Introduction
Welcome to the Insight Advanced Software Revision 3.15 Release Notes (125-3160315).
The electronic version of the Release Notes, available in PDF format with the
installation media and from the Online Documentation toolbar, contains up-to-date
information and supersedes any printed version of this manual.
Update Option for Insight Base Software
If you have Insight Base software and would like to take advantage of the
enhancements in Revision 3.15, you must first upgrade from Insight Base to Insight
Advanced software. Then you can update to Revision 3.15.

Section 1 - New Features and Enhancements
Point Details
Section 1 - New Features and Enhancements
This section describes new features, system enhancements, and information about
resolved defects delivered with this revision. For detailed information on any of the new
features and enhancements, please see the online help system.
Point Details
The Point Details application now includes a Refresh button, which updates the point
properties, such as Value, Totalization, Priority, and Status, for the point currently
displayed. You no longer need to reopen the point in Point Details in order to update
the point.
Point Usage Report
The Point Usage report has been enhanced to also search BACnet Schedules,
BACnet Command Objects, and Graphics. When you select BACnet Schedules and
BACnet Command Objects, the options Search at the Database or Search at the Field
Panels are available. When Graphics is selected, the only option is Search at the
Database.
Program Editor
New PDL Wizard
The Program Editor now provides a PDL Wizard, which guides you through the
process of creating a basic peak demand limiting (PDL) strategy. Prior to Insight
Revision 3.15, you had to either manually configure several PDL-related statements or
use the PPCL assist features in order to define the meters, loads, and intervals.
Once you have provided the required information for configuring your PDL strategy, the
PDL Wizard creates the PPCL statements in the proper order and inserts them into
your program.
PPCL Line Number Displays if an Error Occurs During a Download
Operation
Previously, when a Download operation failed, the PPCL line number was not available
in the Result Pane. PPCL has been enhanced to display the line number where an
error has occurred so that you can easily locate the problem and take corrective
actions.
System Activity Log
You can now select and copy text in the System Activity Log and paste it in any Insight
application, such as PPCL or Point Editor, or other applications, such as Excel or
Notepad. This eliminates the errors that might occur when transcribing content from
the System Activity Log.
The following options are now available in the System Activity Log when you right-click
on a line:

Siemens BACnet Field Panels that are configured as a BACnet Broadcast
Management Device (BBMD), can now be easily identified in the System Profile
tree. The text [BBMD] now displays at the end of each BACnet field panel
identification information that are BBMDs.
You can now search for Siemens BACnet Field Panels that are configured as a
BBMD by entering the text BBMD in the Search field in the System Profile toolbar.
The system will locate and highlight the first BBMD below the object currently
selected, such as a workstation or an ALN. To find the next BBMD in the System
Profile tree, click the Find Next icon.
The BACnet Field Panel Definition dialog box has been updated to default to
MS/TP FLN when adding a new Siemens BACnet field panel. The default selection
for the Type drop-down list in the FLN Configuration section is MS/TP.
TEC applications
TEC Graphics have been added for all 663x applications.
Alarm Issue Management (AIM)
Event Enrollment objects were previously not supported in Alarm Issue Management
(AIM). Event Enrollment objects that were enabled for AIM did not display in the AIM
window. AIM, AIM History, and AIM Report have been enhanced to display both the
point name and the associated Event Enrollment name.

Alarm Status

This section lists bug fixes in Insight Revision 3.15.
Alarm Status
●
●
When a point configured as an Enhanced Alarm and a popup Enhanced Alarm
Message; and the point goes into alarm, the Enhanced Alarm Message popup
would display, as expected. However, after the point was acknowledged and
subsequent alarms occurred, the Enhanced Alarm Message popup would not
display. This issue is now fixed.
When an Event Enrollment Object (EEO) went into Alarm then Normal without
acknowledging the Alarm state, and then the Normal state was acknowledged, the
Alarm Status would revert the EEO to display in Alarm. This would occur if the EEO
was configured with a Notification Class that had the Ack required for To Normal
transition unselected. This issue is now fixed.
Communication Monitor
Previously, Communication Monitor would not update when an Insight workstation’s
communication status had changed. Now a pop-up message displays in the System
Tray when communication status changes. In addition, the Workstation
Communication Status window displays the current communication status and updates
when there’s a change of status.
Database Transfer
At sites with a large number of field panels, the Database Transfer application would
take a long time to launch while the system populated the tree in System Overview.
You could not work in other windows or applications while waiting for the application to
launch.
Now, the tree in System Overview starts loading only after the Database Transfer
application has launched successfully. While the tree is loading, the System Overview
section of the application is disabled, but you can continue to work in other windows or
applications.
Daylight Saving Time (DST)
Previously, when the output format for [ZONE]:NX STRT TIME was set to Date Time,
the time displayed in Graphics and Reports was not adjusted for Daylight Saving Time
(DST). This issue has been fixed.

