1. I received a proof of claim form from the Bankruptcy Court. What is a proof of claim?
A “Proof of Claim” is the official form that a potential creditor must submit regarding any claim
the creditor believes it has against a debtor in bankruptcy, including any amounts owed as of
the date of the bankruptcy filing (i.e. "pre-petition"). The Proof of Claim must be filed with the
claims agent, KCC, or in the district where the case is pending.
A Proof of Claim must be received by the Bar Date, which has been set for Friday, March 4, 2016
at 4:00 p.m. Central Time.
2. I received the bar date notice from the Bankruptcy Court. What is the bar date notice?
The Bar Date Notice provides information about, among other things, the Bar Date, how to file a
Proof of Claim and who must file a Proof of Claim.
The Bar Date is a deadline set by the Bankruptcy Court for filing a Proof of Claim against any of
the debtors (the "Debtors") in the Swift Energy Company Chapter 11 case. The Debtors are:
•
•
•
•
•
•
•
•
•
Swift Energy Operating, LLC
Swift Energy Company
Swift Energy International, Inc.
Swift Energy Group, Inc.
Swift Energy Alaska, Inc.
Swift Energy USA, Inc.
GASRS LLC
SWENCO-Western, LLC
Swift Energy Exploration Services, Inc.
If you believe you have a claim against any of the Debtors, you must submit a Proof of Claim
form to the Debtors' claims agent, KCC. You must submit via US Mail or other hand delivery
system to:
Swift Energy Claims Processing
c/o KCC
2335 Alaska Ave
El Segundo, CA 90245
A Proof of Claim must be received by the Bar Date, which has been set for Friday, March 4, 2016
at 4:00 p.m. Central Time.
3. Why did I receive a Bar Date Notice and Proof of Claim? Does this mean that I have a claim?
The Bar Date Notice and Proof of Claim form were sent to all entities and individuals that the
Debtors' records indicate have done business with, or may have a potential claim against one or
more of the Debtors.
Receipt of a Bar Date Notice and Proof of Claim does not mean you have a claim against any of
the Debtors. You should only submit a Proof of Claim if you believe you have a claim against any
of the Debtors, including for unpaid prepetition amounts (i.e. for amounts due as of December
31, 2015).
4. Do I need to file a Proof of Claim? If I file a Proof of Claim will I automatically be paid for my
pre-petition amount?
Except as otherwise provided in the Bar Date Notice or the order of the Bankruptcy Court
establishing the Bar Date, you must file a Proof of Claim if you believe you have a pre-petition
claim against the Debtors, including for amounts due as of December 31, 2015. The Proof of
Claim form must be received by Friday, March 4, 2016 at 4:00 p.m. Central Time to be included
in the claims process.
Filing a Proof of Claim does not, among other things, automatically qualify you to be paid in full
for a pre-petition claim. The Debtors have filed a Plan of Reorganization that describes the
treatment of allowed claims for each class of creditors.
5. I have already filed a Proof of Claim, do I need to fill out and re-submit the one I received in
the mail?
No. If you have already properly submitted a claim against the Debtors using the Official Form
410 or Proof of Claim form to the Debtors' claims agent, KCC, you do not need to file another
Proof of Claim.
A Proof of Claim must be received by the Bar Date, which has been set for Friday, March 4, 2016
at 4:00 p.m. Central Time.
6. I have already submitted a Proof of Claim form, how can I check if they have received it?
To receive confirmation that your claim has been filed, either enclose a stamped self-addressed
envelope when filing the Proof of Claim form or visit www.kccllc.net/swiftenergy and search
under the “Claim/Creditor Search” tab of the website.
7. Where do I mail my Proof of Claim form?
A Proof of Claim must be received by the Bar Date, which has been set for Friday, March 4, 2016
at 4:00 p.m. Central Time.
Please send your Proof of Claim to the following address:
Swift Energy Claims Processing
c/o KCC
2335 Alaska Ave
El Segundo, CA 90245
8. Does my Proof of Claim form need to be mailed by the bar date or received by the bar date?
Proofs of Claim will only be accepted if they are received by the KCC Claims Processing Center,
or the Bankruptcy Court on or before Friday, March 4, 2016 at 4:00 p.m. Central Time. Proofs of
Claim will not be accepted by fax or email.
9. What happens if I miss the deadline to file a claim? Can I submit a Proof of Claim after the bar
date?
Claims received after the Bar Date will be processed but are subject to objection and may not be
allowed.
10. Do I need to file a Proof of Claim for each Debtor that I hold a claim with? Or can I file one
Proof of Claim for all my pre-petition debt under the main Debtor?
If you have claims against more than one Debtor you must file a separate Proof of Claim against
each Debtor. You must identify on each Proof of Claim the specific Debtor and correlating
bankruptcy case number for that claim.
11. Can I amend a claim after the March 4, 2016 Bar Date?
KCC will process claim amendments received after March 4, 2016, but such amendments may be
subject to objection and may not be allowed.
