notificação” it is not a fac-simile of Annex IA. To access or create a movement you must select the tab Movimentos (1). 1 11 Transboundary Movements of Wastes – “Amber List” How to create movements 6/11 In the tab Movimentos, you can see the number of movements associated with the notification, with the following information: Data do movimento (1) (date in which begins the movement), Quantidade recebida (2) (quantity of waste received at the disposal/recovery facility) and Data conclusão (3) (date of the main operation), as well as Quantidade atingida (4) (quantity achieved of the total quantity). When the quantity achieved (4) matches the total quantity authorized in the notification, or the number of authorized movements is reached, it is no longer possible to create new movements for that notification. 4 1 2 3 12 Transboundary Movements of Wastes – “Amber List” How to create movements 7/11 To create a new movement, it is necessary to fill the following boxes: Movimento nº (1) (Number of the movement), Quantidade real (2) (Actual quantity of the movement), Nome do Produtor (3) (Name of the producer), Quantidade produzida (4) (Quantity produced by each producer) and then click the icon Adicionar (5) (Add). Note: Use point instead of comma for quantities and the quantities are in tons. 1 3 2 4 5 13 Transboundary Movements of Wastes – “Amber List” How to create movements 8/11 Note: the quantity introduced for the producer (Quantidade produzida (1)) must match the actual amount indicated for movement (Quantidade real (2)), otherwise an error message will appear and you will not be able to create the movement. After adding a producer, it is still possible, if necessary, to make changes, edit or remove the producer and respective amount (icons Editar (Edit) and Remover (Delete) (3)). 1 2 1 1 3 The system, intentionally, does not include an option to freely write the name of the producer and also does not include all the producers. The data refereed to the producers is important in a national context because that information migrates to each national company’s individual record in our Waste Electronic Information System. It is not relevant for foreign producers. That data is on the notification files and dossier (physical): it dully contains the list of producers in the complete notification that the notifier or the competent authority sent to APA. As the producer information can be only manually filled and loaded by APA, for foreign companies we only register a producer if there’s only one producer, It’s out of the question to register 20 or 60 producers, as they sometimes appear on some notifications. In these cases the notifier will 14 appear as the producer. Transboundary Movements of Wastes – “Amber List” How to create movements 9/11 The prior information regarding actual start of a shipment, must be communicated by the notifier at least three working days before the beginning of the shipment. Therefore, the box Data efectiva do Movimento (1) (effective date of the movement) only allows the selection of a date 3 days after the current date (see the calendar below). After selecting the Data efectiva do movimento (1) (effective date of the movement), click the icon Escolher ficheiro (2) (Choose file) and select the movement document for transboundary movements/shipments of waste from your computer (Attention: the movement document cannot exceed the size limit of 5 MB). Finally click the icon Criar movimento (3) (Create a movement) to complete. 1 2 3 15 Transboundary Movements of Wastes – “Amber List” How to create movements 10/11 If all data is entered correctly you will see the message "Novo Movimento Criado“ (new movement created), and the new entry will be visible in the table of movements associated with this notification: (Number (1) and date of the movement (2), in this case: Nº 4 and Data do movimento: 12-03-2015). If any data is not correctly filled an error message will appear referring the boxes to be rectify or those that are unfilled. (In the end of this manual you can see the translation to these error messages.) 1 2 16 Transboundary Movements of Wastes – “Amber List” How to create movements 11/11 After the movement is created and until the end of the day (23:59 p.m) in which the movement is scheduled, it’s possible to make some changes for practical and logistical issues. The possible amendments are: actual quantity of the movement (Quantidade real (1)), quantity produced by each producer (Quantidade produzida (2)), effective date of the movement (Data efectiva do movimento (3)). It’s also possible to remove or do a new upload of the movement document for transboundary movements/shipments of waste in (4). However, if you were not able to make this update until the end of the day (23:59 p.m) foreseen for the movement, or the shipment suffered an unforeseen delay due to force majeure or logistics reasons you can still proceed with the movement until a period of 5 days after the effective date of the movement, without the need for additional communication to this agency. However, if the movement does not occur during this period, the competent authorities must be notified of the cancelling by the end of the 5-day period. 