Desigo CC Export Utility

Previously, in some instances, Desigo CC Export Utility (SibxExport.exe) would
display the error BACnet Instance number is out of range in the
Corrective Action Required dialog box. This issue occurred because the field panel
instance number was being set to a very large number (over 1 billion). This issue
has been fixed. All newly-generated instance numbers are limited to the range 0
through 4194302.
Previously, when LPACI points were exported, the Present Value, Low Limit, High
Limit, COV_Increment and Deadband properties contained either invalid values or
an extremely large number for the resolution. This issue has been fixed.
In Insight Revision 3.14, using the Data Export Utility to generate the license
document (ApogeeLicenseInformation.pdf), the license count for Number of Insight
Core (Base) licenses and Number of Insight Combo (Advanced) licenses would
display incorrectly in the Insight System Summary section.
If the Insight Revision 3.14 installation only had Revision 3.14 licenses (Advanced
and/or Base), the license counts for Number of Insight Core (Base) licenses and
Number of Insight Combo (Advanced) licenses would display as zero, respectively.
If the Insight Revision 3.14 installation had Revision 3.14 and 3.13 (or older)
licenses (Advanced and/or Base), the license counts for Number of Insight Core
(Base) licenses and Number of Insight Combo (Advanced) licenses would only
display for the Revision 3.13 licenses.
This issue is now fixed.
Graphics
●
●
Since Insight Revision 3.12, the Run Panel Trend Data Detail report was always
enabled in the right-click menu of the graphic control, even if the point was not
trended. Siemens Industry, Inc. addressed this issue by providing you the ability to
enable the Run Panel Trend Data Detail report in the right click menu if the point is
trended, or disable the report if the point is not trended. Only enable this function if
the time to display the right-click menu is acceptable.
Please contact your Siemens Industry representative for details on enabling this
functionality.
Performance improvements were made so that template graphics with associations
would open more quickly.
Insight Event Log Service
In certain situations, on systems with heavy server/client communications and/or heavy
server load, locking conflicts may have caused the Insight Event Log Service to lock up
or stop running. As a result, new data would not be stored in the Event Log, and the
System Activity Log would not display the new data.
The Insight Event Log Service is now installed on each Insight client. This improves the
reliability of the Event Log database and reduces the possibility of the Insight Event
Log service locking up or stopping.
Insight Async Service
In certain situations, on systems with heavy Remote ALN communications may have
caused the Insight Async Service to stop running. As a result, all ALNs would
disconnect until the service was restarted. This issue is now fixed.

Point Editor

Previously, when modifying an LAI, LAO, or LPACI point, if you toggled between
the radio buttons in the Output Format section, it could appear that two formats
were selected at the same time. This was a display issue, and the last radio button
selected was the format that was saved. For example, if you opened the Point
Editor, changed the Output Format selection to Time, and then toggled to either
Float or Integer, both radio buttons would display as selected. This issue has been
fixed.
Previously, for the BACnet third party points, you were not able to
configure/view/modify the Custom Private Messages. This issue has been fixed
and you can now configure/view/modify the Custom Private Messages by using the
Alarm Message option.
Program Editor

In some cases, while working in a remote session, when the mouse was moved
over a point, the hover text would either briefly display or not display at all. The
problem may occur if Microsoft security update MS15-060 is installed. This issue
has been fixed.
Previously, when there were multiple DEFINE statements in a Program and the
cursor was positioned on the variable in the Program Editor Application, POINT
NOT FOUND IN DATA BASE displayed instead of the point information. This issue
has been fixed. When the cursor is positioned over a point name, the correct
information now displays.
Scheduler

Previously, certain sites experienced a problem when downloading the BACnet
Schedules to a field panel when SSTO was enabled. This issue would only occur if
the computer had a certain type of network card. This issue has been fixed.
Previously, when the default system date format (MM/DD/YYYY) was changed to
use ASCII month (MMM) instead of the numeric month (MM), users were not able
to select any other day other than today when using the calendar control in the
Scheduler application. This issue has been fixed. The Scheduler application is now
compatible with all other date formats.

