Hi James,
I am satisfied on further investigation that the condition for bird surveys (no 26 copied
below) can be deleted. The Extended Phase 1 Habitat Survey by Ahern Ecology
recommended bird surveys and the main reason for this was the loss of woodland and
hedgerow habitats at the northern and western boundaries (the survey report did not
refer to final plans for the site). There is also reference to the site being located within a
SSSI impact zone (for which consultation with Natural England is required), which
refers to airports and helipads as being potential risks. Natural England have been
consulted on this application and they have advised the LPA that there are no expected
impacts on statutory sites. I am therefore satisfied that no further surveys are required,
including breeding / migrating birds.
Please amend the LEMP as you see fit to ensure that it is specific and applicable to the
proposed development in question. As long as the overall requirement for long-term
habitat management and biodiversity enhancements remain, then the wording can be
amended as necessary.

I have shared my draft conditions with the developers and they have a couple of
queries in relation to your recommendations (see below). Can you consider the
comments and let me know any revisions you may be willing to make to make the
conditions more specific and precise?
· In relation to 26 I have re-read yours and Natural England’s comments and
there is no specific justification for the survey work provided. Perhaps just a little
more justification for the condition and leaving eth wording as is will suffice?
·
In relation to condition 28 I think tweaking it to reflect that this is effectively a
self-build proposal will be fine. If you agree to that I will make the tweaks.
I would like to issue the decision on this one today if possible.

No development shall take place (including demolition, ground works,
vegetation clearance) until a Bird Survey has been carried out in
accordance with best practice guidelines and by a professional ecologist
during the appropriate times of year. The results of the survey shall be
used to inform a Bird Mitigation Strategy, which shall be submitted to the
local planning authority for approval. The approved mitigation strategy
shall be implemented in full.
REASON: To minimise impact on protected and priority bird species.
Could this be clarified or be more specific? The ecologist has flagged up that this may be to
do with the SSSI Impact Risk Zone, but if so, it would be helpful to have a clearer
understanding of what the expectations are

No development shall commence until a Landscape and Ecological
Management Plan (LEMP) has been submitted to, and approved in
writing by, the Local Planning Authority. The content of the LEMP shall
include, but not necessarily be limited to, the following information:
a) Full specification of habitats to be created/restored/enhanced,
including locally native species of local provenance and locally
characteristic species; specifically including habitats created for reptiles
(rough grassland, wildflower meadow, scrub, hibernacula, log piles and
grass piles) and other protected species (e.g. dormice);
b) Description and evaluation of features to be managed; including
locations shown on a site map;
c) Aims and objectives of management, including habitat
management for reptiles;
d) Appropriate management options for achieving aims and
objectives;
e) Prescriptions for management actions;
f) Preparation of a work schedule (including an annual work plan
capable of being rolled forward over a 5-10 year period);
g) Details of the body or organisation responsible for implementation
of the plan;
h) Ongoing monitoring and remedial measures;
i) Timeframe for reviewing the plan; and
j) Details of how the aims and objectives of the LEMP will be
communicated to the occupiers of the development.
The LEMP shall also include details of the legal and funding
mechanism(s) by which the long-term implementation of the plan will be
secured by the developer with the management body(ies) responsible for
its delivery.
The plan shall also set out (where the results from monitoring show that
the conservation aims and objectives of the LEMP are not being met)
how contingencies and/or remedial action will be identified, agreed and
implemented.
The LEMP shall be implemented in full in accordance with the approved
details.
REASON: To ensure the long-term management of protected and priority
habitats and other landscape and ecological features, and to maintain
and enhance these habitats and features in perpetuity.
Our understanding of this condition is that it is what we would expect of a developer-led
proposal, but with regards to funding is not entirely applicable to an owner/occupier
submission. Could you confirm whether we’ve understood this correctly?

A couple of questions about the dormouse mitigation strategy that need to be
answered by the applicant:
1. Would the proposed area of woodland planting as compensation for the loss of
the area to the access road be acceptable in terms of the proposed
development?
The indicative proposed planting has been developed following discussions with the
applicant and the ecologist. Both parties are confident that the proposals represent a
deliverable compromise that will satisfy both operational and ecological requirements.
2. Why cannot the southern and eastern boundaries of the site be planted up in
order to retain connectivity to the northern and western areas of woodland
rather than creating a culvert or crossings over the breach created by the
access road?
As part of the above discussions, the ecologist and applicant agreed that while
it may be possible to provide a more contiguous treatment to the southern and
eastern boundaries, the full detail of this may have significant financial impact
n terms of both implementation and ongoing maintenance. At this stage, the
ecologist has put forward a solution that represents a deliverable minimum to
mitigate connectivity issues.
We hope that at this outline stage, this is sufficient for a determination, and
that as part of the landscape detail provided at reserved matters, these
solutions could be enhanced above what we consider to be the baseline of
acceptability. Again, we anticipate that any further requirements would form
part of your formal response.

Hello Simon,
It was good to speak with you this morning. I've had a chat with Melanie and thankfully she agrees that the
potential impact on dormice can be minimised and, as discussed, that the scheme can deliver compensation/
enhancement for dormice through habitat replacement and maintenance of connectivity. As such, she would be happy to progress the outline application, subject to a short addendum from an ecologist
(hopefully me) setting out a mitigation approach, together with an email from the project team committing to
that approach. These would include:
1. Survey for dormice at the appropriate time of year;
2. Precautionary working methods (including timings) during vegetation clearance;
3. Replacement of lost habitat through native species planting, targetted at dormice;
4. Maintenance of connectivity along western boundary through dormouse bridge and/or culvert as
appropriate.
Most of these measures would be implemented anyway to a degree in terms of the reptile and breeding bird
mitigation strategy, as well as for the BREEAM Ecology Credits. This brief statement would allow the application to progress unhindered at this stage. The overall ecology
strategy can then be formalised into a coherent and joined-up document further down the line for Reserved
Matters.

I have received a reply from the Council’s ecologist (please see attached). In
discussion with them we will need answers to the points related to dormice prior to
determining the outline application. In order to keep to the timeframes we discussed I
would be grateful for a response as soon as possible. I would suggest that further
information needs to be provided by your ecologist to address this issue.
I also understand that we are moving from the optimal to sub-optimal time for
dormouse survey work – but I am no expert!
