QUANTITY SURVEYING AND ENGINEERING CONSULTANTS FOR THE DESIGN AND SUPERVISION OF THE
PROPOSED CONSTRUCTION OF THE ZAMBIA REVENUE AUTHORITY (ZRA) MULTI STOREY NEW ULTRA
MODERN HEAD OFFICE.

(1) Clause 3.8: what is meant by the fee must be valid for 1 year of the contract? Will it escalate
thereafter and if so at what rate?

This will be determined at contract negotiation stage.
(2) What is expected to see in the Time schedule for key personnel?
Response
We can’t comment on this matter in detail but it relates to how well you understand the scope
referenced against personnel inputs.
(3) What is expected to see in the Activity schedule?
Response
We are precluded from commenting as above.
(4) Form 4E: “Reimbursement of an activity” what information is needed on this form?

(5) Some of the members do not have 2015 audited results yet; will 2012, 2013 and 2014
suffice?

(6) Is membership with ZIA, SIZ, EIZ/NCC/Association of consulting Engineers compulsory; if so
will proof of an application to such body suffice?

(7) Will a membership of “The Engineering Registration Board” be accepted instead of any of the
mentioned bodies?
Response
Yes. Also note that for one to be a member of ERB, you must be a member of EIZ(Engineering
Institute of Zambia)
(8) There seems to be no organization in Zambia for Project Managers; will a membership with
the Project Management Association of South Africa (PMSA) meet the requirements for the
team leader?

(9) Can we use our own Power of Attorney template since this is not included?
Response
Yes, as long as it is properly issued and witnessed by at least 2 Senior Officers.
(10)If the current PI of a company is lower than what is required, will a letter of insurance
company stating that the PI can be increased on appointment suffice?
Response
Bidders are advised to comply with the stated instructions.
(11)Will a bond of K25,000.00 from Stanbic bank be accepted as bid security?
Response
Any registered Financial Institution is acceptable.
(12)Will it be accepted to fix the post contract fees to the contract duration that we will include
in our bid?
Response
Yes
(13)When and how can we get the proof that we attended the compulsory site visit on 7th
October, 2016; we assume this is a requirement and should be included in our tender
submission?
Response
Bidders that have been to the site are encouraged to collect the certificates from ZRA.

is not in accordance with standard procurement procedures

Your observation is highly noted.
(15)
There is a misunderstanding on the Team Leader or Project Manager. We still insist that
the one referred to and the qualifications mentioned cannot be part of the consulting Team
as listed but has to be appointed directly by the Client as their representative. He is part of
the Client Project Management Team. In fact he should have been in place even much earlier
to be in charge of the proceedings on behalf of the Client. Please check Regulation 145.
It is also true in countries where project management is formalized and controlled by
legislation, such project managers are directly appointed by the Client and they manage other
consultants including the contractor. They are not part of the consulting team as listed but
part of the Project Management Team of the Client to avoid conflict of interest. In some
donor funded projects, they are called Technical Advisers (TAs). It is either an individual or a
firm of consultants but directly appointed by the Client

(16)There is no requirement for Bid Security for Consulting Services in the ZPPA Regulations. The
regulation quoted 55(1) is for Works. The regulations for consulting services start at 77 and
no reference is made to any bid security
Response
The intention of the legislators was to cure a specific evil in all aspects of procurement and not a
section of it. Thus the express provision “in order to deter irresponsible bids and encourage bidders
to fulfill the conditions of their bids”. Had the intention been different, it would have been clearly
stated as compared and contrasted against regulation 127 on performance security where
discrimination on such account is provided for. We encourage all bidders to provide the requested
information as failure to do so will render the bid nonresponsive.
(17)The use of Clerk of Works or Resident Architect or Engineer is supported by legislation “where
constant supervision of work is required” like the proposed project. It cannot be optional but
is must and can also affect the financial proposals of the bidding firms. The project should not
be allowed to start on site without a Clerk of Works or Resident Engineer etc. being assigned
for such a big project and if it has been done elsewhere, then it is wrong. See CAP 442,
Statutory Instrument No.106 of 1999, Second Schedule PART I concerning inspection and
supervision of the works by Architects. The term ‘Shoddy Works” should not be in the public
domain if rules are being adhered to from the start and for such a project there is simply no
excuse.
Response
Kindly note that the clerk of works will be engaged at the construction stage.
(18)
There has been some guidance given to some line Ministries dealing with civil and building
works concerning inclusion of price adjustment clause in all new contracts and the request is
to make it applicable to the proposed contract as well. This was a result of what was
experienced last year which adversely affected the implementation of most of the projects
which were using the ZMW as the currency. ZPPA guidance could specifically be requested.
Response
Kindly note that ZPPA issues circulars from time to time whenever a new development requires
communication to various Procurement Entities. We are yet to receive it.