Depending on the amount of data in the event log, the System Activity Log could
open slowly because the system queried all data, regardless of which columns
were selected for viewing. The System Activity Log is now optimized to only query
the data for the columns selected for viewing, which results in the System Activity
Log opening faster.
System Activity Log allows you to select which columns to display. By default, not
all columns are selected. Previously, if the System Activity Log was exported, data
for the selected columns was exported as expected, but all of the column headings
were exported regardless of the selection. If a column in between selected
columns of the list in the Add/Remove Columns dialog box was not selected, the
data might be shifted or positioned under the incorrect column heading.
For example, even though the Revision and Property columns are not selected by
default, these column headings would still display in the exported file, but the data
for the Revision and Property columns would not. Instead, data for the columns

System Profile
selected after Revision and Property would be shifted left by two columns. Hence,
the Before and After column data would display under the Revision and Property
headings.
● Previously, the following BACnet Events were logged as an UNKNOWN EVENT in
System Activity Log.
– BACnet FLN device failures.
– BACnet FLN device return from failure.
– User Logon on a BACnet field panel.
– User Logoff on a BACnet field panel.
This issue is now fixed.
System Profile

Previously, the Print Preview of the System Profile tree always displayed the
unlocked padlock icon for secure mode TECs, irrespective of the selection in the
Secure Mode TEC options dialog box. This issue has been fixed.
Previously, when an FLN had more than 90 FLN devices defined, the System
Profile application would lock up or take a long time to expand the FLN. This issue
is now fixed.
Previously, the BACnet TECs with Firmware revision number BY3[X], would
display as third party devices. This issue is now fixed.
Trend Definition Editor

Previously, if you selected an existing trend definition without Enable “Buffer
Full“ Notification selected, and you later modified the definition to select Enable
“Buffer Full“ Notification, trend data for that point would not automatically upload
when the buffer threshold was reached. This issue has been fixed. The trend data
automatically uploads when the buffer threshold is reached.
The following issues related to Point Trend Logs have been fixed:
– BACnet P1 or MS/TP subpoints for which Trend Logs were created were not
displaying in the Object Selector of Trend Definition Editor if the parent field
panel was deleted, rediscovered and uploaded.
– When you unbundled an MS/TP subpoint that already had trend definitions in
the database, a second upload of the field panel data was needed in order to
collect trend data for the unbundled subpoint.
– When subpoints that already had trend definitions in the database were rebundled, the trend definitions were deleted. You had to upload the field panel
data in order to restore the trend definitions.
Previously, in certain instances with large databases, when you deleted trended
points in Trend Editor or Trend Grid, the point was not actually removed from the
Insight database or the field panel. For example, the selected point was still
present in the Object Selector as a trended point. The only option for deleting the
trended points was through the field panel HMI. This issue has been fixed.
Previously, the Priority column in the Trend Data Detail report and the Panel Trend
Data Detail report always displayed NONE even when a point was in HAND mode.
The Priority column now displays HAND when the point is in HAND mode.
Performance improvements were made so that the trend related operations, such
as Add/Modify/Delete and trend collection, would occur more quickly.
Previously, when creating a BACnet trend from the trend grid, you were not able to
save the threshold value to more than 80%. This issue is now fixed.

Pre-Install
In the Pre install screen, when you hovered the mouse pointer over the Install Dialogic
Components for Remote Notification help topic, an incorrect Popup message displays.
This issue is now fixed and the proper message to state to acquire the dialogic
software from the vendor where you purchased dialogic board.
Additionally, on clicking the Install Insight on an InfoCenter computer help topic, the
relevant help would not display. This issue is fixed and the help topic now displays.

