The following policy outlines must be complied with for any Backhaul upgrade installation processed at Existing ATC Tower Facilities. This Backhaul Submittal document is governed wholly by the “American Tower and Customer Backhaul Upgrade Policy and Procedure”. ATC Customer Submittal Definitions Customer Exclusive Backhaul Upgrade – Backhaul upgrade that is for the exclusive use of an Existing ATC Customer. Customer warrants that backhaul is exclusively for its use and no other party shall be deemed authorized to connect to or utilize the Backhaul without American Tower’s express written authorization. All of the following criteria are required, Within ATC Tower Facility, proposed telco run is parallel (+/- 1’) within existing ATC Customer’s existing telco run AND Proposed telco terminates wholly within existing ATC customer’s lease area and is exclusively for this customer’s use. AND All new above-ground equipment boxes and cabinets must be wholly within the Existing ATC Customer’s lease area. (Ground-level hand-holes or pull-boxes, no larger than 18" × 30", are allowed outside of Customer’s lease area, within ATC Tower Facility, if they are exclusively for this Customer’s use) Outside of ATC Tower Facility and Within Utility Right of Way- Proposed telco run is parallel (within 1’) to existing telco run and within ATC’s defined utility Right of Way. Existing ATC Customer assumes all responsibility for compliance with existing Right of ways and existing ATC Customer shall not infer from or rely upon any NTP or plan approval by ATC to be any representation or warranty that existing ATC Customer has complied with any existing Right of ways or applicable law. For any Equipment depicted on the drawing as outside of ATC’s Tower Facility, the customer or owner of the equipment shall be solely responsible for any approvals required from neighboring property owners for such an installation. Further, customer is responsible for any necessary permits or authorizations required for this installation. Customer Exclusive Backhaul Upgrade with Additional Ground Space and/or Additional Telco Run – Backhaul upgrade that is for the exclusive use of an Existing ATC Customer. Customer warrants that backhaul is exclusively for its use and no other party shall be deemed authorized to connect to or utilize the backhaul without American Tower’s express written authorization. Including any of the following criteria, Within ATC Tower Facility, proposed telco run is more than 1’ parallel from existing ATC Customer’s existing telco run. OR Within ATC Tower Facility, new above ground boxes or cabinets are needed to be used exclusively for the Existing ATC Customer’s new service, outside of Existing ATC Customer lease area. If any of the above two criterion are met, Existing ATC Customer will be subject to additional ground rent to accommodate the new space that will be taken up within the ATC Tower Facility. Submittal will also require a completed collocation application and will be processed through an amendment to the Existing ATC Customer’s agreement to document the additional ground space. Outside of ATC Tower Facility and Within Utility Right of Way - Proposed telco run is parallel (within 1’) to existing telco run and within ATC’s defined utility Right of Way. Non Exclusive Backhaul Provider Submittal Definition Non Exclusive Backhaul Provider Submittal – Within ATC Tower Facility, Backhaul provider requires a box or cabinet to be used as a demarcation point to service more than one existing ATC customer (not for one existing ATC Customer’s exclusive use). New agreement will be required between ATC and the Backhaul provider. See Backhaul Policy Document for instructions. Drawing Specifications All Drawings must adhere to all of the following criterion, ATC approved site drawing must be used (directions to retrieve these drawings below) All proposed work, including, but not limited to, new conduit paths, hand-holes, pull-boxes, and any other above ground box or cabinet, must be shown to scale, and clearly labeled on Drawing. SUBMISSION PROCESS FOR STANDARD SUBMITTAL q 1. A purchase order or check in the amount of $500 will be required for all submittals for Backhaul upgrades (Review Fee). a. The Review Fee is deemed earned by American Tower upon receipt of the Backhaul Upgrade Request. If payment is not sent with the submittal, a Purchase Order Request will be sent to the Project Contact when the project is created. 2. Submit this completed document together with drawings showing proposed work, generated from an ATC approved site drawing as the starting point , to [email protected]. Drawings must be to scale and clearly labeled. If upgrade requires additional ground space, a completed collocation application will also be needed with submittal (specifics are defined in policy document). If Contractor is not ATC approved, contractor or ATC customer will email and coordinate with [email protected] in order to gain approved status. Upon submittal of this document, you acknowledge that proposed Backhaul is for exclusive use by "ATC Customer Name". “ATC Customer Name’s” use of the Backhaul shall be subject to the terms and conditions of “ATC Customer Name’s” contract with American Tower and shall not be construed to convey a license or property interest in any third-party. Specifically, the provider of Backhaul service for “ATC Customer Name” shall not be considered a third-party beneficiary of “ATC Customer Name’s” rights under its agreement with American Tower. American Tower reserves the right to periodically audit any fiber/telco installation to ensure continued compliance with the requirements provided herein. Failure to comply with these requirements shall be deemed default under Customer’s agreement with American Tower. If American Tower identifies that Backhaul is not being used exclusively for “ATC Customer Name”, without American Tower consent and approval, American Tower reserves the right to pursue actions as according to the terms and conditions of “ATC Customer Name’s” contract with American Tower. 3. A Notice to Proceed will be issued upon receipt of all required information, including, but not limited to, ATC approved Contractor, ATC’s approval of site drawings, and payment of the Review Fee (and a Fully executed agreement for projects that require additional ground space). NTP will be issued by ATC and work conducted without an NTP or outside of the scope of that specifically permitted in the NTP is expressly prohibited and shall be deemed an unauthorized installation. All work at American Tower Facility must be completed by an ATC approved Contractor. 4. Closeout documentation including, As-Built Drawings and photos of all installed equipment and conduit runs with the ground restored to its original condition prior to the fiber/telco installation (collectively, the “Closeout Documentation”) must be submitted to [email protected] within 60 days of the date the NTP is issued.
