The project is registered as a condominium under the Alberta Condominium Act. What this means to h you as an owner, is that you own the interior of your unit, and common property is owned by each unit’s unit factor. The property is managed by a Board of Directors, which the owners elect at the Annual General Meeting (AGM). The Board contracts the services of a professional management company to hire staff and secure contractors as required, taking care of all maintenance and capital improvements. The management company also collects monthly contribution fees (condo fees), takes care of all income and expenses, and maintains accounting records for the project. A unit or any common area shall NOT be used for any commercial, professional or other business purposes involving the attendance of the public OR for any purpose which may be illegal or injurious to Dalton Square or anyone residing in Dalton Square. To ensure maximum enjoyment while living at Dalton Square, you are encouraged to read this information guide in its entirety and keep it close by as a handy reference. IT IS STONGLY RECOMMENDED THAT YOU BECOME FAMILIAR WITH THE BY-LAWS. THIS DOCUMENT IS NOT AN EXHAUSTIVE LIST OF ALL BY_LAWS TAKING POSSESSION OF A UNIT At the time of purchasing your unit, you should have obtained keys and appropriate documentation including a copy of the Bylaws from the previous owner or from your lawyer. You need to contact the Property Manager for the following: Confirm personal information is correct and state who will be residing in your unit ( a security deposit is required if owner is renting the unit or not residing on site) Make arrangements for payment of contribution fees (condo fees) Provide vehicle description information Confirm parking arrangements Obtain a copy of General Information and/or the Rules and Regulations CONDO FEE PAYMENTS At the time of possession please contact the property manager and arrange an automatic debit (PAP)from your chequing account in the amount of your monthly condo fees. The use of a PAP is encouraged. Ensure that your unit number is clearly indicated on the front of each cheque. We will require a further series of post-dated cheques each year. We do not issue receipts for cheques and ask that you use your cancelled cheques or bank statements as your receipt. Cash is not accepted. PROPERTY MANAGEMENT Fireside Property Group Ltd. professionally manages Dalton Square. All payments, written communication, confidential or otherwise, must be directed to Fireside Property Group Ltd. 403-228-4303 [email protected] PARKING Each owner has an assigned parking stall. If you wish to rent an additional parking stall please contact Fireside Property Group Ltd. Please be aware forward parking only into stalls as backing in risks damage to the plug in’s. In addition, many fresh air intake vents for units are at the front of the unit and there is a risk of carbon monoxide poisoning with backing into stalls. Violators will be fined $100.00 daily per offense and also risk being ticketed and towed. Fire lanes are a no parking zone, any vehicle parked in a fire lane will be ticketed and towed. Visitors’ parking is located west of the site office, unit 116. This parking is for visitors only; residents are not to use assigned visitor parking stalls. No vehicle is to be left in a visitor space for longer than two weeks without written consent of the Board. If it is determined that visitor parking is being abused by owners or visitors violating vehicles will be ticketed and towed. Please be advised that car washing, repairs and storage are NOT allowed in the stalls nor anywhere else on the common property. All oil spills and leaks from your vehicle are the responsibility of the vehicle owner and any clean up required will be charged accordingly. Electric vehicles that require power recharging are prohibited from plugging into the electrical outlets to recharge. Vehicles that are non-operational, do not have a current license or registration or are not insured for public liability can be removed from the project even though they are parked in the designated stall. Owners with RV's, boats and trailers may contact Fireside to rent a stall in the RV area. Owners found abusing these rules, are subject to ticketing ($100.00 daily for each violation) and towed at the discretion of the Condominium Corporation. Subleasing of parking stalls to non-residents is NOT allowed. INTERIOR UNIT MAINTENANCE Owners are responsible for their own in-unit maintenance. However, if there were a problem with a main service water pipe for all units this would fall under the Corporation’s responsibility. It is best that you contact Fireside Property Group Ltd. directly for clarification. P a g e |3 Dalton Square Welcome/Key Rules & Regulations If you have a flood in your unit, please shut off the water supply to your unit immediately. If the water is coming from a connecting unit, please contact the owner ASAP to have them shut off their water and contact Fireside Property Group Ltd. ASAP. Depending on the problem, the owner could be responsible for the costs of repair and damage. A reminder: if the main shut off valve has to be shut off, the other four units must be informed in advance and approximately how long it will take. VACATIONS / VACANCY OF UNIT FOR AN EXTENDED PERIOD OF TIME Occupants of any unit who will be absent for any length of time should contact Fireside with the name and phone number of a person whom is looking after the unit in case of an emergency. The unit and mailbox should be checked on a regular basis. Refer to personal home owners