CAUTION
All Insight workstations on a Management Level Network (MLN) must be running the
same revision of the Insight software.
CAUTION
In order to properly install all applications, you must have elevated Windows user
privileges if User Access Control (UAC) is enabled.
NOTICE
The procedure for updating a Server/Client configuration has changed due to updates
in Objectivity services.
Before updating the Insight software on the Database Server connected to an MLN,
you must shut down all workstation applications and services on all other Database
Clients that are connected to the MLN.
NOTE:
Historically, the Insight Event Log Service was always installed on a server. Starting
with Insight Revision 3.15, it will also be installed on each Insight Client. The Event
Log Service should always be running on all Insight workstations as it performs readand-write operations to-and-from the Event Log.
You can perform the following installations:

A new installation of Insight Advanced Revision 3.15.
An update to Insight Advanced Revision 3.15 from an existing Insight Advanced
Revision 3.13 or 3.14 installation.
An update to Insight Advanced Revision 3.15 from an existing Insight Base

Before upgrading to or installing the latest software revision, Siemens Industry, Inc.
recommends that you fully back up your existing database.
Install Operating System Software.
You can only install the software after you have properly installed and configured a
supported Windows operating system. For more information, see Section 4 System Requirements.

If you intend to use the same computer for both the Insight Revision 3.15 Database
Server and InfoCenter Advanced Revision 1.7 Server, only the following operating
systems are supported:
• Windows Server 2012 R2
• Windows Server 2008 R2 Service Pack 1
• Windows 8.1 (64-bit)
• Windows 7 (64-bit) Service Pack 1

Install Windows Service Packs.
Before installing the software, it is highly recommended that you install the service
packs listed in Section 4 - System Requirements [➙ 16] along with the latest
Microsoft security patches.
Other Third-party Software.
PDF-viewing software is required to read the additional documents that are
available with the installation media and from the Online Documentation toolbar. If
you need PDF-viewing software, Adobe® Reader® software is provided with the
installation media.
Some Third-party Software is No Longer Available on the Installation DVD.
The following must be installed from their respective sites:
– Java Runtime Environment (JRE) Version 7 Update 71 (1.7.0_71) through Java
8 Version 91 are supported. To install Java Runtime Environment (JRE), visit
www.java.com.
– Siemens no longer offers Dialogic software. Therefore, verify that the software
is provided with the board purchase or visit
www.dialogic.com/en/products/media/system-release-software.aspx for more
information.
NOTE:
Corel DESIGNER 9 is only included on the installation media when you purchase a
new installation of Insight software. Corel DESIGNER 9 must only be installed on one
Insight workstation per purchase. If you purchase an upgrade, the upgrade disk does
not contain Corel DESIGNER 9. Therefore, the existing installation on your system
will be used by the Insight software.

Install Corel DESIGNER® 9.0 if you purchased a new software installation.
In order to have a registered, non-expiring version of the DESIGNER 9.0 software,
you must install it using the third-party tools section of the Insight Installation dialog
box. Not doing so will install a trial version of the DESIGNER software that will
eventually expire.

updated from Insight Software Revision 3.13 or earlier, you must install the

For existing Insight 3.x users, you do not need to upgrade your current hardware
unless you are experiencing visible performance issues. If you are looking to upgrade
your existing system, use the information in this section as a recommended
purchasing guideline.
For additional requirements to connect Auto-Dial, AEM, and ALNs, see the Getting
Started help that displays after you install the software.

Cimetrics BACstac
Cimetrics BACstac version 6.4-e for BACnet (only required for use of InsightOnline to connect to BACnet trunks).
Corel DESIGNER
Corel DESIGNER 9 is required for graphics editing.

