LEGALBACKGROUNDTEXTS ThesegeneraltermsandconditionsofsalearegovernedbyarticlesL324-2-1andfollowing oftheFrenchCodeduTourisme(FrenchTourismCode). TheindicationsprovidedinthisdocumentaregivenbytakingaccountofFrenchlaws,rules andregulationsatthemomentofpublicationandwhichmaybesubjecttomodifications interveningafterpublication. Theservicesprovidedbythelessorfallwithinthedefinitionofseasonalrentalsandthelease isgrantedfortemporaryresidenceforthepurposeofpleasure.Theleaseholdercannotuse thepropertyasapermanenthomenorasaplaceofbusinessofanysortwhatsoever. ThesetermsandconditionsofsalearesubjecttoFrenchlaw.TheEnglishlanguageversionis atranslationoftheFrenchdocumenttoaidcomprehensionandcannotbeconstruedas substitutingfortheFrenchlanguagelease. 1) INSCRIPTIONANDBOOKING a.Informationprovidedpriortobooking -Thenumberofpeople:whenyoubookyouwillbeaskedtostatethenumberofpeople- adultsandchildren–inyourpartywhowillstayintheflatorchaletduringthelet.This numbermayneverexceedthenumberforwhichtheflatorchaletisequipped.Failureto complywiththisconditionwillleadtoimmediatecancellationofthelease. -durationandperiodofthelet Thedurationoftheletisstipulatedinthespecificconditionsoftheleasingagreement. Theaccommodationismadeavailabletotheleaseholderasfrom17.00(5.00pm)onthe arrivaldateagreedwhenthebookingwasmadeandtheleaseholdermustleaveby10.00am onthedeparturedateagreedwhenthebookingwasmade. Theleasecanneverexceedanon-renewabledurationof90consecutivedays. -Animals:providedthattheauthorizationofthelessorhasbeenobtainedbeforehandpets arewelcomeintheflatsorchaletsprovidedthattheydonotdisturbthepeaceorthreaten thesafetyofotherpeoplepresentontheproperty.Dependingontheanimal’sspeciesand size,thelessorhastherighttorefuseauthorization. Pleasespecifythespeciesandsizeofyourpetwhenmakingyourbooking. -Peoplewithallergies,peoplewithhandicapsandpeoplewithreducedmobility:when makingyourbooking,askourservicesifwecanmeetyourspecificneedstomaximiseyour comfortandsafetyduringyourstay. b. Bookings -Bookingsareonlyconfirmedafterwereceiveadeposit,i.e.: ▪30%ofthefullcostofthebooking.Thebalancemustbepaid1monthbeforearrival. ▪100%ofthecostofthebookingifitismadelessthan30daysbeforeyourarrival. -Allbookingsareguaranteedbycreditcard,detailsofwhichmustbeprovidedwhenthe bookingismade. -Thebalanceofthecostofyourstaycanbepaidbycredittransfer. Afterconfirmationofthebooking,aleasingagreementisdrawnuptowhichadescriptionof thepropertyisappended. c.Ratesandservices -Rates Ourratesincludealltaxesexceptforthevisitor'stax(seebelow)andincludetheprovisionof accommodation,thesupplyofsheetsandhandtowelsandtheconsumptionofwater, electricityandheating. Ourratesdonotincludeadministrativecharges,technicalexpensesoroptionalservices,nor theVisitor'staxwhichispayableadditionally. -ObligatoryCharges:foreachstay,administrativeandtechnicalchargeswillbeinvoicedin additiontotherentfortheaccommodation.Thesechargesarelumpsumswhichvarywith thenatureandsizeoftheaccommodation,namely: • 250€forchaletsD/E/F/G/I/J/K/L/O/P • 200€forchaletsA/B1/B2/C1/C2/HandforVALSOLEILT4flats • 150€forchaletsM/NandforVALSOLEILT2andT3flats -Administrativechargesarefor: ▪openingtheleaseholderaccountandperformingthe“leavinginventory” -Technicalchargesarefor: ▪cleanlinen,changesofsheetsandmakingofallthebeds,thereplacementofdefective utensils,appliancesandfurniture,etc.inflatsandchalets, ▪rebootingsystems,thechangeofaccesscodestotheaccommodation,sharedspaces, Internet,TV,etc…. ▪thoroughcleaningoftheaccommodation. -OptionalServices Additionalservicessuggestedbythelessor(housekeeping,sheetandtowelchangesduring thestay…)mustbepaidforinfulltothelessorattheendofthestayandwillbededucted fromthedepositifnotpaidbeforetheleaseholder’sdeparture. Allotherservicesorderedviatheporter’slodge(conciergerie)mustbepaiddirectlybythe leaseholdertotheserviceprovider. -Visitor'stax:thecostofthevisitor'staxandtheperiodduringwhichitisapplicableare decidedeachyearbythePRAZ/ARLYtowncouncilandthedépartementofHauteSavoie. Thevisitor'staxispayableperpersonpernight.ThecostcanbeconsultedatthePRAZ/ARLY townhallandtouristoffice.Thevisitor'staxispayableattheendofthestay. 