JOB PROFILE Position #: TITLE: SENIOR MARKET CONDUCT OFFICER CLASSIFICATION: APPLIED LEADERSHIP MINISTRY: FINANCE, FINANCIAL INSTITUTIONS COMMISSION WORK UNIT: FINANCIAL INSTITUTIONS DIVISION SUPERVISOR TITLE: DIRECTOR, MARKET CONDUCT SUPERVISOR POSITION #: 71831 PROGRAM The Financial Institutions Commission (“FICOM”) regulates the pension, financial services and real estate industries in British Columbia. This regulation is designed to protect the public against the insolvency of financial institutions, prevent improper market conduct in the financial services and real estate sectors, provide deposit insurance for members of B.C. credit unions and ensure the solvency of pension funds. The Financial Institutions Division (“FID”) is responsible for the administration and enforcement of the following statutes: Credit Union Incorporation Act Financial Institutions Act Insurance Act Insurance (Captive Company) Act Insurance (Marine) Act Under these statutes, FID administers a system of regulatory rules governing prudential and market conduct of credit unions, trust companies, insurance companies, captive insurance companies and other entities. These regulatory rules are designed to protect depositors against insolvency of a trust company or a credit union, to safeguard consumers against the improper marketing of financial products and services, to identify institutions with unsafe business practices or unsatisfactory financial trends, provide an operating framework (supervision and administration) to deal with credit unions which are experiencing financial difficulties, and to, in unsatisfactory situations, initiate remedial action before the possibility of a claim on the credit union deposit insurance fund. JOB OVERVIEW To respond to complaints and inquiries related to the acts and regulations that FID administers. The Senior Market Conduct Officer handles the more complex complaints and inquiries. ACCOUNTABILITIES Required: Responds to complex complaints and inquiries from the general public and other sources related to the acts and regulations that FID administers. Prepares parts of the investigation plan and refers complaints to the Investigation Department if an investigation may be warranted. Undertakes special market conduct projects as determined by the Director, or Executive Director, Regulation. Drafts correspondence on market conduct issues for the Director, Executive Director, Deputy Superintendent and Superintendent. Page 1 of 3 Works with regulated institutions and other regulators to resolve and/or respond to complaints. Keeps current on changes in legislation. Maintain accurate records of complaints and inquiries. Provides assistance to the Market Conduct Officer. JOB REQUIREMENTS Degree or diploma in a field related to economics, finance, accounting, law or equivalent; Three years experience working in a regulatory environment; Working knowledge of business practices of financial institutions; Three years experience in dispute resolution and conflict management; Working knowledge of the Freedom of Information and Protection of Privacy Act and the Personal Information Protection and Electronic Documents Act; Demonstrated ability to interpret and apply complex legislation to private industry practices; Demonstrated ability to provide and obtain clear, concise and complete verbal and written information; Demonstrated ability to prioritize and complete work assignments under tight deadlines including assignments involving complex issues and multiple third parties; Ability to work independently and function effectively as a team member. Successful completion of security screening requirements of the BC Public Service, which may include a criminal records check, and/or Criminal Records Review Act check, and/or enhanced security screening checks as required by the Ministry.