SIEMENS INSIGHT SOFTWARE
IMPORTANT--READ CAREFULLY: This End-User License Agreement ("EULA") is a legal agreement between
“You” (either an individual, a legal entity or any affiliated companies or other entities) and Siemens Industry,
Inc. as the licensor (hereafter “Siemens” or “Licensor”) of the LICENSED SOFTWARE specified in Clause 1
(each a “Party” and collectively “Parties”). An amendment or addendum to this EULA may accompany the
LICENSED SOFTWARE. The use of the LICENSED SOFTWARE is subject to the provisions of this EULA
which is enclosed with the LICENSED SOFTWARE or is integrated therein. Use of the LICENSED
SOFTWARE is only permitted in connection with this EULA. The EULA may not be assigned to third parties.
BY INSTALLING, COPYING, OR OTHERWISE USING THE LICENSED SOFTWARE YOU ACKNOWLEDGE
THAT YOU: (1) HAVE READ AND UNDERSTOOD THIS EULA AND ANY THIRD PARTY LICENSES
(INCLUDING ANY OPEN SOURCE SOFTWARE LICENSES) SET FORTH IN THE “ADDITIONAL TERMS

ON RETURN OR CERTIFIED DESTRUCTION OF THE LICENSED SOFTWARE.
1. Licensed Software. As used in this EULA, the term “LICENSED SOFTWARE” shall mean (i) the software
offered by Siemens under the brand name "Insight®" in any release for use with Siemens’ APOGEE®
building automation products that are separately available for purchase from Siemens and (ii) any related
documentation for the LICENSED SOFTWARE.
2. Intellectual Property Rights Notice. The LICENSED SOFTWARE and all rights, without limitation including
proprietary rights therein (including any all copyrights, patents, trademarks, trade secrets, and publicity
rights), are owned by Siemens, its licensors or affiliates. The LICENSED SOFTWARE is protected for
Siemens on the basis of copyright law and international treaty provisions as well as on the basis of other
laws and agreements regarding intellectual property. Except as expressly and unambiguously provided
herein, You do not possess, and Siemens does not grant to You, any express or implied rights (whether
by implication, estoppel or other legal theory) in or to any such intellectual property rights and all such
rights are retained by Siemens, its licensors or affiliates. You acknowledge and agree that You, and not
Siemens, shall be solely responsible for the investigation, defense, settlement and discharge of any
intellectual property infringement claim or suit, or any other harm or damages resulting from Your use of or
access to the LICENSED SOFTWARE.
3. License Grant. Only a license is granted for the LICENSED SOFTWARE, the LICENSED SOFTWARE is
not sold. Siemens grants to You in this EULA a revocable, non-transferable, non-exclusive license to use
the LICENSED SOFTWARE in object code solely for Your own use provide You comply with all terms and
conditions of this EULA. The configuration and execution of the LICENSED SOFTWARE is supervised by
either a hardware dongle with a license key, a remote software sentinel with a license key, or a PC-bound
copy protection, supplied separately for the LICENSED SOFTWARE. The EULA permits use of the
LICENSED SOFTWARE, only within the boundaries established by the dongle or remote sentinel and the
license key. Siemens, in its discretion, may withhold distribution of the license key for use of the
LICENSED SOFTWARE by You until an executable version of this EULA is signed by the Parties.
4. Description of Further Rights and Restrictions.
a) If the LICENSED SOFTWARE was obtained by You from Siemens directly or through its licensed
distributors for use on a single machine, then You may only install the LICENSED SOFTWARE on a
single machine owned or licensed by You at any one time.

