MAXIGESIC ‘BE IN TO WIN THE CHANCE TO WIN $1MILLION’ CONSUMER PROMOTION
1.
Information on how to enter and prizes form part of these terms and conditions. Any entry not complying with
these terms and conditions is invalid. Participation in this Promotion is deemed acceptance of, and agreement to be
bound by, these terms and conditions.
2.
The $1 million prize is not a guaranteed prize in this Promotion (refer to clause 11).
3.
Entry is open to individuals aged 18 years or over who are residents of New Zealand (“Eligible Entrant”).
Employees of the Promoter and retailers associated with the competition, the Promoter’s associated companies, the
Promoter’s agencies associated with this competition and their immediate families are ineligible to enter. The entrant
must not be a business (or other organisation) or make the entry on behalf of a business (or other organisation).
Entrants can only enter in their own name.
4.
The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with
the entry process or who submits an entry that is not in accordance with these terms and conditions. It is a condition
of entry that Eligible Participants are able to accept the prizes as stated. Inability to accept the prize as stated, on the
dates indicated, will deem the participant an ineligible entrant and the prize won will be forfeited and no future claims
can be made.
5.
The “Promotion Period” starts from Monday 3 April 2017 and closes at 11.59pm on Wednesday 31 May 2017.
6.
To participate in the Promotion, look for an in-store promotional entry form at any of the following
participating retailers’ stores; Green Cross Pharmacies | Life Pharmacy | Unichem | Vantage Pharmacy Group |
Access Pharmacy Group | Maxigesic Platinum Club pharmacies, and:
i.
Successfully complete the entry form, including answering a skill question, providing contact details and the
name of the participating retail store.
ii.
Place the promotional entry form in the official entry box provided in the participating retail store within the
promotional period.
7.
There is no purchase necessary to participate in the promotion. Entrants will receive one entry per person
for each completed entry form submitted, as outlined in point 5. Each entrant is limited to a total of 10 entries for the
promotion.
8.
No responsibility will be taken by the Promoter for any ineligible or lost entries or entries submitted or
received by the Promoter after the closing date. Entries that do not comply with these terms and conditions, are
incomplete, illegible, inaccurate, damaged or submitted or received by the Promoter after the closing date will be
declared void.
9.
Important times and dates are as follows:
i.
Completed entry forms must be placed into an official entry box at a participating retail store by 11.59pm
Wednesday 31 May 2017. It is the participant’s responsibility to be aware of the open and close times of the relevant
participating store to ensure this is achievable by the promotion close time and date.
ii.
Finalists Draw will be held across all valid entries received from all participating retail stores by Wednesday
28 June 2017. Five randomly drawn valid entries will each become a Finalist. Finalists will be notified by phone and
confirmed in writing using the contact details provided on their entry form, and will be invited to participate in an
Elimination Event. All Finalists must make themselves or a nominated proxy available to attend the Elimination Event
at a time and date specified by the Promoter. In the event a Finalist or their nominated proxy is unable to attend the
event or if the Promoter cannot make contact with any Finalist drawn, after making reasonable effort, the Promoter
reserves the right to conduct a re-draw on or around Wednesday 12th July 2017.
iii.
Elimination Event and the following Challenge Event are to be held by Sunday 27 August 2017 at a location,
time and date specified by the Promoter.
Elimination Event details
10.
The five Finalists or nominated proxies will be invited to attend an Elimination Event. At this event each
Finalist or nominated proxy will be asked to draw from a number pool of 1-5 indicating the order of the next round of
selection. The Finalist or nominated proxy who selected number 1 will be the first to select one ‘item’ from five made
available. The ‘item’ will correspond to/reveal what opportunity they will receive from one of the following messages;
either ‘Congratulations, you have won NZ$2,000!’ or ‘Congratulations, you are proceeding to the Challenge Event
for a Chance to win $1Million!’ The next Finalist or nominated proxy who selected number 2 will complete the same
process from the remaining items available to be selected, and so on until all Finalists have had the opportunity to
select an item from the remaining items.
