WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNIFICATION
The undersigned, for himself/herself and/or on behalf of any participant ("Participant") under the age of eighteen
(18) indicated below (collectively, the “Undersigned”) hereby assume all responsibility for any and all risk of
damage or injury that may occur to the Undersigned and/or the Participant, resulting from or arising out of or in
connection with the Premises and equipment rented from The Sports Academy, LLC (the “Company”) and the
Undersigned’s use thereof and participation of any activities, programs and/or events therein (collectively, the
“Activities”).
The Undersigned acknowledge and fully understand that the Undersigned will be engaging in Activities that involve
risk of serious injury, including permanent disability or death, and severe social and economic losses which might
not only result from their own actions, inactions or negligence, but action, inaction or negligence of others, the rules
of play, and/or the condition of the premises or of any equipment used and further that there may be other risks
neither known to the Company or reasonably foreseeable at this time.
The Undersigned, for himself/herself and on behalf of Undersigned's heirs, next of kin, personal representatives,
and/or assigns, hereby assume all of the foregoing risks and hazards incidental to the Activities and accept
personal responsibility for any damages following such injury, permanent disability or death. The Undersigned
covenant not to sue or bring any action against the Company, its affiliated entities and each of their directors,
officers, members, managers, employees, coaches, agents, sponsors, associated personnel, and the owners and
lessors of premises used to conduct any Activities (collectively, the "Releasees") and hereby release and discharge
each of the Releasees from any and all liability, demands, losses, claims or damages, including without limitation
any injury, including death or damage to, loss or theft of property, on account of Undersigned's participation in the
Activities and any and all liability, demands, losses, claims or damages caused or alleged to be caused in whole or
in part by the action, inaction or negligence of the Releasees or otherwise.
The Undersigned agree to indemnify, defend and hold harmless the Releasees from all liability, loss, cost, claim or
damage whatsoever which may be imposed upon the Releasees arising in connection with the Undersigned's
participation in the Activities.
The Undersigned understand that the Company has rules and standards of conduct regarding the Activities and the
Undersigned agree to abide by these rules and standards and customary terms and conditions for participation in
the Activities for the safety of all participants, staff, guests and employees.
The Undersigned understand that each has given up substantial rights by signing this document. The Undersigned
acknowledge freely and voluntarily signing this document and intend the Undersigned's signature to signify a
complete assumption of the inherent risks of participating in or observing Activities to the greatest extent allowed by
law in the State of Illinois. If any portion of this Waiver of Liability, Assumption of Risk and Indemnification is held to
be invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect. The
Undersigned acknowledge that they have read the foregoing and agree to its terms.