ADDENDUM No. 1
This information is meant to assist all bidders that might not have received the first
Addendum. Below were the questions and responses.
Query Number 1
1. The Team Leader for such similar works is normally an Architect and there is a
rationale behind it but if an independent expert is required, the experts from allied
professions (Architect, Engineer, and Quantity Surveyor) would be most suitable with
probably a post graduate qualification in project management or similar like Master’s
Degree.
The requested firm of project management and an expert with minimum Bachelor’s
Degree in Project Management to head the consulting team may not achieve the
desired result apart from adding avoidable cost.
Response
The Team has evaluated all the valid suggestions and comments from the bidders
on this matter. The conclusion however, is that the qualifications be left as
provided for in the RFP.
2. The reference to RIBA qualifications for an Architect is not as per existing Law in
Zambia and is unnecessary discrimination. The legislation only refers to the Zambia
Institute of Architects
Response
The Team agreed with your submission and the requirement for RIBA has been
removed to comply with the existing law in Zambia.
3. The Client to consider having the pre-contract services to be Lump sum contract and
the Supervision services to be time based as per works contract to be later signed
with the successful bidder. This makes the supervision effective and is in consistence
with other similar contracts and removes all perceived problems between consultants
and contractors. The milestones achievement works properly for pre-contract services
but supervision is time based and incase the works are not completed in the foreseen
time, the defaulting party takes over the cost of supervision which could be reflected
in the Special Conditions
Response
The lump sum contract is advised. However, the consultants must be clear in
terms of pricing of the pre contract services and post contract service in the
Financial Proposal.

4. The requested bid security is not a standard practice for consultants’ tenders including
the international ones and there is a rationale behind it. ZPPA is encouraging to use
the Bid Declaration Format to allow the maximum participation of Local firms and
most appropriate for consultants.
Response
Procurement is administered through legislation enacted by government.
Therefore, the aspect of Bid Security is provided for in regulation 55 (1) of the
public procurement regulation statutory instrument No.63 of 2011. As clearly
stated, all procurements must be accompanied by a valid Bid Security. ZRA
therefore stands with that provision.
5. All the requested firms have the amount of professional Indemnity indicated
separately. Is the Client going to sign separate contracts with each Firm? Or the Lead
firm will be responsible to the Client and sign separate sub-contracts with other firms?
The standard practice is to have one firm responsible to the Client as the Lead Firm
and will in turn hold the sub-consultants accountable to their various works and
specialization. Why should the Professional indemnity for architects be higher than the
others when their role as Lead Firm is not there?
Response
Professional indemnity for Architects, Engineering and other related services still
remain unchanged. The indemnity for the Team Leader is lower than the rest
because their role is only limited to the Project Manager.
6. The format of RFP seems to be old version and is not consistence with the latest
version being used for similar works especially for GRZ and other connected
institutions. Advice from ZPPA could be useful.
Response
The new RFP will be circulated and uploaded onto the ZRA site immediately.
However, all other qualifying information remains unchanged.
7. It has been noted that whenever works for GRZ and other related institutions have a
problem during execution, the opinion of the Director of Buildings under the Ministry
of Works and Supply is always sought by the monitoring institutions. It could be
useful to get some advice for the RFP especially the ToR as they deal with many such
similar projects.
Response
The matter is noted though it would have been very helpful if specificity could be
applied when making reference. However, all matters of disputes will be