insurance for additional requirements. UTILITIES Heat and electricity costs of each unit are the owner’s responsibility. Cable TV, water, sewer and parking lot electricity costs for vehicle plugins are included in the monthly condo fees. Please be conscious of the amount of water you use and your form of usage as high or neglectful usage only means higher condo fees. Frequently check your toilet to ensure that you do not have a leak within the tank to the toilet bowl; place food coloring in the tank of the toilet, if the colored water seeps into the bowl, you then have a leak. Also change any tap washers frequently to reduce water waste through dripping taps. Please be aware during the winter months of the length of time, you plug your vehicle in. If you will not be using your vehicle for a period, please do not have it continually plugged in. Like high water usage, this increases the condo fees with the high electricity costs. PUBLIC TRANSPORTATION There is a bus stop directly across from the north entrance of Dalton Square on Dalton Drive and on the corner of Dalton Drive and Dalhousie Drive. Dalhousie C-Train Station is a 5 - 10 minute walk to the west of Dalton Square. P a g e |4 Dalton Square Welcome/Key Rules & Regulations FREQUENTLY ASKED QUESTIONS: QUESTION: What if I don’t pay my Condominium Fees? ANSWER: Every owner is obligated to pay his or her fees in full on the first day of every month. A service charge of $100 per month plus interest charges at a rate of 18% per annum is assessed on all accounts that are in arrears. Failure to pay will result in a caveat being registered against the title of your property at an additional charge to you. Arrears in excess of three months could result in legal or foreclosure action. A $75 service charge will be charged for NSF cheques. QUESTION: Are pets allowed? ANSWER: Yes, with written permission from the Board (owners may have three pets; each must be registered and approved by the Board.) QUESTION: Can I make modifications to my unit? ANSWER: Yes, but only with written permission from the Board. Modifying or cutting into any walls can pose a hazard as utility service pipes and wires, which service other units, may be located within interior walls. Also, any construction materials must be disposed of by your own contractor, and not placed in the on-site garbage bins (costs will apply to the offender.) QUESTION: Can I construct a deck/shed etc. or paint my deck existing deck? ANSWER: Yes, but only with written permission from the Board. There are specific colors that are allowed for painting of decks and an allowable size for sheds. The shed is to be pre-manufactured made of either metal or plastic materials with a base measurement of no more than 8' X 8' and no higher than 6' 6". ANSWER: Owners are responsible for the cost and maintenance of screen doors, mail boxes, door bells and their unit front and back exterior light fixtures (excluding security lights.) All units must have unit numbers by the front and patio entrance doors. QUESTION: Can I install an air conditioning unit in my window or the exterior of my unit? ANSWER: No window mounted air conditioning units or air conditioning units affixed to the exterior are allowed. Please contact Fireside Property Group Ltd. if you require further information. QUESTION: How do I dispose of furniture or larger items? ANSWER: You are to contact the City of Calgary or an independent contractor to remove any large items from the site. Violators will be fined $300.00 per occurrence. Dalton Square participates in the City of Calgary multi-unit recycling plan. Bins are color coded for recycling and for garbage. QUESTION: Am I allowed to barbeque on my deck? ANSWER: Yes, a barbeque with a propane bottle, maximum size of 20 lbs is allowed. Outside fire pits and barbeques using solid fuel such as wood briquettes are not allowed. QUESTION: What am I allowed to place in my yard area? ANSWER: Your yard area is common area which is exclusively designated for your use. Yards must be kept clean and tidy, weed free and clutter free. Owners must receive written approval from the Board for large items (i.e., sheds, trees). Owners that are not keeping their exclusive use yard tidy, weed free and uncluttered are subject to a fine of $300.00 per occurrence. If the violation is not corrected in a specific period of time (written notice will be provided) then the corporation will have the yard cleaned up, at the owner’s expense. QUESTION: Do I have to carry insurance? ANSWER: Yes, you need to purchase what is called a condominium Home Owners Policy. You are responsible for covering your personal belongings as well as any damage that may occur to the interior of your unit, damage to other units or any common property. We strongly recommend you speak to your Insurance Agent. QUESTION: What if someone is parked in my stall? ANSWER: The simplest way is to provide a note on the windshield and park in visitor parking till the situation is corrected. If it is a regular occurrence, please contact Fireside Property Group Ltd. QUESTION: What clean up am I responsible for? ANSWER: You are responsible for keeping your yard area clean, weed free neat and uncluttered. You are also responsible for keeping your assigned and any rental parking stalls free of stored items or garbage and oil stains. If you are using any of the common areas including the kids play area, please ensure you leave the premises in a clean and orderly fashion; pick up any garbage or toys. Please ensure the walk ways are free from any toy items. Please note the kids play area is only for residents and