To whom it may concern,
Sillito Environmental Consulting (SEC) has been appointed by the City of Cape Town to
undertake an application for an Environmental Authorisation to construct a sewer
pipeline in the Kuils River area.
Currently nine properties (erven 2423, 2424, 2426, 7409, 7410, 8112, 8113, 8114 and
8115) within Kuils River are currently serviced by means of a conservancy tank situated
on erf 8115 which is pumped out twice a week. In line with the City of Cape Town’s
objective to provide on-site water borne sewerage (City of Cape Town, Water and
Sanitation Standard, 2008) in all urban areas, the City of Cape Town proposes to install
a connector sewer pipeline to serve these erven in question. The preferred option for
this, (gravity system) would be to install a deep sewer pipeline running in a southeastern direction along Van Riebeck Road and connecting to the existing 600mm
diameter sewer in the area. It is anticipated that the pipeline most likely will not fit within
the road reserve itself and as such will have to run through a portion of the adjacent
erven: Erf 8115, Erf 928, Erf 10571, Erf 18030, Erf 915, Erf 935, Erf 936, Erf 922.
The proposed activity triggers two activities listed in terms of the Environmental Impact
Assessment Regulations published in 2010 in terms of the National Environmental
Management Act (Act No. 107 of 1998) as amended. The activities in question are listed
as follows:

 Government Notice R544 Activity 18
As such, a Basic Assessment process is required to apply for authorisation of the
construction of the pipeline.
As the registered landowner, you will be included in the database of the affected parties
and so will be given the opportunity to review and comment on the assessment reports
produced for this application process. Public participation is anticipated to commence in
approximately one month’s time.

The Draft Basic Assessment Report was sent out for the 40 day period of public
comment between 30th July 2014 and 8th September.
The DEA&DP Land Management Region 1 commented that as a hospital is located in
close proximity to the proposed pipeline, comment must be obtained from the
Directorate: Pollution Management with regard to construction related noise impacts and
input must be obtained regarding the latest applicable noise Regulations and Standards.
The aforementioned comment must be included in the final BAR to be distributed for
public comment.

Fighting fit: Students of Kyokushin­Kan
Karate recently competed in a Junior
Inter­Club Kyokushin Tournament. There
were almost 200 competitors ­ all between
the ages of 5 ­ 18yrs ­ who took part. The
Tournament was hosted by All Japan
Kyokushin Union Organisation at the
Bonteheuwel Multipurpose Centre. The
Kyokushin­Kan students of Highbury, Kuils
River and Mitchells Plain did exceptionally
well, winning gold, silver and Bronze in
their respective weight and age categories

Dit was nie net Tamarin Valentine van Morningstar
se eerste keer op ’n vliegtuig nie, maar ook haar eerste
oorsese reis.
Sy het saam met haar Engels-onderwyser, Gina Mantel-Böhr, die toer na Engeland onderneem – ’n jaarlikse instelling by dié skool.
Die hele Morningstar-gemeenskap het Tamarin ondersteun en gehelp om geld in te samel. Haar ma, Sophia, het braaigeleenthede en modevertonings gehou.
Dit is ook moontlik gemaak danksy ’n skenking van
die Heath-skool in Engeland verlede jaar toe die skool
Suid-Afrika besoek het. Hulle kon nie Robbeneiland besoek weens weersomstandighede nie, en het toe die
geld wat dit sou kos, aan die Primêre Skool Alpha in
Morningstar geskenk.
Tamarin was hoofmeisie by dié skool op laerskool
en die skool het dit aan Tamarin bewillig vir haar oorsese reis.
Hulle het op 25 Junie vertrek en drie weke daar deurgebring. Vir Tamarin was die London Eye, asook Buckingham Palace en die “changing of the guards”, van
die talle hoogtepunte. Sy som die ervaring met een
woord op: “Ongelooflik!” Ander hoogtepunte was hul
besoek aan die Londen-museum, die kerkdiens wat hulle in St Paul’s-katedraal bygewoon het en ’n piekniek
in Green Park – nogal met spesiale eetgoed van Sainsbury’s. Sy was bevoorreg om beide die stad én die platteland te sien. Sy was ook in Wallis, waar die besoek
aan die Cardiff-kasteel nog ’n hoogtepunt vir haar was.
Volgens Mantel-Böhr was Tamarin deurentyd ’n ware ambassadeur vir die Hoërskool Durbanville én SuidAfrika.
Met haar terugkoms is sy met ’n banier by die huis
terugverwelkom, en haar ouers het op dieselfde dag ’n
braai gehou om dankie te sê vir almal wat gehelp het
om Tamarin se droom te verwesenlik.

