Back to Top TYPE OF INCIDENT Drug Violations. Use, possession, or sale of drugs or controlled substances on school grounds, in school vehicles, or at school activities or sanctioned events. Alcohol Violations. Use, possession or sale of alcohol on school grounds, in school vehicles, or at school activities or sanctioned events. Tobacco Violations. Use or possession of tobacco products on school grounds, in school vehicles, or at school activities or sanctioned events. 1st, 2nd Degree or Vehicular Assaults: Commission of an act on school grounds that if committed by an adult, would be considered First Degree Assault, as described in Section 18-3-202, C.R.S., Second Degree Assault, as described in section 18-3-203, C.R.S., or Vehicular Assault, as described in Section 18-3-205, C.R.S. Clarification: In keeping with the requirements of C.R.S. 22-32-109.1(b)(IV)(F), this category includes acts considered first and second degree assault, as defined by state statutes or municipal ordinances, but does not include acts considered third degree assault, (22-32-109.1(2) (b) (IV) (F) (C.R.S.). Fights and other third degree assaults in violation to the local code of conduct should be reported in the "3rd Degree Assaults/Disorderly Conduct" category. If unsure what type of event constitutes which degree assault, consult the language of the cited state statutes, and contact the school district’s legal counsel, local law enforcement officials or municipal attorneys for assistance. 18-3-202. Assault in the First Degree. (1) A person commits the crime of assault in the first degree if: (a) With intent to cause serious bodily injury to another person, he causes serious bodily injury to any person by means of a deadly weapon; or (b) With intent to disfigure another person seriously and permanently, or to destroy, amputate, or disable permanently a member or organ of his body, he causes such an injury to any person; or (c) Under circumstances manifesting extreme indifference to the value of human life, he knowingly engages in conduct which creates a grave risk of death to another person, and thereby causes serious bodily injury to any person; Refer to the statute for more specifics about assaults against peace officers, fire fighters, employees of the court and detention centers, or other youth service providers. First degree assault is almost always a felony. 18-3-203. Assault in the Second Degree. (1) A person commits the crime of assault in the second degree if: (a) Repealed. (b) With intent to cause bodily injury to another person, he or she causes such injury to any person by means of a deadly weapon; or (c) With intent to prevent one whom he or she knows, or should know, to be a peace officer or firefighter from performing a lawful duty, he or she intentionally causes bodily injury to any person; or (d) He recklessly causes serious bodily injury to another person by means of a deadly weapon; or (e) For a purpose other than lawful medical or therapeutic treatment, he intentionally causes stupor, unconsciousness, or other physical or mental impairment or injury to another person by administering to him, without his consent, a drug, substance, or preparation capable of producing the intended harm; 18-3-205 VEHICULAR ASSAULT (1) (a) If a person operates or drives a motor vehicle in a reckless manner, and this conduct is the proximate cause of serious bodily injury to another, such person commits vehicular assault. (b) (I) If a person operates or drives a motor vehicle while under the influence of alcohol or one or more drugs, or a combination of both alcohol and one or more drugs, and this conduct is the proximate cause of a serious bodily injury to another, such person commits vehicular assault. This is a strict liability crime. Refer to the statute for more specifics about assaults against peace officers, fire fighters, employees of the court and detention centers, and other youth service providers. 3rd Degree Assaults/Disorderly Conduct: Commission of an act on school grounds that, if committed by an adult would be considered third degree assault, as described below in section 18-3-204, C.R.S., or Disorderly Conduct, as described below in section 18-9-106 (1) (d), C.R.S. referring to fights. Note: In keeping with legislative intent, if the behavior fits these descriptions, report them even if no police report or charges were filed. 18-3-204. Assault in the third degree. A person commits the crime of assault in the third degree if he knowingly or recklessly causes bodily injury to another person or with criminal negligence he causes bodily injury to another person by means of a deadly weapon. Assault in the third degree is a class 1 misdemeanor. 