their guests. Climbing trees is prohibited. QUESTION: Who do I contact if I notice items or deficiencies in the common areas? ANSWER: If any general maintenance items should arise such as security lights not working, broken windows, shopping carts etc. please contact Fireside Property Group Ltd. ASAP. These items will be dealt with on the next business day following reporting. Please be proactive and report any deficiencies to Fireside Property Group Ltd. ASAP. P a g e |6 Dalton Square Welcome/Key Rules & Regulations QUESTION: What do I do about noisy people or parties? ANSWER: You have the option of either knocking on the offending unit door and asking them to quiet down or calling the police. Please report all issues of noise complaints to Fireside Property Group Ltd. on the next business day so that they may keep a record of the problem owners or their tenants. QUESTION: How much noise is allowed? ANSWER: Common sense must be exercised here. Excessive noise (i.e. booming stereos) will not be tolerated at any time. In the summer time with sliding glass doors and decks, please consider that sound carries outside and some people are sleeping with their windows open. Renovation/repair work time frame is 7:00 am to 6:00 pm. QUESTION: How often should I check my smoke detector? ANSWER: Your unit may have a smoke detector that was hard wired into your unit electrical (batteries not required) at the time of construction. Owners may have added subsequent smoke detectors over time. You should test all smoke detectors occasionally. You may want to try lighting a candle, blowing it out and let the smoke from the extinguished candle go into the smoke alarm. To turn off the alarm, simply wave a newspaper underneath the detector. You can occasionally vacuum the detector to clear away accumulated dust. If your smoke detector does not work, it is the owner’s responsibility to have it checked and/or replaced immediately. The battery should be changed twice a year. QUESTION: Can I install hardwood, tile or laminate flooring or change the carpeting or lino? ANSWER: You must get written Board approval. To prevent unreasonable sound travel, any flooring products installed must be insulated with material that proves to have an impact insulation class rating (IIC rating) of 74 or higher. The IIC is a measurement used which indicates the average noise reduction in decibels for sounds passing through floors. Fireside Property Group Ltd. can recommend flooring companies that comply with the requirements. All requests must be made in writing to the Board of Directors and written approval obtained from the Board prior to any installation. Failure to do so can result in extra costs to the owner to ensure approved flooring is installed. QUESTION: What do I own? ANSWER: You own the interior of your unit. You also own a “share” of the common areas of the buildings and grounds. More specifically, the only portion of the floor, ceiling or exterior walls that form part of the unit is the finishing material that is the interior of the unit, including the lath and plaster, paneling, gypsum board, panels, flooring material or coverings or any other material that is attached, laid glued or applied to the floor, wall ceiling, as the case may be. All doors and windows of a unit that are located on exterior walls of the unit are part of the common property. Any reference to doors (excluding any screen doors but including the patio glass window – not the screen) herein, refers to the door, the doorframe and the door assembly components, if any, but does not include the door casing, trim or moldings. Any reference to a window includes the glazing, the window frame and the window assembly components, if any, but does not include the window casing, screens, trim or moldings. QUESTION: What if I have a problem with my unit? ANSWER: As an owner, you are responsible for all items on the interior of your units except for utility components which may be part of a common distribution system. If you are not sure if a specific problem is a common property concern, or an owner issue, contact Fireside Property Group Ltd. Any unresolved problems should be addressed in writing to the Condo Board and submitted through Fireside Property Group Ltd. Your correspondence should include a detailed outline of your problem, your name, unit number and a phone number P a g e |7 Dalton Square Welcome/Key Rules & Regulations and email address (if available.) Most requests and problems will be presented to the Board of Directors for discussion at the next Board meeting and you will be contacted by letter or email once a decision has been made. Emergencies will be dealt with on an “as needed basis.” QUESTION: What do my condominium fees pay for? ANSWER: Your condominium fees cover the costs of maintaining the common areas of the complex (landscaping, snow removal, flower beds, signage, electrical, common area utilities, water, garbage, sewer, repairs, management fee etc.), basic cable and insurance on the complex in the event of mass destruction. A portion of your condominium fees also goes into a reserve (savings) fund for future capital replacements or improvements such as re-roofing, staining, painting, exterior siding, etc. QUESTION: What is a Board of Directors? ANSWER: The Board of Directors are owners elected to manage the financial and physical affairs of the condominium property as well as provide direction to Fireside Property Group Ltd. They are responsible for making decisions regarding maintenance, capital improvements and investments for Dalton Square. The Board of Directors approves