Agent and Eligibility Information
SMC is committed to protecting our student-athletes from any contact, communication, or conduct with
individuals who seek to inappropriately contact or represent student-athletes before their eligibility is
exhausted or voluntarily terminated.
All Agents must complete an Agent Registration Form and submit it to the SMC Compliance office before
any contact is made with SMC student-athletes.
California State Law (Miller-Ayala Athlete Agents Act) states that:
1. No benefits to the Student Athlete or the student athlete family member or friend can be
provided by agent, agent representative, or agent employee
a. Lodging, transportation, meals, gear, etc
2. Agent may not make or continue any contact with any student athlete, spouse, parent, foster
parent, guardian, grandparent, child, sibling, aunt, uncle, or first cousin, or any person who
resides in the same place as the student athlete or any representative of any of these persons.
3. Agent may send written materials provided that an identical copy of the materials is sent to the
SMC Compliance office.
Agent Information
For a Student Athlete to maintain NCAA eligibility, Agents
1.
Cannot provide benefits to a current SA and his/her family including (but not limited to)
a. Free/discounted transportation
b. Free/discounted meals
c. Free/discounted clothing
d. Free/discounted lodging
e. Free/discounted ticket to sporting events/entertainment
f. Gifts or Gift Cards
g. Free or discounted use of training facilities
h. Payment of SA or family member’s living expenses
i. Securing a loan for a SA

Cannot secure a written or verbal agreement with current SA for future representation or
making of SA’s athletic ability prior to completion of eligibility
3.
Cannot secure a written or verbal agreement to currently represent
Agent Contact with Student Athletes
1. Student Athlete is an individual enrolled at SMC, is participating in an NCAA sponsored sport,
and has college eligibility remaining in sports being for which they are being contacted.
2. All agents must contact SMC Compliance Office prior to contacting Student-Athlete and their
families
3. Agents are prohibited from having any contact (in-person, phone, in writing, electronically,
social media, and all others.)
Advisor Role
A student athlete may hire an advisor and maintain NCAA eligibility so long as:

No benefits are accepted from the advisor by the student athlete, family members, or
friends.
The advisor does not market a student athlete’s athletic ability or reputation to a
professional team on their behalf.
a. An advisor may not make any contact (phone, electronic, face-to-face) with a
professional team on the athlete’s behalf.
Permissible Activities –

Review contracts

Receive Payment for Services
Impermissible Activities –
1.
Market a student athlete to a team/club in any manner
2.
Attend contract negotiations on a student athlete’s behalf
3.
Directly negotiate a student athlete’s contract with an MLB team
4.
Student athlete does not render payment for services
5.
Advisor must be paid the going rate
6.
Enter into a contract (oral or written) with a student athlete for current or future
representation
Men’s Baseball
A student athlete will lose your eligibility IF:
1. The student athlete agrees orally or in writing to be represented by an agent or any individual
acting on behalf of the agent (e.g.,runner)
2. The student athlete accepts any benefits from an agent, a prospective agent or any individual
acting on behalf of the agent (e.g., runner).
a. benefits include – meals, transportation, use of a vehicle, lodging, clothing, tickets to
sporting/entertainment event, parking passes, gift cards, free use of discounted use of
training facilities, living expenses, secure loan on your behalf
3. The student athlete participates in a tryout with an MLB team that lasts longer than 48 hours,
which has not personally financed by the student athlete.
4. The student athlete attends a tryout with a professional team during the academic year and
misses class.
5. The student athlete uses an advisor throughout the process and does not pay the going rate for
the advising services.
6. An advisor markets a student athlete’s athletic ability or reputation to a professional team on
the student athlete’s behalf.
No violation
1. Student athlete is drafted in the MLB Draft
2. Contract is not signed with MLB Team by deadline
3. Student athlete attends MLB Draft
4. Student Athlete goes up on stage and holds up jersey or baseball cap

Sanctions

The Student Athlete may be ineligible for intercollegiate competition
Minimally the Student Athlete may be required to pay value of impermissible benefits and
withheld on a certain number of contests.
Men’s Basketball
A student athlete will lose eligibility IF:
1. The student athlete agrees orally or in writing to be represented by an agent or any individual
acting on behalf of the agent (e.g.,runner)
2. The student athlete accepts any benefits from an agent, a prospective agent or any individual
acting on behalf of the agent (e.g., runner).
b. benefits include – meals, transportation, use of a vehicle, lodging, clothing, tickets to
sporting/entertainment event, parking passes, gift cards, free use of discounted use of
training facilities, living expenses, secure loan on your behalf
3. The student athlete participates in a tryout with an NBA team that lasts longer than 48 hours,
which the student athlete has not personally financed.
4. The student athlete uses an advisor throughout the process and does not pay the going rate for
the advising services.
5. The student athlete attends a tryout with a professional team during the academic year and
misses class.
6. The student athlete enters the draft AND does not take the appropriate steps to withdraw and
declare their intention to resume intercollegiate participation by the required date.
a. If a student athlete declares the last two weeks of the draft, remaining eligibility will be lost
7. The student athlete enters the draft AND is drafted by a professional team
8. The student athlete may enter a professional league draft once during college career without
jeopardizing eligibility so long as
a. Not drafted by a professional team; and
b. Declares intention to resume playing for college team before the first day of the spring
signing period (typically in April). Declaration must be in writing to the SMC Athletic
Director
No violation
1.
If a student athlete talks to an agent or financial advisor
a. If a student athlete goes to dinner with agent, they must pay their own transportation
and own meal

Women’s Basketball
A student athlete will lose eligibility IF:

acting on behalf of the agent (e.g., runner).
2. The student athlete accepts any benefits from an agent, a prospective agent or any individual
acting on behalf of the agent (e.g., runner).
3. The student athlete participates in a tryout with a Women's National Basketball Association
Draft (WNBA) team that lasts longer than 48 hours, which has not been personally financed.
4. The student athlete tries out with a professional team during the academic year and misses
class.
5. The student athlete enters the draft AND does not take the appropriate steps to withdraw and
declare intention to resume intercollegiate participation.
6. The student athlete enters the draft AND is drafted by a professional team.
a. Student Athlete, Parents, may negotiate with Professional sports organization without
loss of amateur status. Student-Athlete who retains an agent will lose amateur status.
No violation
1. If a student athlete talks to an agent or financial advisor
b. If a student athlete goes to dinner with agent, they must pay their own transportation
