Sub: Violation of provisions of MCDR, 1988 in respect of your Kamalapuram Limeston
& Dolomite mine over an extent of 4.858 ha situated in S.NO.650/P of Kamalapuram H/O
Malkapuram village, Dhone Mandal, Kurnool District, Andhra Pradesh.

The following provisions of Mineral Conservation and Development Rules, 1988 (Amended
in 2011) were found violated in your above mine during MCDR inspection on 17.10.2016 by Sri
A.PrabhakaraRao, Assistan Mining Geologist, accompanied by your representative Sri M.Nagendra.

12(3)
The Scheme of Mining should have been submitted to the Regional
Controller of Mines, IBM, Secunderabad at least one hundred twenty days
before the expiry of the five years period, for which it was approved on
the last occasion. The Mining Plan was approved on 02.03.2002 and the
five year period of Mining plan has expired 31.03.2007 and no Scheme of
Mining was submitted to the competent authority i.e. Regional Controller of
Mines for the subsequent periods.
13(1)
Every holder of a mining lease shall carry out mining operations in
accordance with the approved mining plan with such conditions as may
have been prescribed under sub-rule (2) of rule 9 or with such
modifications, if any, as permitted under rule 10 or the mining plan or
scheme approved under rule 11 or 12 as the case may be.
Mining operations should have been undertaken in accordance with
the approved Mining Plan/ Scheme of Mining. Since you have no
approved document for your above mentioned Mine, it is evident that the
Mining Operations are not being carried out in accordance with the
approved document.
23(E)(2)
The yearly report for the year 2015-16 setting forth the extent of protective
and rehabilitation work as envisaged in the approved Scheme of Mining
have not been submitted to the Regional Controller of Mines, Indian
Bureau of Mines, Hyderabad before First July, 2015.
45(5)(a)(viii)
The owner, agent, mining engineer or manager of every mine, shall
submit to the Regional Controller of Mines in the Indian Bureau of Mines
or any other authorised official of the Indian Bureau of Mines, returns in
respect of each mine, in the following manner, namely:A monthly return which shall be submitted before the 10th of every month
in respect of preceding month in the Form F-8
However this office has not received any monthly returns since August
2016.
45(5)(b)(viii)
The owner, agent, mining engineer or manager of every mine, shall
submit to the Regional Controller of Mines in the Indian Bureau of Mines
or any other authorised official of the Indian Bureau of Mines, returns in
respect of each mine, in the following manner, namely:Annual return which shall be submitted before the 1st July each year for
the preceding financial year in the Form H-8 has not been submitted for
the year 2015-16.

It is brought to your notice that the above said violations constitute an offence
punishable under Rule-58 of MCDR, 1988. Besides, inability to comply the provision of Rule
13(1),& 45(5)(a)(viii) & 45(5)(b)(viii) is also liable for suspension of mining operations under
rule 13(2) & 45(7)(i)(a) of MCDR, 1988.

You are, therefore, directed to show-cause within a period of 30(thirty) days from the
date of issue of this letter, as to why you should not be prosecuted for the above offence
and or Mining operations shall be suspended under the provision of Rule 13(2) &45(7)(i)(a)
of MCDR,1988 in the Mine till the compliance of the aforesaid violation.
04. Please note that no further notice will be given to you in this regard.