special requests from owners such as pet applications, renovations, etc. An owner may attend a board meeting, with written request sent to Fireside Property Group Ltd. stating the reason for the attendance. Once the board approves, the owner will be allotted a time to attend. Approved Board of Directors meeting summaries will be posted on the Dalton Square website each month. Afterwards the minutes may be purchased from Fireside Property Group Ltd. QUESTION: How will I know when the AGM is being held? ANSWER: A notice will be mailed out to all owners that will indicate when and where the AGM will be held. To date the most common location has been the Dalhousie Community Centre. QUESTION: What if I rent out my unit? ANSWER: In the event that you do not personally occupy your unit, you continue to be responsible for the actions of anyone occupying the unit. Before renting your unit you should carefully read the Bylaws and you need to subsequently provide your renter with a copy of the Bylaws. Any occupant or tenant must comply with the Bylaws and Rules and Regulations of the condominium as if they are an owner. Any deviation from the Bylaws or Rules and Regulations can result in a fine levied on the owner. The Condominium Corporation reserves the right to evict your tenant with or without your knowledge on a thirtyday notice for non-compliance of the Bylaws or Rules or Regulations. Note that the Condominium Property Act supersedes the Residential Tenancies Act in Alberta. You must register with Fireside Property Group Ltd. the information on your renters and their vehicles plus provide a $1,000.00 security deposit to the Corporation. Any violators not registering their tenants will incur a fine of $300. Fireside Property Group Ltd. will communicate only with owners, unless there is an emergency situation. QUESTION: What if I move but do not sell my unit? ANSWER: All owners must contact Fireside Property Group Ltd. with respect to any address change to ensure that correspondence regarding the condominium is being received. The Condominium does not assume responsibility for trying to locate owners and will not assume liability for any important information that they have not received because the owner does not make the appropriate address/phone and email changes. The Condominium is not responsible for any loss incurred by the owner in their absence. QUESTION: How can I add to the wellbeing of Dalton Square community I live in? P a g e |8 Dalton Square Welcome/Key Rules & Regulations ANSWER: By keeping your exclusive use yard clean, weed free and tidy, keeping assigned parking and rental parking stalls clean of garbage and oil spills, park only face forward in ANY parking stall located in Dalton Square, promptly reporting any deficiencies within Dalton Square to Fireside Property Group Ltd. , picking up visible garbage in the common areas, respecting the kids lot and usage, preventing plugged sinks, tubs, toilets drains, using water consciously and modestly, not pouring hot grease, coffee grounds, tea leaves, dental floss, etc. down any drain, flush only toilet paper down a toilet – Kleenex, paper towels, rags etc. are not to be flushed down the toilet (you can purchase a “strainer cup” from Canadian Tire for the bathroom tub to collect stray hair.) These are some obvious examples; please just be conscious that Dalton Square is a multi-family community and respect your neighbours, your exclusive use areas and the common areas. P a g e |9 Dalton Square Welcome/Key Rules & Regulations SUMMARY The owner of a condo unit is a citizen of a miniature democracy that has its own elected government, the condo board. A condominium is a legally registered entity. The Condominium Property Act, Bylaws of the Corporation and the Welcome Package/Rules and Regulations, governs its operation. Owning a unit at Dalton Square obligates you to comply with the content of all these documents. In accordance with the Alberta Condominium Property Act, Bylaws, and the Welcome Package/Rules and Regulations, the condominiums are run by a corporation of owners forming a legally recognized and accountable Board. An election from among the owners takes place once a year and up to seven board members are elected to run the affairs of the Corporation. Their services are essential to you, as an owner, under condominium law in Alberta. Condo unit owners look to their Board for sound management of the corporation's affairs. The Board budgets prudently, ensuring the unit owners get good value for their condo fees. The Board is also expected to arrange adequate insurance, maintain financial controls and supervise the performance of the management company it has hired. The Board enforces bylaws to help the condo community run smoothly. When people buy condo units, they agree to be bound by the rules. It's important to remember that as an owner, you have agreed to live by the bylaws and you've empowered the Board with the right to enforce them. Each owner should understand that he or she has an obligation to live by the rules of the community. Infractions are subject to fines. As you can well imagine this is a significant time commitment for the Board, it is only fair and reasonable that all owners should be willing, from time to time, to contribute some degree of help to run the Corporation. Help can be given by standing for election for the Board, being an alert and engaged owner by reporting any deficiencies, picking up garbage etc. We all wish to keep Dalton Square an attractive complex, keep property values as high as possible and enjoy being an owner within Dalton Square.
