INSTRUCTIONS TO BIDDERS AND TERMS AND CONDITIONS FOR PREPARATION OF BIDS are given in tender documents. Bids shell be prepared and submitted in accordance with the public invitation and tender documents. Bids with variants are not permitted. INSTRUCTION TO BIDDERS HOW TO PREPARE A BID The bidder has to meet all the requirements for participation in the procedure of public procurement as prescribed by Public Procurement Law and the bid has to be prepared in conformity with public invitation and tender documents. Otherwise, the bid will be rejected. 1. SUBMISSION OF BIDS Bidder submits its bid directly or by mail. Bidder submits its bid in sealed envelope or box, sealed in such manner that during bid opening it can be determined with certainty that it is being opened for the first time. Bidders shall submit their bids with the designation „bid for the public procurement no. 14/13 – DO NOT OPEN LOT no. ____“, for each lot separately, at the following address: Directorate of Measures and Precious Metals, Mike Alasa 14, Belgrade. On the backside of the envelope bidder’s name анд address are to be indicated. When receiving bid, contracting authority shall note down on envelope or box containing the bid the time and date of receipt and register ordinal number of bid in order of reception. For hand delivered bid, contracting authority shall issue confirmation of reception to the bidder with exact time and date of bid reception. If a bid has been submitted after the expiry of the time limit for bid submission, i.e. after the date and hour by which bids may be submitted, it shall be considered untimely. 2. LANGUAGE OF BID Tender documents are prepared in Serbian and English language. The bid prepared by the bidder shall be written in Serbian or English language. 3. MANDATORY CONTENTS OF BID а) correct bid shall mean a bid submitted in a timely manner, for which it has been established, following the opening and examination, that it fully complies with all the requirements referred to in the Law and tender documents. Bidder has to submit correctly filled in following documents: 1. Bid template - (form no. 1); 2. Bidder`s data sheet (form no. 2); 3. Form for evaluation of compliance with the requirements referred to in articles 75 and 76 of the Law on public procurement (form no. 3 or 3/1) and valid license issued by competent body to carry out economic activity which is the subject of public procurement, if such permit is stipulated by special regulation; 4. Model contract (form no. 4 or 4/1); 5. Declaration of independent bid (form no. 5 or 5/1); 6. Price structure template, correctly filled in, signed and stamped (form no. 7 and 7/1). b) Price Price (form no. 7 and 7/1), total and particular including all related costs, may be expressed in Dinars (VAT free) or in Euro currency (VAT free). Conversion into Dinars will be made according to the middle exchange rate of the National Bank of Serbia as effective on the day of bid opening. If the bid offers abnormally low prices, the contracting authority shall act in accordance with the provisions of Article 92 of the Law on Public Procurement. c) Payment terms Period for payment can not be shorter than 20 days after the calibration service is realized and shall be defined in the contract. Otherwise, the bid will be rejected as unacceptable. Where the bid validity period expired, contracting authority shall in writing request the bidder to extend the period of bid validity. g) Data protection and confidentiality This public procurement contains NO confidential data and information obtained from bidders. h) Criteria for evaluating bids The criteria for the selection of the most advantageous bid is „the economically most advantageous bid“. Calibration specification (maximum 80 points) According to this criteria, offered calibration measurement capabilities of the bidder will be evaluated related to requirements given in tender documents/specifications. The lowest offered uncertainty will be given 80 points. In this respect other Bids will be evaluated according to the following formula: The lowest offered price x maximum points _______________________________________________ The particular offered price i) Bids with variants Bids with variants are not allowed. j) Additional explanations, control, and permitted corrections Contracting authority may request from bidders to supply additional explanations that will be useful in the course of examining, evaluating and comparing bids, and it may also conduct control (inspection) of bidder or its subcontractor. k) Additional information and explanations The bidder may request any additional information and explanations related to the preparation of the bid in writing, but not later than five days before the expiry of the deadline for the submission of bids. The contracting authority will answer in writing to the queries of interested bidders within three days and set this information on the Public procurement portal as well as on the Contracting authority website www.dmdm.gov.rs. Bidders are kindly asked to address their queries or questions in writing and to avoid from any telephone calls. Communication in public procurement procedure and in relation with execution of public procurement tasks shall be in accordance with Article 20 of the Law, i.e. in writing or by means of mail, e-mail or fax. 4. FULFILLING OBLIGATIONS UNDER APPLICABLE LEGISLATION The bidder is obliged to explicitly state in its offer that it fulfilled obligations under applicable legislation concerning safety at work, employment and working conditions, protection of environment, and that it guarantees that it holds the rights to intellectual property (form no. 3 or 3/1). PATENT FEE AND LIABILITY FOR ANY BREACH OF PROTECTED INTELLECTUAL PROPERTY RIGHTS OF THIRD PERSONS The patent fee and liability for any breach of protected intellectual property rights of third persons shall be borne by bidder. 