18-9-106. Disorderly conduct. Statute text (1) A person commits disorderly conduct if he or she intentionally, knowingly, or recklessly: (d) Fights with another in a public place except in an amateur or professional contest of athletic skill; or Dangerous Weapons. Carrying, bringing, using or possessing a dangerous weapon on school grounds, in school vehicles, or at school activities or sanctioned events without the authorization of the school or the school district. A firearm, whether loaded or unloaded, or a firearm facsimile that could reasonably be mistaken for an actual firearm; any pellet or BB gun or other device, whether operational or not designed to propel projectiles by spring action or compressed air; a fixed blade knife with a blade that measures longer than three inches in length or a spring-loaded knife or a pocket knife with a blade longer than three and one-half inches; or any object, device, instrument, material, or substance, whether animate or inanimate, used or intended to be used to inflict death or serious bodily injury. Clarification: The rules provide the Colorado Statutory definition for a dangerous weapon that is set forth in state law for the grounds for suspension and expulsion of students (22-33-106(1)(d)(II), C.R.S.) All incidents in which a student is disciplined for carrying, bringing, using or possessing a dangerous weapon should be reported in this category. Under Colorado Law, firearms lawfully stored inside a vehicle on school property must be included here instead of in the Gun-Free Schools section. Robbery. Commission of an act on school grounds that, if committed by an adult, would be considered robbery. Robbery is a class four felony. 18-4-301. Robbery. (1) A person who knowingly takes anything of value from the person or presence of another by the use of force, threats, or intimidation commits robbery. Example: A 12-year old student approaches another student on the playground and in a very threatening manner demands the younger student’s lunch money. When the student refuses to hand over the money, the older student pushes the younger student to the ground and forcefully takes the money from his shirt pocket. This would be considered a robbery because a thing of value (the lunch money) was taken from the person (his shirt pocket) by the use of force (pushing to the ground.) Other Felonies. Commission of an act on school grounds that, if committed by an adult, would be considered a felony. Clarification: Any incident for which a student is disciplined which would be considered a felony if committed by an adult, shall be reported in the "other felonies" category except those related to, and already reported under, substance abuse, assault, dangerous weapon or robbery. Disobedient/Defiant or Repeated Interference. Being willfully disobedient or openly and persistently defiant OR REPEATEDLY interfering with the school’s ability to provide educational opportunities to and a safe environment for other students. Detrimental Behavior. Behavior on or off school property that is detrimental to the welfare or safety of other students or of school personnel, including behavior that creates a threat of physical harm to the student or to other students. Destruction of School Property. Willful destruction or defacement of school property. Other Violations of Code of Conduct. Other violations of the Local Board of Education’s code of conduct that resulted in suspensions, expulsions or resulting referrals to law enforcement, not already reported in above categories. These violations may or may not be documented in a student’s record (22-32-109(1) (2) (B)). Back to Top ACTIONS TAKEN Classroom Suspension/Teacher Removal. Removal from the classroom in accordance with Local Board Policy. Include in this column only incidents where the teacher removal process provided by C.R.S. 22-32-109.1(2) (a) (II) was followed (including contacting the parent or guardian, having a student-parent-teacher conference and if the second removal, developing a behavior plan). Other in school suspensions should be reported in the "In School Suspension" column. In School Suspension. Student suspended from classroom to another location in the school in accordance with Local Board Policy. Do not report any incidents that followed the teacher removal process provided by C.R.S. 22-32-109.1(2) (a) (II) in this column. They should be reported in the "Classroom Suspension/Teacher Removal" column. Out of School Suspension. Student suspended from school grounds in accordance with Local Board Policy. Expulsion. Student expelled in accordance with Local Board Policy. Expelled students who are on abeyance should be included in this action taken category because the most serious action taken is expulsion. Referred to Law Enforcement. Includes situations in which a student was referred to a school resources officer; a police report was filed; and/or police were called, but no report was filed. Clarification: If the incident was referred to law enforcement, indicate the most serious action taken (e.g., suspension, expulsion, etc) in addition to the referral to law enforcement. Law enforcement referrals will not be counted in the total incident count unless law enforcement referral is the only column checked. Other. Only include other extremely serious disciplinary actions according to local board policy. Less serious disciplinary actions such as warnings, Saturday school, sent to the office, detention for three tardies, etc. are not to be included in the "Other" column. Federal Race/Ethnicity Reporting Category*, Gender*, Unduplicated Total Count of Students: Provide an unduplicated count of students involved in incidents reported on both Safety and Discipline tables. Regardless of how many times a student appears in the Action Taken columns to the left, only count this student once in the unduplicated total on the Actions by Race/Ethnicity and Gender Table. Federal Race/Ethnicity Reporting Category*, Gender*, Habitually Disruptive Students: The total number of students in this Federal Race/Ethnicity Reporting