2)MODIFICATION-CANCELLATION -ModificationbytheLessor Forreasonsofforce majeure and/orsafetyand/ormaintenance,thelessormaybeobliged tomodifypartiallyortotallytheleaseholder’sstay.Inthisevent,theLeaseholdercancancel theleaseandobtainarefundofthesumsalreadypaidwithoutcost,oracceptamodification suggestedbythelessorasanadditionalclauseintheleasesignedbetweenthelessorand theleaseholder. ▪ModificationbytheLeaseholder TheLessorshalldoeverythingpossibletomeettheLeaseholder’srequestforamodification. Ifsuchamodificationisnotpossible,themodificationwillbeconsideredtobeacancellation andtherulesstipulatedbelowapply. ▪Cancellation Itisadvisabletosubscribeacancellationinsurancepolicy. Cancellationofastaybeforeitbeginsgivesrisetothefollowingcharges: -Cancellationmorethan90daysbeforethearrival:20%oftheadministrativechargesare payabletoSASCACHEMIRERENTAL -Cancellationbetween90and61daysbeforearrival:30%ofthefullcostofthestay -Cancellationbetween60and31daysbeforearrival:50%ofthefullcostofthestay -Cancellationlessthan30daysbeforearrival:100%ofthefullcostofthestay. -Interruptionofstay: Ifthestayisinterrupted,evenforhealthreasonsorforcemajeure,theleaseholdercannot claimarefund.Tocoverthiseventuality,itisadvisabletosubscribecancellationinsurance withaninsurancecompany. -LateArrival Latearrivaldoesnotextendtheleasebyacorrespondingduration.Theoriginalleasestands andwillbeinvoicedfully. -LateDeparture TheLeaseholderwillincuradditionalexpensescorrespondingtotherentalrateforonenight oftheaccommodationinquestion,unlessthelessorhasapprovedthislatedeparture beforehand. 3)THESTAY SEJOUR Providedthatthebalanceofthestayhasbeenpaidinfullyouwillreceivethe“LesPortes deMegève”Guideatleast15daysbeforethebeginningofthestaybye-mail.TheGuide containsallthepracticalinformationyouneedtohelpyoufullyorganizeandmakethe mostofyourstay-route,map,address,arrivalanddepartureinstructions, -Departuretime Departuretimesmustberespectedorelsetheleaseholderwillincuradditionalexpenses amountingtoonenight’srentfortheaccommodationinquestion. -Arrival:flatsandchaletsarereadyat17.00(5.00pm).Leaseholderswhohavetheaccess codescanarrivewhenevertheywant. -Departure:Fororganizationalreasons,youmustleaveby10am. -AdministrativeObligation Newleaseholdersmustpresentthemselvesatthereceptiondeskwithin24hoursofarrival at“LesPortesdeMegève”totakeaprintoftheircreditcard(seeguaranteeandpayment headingbelowinthesegeneraltermsandconditions). -Departure Housekeeping:thechaletsmustbeascleanastheywerewhenyouarrivedexceptthat: -bedsshouldbestrippedandthesheetsleftattheendofeachbed -towelsandbathroomlinenmustbeleftintheshowertubs -teatowelsmustbeleftinthekitchensink If,duringthefixturesinventory,itisdecidedthatitisnecessarytointerveneforrepairsor cleanliness,interventionswillbeinvoicedattherateof75€anhour(seeguaranteeand paymentheadinginthesegeneraltermsandconditionsbelow) Leavingafter10a.m.andextendingthedurationoftheleasemustbenegotiated beforehandwithCACHEMIRERENTALmanagementatleast48hoursbeforethelease expires. 