CapeNature would like to thank you for the opportunity to comment on the proposed
development and would like to make the following comments. Please note that our
comments only pertain to the biodiversity related impacts and not to the overall desirability
of the proposed development.
The route (including alternatives) traversed by the proposed pipeline is located within an
urban area and has been transformed, as verified by the Biodiversity Network. There is
however a wetland classified as Other Ecological Support Area on two of the larger erven
traversed. The termination point of the pipeline is on the banks of the Kuils River.
A freshwater ecological specialist study was undertaken, which verified that the wetlands
are highly disturbed and of low ecological value and also indicated the poor, modified
condition of the Kuils River. The Kuils River does still however perform an important
functional and ecosystem services role as the major drainage line in the area.
CapeNature supports the findings of the freshwater ecological specialist study and all the
proposed recommendations must be implemented. In particular, mitigation measures must
be implemented to ensure no spillages of sewage into the Kuils River during the operational
phase as this has the potential to result in impacts of high significance.
CapeNature reserves the right to revise initial comments and request further information
based on any additional information that may be received.

Good afternoon Rhett, SEC acknowledges receipt of Cape Nature’s comments on the above mentioned project in compliance with the feedback received from DEA&DP, thank you. SEC notes that Cape Nature supports the findings and recommendations of the freshwater ecological specialist study and further notes that Cape Nature agrees that the proposed recommendations of the freshwater study must be implemented. Mitigation measures, as recommended by the freshwater specialist, to ensure no spillages of sewage enter the Kuils River during the operational phase have been included in the Environmental Management Plan and will be implemented accordingly. Further, as per comment 3.5 of the DEA&DP: Land Management comment on the Draft BAR dated 8th September, the existing EMP will be revised to include a river maintenance management plan to guide future river maintenance work. Nine properties erven 2423, 2424, 2426, 7409, 7410, 8112, 8113, 8114 and 8115, (hereafter known as “Erf
8115 and the adjacent erven”) within Kuils River are currently serviced by means of a conservancy tank
situated on erf 8115. The City of Cape Town’s Water and Sanitation Department pump this conservancy
tank twice a week and as such, the operation and maintenance costs are high. The applicant, City of Cape Town, thus proposes to construct a sewer connection pipeline to connect Erf
8115 and the adjacent properties to the existing bulk sewer infrastructure in the area. The proposed activity triggers the following listed activities which are listed in terms of Government Notice
No. 544 of 2010, which is promulgated in terms of the NEMA:  GN No. R. 544 Activity No11:
The construction of:
(xi) infrastructure or structures covering 50 square metres or more;
Where such construction occurs within a watercourse or within 32 metres of a watercourse, excluding
where such construction will occur behind the development setback line.
 GN No. R. 544 Activity No 18:
The infilling or depositing of any material of more than 5 cubic metres into, or the dredging excavation,
removal or moving on soil, shells, pebbles or rock of more than 5 cubic metres from:
(i)
a watercourse
The Draft Basic Assessment Report was sent out for the 40 day period of public comment between 30th
July 2014 and 8th September. As per point 3.3 of the attached DEA&DP Land Management Region 1 feedback, DEA&DP
commented that as a loss of wetland habitat and biota could be expected during the construction
of the pipeline within the wetland, comment must be obtained from Cape Nature in this regard. The
aforementioned comment must be included in the final BAR to be distributed for public comment. As such, SEC has sent, for your review and comment, 1 CD and 1 hardcopy of the Draft Basic Assessment

