Policy statement We are committed to protecting your health, safety and welfare and that of all those who work for us by providing a safe place of work and protecting all workers, service users, customers and visitors from exposure to smoke. All of our workplaces (including our vehicles) are smoke-free and all students, staff and visitors have a right to a smoke-free environment. This no-smoking policy has been devised on the basis of advice from professional bodies as well as in consultation with Trade Unions and complies with the Health Act 2006 and associated regulations. We are committed to a programme of action to make this policy effective and to bring it to the attention of all staff. This policy does not form part of any employee's contract of employment and it may be amended at any time. Throughout this document, “the Company” will refer to the Academies Enterprise Trust or London Academies Enterprise Trust as appropriate. 2. Who is covered by the policy? This policy covers all individuals working at all levels and grades, including senior managers, school leaders, teachers and education support staff, directors, employees, consultants, contractors, trainees, part-time and fixed-term employees, casual and agency staff and volunteers (collectively referred to as staff in this policy). Third parties who have access to our premises (such as consultants, contractors, customers and visitors) are also required to comply with this policy. 3. Personnel responsible for implementation of the policy The Company has overall responsibility for the effective operation of this policy, but has delegated day-to-day responsibility for its operation to the Director of HR. Any questions concerning the operation of this policy should be directed to the Director of HR. Responsibility for monitoring and reviewing the operation of the policy and any recommendations for change to minimise risks to our operations also lies with the Director of HR. All managers have a specific responsibility to operate within the boundaries of this policy, ensure that all staff understand the standards of behaviour expected of them and to take action when behaviour falls below its requirements. All staff must comply with and support this policy. No Smoking Policy 4|P a g e 7 4. Scope and implementation of the policy Smoking is banned in any enclosed or substantially enclosed premises within our workplace and within any area the students have access, e.g. grounds and playing fields. The ban applies to anything that can be smoked and includes, but is not limited to, cigarettes, pipes (including water pipes such as shisha and hookah pipes), cigars and herbal cigarettes. No-smoking signs are displayed at the entrances to enclosed or substantially enclosed premises at our workplace. Staff shall not smoke outside of our workplace at any time when students are present or likely to be present. Staff using our vehicles, whether as a driver or passenger, must ensure the vehicles remain smoke-free. Any of our vehicles that are used primarily for private purposes are excluded from the smoking ban. Any questions concerning these provisions should be directed to the Principal. We are committed to making this policy effective and to promoting a healthy working environment. Staff who experience particular difficulty complying with this policy should discuss their situation with their line manager or the Principal. 5. Breaches of the policy Breaches of this policy will be dealt with under our Disciplinary Procedure and, in serious cases, may be treated as gross misconduct leading to summary dismissal. Smoking in smoke-free premises or vehicles is also a criminal offence and may result in a fixed penalty fine and/or prosecution. No Smoking Policy 6|P a g e 7 APPENDIX A Glossary and Status of the Policy and Guidance Glossary Throughout this policy and guidance (where applicable), the terms shown below will have, or include, the following meanings: Principal includes Headteachers where these are in post; Vice-Principal includes Deputy Headteachers where these are in post; Company refers to the Academies Enterprise Trust and London Academies Enterprise Trust; Department refers to the Department for Education and/or its predecessors and successors; Line Manager includes any members of teaching and support staff with management responsibility for other staff.
