Definitions: ‘The Program’ means winnow.exe. ‘WQC’ means the “Water Quality Centre at Trent University, Peterborough, Ontario, Canada”. WQC includes the author of The Program and the co‐author of the article on which it is based. ‘User’ means any person who downloads and/or uses The Program. Terms of Use: This agreement is between the User of The Program, and the WQC. By downloading and/or using The Program, the User acknowledges and agrees to the following: 

The Program is not guaranteed to be error‐free, nor is it guaranteed to give satisfactory results; The Program may be unstable and may produce unpredictable results with some data sets; Repairs and/or modifications to The Program may be done on a best‐efforts basis but the WQC does not in any way guarantee that such repairs or modifications will be done; The Program will not be used for any purpose that is contrary to any law; The Program will not be used for any purpose that could contribute to or result in property damage, the infringement of any person’s rights, personal injury or death; Downloading and use of The Program are entirely at The User’s risk and expense. 2567. The User may distribute The Program to other users only on the condition that such other users have first read and agreed to these Terms of Use in their entirety. The User undertakes to ensure that this condition has been met before distributing The Program. Under no circumstances and under no legal theory, whether tort (including negligence), contract, or otherwise, shall the WQC be liable to The User nor to any person to whom The User has distributed The Program for any direct, indirect, special, incidental, or consequential damages of any kind including, without limitation, damages for lost profits, loss of goodwill, work stoppage, computer failure or malfunction, or any and all other commercial damages or losses, even if such party shall have been informed of the possibility of such damages. This agreement shall be governed by the laws of the Province of Ontario, Canada.