4).SAFETYANDHOUSERULES Tokeepyourholidayssimple,houserulesaredisplayedineachflatandchalet.Please familiariseyourselfwiththemwhenyouarrive–andrespectthem. -Houserules Leaseholdersareresponsibleforanyandalldisturbancesordamagecausedbythepeople stayingintheaccommodation.Ifthepeace,integrityorsafetyofpeoplelivingorworkingon theestateisthreatened,wehavetherighttoterminatetheleasewithimmediateeffect withoutcompensation. Leaseholdersmustnotcommitimprudentornegligentacts.Inparticulartheymusttake everyprecautionnottoleavetheflatorthechaletopenwithoutsurveillanceandlockthe doorswhenabsenttopreventintrusions. Leaseholdersundertaketousetheaccommodationandthefurnitureandfittingsnormally. Ourcompanyrefusesliabilityforthefollowing: -theftofordamagetoobjects Ourcompanyrefusesliabilityforthetheftofordamagetogoodsbelongingtoleaseholders intheiraccommodationortheLesPortesdeMegèvecarpark. Safesareavailableforleaseholdersineveryflatandchalet.Leaseholdersaresolely responsiblefortheirgoodsandpersonaleffectsduringtheirstay. 5)LIABILITYANDCLAIMS RECLAMATIONS • Liability -Liabilityof“LesPortesdeMegève”.Assafesareavailableforleaseholdersintheflatsand chalets,ourcompanycannotbeheldliableforthefts. -Leaseholderliability:leaseholdersareresponsibleforthemselvesanditistheir responsibilitytousethesafesandotherservicesavailable.Intheeventofamissingobject ordamagetotheaccommodation,thecostofrepairswillbedeductedfromtheguarantee depositorbilledtoleaseholdersattheendoftheirstay.Ourcompanycannotbeheldliable fordamagetoortheftsfromtheflatsorchalets. Leaseholdersmustprovetheyholdthird-partyandfullycomprehensiveinsurancepolicies. • Claims Forourleaseholders,thepropertiesmanagedbyourcompanymustbeplacesfor unforgettableholidayswithwhichtheyarefullysatisfied. Thisiswhyweaskyoutopointoutanypossiblecausefordissatisfactionduringyourstayso wecanfindasolutionassoonaspossible. 6)GUARANTEES,DEPOSITSANDPAYMENTS a.Damageguarantee A“damage”guaranteeof2500€willberegisteredbutnotdebitedwhenyouarrive.The guaranteemustbeconfirmedbyacreditcardprintwhenyouarrive,atthelatestwithin24 hoursfollowingyourarrivalat“LesPortesdeMegève”. Thisguaranteeisintendedtocover: -Damagetoproperty,furnitureorfittingsduringtheleaseholdperiod.Theguaranteeis automaticallyreturnedifnodamageisnoted,atthelatestwithin1weekfollowingthe leaseholder’sdeparture. Damagetoproperty,furnitureandfittingsmeansdamagetoandthelossortheftofany movablegoodsintheaccommodationduringtheleaseperiod. -supplementarychargesforhousekeeping:toavoidthesecharges,leavethe accommodationascleanasyoufounditwhenyouarrived. -paymentforanoptionalservicenotsettledbeforeyourdeparture. Returnofthedamageguarantee • Iftheaccommodationisreturnedinaconditionincompliancewiththeinventoryof fixturesandfittingstakenuponyourarrivalandifalloptionalserviceshavebeenpaidfor, theguaranteewillnotbedebited. • Ifminordamageorwearisobservedorifahousekeepingserviceisnecessaryorif optionalserviceshavenotbeenpaidfor,thecreditcardwillbepartiallydebitedin compliancewiththeratesforrepairs,housekeeping,optionalservices,etc.displayedinthe accommodation. • Ifmajordamageorwearisobserved,thecreditcardguaranteewillbecompletely debited.Anybalanceoutstandingafterdeductionofthecostofrepairorreplacementwill bereimbursedwithin2months. b.Payments -Allpaymentsaredueonthedatescheduledinthebookingcommitmentandasstipulated inthetermsandconditionsofsale. -Visitor'staxesareautomaticallydebitedonthedayleaseholdersdepartofviathecredit cardprintprovidedbyleaseholderswhentheyarrive(seeadministrativeobligationheading inSTAYabove) -Ifpaymentsaremadebybanktransferorcreditcard,bankchargesarepayableby leaseholders. -French“ChèquesVacances”areaccepted -Wedonotacceptpaymentsbychequeorinforeigncurrencies. -Extrasmustbepaidforbycreditcardorincashatthereceptiondeskonthedayof departure. -Additionalservicesorderedbytheleaseholdermustbepaiddirectlytotheprovider concerned. Wedonotacceptpaymentby: -Acreditcardnumberwithoutconfirmationfromthebankingcentre -Chequesexceptforcertifiedcheques. -Apostalorderorcredittransfernotcreditedtoouraccount. 7)AFTERSALES Ourteamsonsiteareatyourdisposalduringyourstaytoansweryourcomplaints,solveany dysfunctionssoyoucanmakethemostofyourstay.