1 2 3 4 17 Transboundary Movements of Wastes – “Amber List” How to submit a Waste Reception Certificate 1/4 The submission of written confirmation of reception of the waste in the disposal or recovery facility, which may be indicated on the Movement document for transboundary movements/shipments of waste (Block 18) or annexed. This submission on SILiAmb can be made by the: - Notifier; - Consignee (if the recipient is not the disposal/recovery facility) - Disposal or recovery facility. 18 Transboundary Movements of Wastes – “Amber List” How to submit a Waste Reception Certificate 2/4 To submit the waste reception certificate, after accessing the SILiAmb, you will have to go through the path previously explained: Resíduos (1) -> MTR-Lista Laranja (2) -> Select the notification in question (3), and then click on the tab Movimentos (4) to upload the certificate of reception of waste. 4 3 1 2 19 Transboundary Movements of Wastes – “Amber List” How to submit a Waste Reception Certificate 3/4 At this stage you must enter the date of reception of the waste (Data da recepção do movimento (1)), click on the icon Escolher ficheiro (2) (choose file), then select from your computer the waste reception certificate (Attention: the certificate cannot exceed the size limit of 5 MB), enter the quantity received (Quantidade recebida (3)) and click on the icon Gravar (4) (Save). 1 2 3 4 20 Transboundary Movements of Wastes – “Amber List” How to submit a Waste Reception Certificate 4/4 As visible in Table bellow, the movements were updated and it is now possible to see the quantity of waste received (Quantidade Recebida (1)). 1 21 Transboundary Movements of Wastes – “Amber List” How to submit a Conclusion Certificate of the Main Operation 1/3 The next step is the submission of the Conclusion Certificate for the main operation (which can be an interim recovery or disposal operation) by the disposal or recovery facility, that can be indicated in the movement document (Block 19) or annexed. This submission on SILiAmb can be made by the: - Notifier; - Consignee (if the recipient is not the disposal/recovery facility); - Disposal or recovery facility. Prior to this phase, you must follow the steps explained in slide 18. 22 Transboundary Movements of Wastes – “Amber List” How to submit a Conclusion Certificate of the Main Operation 2/3 Insert the Data da conclusão da operação principal (1) (date of conclusion of the main recovery or disposal operation), click on the icon Escolher ficheiro (2) (choose file), upload the Certificate (< 5 MB) for the main recovery or disposal operation from your computer and click on the icon Gravar (3) (Save). 1 2 3 23 Transboundary Movements of Wastes – “Amber List” How to submit a Conclusion Certificate of the Main Operation 3/3 As visible bellow, the table of movements is now updated, with the conclusion date (Data de Conclusão (1)) of the main operation. After saving , this movement is completed. 1 24 Transboundary Movements of Wastes – “Amber List” How to submit a Conclusion Certificate of the Subsequent Operation 1/3 When the main operation is an interim recovery or disposal operation and there is a subsequent interim or non-interim recovery or disposal operation, it is necessary to submit also the Certificate of the conclusion for this subsequent operation. By delivering waste to a subsequent operation, the recovery or disposal facility responsible for the interim operation, must obtain from the facility which carries out the subsequent interim or non-interim recovery or disposal operation, a Certificate that indicate that the subsequent operation was completed, as indicated in consent conditions. This certificate may be submitted by the: - Notifier; - Consignee (if the consignee is not the interim recovery/disposal facility); - Interim recovery or disposal facility 25 Transboundary Movements of Wastes – “Amber List” How to submit a Conclusion Certificate of the Subsequent Operation 2/3 For the submission of the Certificate for the subsequent recovery or disposal operation, please enter the date of conclusion of this operation (box Data da conclusão da operação associada (1)), click the icon choose file (Escolher ficheiro (2)), upload the Certificate of conclusion of the operation (< 5 MB) and click the icon Save (Gravar (3)). 1 2 3 26 Transboundary Movements of Wastes – “Amber List” How to submit a Conclusion Certificate of the Subsequent Operation 3/3 After saving, the movement is completed and dully reported to the Portuguese Environment Agency. 27 Transboundary Movements of Wastes – “Amber List” Translation to English of the possible error messages (example) To be valid for submission, you should correct the following errors: - The number of movement must be greater than 0. (1) - The sum of the quantities of producers (2) has to be 25 (3).