b) If the LICENSED SOFTWARE was obtained by You from Siemens or its distributors for networked
use, You may copy and distribute the LICENSED SOFTWARE over an internal network for use, at any
one time, by the number of active concurrent users for which You obtained a license key from
Siemens.
c) You may not sublicense, assign or transfer this EULA, the LICENSED SOFTWARE or its components,
or any portion thereof without express written consent from Siemens.
d) You may not or direct any third party to, reverse engineer, decompile, decode or disassemble the
LICENSED SOFTWARE except and only to the extent that such activity is expressly permitted by
applicable law notwithstanding this limitation.
e) You (or any third party at Your direction) also shall not (i) modify or create a derivative work of the
LICENSED SOFTWARE, or (ii) extract any individual parts except and only to the extent that such
activity is expressly permitted by applicable law notwithstanding this limitation.
f) This EULA does not grant You any rights whatsoever in relation to Licensor’s or Siemens AG’s
trademarks or service marks.
g) Siemens may at its discretion offer You support services concerning the LICENSED SOFTWARE
("Support Services"). Siemens is entitled to use the technical data that You make available to
Siemens in connection with the use of the LICENSED SOFTWARE and/or with Siemens’ Support
Services for business purposes, including product ordering, support and development. Siemens does
not guarantee that Support Services shall cure any technical problem caused by the use of the
LICENSED SOFTWARE.
5. Reservation of Rights. Licensor reserve all rights not expressly granted to You in this EULA.
6. Additional Software / Component or Third Party Licenses. This EULA applies to updates or supplements
to the original LICENSED SOFTWARE provided by Licensor or Siemens, unless Licensor or Siemens
provides other terms along with the update or supplement. The LICENSED SOFTWARE may contain
certain components such as open source software components or third party components licensed by
Siemens (each, a “Component”). Each Component may have a separate end user license agreement (a
“Third Party License”). The terms of any Third Party License (if any) that apply to the LICENSED
SOFTWARE are either: a) specified in the Additional Terms Addendum below, b) separately accompany
the LICENSED SOFTWARE and are automatically presented for acceptance prior to first use of the
LICENSED SOFTWARE by You and other users You allow access to the LICENSED SOFTWARE in
accordance with the single or networked use licenses You obtained from Siemens, or c) are specified in
the READ ME OSS document available at “WWW.USA.SIEMENS.COM/BTCPSEULA” for the LICENSED
SOFTWARE. The terms of such Third Party Licenses are herein incorporated by reference to this EULA.
7. Termination: This EULA is effective from the first date You install, copy or otherwise use the LICENSED
SOFTWARE. Without prejudice to any other rights of Licensor or Siemens, the EULA shall terminate
automatically and immediately without notice upon conditions set forth in Clause 4 or if You fail to comply
with any provision or condition of this EULA. In such a case You will be obliged to destroy all copies, all
related materials of the LICENSED SOFTWARE and all its components. You may terminate this license at
any time by deleting or destroying the LICENSED SOFTWARE, all backup copies and all related materials
provided to You by Siemens.
8. Backup Copy and Printing Documentation. You may make one copy of the LICENSED SOFTWARE,
excluding the documentation, as an archival backup copy of the original. Any other copies You make of
the LICENSED SOFTWARE are in violation of this EULA. If this LICENSED SOFTWARE includes any
related documentation provided in electronic form, You may print copies of this electronic documentation.
You must reproduce and include the copyright notices on any permitted copies You make of such
electronic documentation.

