Terms and conditions Design Zentrum Nordrhein Westfalen e. V. and Red Dot GmbH & Co. KG in respect of the sale of tickets for the Red Dot Gala and/or Winners’ Dinner and/or Designers’ Night General/applicability The following terms and conditions apply to all legal relationships between Design Zentrum Nordrhein Westfalen e. V. and between Red Dot GmbH & Co. KG (hereinafter referred to as “the Organiser”) and all participants (hereinafter all referred to “the Guest”) of the Red Dot Gala, Winners’ Dinner and Designers' Night of the Red Dot Award: Product Design. Any conditions that contradict or deviate from these terms and conditions will not be recognised unless the Organiser has expressly agreed to them in writing. The mutual performance obligations of the parties result from the separate performance descriptions of the event and from the attached pricelist for the entry tickets. By ordering and/or purchasing the tickets for the Red Dot Gala and/or the Winners’ Dinner and/or the Designers’ Night, the Guest accepts the following terms and conditions: 1. Ordering tickets/entering the contract 1.1 The tickets for the Red Dot Gala, Winners’ Dinner and Designers’ Night events are personalised and entitle only those persons named on the ticket to attend the events. Name changes can be made pursuant to 5.2. below. 1.2 The Guest can book his/her tickets in advance solely via the internet. The Guest is liable for all bookings made using his/her My Red Dot portal unless he/she can prove that he/she has not breached any obligations regarding the use of the My Red Dot portal. 1.3 The Guest is obliged to check the data provided for accuracy and completeness before ordering the tickets. Notice of changes must be given immediately to the Red Dot project team at [email protected] Page 1 of 4 1.4 The Guest has the possibility to order further tickets for other persons whose names must be provided when ordering. In order to ensure the smooth running of the Red Dot Gala, the Guest and his/her other guests have no entitlement to be given seats together. 1.5 After ordering the tickets, the Guest will receive a confirmation email to the e-mail address provided. 2 Ticket delivery 2.1 The ticket will be provided to the Guest solely as a pdf document for download, at least 7 days before the event. Tickets will not be sent by post. The Guest will also receive a download link via e-mail from the Organiser. 2.2 The Guest is solely responsible for keeping safe his/her ticket and in particular the access code on the ticket. The Organiser wishes to point out that on the evening of the event the Guest will receive a wristband to gain entry only in return for presenting a print-out of the corresponding ticket. The closed wristband entitles this person and only this person to access the event as part of the Red Dot Gala and/or Winners’ Dinner and/or Designers’ Night events. In the event of any actions that breach these rules, the Organiser reserves the right to exclude the Guest from the celebrations. 3 Errors when ordering tickets 3.1 The Guest bears the sole risk for all data entered when ordering tickets. Any errors made when ordering tickets, in particular if he/she orders a different ticket from what he/she wants, are the responsibility of the Guest. The Guest is obliged to check the confirmation e-mail for the order immediately upon receipt. Notice of errors must be given immediately via e-mail to the Red Dot project team at [email protected] 3.2 The Guest is also obliged to check his/her ticket/s immediately upon receipt in order to ensure that the ticket/s is/are as ordered. Notice of errors must be given immediately via e-mail to the Red Dot project team at [email protected]. 4 Payment 4.1 Within and outside of Germany, the cost of the tickets can be paid by credit card (VISA, Mastercard, Eurocard, American Express Card). All participants receive an invoice via e-mail. 4.2 In the event that the cost of the tickets is not paid on time and in full, the Organiser reserves the right to block the ticket without further notice. 4.3 Only one invoice will be issued for each order. It is not possible to issue separate invoices for further guests. Page 2 of 4 4.4 Any costs incurred by the Organiser through incorrect account details, a refusal by the bank to settle the receivable or a payment reversal must be refunded by the Guest unless he/she can prove that he/she was not responsible. 5 Cancelling/changing the name on a personalised ticket 5.1 Ordering the tickets is a binding act. In the event that the Guest wishes to cancel the booking, the following rules apply: Cancellation 30 days or more before the event free of charge Cancellation 14 days or more before the event 50% of the costs incurred are refunded Cancellation 7 days or more before the event 20% of the costs incurred are refunded Cancellation less than 7 days before the event or cancellation after the event no refund possible The authoritative date is the date on which notice of cancellation is received by the Red Dot project team at [email protected]. 5.2 Name changes on the ticket can be made free of charge 3 working days or more before the event. After this time the Organiser can no longer guarantee that a name change will be possible. 6 Disclaimer by the Organiser 6.1 If an event does not take place, the Organiser undertakes to refund the purchase price of the entry tickets for all events related to the award ceremony for the Red Dot Design Award: Product Design on the date of the event, i.e. events such as the Red Dot Gala, Winners’ Dinner, Designers’ Night etc., in return for the e-ticket up to two weeks after cancellation of the event to the participants as named on the entry ticket. Any further entitlements, e.g. to refunds of lump-sum costs, travel and/or hotel expenses etc. are excluded. This applies also and in particular to recipients of complimentary tickets. 6.2 Claims for damages based on damage to property or bodily injury as well as claims based on the breach of contractual obligations are excluded unless the Organiser and/or its vicarious agents acted Page 3 of 4 with intent or in a grossly negligent manner or breached material contractual duties. The Organiser will not be liable for belongings. 7 Media recordings before and during the events 7.1 When ordering his/her ticket, each Guest grants the Organiser or persons appointed by the Organiser permission to make video and audio recordings of the Guest without payment before, after and during the event, to copy such recordings and to use them for all communication channels. These rights are not restricted geographically or in terms of time. The Guest expressly waives any rights to video and/or audio recordings of him/her. 8 Final provisions 8.1 The place of performance and court of competent jurisdiction is Essen, Germany. However, the Organiser is also entitled to file proceedings against the participant at the participant’s general court of competent jurisdiction. 8.2 The legal relationships are determined solely by German law with the exception of the UN Convention on Contracts for the International Sale of Goods. This also applies if the participant is domiciled abroad. 8.3 In the event that individual parts of the above terms and conditions are invalid, all other terms and conditions will remain unaffected in terms of their validity. The contractual partners are obliged where possible to replace any invalid provision with a valid provision that meets the economic purpose of the invalid provision.