As per comment 3.1, the WULA assessment information will be included in the Final BAR and SEC confirms that the applicant will comply with the SOP between the DEA&DP and DWA for the remainder of the process. As per comment 3.2, the NID will be included in the Final BAR. SEC confirms that further processes under Section 38 of the National Heritage Resources Act (Act 25 of 1999) do not apply and the applicant will comply with SOP between the DEA&DP and HWC for the remainder of the process. As per comment 3.3, SEC has obtained comment from Cape Nature. The comment will be incorporated into the Draft BAR and EMP where applicable, the Comments and Responses Report and will also be attached as part of Appendix F to the Final BAR. As per comment 3.4 SEC has obtained comment from Pollution Management. The comment will be incorporated into the Draft BAR and EMP where applicable and Responses Report and will also be attached as part of Appendix F to the Final BAR. As per comment 3.5, SEC is currently compiling a Maintenance Management Plan for future river maintenance work related to GN. No. R544, Activity 18. This will be included as an Appendix to the Environmental Management Plan contained as Appendix H of the Final BAR. As per comment 3.6 the original signed and dated applicant declaration will be submitted with the final BAR when the BAR is submitted to DEA&DP for a decision. As per comment 3.7, 3.8, 3.9. 3.10, 3.11 and 3.12 proof of all public participation undertaken will be included in Appendix F of the Final BAR. SEC is currently preparing the Final BAR. Once this has been done, it will be circulated for a further 21 days to all relevant Organs of State and registered interested and affected parties prior to being submitted to DEA&DP for a decision. The Department has reviewed the report and has the following
comments:
 If Option 1 is chosen, a Water Use License is triggered for
section 21 (c) impeding or diverting the flow of water in a
watercourse; and (i) altering the bed, banks, course or
characteristics of a watercourse of the National Water Act,
1998 (Act 36 of 1998). The applicant will require authorisation
before any development may commence.
 Chemical toilets that will be utilised during the construction
phase must be located such that it does not pose a risk of
water pollution and its contents must be disposed of at an
appropriate facility.
 No pollution of surface water or ground water resources may
occur due to activities on the property.
 The Stormwater Management Plan must be implemented. The
clean stormwater must be separated from the dirty stormwater
and measures to control illegal dumping of construction waste

In an email dated 4th September 2014 SEC responded to the

 SEC acknowledged receipt of the comment from the

 With regards to point 1 of the attached comments, SEC
submitted a Water Use License Application to Collette Parker
of Water Affairs on the 12th June 2014. Acknowledgement of
receipt attached dated 24th July 2014 was sent with the email
as proof to DWA. The Final BAR will be updated to include
this information accordingly.
 SEC notes point 2- 9 of the attached comments and confirms
that these measures will be incorporated into the Final Basic
Assessment Report as well as the Final Environmental
Management Plan prior to submission to DEA&DP for a
decision.

1) the include the following:
 The Department notes that a WULA was submitted in terms of
the National Water Act, 1998 (Act No 36 of 1998). The
Department requires that the WULA assessment information
be included in the final BAR and that the Applicant/EAP
comply with the Standard Operating Procedure between
DEA&DP and the Department of Water Affairs which came
into effect on 17th June 2014.
 The Department notes that a Notice of Intent to Develop (NID)
was submitted to Heritage Western Cape (HWC). The
Department requires a copy of the NID and Heritage Impact
Assessment (if applicable) to be included in the final BAR and
the that the Applicant/EAP comply with the Standard
Operating Procedure between DEA&DP and HWC which
came into effect on 1st July 2014.
 The Department notes that a loss of wetland habitat and biota
could be expected during the construction of the pipeline
within the wetland. Comment from Cape Nature must be
obtained in this regard and included in the final BAR to be
distributed for public comment.

applicant will comply with the SOP between the DEA&DP and
DWA for the remainder of the process.
 As per comment 3.2, the NID will be included in the Final
BAR. SEC confirms that further processes under Section 38
of the National Heritage Resources Act (Act 25 of 1999) do
not apply and the applicant will comply with SOP between the
DEA&DP and HWC for the remainder of the process.

The Department notes that a hospital is located in proximity to
the proposed pipeline and that noise is likely to be one of the
greatest impacts during the construction phase. The EMP
does not make reference to the latest applicable noise
regulations (Western Cape Noise Control Regulations, 2013).
Comment must be obtained from the Directorate: Pollution
Management with regard to construction related noise impacts
and input must be obtained regarding the latest applicable
noise Regulations and Standards. The aforementioned
comment must be included in the final BAR to be distributed
for public comment.
The EMP must be revised to include a Maintenance
Management Plan (MMP) for future river maintenance work
related to GN. No. R544, Activity 18.
An original signed and dated applicant declaration is required
to be submitted with the final BAR to this Department for

declaration will be submitted with the final BAR when the BAR

 D:PM acknowledges comment is required on noise impacts
especially on the nearby hospital.
 Comments are made in terms of the Western Cape Noise
Control Regulations of 20th June 2013 (P.N 200/2013), (Section
5 of the Environmental Conservation Act, 1989 (Act 73 of
1989)).
 During the construction phase, the contractor must strictly
adhere to the approved working hours as set out by the local
authority and no work must take place on Sundays.
 The contractor must inform surrounding land owners and the
Hospital of the approved working hours, and if any urgent work
is to take place outside of these times.
 According to Table 2 of South African National Standard Codes
(SANS), 10103 of 2008, the hospital falls (most likely) in ‘Urban
districts with one or more of the following: main roads’. For this
type of zonation the outdoor daytime rating level 60dB. Where
possible, the contractor and ECO must ensure that noise levels
are kept below this level.
 In addition, the application must adhere to all the other noise
mitigation measures as listed in section 2.2.3 of the
Environmental management Plan.

