MINUTES WEST VIRGINIA BOARD OF EDUCATION Capitol Building 6, Room 353 1900 Kanawha Boulevard, East Charleston, West Virginia September 7, 2016 I. Call to Order Following the welcome, Pledge of Allegiance, and introductions, President Michael I. Green called the meeting of the West Virginia Board of Education (WVBE) to order at 10:07 a.m. on September 7, 2016, in Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia. The following members were present: President Green, Vice President Lloyd G. Jackson II, Secretary Beverly E. Kingery, Thomas W. Campbell, Tina H. Combs (via telephone and in person), F. Scott Rotruck, William M. White, James S. Wilson, and ex officio Michael J. Martirano, State Superintendent of Schools. Members absent were Gayle C. Manchin and ex officios Paul L. Hill, Chancellor, West Virginia Higher Education Policy Commission, and Sarah Armstrong Tucker, Chancellor, West Virginia Council for Community and Technical College Education. II. WVBE Outreach and Support to Flooded Schools President Green, Major General James A. Hoyer, The Adjutant General of West Virginia, Mr. Jimmy Gianato, Division Director, Department of Homeland Security and Emergency Management and Homeland Security Advisory to Governor Earl Ray Tomblin, and Ms. Kingery provided an update regarding the flood recovery effort. The Board and Department recognized General Hoyer and Mr. Gianato for their exemplary service and assistance to schools and students impacted by the flood. President Green called on Senator Corey Palumbo, Kanawha County, 17th District, to address the Board regarding flood recovery efforts undertaken for Herbert Hoover High School. President Green called on Parween Sultany Mascari, Esq., West Virginia Chamber of Commerce, to address the Board regarding the Chamber's assistance to businesses affected by the flood. President Green also recognized The Education Alliance that provided assistance to teachers affected by the flood. Ms. Kingery introduced a video showcasing outreach and support provided to flooded schools and recognized WVDE and WVBE staff, Ms. Donna Hoylman Peduto, WVBE Director of Operations, Mr. Jackson, Mr. Paul Hardesy, Logan County Board of Education, Mr. Danny Ellis, Logan County Commission, Ms. Jane Massi, Mr. John Fawcett, WOWK TV, and Mr. Phil Kingery. President Green called Mr. Jackson to the podium to provide remarks in recognition of Ms. Kingery for her leadership and dedication in making the flood recovery relief an outstanding success. III. Remarks from the 2016 Teacher of the Year Ms. Andrea Santos, 2016 Teacher of the Year, Logan County High School, provided remarks regarding her experiences while serving as Teacher of the Year. -2IV. Delegations The following individuals addressed the Board regarding the proposed amendment of the Fayette County Comprehensive Educational Facilities Plan: Ms. Pam Prince, Mr. Stephen G. Slockett, Mr. Thomas Skaggs, Ms. Elisabeth Akers, Ms. Amy Bennett, Ms. Olivia Tygrett, Ms. Debbie Gipson, Ms. Sharon Cruikshank, Mr. Matt Wender, Ms. Jennifer Campbell (presented a Petition to Approve the CEFP Amendment for Fayette County Schools for the record), Ms. Lou Jones (provided information for the record), Mr. Patrick Whittington, Ms. Carolyn Arritt (provided her remarks and a Petition to Keep Meadow Bridge High School Open for the record), Ms. Shirley McGraw, Ms. Patsy Holliday, Ms. Brandie Alley, Ms. Sandra Harkins (provided her remarks for the record), Ms. Shawna Sparks, Ms. Amanda Skaggs, Mr. William Willis, and Ms. Kimberly Pernell. Mr. Dale Lee, WVEA, addressed the Board regarding teacher shortages. (Copies provided for the record appended to Official Minutes, Attachment O.) V. Approval of Agenda President Green moved the technology showcase to later in the agenda and called for a motion to approve the agenda. Dr. White moved, and Mr. Rotruck seconded, that the agenda be approved. Mr. Campbell questioned the process for development of the agenda. Dr. White requested the Board take up the process for development of the agenda and the timeline for its development and release. Following discussion, President Green called for the question and the motion was carried with seven members voting yes and one member, Mr. Campbell, voting no. VI. Consent Agenda President Green requested a motion to approve the Consent Agenda. Ms. Kingery moved, and Mr. Rotruck seconded, that the Consent Agenda be approved. Mr. Campbell questioned how the Consent Agenda was determined. Following discussion, President Green called for the question; the motion was carried unanimously. Approved West Virginia Wesleyan College's Teacher-in-Residence Agreements with Upshur and Preston Counties (Attachment G) Appointed Belinda Baker, Pamela Bailey, and Becky Wood to the West Virginia Commission for Professional Teaching Standards (Attachment H). Amendment - Fayette County Comprehensive Educational Facilities Plan (CEFP) President Green requested Superintendent Martirano addressed the Board regarding the proposed amendment to the Fayette County CEFP. Mr. Campbell and Dr. White requested a break prior to the presentation. Following discussion, Mr. Campbell moved, and Dr. White seconded, that the Board take a fifteen minute break. VIII. Break President Green called for a fifteen minute break at 12:34 p.m. IX. Call to Order President Green called the meeting back to order at 12:55 p.m. X. Amendment - Fayette County Comprehensive Educational Facilities Plan (CEFP) (Continued) Superintendent Martirano requested