Chance to WIN $1Million Challenge Event details
11.
The successful Finalist “winning participant” will have the opportunity to participate in the Challenge Event
for a 1 in 100 chance to win $1,000,000 (held immediately after the Elimination event) and it will be conducted as
follows:
I.
100 numbers/items will be presented to the winning participant or a nominated proxy
II.
They will be offered one chance to select one number/item of their own choice
III.
It will be revealed what outcome that number/item corresponds to, and that will be what the winning
participant receives as a prize
Noting; 99 of the numbers/items will correspond to the one Consolation Prize of $10,000. Only one number/item will
correspond to a successful result of receiving $1,000,000, the chance of the winning participant or nominated proxy
selecting the $10,000 is 99 in 100, the chance of the winning participant or nominated proxy selecting the $1,000,000
is 1 in 100. Total maximum prize pool value at the Challenge Event is $1,000,000. In the event the winning participant
or nominated proxy is successful in the Challenge Event the $1,000,000 will be subject to the Prize Provider’s terms
and conditions.
12.
In the case of any Finalist or winning participant being unable to attend any event they may nominate a
proxy to attend and complete their tasks (as outlined in these terms and conditions) in their absence on their behalf.
The $1,000,000 and all other prizes are non-transferable or exchangeable, and will accordingly be distributed to the
Finalist rather than the nominated proxy. The nominated proxy may be required to sign a waiver to confirm their
understanding that they will not be the recipient of any prize or other consideration.
13.
The Promoter will arrange travel to and from the Event(s) and one night’s accommodation only to any
Finalist or nominated proxy (and parent/guardian if required) whose main residence is outside of Auckland, at their
discretion.
14.
The Promoter will not be responsible for any other expenses incurred by the Finalist, their nominated proxy,
parent, guardian, or other associated party, including but not limited to meals, beverages, travel insurance, travel to
and from the relevant airport, and additional baggage costs.
Guaranteed Prize Pool and Unguaranteed Prize
15.
There is a total of $18,000 in prizes guaranteed to be given away as a part of this promotion made up of 4
x $2,000 Runner’s Up prizes for any unsuccessful Finalists, and 1 x $10,000 Consolation Prize should the winning
participant at the Challenge Event be unsuccessful in choosing the number/item corresponding to the $1,000,000
unguaranteed prize.
Prize(s) and winner(s) conditions
16.
All prizes (guaranteed and unguaranteed) are stated in NZ$.
17.
Any incidental costs, including but not limited to travel to the location of the event(s) relating to prizes are the
responsibility of the winner (except as provided for in clause 12 above).
18.
In the case of any Finalist or winning participant being disqualified because of a breach or non-acceptance
of these terms and conditions the Promoter reserves the right to repeat any process outlined in these terms and
conditions for selection to allocate a replacement Finalist or winning participant.
19.
Any taxes (other than GST), which may be payable as a consequence of winners receiving prizes are the sole
responsibility of the winners. The Promoter accepts no responsibility for any tax implications that may arise from the
prize winnings. Independent financial advice should be sought by winners.
20.
The Promoter reserves the right to ask any winner to provide proof of age and identity in order to claim
their prize. In the event that the Promoter believes it is inappropriate to award the prize directly to the winner for any
reason, the winner agrees that their parent/guardian will be required to support and attend event(s) with them and
that any prize awarded will be to the winner’s parent/guardian on their behalf, and that the parent/guardian may be
required to sign further legal documentation as and in the form reasonably required by the Promoter in its absolute
discretion to confirm acceptance of and be bound by the terms and conditions prior to any event(s) or claiming any
relevant prize. If at any stage the Promoter or any other invested party has concerns of the ability of the parent/
guardian to support or act on the Finalist’s behalf then the Promoter reserves the right to seek legal advice and/or pay
any prize into a Trust and appoint a Trustee on the Finalist’s behalf.
21.