6. TIME LIMITS AND MANNER OF SUBMISSION OF REQUEST FOR THE PROTECTION OF RIGHTS Request for the protection of rights may be submitted by bidder as well as any interested person, or business association on behalf of the bidder or any interested person (hereinafter: the claimant). Request for the protection of rights is filed to the Republic Commission, and submitted to the contracting authority. The claimant shall simultaneously submit a copy of the request for the protection of rights to the Republic Commission. The claimant submits its request directly, by e-mail [email protected], by fax. 011-21-81-668 or by registered mail with return receipt. Request for the protection of rights may be filed during the entire public procurement procedure against any action of contracting authority, unless otherwise specified by the Law. Contracting authority shall inform all participants in public procurement procedure of the filed request for the protection of rights, namely, post notice on the filed request at the Public Procurement Portal, no later than two days from the day of receiving request for the protection of rights. Request for the protection of rights challenging the type of procedure, the contents of the call for competition or tender documents, shall be considered timely if received by contracting authority at latest three days before the expiry of time limit for the submission of bids, regardless of the manner of delivery. In that case of filed request for the protection of rights, there ensues the delay of deadline for submission of bids. After contracting authority makes decision on awarding contract referred to in Article 108. of the Law, or decision on cancelling the procedure referred to in Article 109. of the Law, time limit for filing request for the protection of rights is five days from the day of receiving decision. Request for the protection of rights cannot challenge activities of contracting authority performed in public procurement procedure if the claimant knew or could know the reasons for its submission before the expiry of time limit for submission of request and the claimant did not submit it before the expiry of that time limit. Where in the same public procurement procedure was filed another request for the protection of rights by the same claimant, the second request cannot challenge the activities of contracting authority which the claimant knew or could know during the submission of the previous request. Claimant shall pay a fee to a specified account of the Budget of the Republic of Serbia, in the amount of RSD 40,000 (account number 840-742221843-57, payment purpose indication: “Republic administrative tax with indication of tender code 14/13”, Beneficiary: Republic budget, reference number: 50-016. Procedure of the protection of rights is prescribed in Articles 138.-167. of the Law. 7. TIME LIMIT FOR CONCLUDING CONTRACTS Contracting authority concludes public procurement contract with the bidder to whom was awarded contract, within eight days from the day of expiry of time limit for filing requests for the protection of rights referred to in Article 149. of the Law. In the case of only one bid was submitted, contracting authority may conclude public procurement contract before the expiry of time limit for filing request for the protection of rights in accordance with Article 112., Paragraph 2, item 5) of the Law. REQUIREMENTS FOR PARTICIPATION IN PUBLIC PROCUREMENT PROCEDURE AND INSTRUCTIONS HOW TO PROVE FULFILLMENT OF REQUIREMENTS REFERRED TO IN ARTICLE 75. AND 76. OF THE LAW The right to participate in this public procurement procedure shall have the Bidder if it meets the mandatory eligibility requirements referred to in Article 75 of the Public Procurement Law as follows: 1) It is registered with the competent body, or entered in the appropriate register (Article 75, Paragraph 1, item 1) of the Law); 2) It or its legal representative have not been convicted for any criminal act as members of an organized criminal group; that it has not been convicted for commercial criminal offence, criminal offence against environment, criminal offence of receiving or offering bribe, criminal offence of fraud (Article 75, Paragraph 1, item 2) of the Law); 3) It has not been prohibited from performing economic activity by any measure in force at the time of publishing tender notice and/or call for competition (Article 75, Paragraph 1, item 3) of the Law); 4) It has paid due taxes and other public charges in accordance with laws of the Republic of Serbia or a foreign country if its registered address is in its territory (Article 75, Paragraph 1, item 4) of the Law); 5) It has valid permit issued by competent body to carry out economic activity which is the subject of public procurement (Article 75, Paragraph 1, item 5) of the Law). Where state of bidder’s registration does not issue evidence under Article 77 of the Law, instead of evidence bidder shall submit its written statement, given subject to criminal and material liability and certified by the court, administrative body, public notary, or another competent body of that state. The bidder is obliged to explicitly state in its offer that it fulfilled obligations under applicable legislation concerning safety at work, employment and working conditions, protection of environment, and that it guarantees that it holds the rights to intellectual property. INSTRUCTIONS HOW TO PROVE FULFILLMENT OF REQUIREMENTS Bidder proves fulfillment of mandatory eligibility and additional requirements for participation in this public procurement, in accordance with Article 77, Paragraph 4 of the Law, by supplying its written statement, given subject to criminal and material liability, that it fulfilled requirements under Articles 75. and 76. of the Law and defined in tender documents, except requirements under Article 75, paragraph 1, item 5) of the Law. The statement must be signed by authorized (legal) representative of bidder and stamped. If the statement is signed by person who is not registered as bidder`s legal representative, the bidder must submit authorization for that person for statement signing as well. The contracting authority may, before decision on awarding contract, request from the bidder, whose bid was evaluated as most advantageous bid, to present the original documents or certified copies of all or of only some of proofs. Bidder shall inform contracting authority, in writing and without delay, of any change concerning fulfillment of requirements for participation in public procurement procedure, which occurs before the decision is made or the contract awarded, or during the public procurement contract validity period, and shall document such change in the prescribed manner. CONTRACT TEMPLATE Contracting authority concludes public procurement contract with the bidder to whom was awarded contract in accordance with the form of contract template (form no. 4 or 4/1) given in the tender documents. Bidder has to fill in the contract template, and sign and stamp it, thus confirming acceptance of the contract template’s contents. The procuring entity will deliver a public procurement contract to the bidder whose bid was selected as the most advantageous in accordance with the form of contract template given in the tender documents, which can be amended with elements from selected most advantageous bid and which was not known during preparation of tender documents and delivered contract template. The most advantageous bidder will be invited to conclude contract after expiry of the time limit for the submission of a request for the protection of rights referred to in Article 112, Paragraph 2, item 5) of the Law.
