Authorisation for the Sale of Alcohol at Maldon Town Hall
Maldon Town Hall is licensed for a number of activities under the Licensing Act 2003,
however in the case of the Retail Sale of Alcohol a number of special conditions apply. In
order to sell alcohol using this licence, the hirer must complete the enclosed forms and
submit them in advance of the event to the Town Clerk to obtain authorisation. The signed
forms will be returned to the hirer who must retain them for at least 12 months after the
event. In acting on behalf of the Town Council, the Town Clerk or relevant Council Officer is
not obliged to provide authorisation. Without the authorisation of the Town Clerk, the hirer is
free to apply to the Local Licensing Authority for a TEN.
PROCEDURE

Responsible person
When an event is planned which involves the Retail Sale of Alcohol the organisation
concerned should nominate one responsible person to take charge of the bar, this person
must be present within the building whenever the bar is open. Should it not be possible to
have the same person throughout the event this should be discussed with the Town Clerk
and documents filled out as though each period covered by a different person is a separate
event.

Documentation and training
Prior to the event taking place the responsible person must pick up the documentation pack
from the Town Council Office. All forms are to be completed and returned to the Town
Council Office at least seven days before the event giving the Town Clerk the opportunity to
check the documentation and counter sign them. The responsible person must then arrange
to pick up a copy of all the documents and the signed authorisation from the Town Council
office. Only then will the Retail Sale of Alcohol be authorised for the event.

Premises Licence displayed in the Main Hall.
2. I am aware that the sale and consumption of alcohol is restricted to the ground floor of the
building excluding the entrance lobby, and I will not allow the sales or consumption to occur
outside of these areas and will take note of customers actions at all times.
3. I will not sell alcohol to anybody under the age of 18.
4. I will challenge anybody attempting to purchase alcohol who appears to be under the age of 21 to
prove they are over the age of 18.
5. I will only accept a Passport, a Photo Driving Licence or a Pass accredited card such as a
Portman ‘Prove It’ card or a Citizens card as proof of age.

I will not sell alcohol to anybody who I believe is purchasing to supply somebody under the age
of 18 with the following exception: - Only when purchased and accompanied by an adult may a
16 or 17 year old consume alcohol with a table meal and then only beer, wine or cider.
7. I will not sell alcohol to anybody who is, or appears to be, drunk.
8. I will not sell alcohol to anybody who I believe is purchasing for somebody who is, or appears to
be, drunk.
9. If I am in any doubt on the above I will refuse to make the sale.
10. I will record all incidents of refusals on the refusals/incidents form, which is held by the
Responsible Person ……………………………….. noting the date and time, plus a description of
and name of the person if known together with a note of the product refused.
11. I will advise the Responsible Person as soon as possible and certainly no later than the end of my
shift.
12. I acknowledge that I am not authorised to sell alcohol unless I comply with all of the above at all
times.
I am 18 years of age and confirm that I have read the above and understand my
responsibilities when serving Alcohol at The Maldon Town Hall. I am fully conversant with my
obligations in the sale of alcohol and the penalties that will apply if I serve a customer
illegally. These range from a fixed penalty noticed of £80 to a criminal conviction with a fine
up to £20,000 and/or 6 months imprisonment.