Mr. David Sneed (PowerPoint presentation attached), Executive Director, and Mr. Scott Raines, Director of School Planning and Construction, School Building Authority of West Virginia, and Mr. Terry George, Superintendent, Fayette County Schools, address the Board regarding the process for the development of the CEFP amendment. Superintendent Martirano thanked Mr. Sneed for the School Building Authority's involvement in the amendment of the Fayette County CEFP. Mrs. Combs joined the meeting in person. Discussion ensued regarding facilities, finances, and transportation. Ms. Kingery addressed the audience regarding local decision making. Superintendent Martirano, acting in lieu of the Fayette County Board of Education pursuant to the provisions of W. Va. Code §18-2E-5(m)(4)(C), presented an amendment to the Fayette County Board of Education’s 2010-2020 CEFP for the Board's consideration. The 2010-2020 CEFP was previously amended on September 8, 2015. The attached amendment sets forth the planned facility reconfigurations for Fayette County, including the construction of four new schools, the closure of multiple schools/school buildings, and the renovation of multiple schools/school buildings. The amendment was developed in conjunction with the West Virginia School Building Authority and the Fayette County Capital Planning Committee, a committee of 54 citizens chosen to represent and act as liaisons for each Fayette County school attendance area. The plan has been considered and approved by the Fayette County Board of Education via a resolution adopted August 22, 2016. -4Mr. Jackson moved, and Mrs. Combs seconded, that the amendment to the Fayette County Board of Education’s 2010-2020 CEFP be approved. Following discussion, President Green called for the question. The motion was carried with seven members voting yes and one member, Mr. Campbell, voting no. XI. 2016-2017 Statewide Master Plan for Professional Learning Ms. Kingery presented the 2016-2017 Statewide Master Plan for Professional Learning for the Board's consideration. W. Va. Code §18-2I-3 requires the WVBE to establish an annual master plan for professional development in the public schools of the state. Upon approval of the plan, the WVBE shall submit the master plan to the WVDE, the Center for Professional Development, the regional educational service agencies, the Higher Education Policy Commission and the Legislative Oversight Commission on Education Accountability. The Master Plan for Professional Development will continue to bring together all systems that support the growth and development of all educators across the state of West Virginia. The second full year of implementation will allow for the continued integration of the adopted professional learning standards and definition of professional learning for all educators. The goals and activities will ensure we are providing a seamless support system to our districts and schools. The WVCPD, WVDE and RESAs will remain committed in providing quality professional learning with the ultimate goal of ensuring we are preparing college and career ready students. Mr. Campbell moved, and Dr. White seconded, that the 2016-2017 Statewide Master Plan for Professional Learning be approved. Upon the call for the question the motion was unanimously carried. Call to Order President Green called the meeting back to order at 2:42 p.m. XIV. Technology Showcase Mr. David Cartwright, Technology Infrastructure Manager, WVDE Office of Technology Integration and Support, and Ms. Becky Butler (distributed information), Assistant Director, WVDE Office of Middle/Secondary Learning, provided a video presentation regarding virtual schools. (Copy appended to Official Minutes, Attachment P.) XV. Statewide Waiver of Policy 5310, Performance Evaluation of School Personnel Ms. Michele Blatt, Chief Officer, Division of School Effectiveness, presented a statewide waiver of Policy 5310, regarding requirements that fifteen percent of the evaluation for English/language arts and mathematics teachers be based upon student growth determined by the -5results of the state summative assessment and the five percent schoolwide growth metric, for the Board's consideration. Since this is not a required component with the reauthorization of ESEA and West Virginia has a school accountability system in place which holds every school accountable for student growth on the state summative assessment, this waiver allows the focus of the Educator Evaluation System to be professional learning and continuous improvement. In order to provide personalized professional learning to our teachers, counselors, and administrators, it is critical that the supervisor be able to finalize evaluations at the end of the year. By finalizing the evaluations at the end of the year, supervisors will be able to address strengths and weaknesses which will need to be discussed in the development of the professional and student learning goals for the next school year. The educator evaluation system promotes professional growth and development that advances student learning in West Virginia schools. By utilizing the West Virginia Educator Evaluation System, West Virginia students have greater access to highly effective teachers and leaders. Mr. Rotruck moved, and Dr. Wilson seconded, that the statewide waiver of Policy 5310 be approved. Upon the call for the question the motion was unanimously carried. XVI. Policy 2422.8, Medication Administration Ms. Rebecca King, Coordinator, WVDE Office of Special Education, presented Policy 2422.8 for the Board's consideration. Policy 2422.8, as amended, will allow county boards of education the option of stocking naloxone under the standing orders and protocol of a county medical director for administration by RNs and LPNs to ensure safe and quality healthcare is provided to students in West Virginia public schools. Stocking naloxone in schools is a prevention mechanism in the rare incidence that a student would experience a drug overdose in the school setting. Six comments were received during the comment period resulting in no change to the policy. Dr. White moved, and Dr. Wilson seconded, that Policy 2422.8 be approved. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachment K.) XVII. Policy 4350, Procedures for the Collection, Maintenance and Disclosure of Student Data Ms. Georgia Hughes-Webb, Data Governance Manager, WVDE Office of Research, Accountability and Data Governance, presented Policy 4350 for the Board's consideration. A review of Policy 4350 during the course of the 2015-2016 school year revealed certain areas where additional clarification is needed regarding state-level expectations for the security and use of student data and for district responsibilities to maintain local expertise with respect to student privacy. The revisions to Policy 4350 ensure that state level expectations are clear and unequivocal with respect to data access and privacy. The revised policy also ensures that all stakeholders have a shared understanding of state-level expectations with respect to responsibilities for securing student data and maintaining local capacity for enforcing privacy regulations. No comments were received during the comment period. -6Mr. Rotruck moved, and Dr. Wilson seconded, that Policy 4350 be approved. Upon the call for the question the motion was carried unanimously. Policy 5800, Standards of Professional Practice for West Virginia Superintendent, Principals and Teacher Leaders Ms. Blatt presented Policy 5800 for the Board's consideration. Policy 5800 was developed as a foundational document to inform and direct educational leadership policy and programs at the state, county, regional and school level. This policy is intended to be the central guide for future policy and program development in the areas of leadership recruitment, selection, preparation, licensure, induction, professional development and evaluation. This policy is also intended to be a framework of professional practice around which current and future leaders can reflect on and improve their professional expertise. The underlying focus of each leadership standard described in this policy is a pervasive commitment to the advancement of student learning; learning that is broad enough, deep enough and individualized enough to develop the conceptual understandings, skills and dispositions necessary for transition to postsecondary education and careers. Fourteen comments were received during the comment period; changes were made to address several comments regarding clarity of meaning and to avoid redundancy. Ms. Kingery moved, and Mrs. Combs seconded, that Policy 5800 be approved. Upon the call for the question the motion was carried unanimously. (Copy appended to Official Minutes, Attachments M.) XIX. Policy 2520.13, West Virginia College- and Career-Readiness Programs of Study/Standards for Career and Technical Education Dr. Kathy D'Antoni, Chief Officer, Division Career Technical Education, presented Policy 2520.13 for the Boards' consideration. Policy 2520.13 is being amended to: 1) clarify the programs of study; 2) include updated Simulated Workplace protocols; 3) add standards to each program of study to align with the national cluster areas; 4) change the student performance measures by eliminating the ACT WorkKeys® and Global 21 Performance Assessments and replacing with a technical assessment; 5) add programs of study and clarify required courses for each program of study; 6) add and clarify definitions and acronyms; and, 7) align West Virginia Education Information System (WVEIS) prefixes for each cluster CTE programmatic change. Mr. Jackson moved, and Dr. White seconded, that Policy 2520.13 be placed on public comment for 30 days. Upon the call for the question the motion was carried unanimously. Update - WVBE Actions for Improved Outcomes and Accountability Plan Ms. Peduto (distributed information), provided an update regarding actions taken by the Board to improve educational outcomes and support to county boards of education. WVBE Coordinator of Board Agencies Report Mr. Jason L. Butcher, WVBE Coordinator of Board Agencies, provided information regarding current projects and his work with Board agencies. XXX. Items for Future Consideration President Green called for items for consideration on a future agenda. Dr. White reported that work is underway regarding a diversity initiative. Dr. Wilson requested that an outline of the report card be shared with members. Mr. Jackson requested a resolution for Board action regarding the teacher shortage and that the legislature be requested to take up voting across county lines to allow parents to vote in the county in which their student attends school. XXXI. Future Meetings The next regular meeting of the WVBE will be held October 12, 2016, in Charleston, West Virginia. The meeting will continue on October 13, 2016, if the agenda is not completed on October 12, 2016. XXXII. Adjournment President Green called for a motion to adjourn.
