Our mission is championing competition for growth and choice. Through advocating pro-competition practices and enforcing against anti-competitive behaviour, CCS is committed to safeguarding the competition process, thereby supporting the competitiveness and vibrancy of our economy. Everyone’s interest is best served by competitive markets that deliver the best products at the lowest prices. Since companies also consume goods and services New firms enter market More competitive firms Firms compete to win customers Competition Commission of Singapore in their production process, they will benefit from it as well. 03 The Competition Act The competition law penalises businesses which engage in anti-competitive practices, namely: • Anti-Competitive Agreements, such as agreements to fix prices, control production or share markets. Specifically, it is an infringement to form a cartel to devise plans to influence market prices, e.g., by fixing prices, rigging bids or controlling the production of products. • Abuse of a Dominant Position, such as conduct that protects a dominant business position in ways unrelated to competitive merit. • Mergers that Substantially Lessen Competition in Singapore, because of a concentration of market power. To help businesses understand how CCS interprets and enforces the Act, we have issued 13 guidelines which can be found on our website: www.ccs.gov.sg. We would appreciate if you could furnish us with the following information: • information about you and the organisation you represent (if applicable); • information about the party or parties you are complaining against; • a brief description of the agreement, conduct or merger that is being complained against; and • any other relevant information and supporting documents. All information furnished will not be disclosed unless permission has been granted by the informant. Outreach Posters on the Three Provisions of the Act Championing Competition for GROWTH and CHOICE Filing Notifications for Guidance or Decision Companies can seek Guidance or Decision from CCS to find out if their agreements or conduct may have inadvertently infringed the Competition Act. You will find it particularly useful to refer to the Guidelines on Notifications for Guidance or Decision and the Competition GUIDANCE Regulations for details when filing a notification. Both publications are available on our website at www.ccs.gov.sg. The application for Guidance or Decision must be made by first submitting Form 1 to CCS. The form can be obtained from our website. Please take note that Form 1 will require information relating to: • the applicant and the other parties involved in the agreement D E C IS IO N or conduct; • the purpose of the application; • details of the agreement or conduct; and • the groups to which the parties to the agreement or conduct belong. Competition Commission of Singapore 06 07 Leniency Programme Cartels are agreements between market players to fix prices and/or limit supply. Cartels restrict competition since there is little or no incentive for cartel members to lower prices or provide better quality goods or services through operating efficiently or investing in technology and innovative processes. Cartels are generally secret. CCS’ leniency programme would give cartel members an incentive to come forward and inform CCS of the cartel activities. The leniency applicant may be an organisation or a person. Once the criteria for leniency are met, leniency applicants will be granted full immunity or reductions in financial penalties.