addressed in accordance with the provisions of arbitration described in the
contract.
8. We propose that the Resident Engineer to be based full time on site be included and
Expert F and G on page 41 to be one. RE is vital for quality control for such works
Response
Inclusion of the resident engineer on the consortium is not mandatory but can be
included on the team at the discretion of the consultant.
Query Number 2: QUESTIONS/REQUESTS ON TENDER NO. ZRA/PSU/CS/20/16
1) Confirm that there is not restriction to the use of the same sub consultants by two or
more lead consultants. For example, lead consultants using the same Quantity
Surveyor or Services Engineer.
Response
There is no exclusivity clause whatsoever.
2) Clarify the role of Project Manager in this type of tender and why a Certificate in
Project management is a must (as opposed to being an advantage) when architects and
Engineers are traditionally project managers in their respective fields i.e. managing of
construction projects. Educate us further on Prince 2 Methodology and its relevance
to this tender. Our view is that a team leader who could be either an architect or
Engineer, could manage the project (manage other associated consultants and later the
contractor) since it is for an identified specific use.
Response
ZRA simply wants someone with a formal qualification in Project Management and
with the knowledge applying Prince 2 in the management of the entire project. The Role
of the Project Manager is to manage the other consultants involved and anyone can be
the PM as long as they have the attributes stated.
3) Could the number of years for sub consultants not be reduced from 10 years to around
5 years as long as the principal consultant of the firm has 10 or 15 years of experience
(as requested for the firm)? This could still achieve the intended purpose of achieving
quality through experience, will broadening the level of participation among the
consultants.
Response
The requirement is on the level of experience of the firm and not an individual and
therefore , the number of years of experience of the firm cannot be waived. It remains as
indicated.
4) Could we not do away with the Environmental Health and Safety Expert If the Social
and Environmental Impact Assessment Expert could do his work?

If the specified expert meets the requirements then it’s a ‘yes’.
Query Number 3:
We have two queries arising from the tender document.
1. The Engineering Institute of Zambia (EIZ) membership is the only statutory required
registration for engineers in Zambia. Membership to the Association of Consulting
Engineers (ACEZ) is not a statutory requirement. Will experts with membership with
EIZ but not ACEZ be acceptable?

2. In the case of a firm associating with another firm to enable them meet the minimum
requirements; one of the firms will have membership with EIZ, ZIA etc... but the other
consortium partner may not have these Zambian registrations. Will a
consortium/association of firms with one registered with EIZ, ZIA and another
registered with an equivalent body be acceptable?
Response

The consortium should conform to the laws and regulations of Zambian practice
governing joint ventures of local and foreign firms in the provision of consultancy
services.

Joint venture Agreement submitted and properly issued in case of a submission
by a (Joint Venture
The Bid shall include a copy of the agreement entered into by the joint venture
partners defining the division of assignments to each partner and establishing that
all partners shall be jointly and severally liable for the execution of the Contract in
accordance with the Contract terms; alternatively, a Letter of Intent to execute a
joint venture agreement in the event of a successful bid shall be signed by all
partners and submitted with the bid, together with a copy of the proposed
agreement;
one of the partners shall be nominated as being in
charge, authorized to incur
liabilities, and receive instructions for and on behalf of any and all partners of the
joint venture; and
The execution of the entire Contract, including payment, shall be done exclusively
with the partner in charge



All pages of the original Technical and Financial Proposal shall be initialled by the same

Our Financial Proposal shall be binding upon us subject to the modifications resulting
from Contract negotiations, up to expiration of the validity period of the Proposal, i.e. before
the date indicated in Clause 12.1 of the Data Sheet.
