Report to the Scottish Ministers – 1st April 2005
In accordance with Section 2(2) of the Reservoirs Act 1975, and as prescribed by Regulation
3 of Statutory Instrument 1985 No. 177, a Register of Large Raised Reservoirs within the
boundaries of the South Ayrshire Council area has been established.
The Register is kept at Burns House, Burns Statue Square, Ayr KA7 1UT (Building
Standards Services, 2nd floor). The information contained in the Register is as set out in
Schedule 1 of S.I. 1985 : No. 177.
On 1st April 1996, South Ayrshire Council became the Enforcement Authority for large
raised reservoirs in South Ayrshire, replacing Strathclyde Water Services who had formerly
undertaken the duties on behalf of the Strathclyde Regional Council.

Steps taken as Enforcement Authority to Secure Compliance
Since the Ninth Report on 1st April 2003, this Authority has had to take the
following enforcement action:Loch Spouts Reservoir
In the period since the last biennial Report it was brought to the Council’s
attention that Loch Spouts was no longer under the supervision of a
Supervising Engineer. Attempts were made to contact the registered private
owner of the Reservoir, a Mr James Brown, by telephone and letter, without
success.
Subsequently a Notice under Section 12(4) of the Act, requiring that a
Supervising Engineer be appointed, was sent by recorded delivery with copies
displayed at the reservoir. As no response was received the Council has
appointed Mr R Y Gibson, a Panel Engineer, to be Supervising Engineer for
Loch Spouts, under Section 15 of the Act.

Steps taken to Observe and comply with the Act where the Authority is
the Undertaker
There are two reservoirs, situated wholly within South Ayrshire boundaries for
which South Ayrshire Council is the Undertaker, namely Collenan and Raith.
(i)
In accordance with Section 10 of the Act, I can confirm that Inspecting
Engineers and Supervising Engineers have been appointed for both
reservoirs for which South Ayrshire Council is the Undertaker.
(ii)
Where reports from the Inspecting Engineers have recommended
measures to be taken in the interests of safety, I can confirm that action
has been taken.
At Collenan there are currently no measures which need to be taken in the
interests of safety requiring supervision by an AR Panel Engineer. At Raith,
the last inspection, in June 2002, had one recommendation as to measures to
be taken in the interests of safety requiring supervision by an AR Panel
Engineer, namely a CCTV investigation of the internal condition of the scour
pipe. This work was subsequently carried out.

There are seven reservoirs for which South Ayrshire Council acts as
Enforcement Authority (Scottish Water are the Undertakers of six of these
reservoirs, with one privately owned).
