REQUEST AND AGREEMENT OF APPLICANT:
This is my request to the Friends of Red Clay that I be approved as a Vendor to provide food, goods or
services described above. I request that they accept this application. I will pay a Vendor Fee in the amount
as follows:

I agree to the following terms and conditions:
1. The Red Clay Pow Wow is an outdoor event and I fully accept and assume all risks and
responsibility for losses, costs & damages that may occur as a result of major inclement weather.
2. I hereby release and hold harmless the Friends of Red Clay and Red Clay State Historic Park and
all other respective agents, employees, members or representatives (collectively, the “Released
Parties”) from and against any loss, damage, theft, personal injury or injury to property that I
may suffer as a result of my participation in the event as a Vendor, attendee and/or participant
including, without limitation, any loss due to the acts or negligence of any event participant or
patron.
3. I agree to indemnify and hold harmless the Released parties from and against any loss they may
suffer as a result of my negligence or actions as a Vendor at the event.
4. I agree to maintain and keep my assigned site in a clean, safe and orderly fashion during the
event and to leave my site in the same condition as it was in at the time I first occupied it. I
agree to park my vehicles in the provided area by the Park.
5. I agree that my Vendor Fee, once received by Friends of Red Clay, is non-refundable.