Following an email requesting comments on the Draft BAR
sent to Cape Nature on 16th September, Cape Nature
commented as follows:
 All comments made pertain to the biodiversity related impacts
and not to the overall desirability of the proposed development.
 The route (including alternatives) traversed by the proposed
pipeline is located within an urban area and has been
transformed, as verified by the Biodiversity Network. There is
however a wetland classified as ‘Other Ecological Support

point of the pipeline in on the banks of the Kuils River.
A freshwater ecological specialist study was undertaken, which
verified that the wetlands are highly disturbed and of low
ecological value and also indicated the poor, modified condition
of the Kuils River. The Kuils River does still however perform
an important functional and ecosystem services role as the
major drainage line in the area.
Cape Nature supports the findings of the freshwater ecological
specialist study and all the proposed recommendations must
be implemented. In particular, mitigation measures must be
implemented to ensure no spillages of sewage into the Kuils
River during the operational phase as this has the potential to
result in impacts of high significance.
Cape Nature reserves the right to revise initial comments and
request further information based on any additional information
that may be received.

Mitigation measures, as recommended by the freshwater
specialist, to ensure no spillages of sewage enter the Kuils
River during the operational phase have been included in the
Environmental Management Plan and will be implemented
accordingly.
Further, as per comment 3.5 of the DEA&DP: Land
Management comment on the Draft BAR dated 8th September,
the existing EMP will be revised to include a river maintenance
management plan to guide future river maintenance work. This
will be included as an appendix to the EMP and circulated with
the Final BAR.

KUILSRIVER SITE MEETING MINUTES 02/06/14 LOCATION VENUE: DAVENG CONSULTANTS BOARD ROOM TIME: 10:00 DATE: 6TH JUNE 2013 ATTENDEES RONALD VAN VYK CLARET WALKER KIRSTY ROBINSON MEETING OUTCOMES 1. The development footprint will have a diameter of 3metres within which the pipeline will be lain. 2. The deepest point of excavation will be 2.5metres. 3. It has been ascertained that the pipeline will not fit within the paved portion of the road reserve and as such it will be lain adjacent to the paved portion of the road reserve and run within a small portion of each of the adjacent erven. 4. All landowners of the erven which will have the pipeline running through them have been verbally notified by Daveng. 5. Total length of the pipeline will be 510metres with approximately 10 manholes. 6. It is anticipated that the material that will be need to be excavated in order to lay the pipeline will be sand. Should this be the case, the sand will be excavated and laid to one side (not on the portion where the wetland is currently). Once the pipeline has been lain, the sand will be used as backfill. Should the material be clay or another type of material that is difficult to use as backfill (very wet, or lots of rubble), it will be excavated and either re‐used elsewhere if possible or relocated to a general waste landfill. The excavated area containing the pipeline will then in filled in with sand. 7. Option 1 (preferred option)  Cheaper option  Will lie adjacent to already existing infrastructure  It is a requirement of the developer to build a sewer connection pipeline  It will link up with the existing sewerage infrastructure to the South along Van Riebeck Road.  Positive impact for adjacent landowners as they can connect to the system 

Not a preferable option. The condition of the signing over of the title deed was that the pipeline would need to be constructed‐ this has never been done. It is anticipated that the pipeline will not fit entirely within the road reserve and as such will have to run through a portion of each of the adjacent erven along Van Riebeck Road. This would mean that the pipeline would be about 1 metre from the road. The surrounding land use of the area is mixed and comprises of both residential as well as business, a school, a hospital, 2 x service stations as well as a car park. Expected capital value of the activity after completion is R850 000 The construction phase will last approximately one month. During that time the work will done by a combination of manual labour and machine. It is anticipated that approximately 5‐
8 previously disadvantaged individuals will be hired to undertake the construction. This will provide employment for approximately one month. The expected value of employment per person is R200.00 (amounting to R4000.00 per person per month). Any water required during the construction phase will be supplied by water tanker. Municipal water is not anticipated to be required. Municipal power supply is not anticipated to be required as diesel generators will be used to supply all required power on the site.