Category,, gender that were declared habitually disruptive and expelled. A child who has been suspended pursuant to 22-33-106(1) (A) (B) (C) or (D) of this subsection (1) three times during the course of the school year for causing a material and substantial disruption in the classroom, on school grounds, on school vehicles, or at school activities and events because of behavior that was initiated, willful and overt on the part of the child. Clarification: Include only students who have been declared Habitually Disruptive. Each of the suspensions which caused a "material and substantial" disruption that led to this expulsion will be reported separately in the appropriate incident category. The final suspension leading to an expulsion should be recorded only once under the "Pupils Expelled" column as the expulsion was the most serious action taken as a result of the third or final incident. *Report each student only in one gender and one Federal Race/Ethnicity Reporting Category. Student Total Days Attended: The aggregate numbers of whole and partial days the students have attended school for the current school year. It is calculated by adding the number of days each student attended (full and partial days) in the current school year. Student Total Days Excused Absent: The aggregate number of whole and partial days students had excused absences (out of school), for the current school year. Absence due to a suspension is excused. (A student that is tardy is not considered to be absent.) Student Total Days Unexcused Absent: The aggregate number of whole and partial days students were absent (out of school), without being excused from a parent/guardian for the current school year. (A student that is tardy is not considered to be absent.) Student Total Days Possible: The aggregate number of whole and partial days students would have attended school if there had been no absences for the current school year. It is calculated by adding the number of days that each student was enrolled in the current school year. Expelled students are included until date of expulsion. This number should be the sum of Total Days Attended, Total Days Excused Absent and Total Days Unexcused Absent. Habitually Truancy Count: Four or more days in one month (A): The unduplicated count of Habitually Truant students who are at least the age of six on or before August 1 of the year in question and under the age of seventeen years having four total days of Unexcused Absences from public school in any one calendar Month; calculated by the sum of Unexcused Absences converted to days and fractions of days. Habitually Truancy Count: Ten or more days in one school year (B): The unduplicated count of Habitually Truant students who are at least the age of six on or before August 1 of the year in question and under the age of seventeen years having ten or more total days of Unexcused Absences, but never accumulated four or more total days of Unexcused Absences from that public school in any one calendar month; calculated by the sum of Unexcused Absences converted to days and fractions of days. Habitually Truancy Count: Met Both Conditions (A & B): The unduplicated count of Habitually Truant students who are at least the age of six on or before August 1 of the year in question and under the age of seventeen years four or more total days of Unexcused Absences from the reporting public school in any one calendar Month and also accumulated ten or more total days Unexcused Absences from the same public school during the Reported School Year; calculated by the sum of Unexcused Absences converted to days and fractions of days. Length of School Year -- A four-digit field (three digits with one digit to the right of an implied decimal point) which indicates the number of whole and partial days your school is in session for the current school year. This is the actual number of days when students are present. Valid values are between 130 (coded as 1300) and 245 (coded as 2450) days. This field is REQUIRED and, if left blank, will result in a FATAL error which will stop all processing of your file. EXAMPLES OF REPORTING Two White male students are involved in a fight (second degree assault). Colorado statute dictates that these students be expelled. The count of incidents placed in the "1st, 2nd Degree or Vehicular Assaults" row should be one under the "Expelled" column on the Incident Table. On the Race/Ethnicity and Gender Table the count of two students involved would be placed in the "White Male" row under the "Expulsions" column. The "Unduplicated Total Count of Students" would be two in the "White Male" row. Two Hispanic male students are involved in a fight (third degree assault). Local board policy dictates that these students receive an in school suspension. The count of incidents placed in the "3rd Degree Assaults/Disorderly Conduct" row should be one under the "In School Suspension" column on the Incident Table. On the Race/Ethnicity and Gender Table the count of two students involved would be placed in the "Hispanic Male" row under the "In School Suspensions" column. The "Unduplicated Total Count of Students" would be two in the "Hispanic Male" row. One Asian female student is caught drinking alcohol in school on two separate occasions. The young lady is suspended for the first incident and expelled for the second according to local board policy. The count of incidents