9. Warranty. Siemens shall be only liable for defects and any violation of property rights, as set forth in this
Clause 9.
a) UNLESS SIEMENS AGREES IN A SEPARATE WRITING TO PROVIDE AN EXCEPTION TO THIS
WARRANTY DISCLAIMER WITH RESPECT TO THE LICENSED SOFTWARE, YOU
ACKNOWLEDGE THE LICENSED SOFTWARE IS PROVIDED “AS IS” AND NEITHER SIEMENS
NOR ANY OF THEIR LICENSORS (IF ANY) MAKE ANY REPRESENTATIONS OR WARRANTIES,
EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR THAT THE LICENSED
SOFTWARE WILL NOT INFRINGE ANY THIRD PARTY PATENTS, COPYRIGHTS, TRADEMARKS
OR OTHER RIGHTS. THERE IS NO WARRANTY BY SIEMENS OR THEIR LICENSORS OR BY
ANY OTHER PARTY THAT THE FUNCTIONS CONTAINED IN THE LICENSED SOFTWARE WILL
MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE LICENSED SOFTWARE WILL
BE UNINTERRUPTED OR ERROR-FREE. NO ORAL OR WRITTEN INFORMATION OR ADVICE
GIVEN BY A SIEMENS REPRESENTATIVE SHALL CREATE A WARRANTY OR IN ANY WAY
AFFECT THIS DISCLAIMER. YOU ASSUME ALL RESPONSIBILITY TO ACHIEVE YOUR
INTENDED RESULTS AND FOR THE INSTALLATION, USE, AND RESULTS OBTAINED FROM IT.
b) Any further rights and remedies than those as per this Clause 9 (in particular Your right to claim
damages) based on a defect or a violation of property rights shall be excluded. This exclusion shall
not apply in the event of gross negligence, unlawful intent or insofar as mandatory law provides
otherwise.
10. Limitation Of Liability. UNLESS OTHERWISE AGREED IN CLAUSES 9 AND 10, IN NO EVENT SHALL
SIEMENS, ITS EMPLOYEES, LICENSORS, AFFILIATES, AGENTS OR SIEMENS AG AND THEIR
AFFILIATES BE LIABLE FOR ANY LOST PROFITS OR COSTS OF PROCUREMENT OF SUBSTITUTE
GOODS OR SERVICES, PROPERTY DAMAGE, LOSS OF PROFITS, INTERRUPTION OF BUSINESS
OR FOR ANY SPECIAL, INDIRECT, INCIDENTAL, ECONOMIC, PUNITIVE OR CONSEQUENTIAL
DAMAGES, HOWEVER CAUSED, AND WHETHER ARISING UNDER CONTRACT, TORT,
NEGLIGENCE, OR OTHER THEORY OF LIABILITY, OR ARISING OUT OF THE USE OF OR INABILITY
TO USE THE LICENSED SOFTWARE, EVEN IF SIEMENS IS ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES. THE LIMITATION OF LIABILITY SHALL NOT APPLY IF AND TO THE EXTENT
SIEMENS’ LIABILITY IS MANDATORY UNDER THE APPLICABLE LAW (e.g., PRODUCT LIABILITY
LAW OR INTENSIONAL MISCONDUCT).
11. Debugging / Technical Support. Unless otherwise agreed, Siemens or SIEMENS AG and their affiliates
have no obligation to furnish You with any further technical support or to debug the LICENSED
SOFTWARE. Siemens reserves the right to improve the LICENSED SOFTWARE described here and to
carry out modifications at any time without any prior notice.
12. Governing Law/Export Restrictions/Legal Compliance. This EULA shall be governed by and construed
and interpreted by the laws of the State of Illinois, without regard to any conflict of laws provisions therein.
Licensee shall comply with all then-current export and import laws and regulations of the United States
and such other governments as are applicable when distributing or using the LICENSED SOFTWARE.
Licensee hereby certifies that it will not directly or indirectly export, re-export, transship, or transmit the
LICENSED SOFTWARE, or any portion thereof, or related information, media, or products in violation of
United States laws and regulations. You represent and warrant that You are not (i) located in any country
that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a
"terrorist sponsoring" country, or (ii) listed on any U.S. Government list of prohibited or restricted parties
including the Treasury Department's list of Specially Designated Nationals or the U.S. Department of
Commerce Denied Person's List or Entity List.
13. For U.S. Government End Users: The LICENSED SOFTWARE was developed at private expense and is
a “commercial item” as that term is defined at 48 C.F.R. 2.101, consisting of “commercial computer
software” and “commercial computer software documentation” as such terms are used in 48 C.F.R.
12.212. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4, all U.S.
Government end users acquire the LICENSED SOFTWARE with only those limited rights set forth therein.

14. Miscellaneous. This EULA represents the entire agreement between You and Licensor or Siemens
relating to the LICENSED SOFTWARE and (i) supersedes all prior or contemporaneous oral or written
communications, proposals, and representations with respect to its subject matter; and (ii) prevails over
any conflicting or additional terms of any acknowledgement or similar communication between the parties
during the term of this License. If any provision of this EULA is held invalid, all other provisions shall
remain valid unless such validity would frustrate the purpose of this EULA, and this EULA shall be
enforced to the full extent allowable under applicable law. No modification to this EULA is binding, unless
in writing and signed by a duly authorized representative of each party. This EULA shall be binding on and
shall inure to the benefit of the heirs, successors, and assigns of the parties hereto. The failure of either
party to enforce any right resulting from the breach of any provision of this EULA by the other party will not
be deemed a waiver of any right related to a subsequent breach of such provision or any other right
hereunder.
ADDITIONAL TERMS ADDENDUM
Note: The Third Party Licenses applicable for Components of a respective release of the LICENSED
SOFTWARE are compiled in a readme document that accompanies such release of the LICENSED
SOFTWARE and are presented for “click through” acceptance prior to first use by You and other users You
allow access to the LICENSED SOFTWARE in accordance with the single or networked use licenses You
obtained from Siemens. Upon request by You, Siemens may provide You with an advanced copy of the
readme document containing such Third Party Licenses for the release of the LICENSED SOFTWARE to be
licensed to You.