Winners of prizes acknowledge that they participate at their own risk. To the full extent permitted by law
neither the Promoter, and/or any of its employees, contractors and agents or employees of its contractors and
agents, and/or companies providing prizes for the Promotion, will be liable for any liability / cost / loss / damage
/ expense / death / personal injury / dispute suffered or incurred (including, but not limited to, direct/indirect/
consequential loss) arising out of, or in connection with this Promotion.
22.
As a condition of accepting a prize, winners may be required to sign any legal documentation as and in the
form reasonably required by the Promoter and/or Prize Provider in their absolute discretion, including but not limited
to a legal release and indemnity form. All prize winners agree that they will not sell or otherwise provide their story
and/or photographs to any media or other organisation.
23.
The Promoter, Prize Provider and activity operators/representatives, in their absolute discretion, at all times
reserve the right to: (a) Prevent any winner and/or their companion from participating in the Elimination or Challenge
Event if, at any time, they reasonably believe that they pose a safety risk or for any other reason; and/or (b) Cancel the
Event(s) if the conditions are deemed dangerous; and/or (c) Vary and/or substitute the prize (or part thereof) without
notice with a prize to the equal value and/or specification.
24.
A prize will only be awarded where the winner’s entry and, if applicable, additional documentation fulfils
all of the requirements of the Promoters’ verification tests and procedures. Verification tests and procedures are
determined by the Promoter in its absolute discretion and may include proof of identity and age.
25.
Prizes will only be delivered in New Zealand and winners should allow 60 days to receive their prize from the
date of the validation of their prize claim (by the Promoter or third party suppliers).
26.
If any Finalists or winning participant are deemed not to have complied with the terms and conditions of this
Promotion, their entry will be declared invalid and a replacement Finalist or winning participant will be determined in
a re-draw or selection process (as previously outlined) with the original Finalist or winning participant forfeiting any
further claims or rights to any prizes or compensation.
27.
The result of any Event or draw is final and no correspondence will be entered into.
28.
To the full extent permitted by law, the Promoter, its associated companies and agencies exclude all liability
for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Entrant and/or
prize winner in connection with the Promotion or prizes, including: i. any indirect, economic or consequential loss or
loss of profits; ii. any loss arising from the negligence of the Promoter, its associated companies and agencies; iii. any
liability for personal injury or death.
General
29.
All entries (including personal information collected from the entrants) will only be held and used for
the purposes of this promotion (which may include disclosure to third parties for the purpose of processing or
conducting the promotion) and all consumer contact details collected from the entrants will be destroyed at the end
of the promotion. By entering this promotion, entrants consent to the use of their personal information as described.

30.
The Promoter will organise their own actuary insurance to provide for the event that a Finalist or nominated
proxy successfully chooses the item or number corresponding to the prize of $1,000,000. It will be the responsibility
of the insurer to pay out the amount to the participant should this event occur.
31.
If for any reason this promotion is not capable of running as planned, whether caused by infection by
computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause
beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the
promotion, the Promoter reserves the right in its sole discretion, (subject to any written direction given by a relevant
Regulatory Authority), to cancel, terminate, modify or suspend the promotion. The Promoter may in its sole discretion
disqualify any individual who tampers with the entry process.
32.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the
Promoters’ ability to proceed with the Promotion on the dates and in the manner described in these Conditions of
Entry, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest,
strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Promotion and recommence it
from the start on the same conditions.
33.
Entries are deemed to be received at the time of receipt to the Promoter. The Promoter is not responsible for
receipt of incorrect, inaccurate or incomplete information caused by an entrant or occurring during transmission.
The Promoter is not responsible for any problems or technical malfunction of any telephone, telephone or computer
network, or lines, servers, or telephone or internet providers, traffic congestion on any phone or computer network, or
any combination thereof, including any injury or damage to participants or any other person’s computer related to or
resulting from participation or sending or receiving of any communication or of any materials in this promotion.
34.
The Promoter reserves the right in their sole discretion to disqualify any individual who the Promoter has
reason to believe has breached any of these Conditions of Entry, or engaged in any unlawful or other improper
misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoters’ legal rights to
recover damages or other compensation from such an offender are reserved.