would be two, one placed under the "Out of School Suspension" column and one under the "Expulsion" column on the Incident Table. The count by race/ethnicity would be one for an "Asian Female" under "Out of School Suspensions" and one in the "Asian Female" row under "Pupils Expelled". However, this student would only be counted one time in the "Unduplicated Total Count of Students" column in the "Asian Female" row. One Black male is disciplined for a behavior problem. First he received a suspension for verbally threatening his classmates; secondly he was suspended for repeatedly being defiant in classes; and suspended a third time for a fight (third degree) with his buddies; all carried out according to local board policy. The student and his parents have been notified in writing of each suspension counted toward declaring the student as habitually disruptive and have been notified of the definition of "habitually disruptive student" and the mandatory expulsion of such students. On the Incident Table this student will be represented twice in the "Out of School Suspension" column, once under "Disobedient/Defiant or Repeated Interference" and once under "Detrimental Behavior". He will be counted once under "Expulsion" in the "3rd Degree Assaults/Disorderly Conduct" row since his third suspension was a fight that ultimately led to his expulsion. On the Race/Ethnicity and Gender Table the count in the "Black Male" row under the "Out of School Suspensions" column is two, and the count is one under the "Pupils Expelled" column. However, this student is counted only once in the "Unduplicated Total Count of Students" column and also once in the "Habitually Disruptive Students" column. One American Indian female student is caught vandalizing school property on two separate occasions. The student is suspended for both incidents according to local board policy. The count of incidents would be two, both placed under the "Out of School Suspension" column on the Incident Table. The count by race/ethnicity would be two for an "American Indian Female" under "Out of School Suspensions". However, this student would only be counted once in the "Unduplicated Total Count of Students" column in the "American Indian Female" row. Back to Top GUN-FREE SCHOOLS ACT (GFSA) FIREARM EXPULSION TABLE Note: Expulsions reported in this data are a subset of Dangerous Weapon Expulsions reported in the incident information. Do not include firearms that are lawfully stored inside a locked vehicle on school property under the Gun-Free Schools Act (GFSA) Firearm Expulsions table although they are included under the School Safety/Discipline and School Safety/Ethnicity tables under Colorado law. Expulsions under these circumstances are exempted from the Gun-Free Schools Act. TYPE OF FIREARM Handgun. A firearm which has a short stock and is designed to be held and fired by the use of a single hand; and any combination of parts from which a firearm described previously can be assembled as defined in Title 18 United States Code 921(a). Rifle/Shotgun. A rifle is a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of an explosive to fire only a single projectile through a rifled bore for each single pull of the trigger. A short-barreled rifle is a rifle having one or more barrels less than sixteen inches in length and any weapon made from a rifle (whether by alteration, modification, or otherwise) if such weapon, as modified, has an overall length of less than twenty-six inches as defined in Title 18 United States Code 921(a). A shotgun is a weapon designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of an explosive to fire through a smooth bore either a number of ball shot or a single projectile for each single pull of the trigger. A short-barreled shotgun is a shotgun having one or more barrels less than eighteen inches in length and any weapon made from a shotgun (whether by alteration, modification or otherwise) if such a weapon as modified has an overall length of less than twenty-six inches as defined in Title 18 United States Code 921(a). Other Firearm. Definition of "other firearms" according to the Gun-Free Schools Act Firearms other than handguns, rifles or shotguns as defined in 18 USC 921. According to Section 921, the following are included within the definition: -- any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive; -- the frame or receiver of any weapon described above; -- any firearm muffler or firearm silencer; -- any destructive device, which includes: (a) any explosive, incendiary, or poison gas (1) Bomb, (2) Grenade, (3) Rocket having a propellant charge of more than four ounces, (4) Missile having an explosive or incendiary charge of more than one-quarter ounce, (5) Mine, or (6) Similar device (b) any weapon which will, or which may be readily converted to, expel a projectile by the action of an explosive or other propellant, and which has any barrel with a bore of more than one-half inch in diameter (c) any combination or parts either designed or intended for use in converting any device into any destructive device described in the two immediately preceding examples, and from which a destructive device may be readily assembled. (Note: This definition does not apply to items such as toy guns, facsimilies, cap guns, beebee guns, and pellet guns.) Total. Aggregate number of expulsions across the three firearm type categories.
