CRESWICK FOOTBALL NETBALL CLUB CONTRACT
This contract is entered into by:
_______________________________________________ (“the player”)
AND
The Creswick Football Netball Club (“the Club”) as a member club of the Central Highlands Football
League (“the League”)
The player shall play for the club for the following playing season(s) _______________________
The player agrees to play with the club in accordance with the following terms and conditions:
1. PLAYER BOUND TO RULES
1.1.
The Player hereby agrees with the Club that he is bound by:
1.1.1. The Rules and Regulations of the Club as stated within the ‘Creswick FNC Player
Handbook’;
1.1.2. The Rules and Regulations of the League within which the Club plays (including
requirements of players and clubs regarding registration); and
1.1.3. The Rules and Regulations of AFL Victoria Inc, including any modifications thereof
made from time to time (“the Rules”).
2. DISPUTE
2.1.
In the event of a dispute arising between the parties during the term of this Contract or
following the termination hereof, the matter may be referred for determination to the
nominee of the league. A request for determination by an aggrieved party shall be made in
writing to the other party and shall contain a precise statement of the issue in dispute and
all relevant facts giving rise to the dispute. The League may adjudicate upon any dispute
in accordance with its rules in force at the time.
3. TERMINATION
3.1.
This Contract may be terminated by:
3.1.1. The Club if the Player is in breach of any of his obligations hereunder and the breach
continues for a period of 14 days after notice in writing by the Club to the Player
requiring the breach to be remedied.
3.1.2. The Player if the Club is in breach of any of its obligations hereunder and the breach
continues for a period of 14 days after notice in writing by the Player to the Club
requiring the breach to be remedied.
3.1.3. The Player immediately by notice in writing given to the Club upon his name being
included, in accordance with the Rules of the Australian Football League (“the AFL”),
on the official list of players of any team competing in the AFL competition.

4. DURATION OF CONTRACT
4.1.

The player will remain contracted with the club named on the reverse side of this form until
the expiration of the contract which shall be on the 31st of October of the final year first
therein before mentioned.
The club and player acknowledge that this contract has been entered into in good faith.
The contract shall only be valid, when the player becomes registered with the club
It is noted and agreed to by all parties to this contract that the VFL and or AFL contract will
take precedence over this contract and that the rules and regulations of the VFL of AFL will
be adhered to.
5. PLAYER MOVEMENT TO VFL / AFL
5.1.
The player will remain contracted with the club named on the reverse side of this form until
the expiration of the contract. It is noted and agreed to by all parties to this contract that the
VFL and or AFL contract will take precedence over this contract and that the rules and
regulations of the AFL or VFL will be adhered to.
6. WAIVER
6.1.
6.2.
6.3.
A waiver by any party of any of the terms and conditions of this Contract in any one case
shall not be deemed or construed to be a waiver of such term or condition for the future or
for any other or subsequent breach unless the breach is severe enough to warrant
termination of the Contract, in accordance with the terms as set at herein.
A waiver or consent given by a party under this Contract is effective and binding on that
party if it is given or confirmed in writing by that party.
A waiver by any party of any of the terms and conditions of this Contract in any one case
shall not be deemed or construed to be a waiver of such term or condition for the future or
for any other or subsequent breach
7. JURISDICTION
7.1.
The regulations and by laws of the League take precedence over any club rules if there is
a dispute between the parties to this Contract.
8. GOVERNING LAW
8.1.
This Contract is governed by and must be construed according to the law of Victoria.
9. ENTIRE AGREEMENT
9.1.
To the extent permitted by law, in relation to the subject matter of this Contract, this
Contract:
9.1.1. Embodies the entire understanding of the parties, and constitutes the entire terms
agreed by the parties; and
9.1.2. Supersedes any prior written or other agreement of the parties.

10. PAYMENTS
In accordance with the aforementioned information, the following details set out the payment
details from the club to the player as a return for services associated with the club.
The club agrees to pay the player in accordance with the following payment schedule:Match payments: $_____________ (Per senior match played during the home and away season)

Manner and dates for payment:
Match payments will be made after each senior match played during the home and away season.
Incentives will be paid during the after game presentations or by the following Saturday where
circumstances arise that do not allow this to be possible.
