LEARNER ASSESSMENT APPEALS PROCESS
Note:
1) In the case of practical tests that relate to performance observation the recheck/review/appeal may be based on test/assessment records as opposed to
test/assessment evidence
2) Test/assessment results which are the subject of an appeal will be sent to QQI together with
notification that the results are under appeal
Application
1. Learners who wish to appeal their test/assessment outcome must apply using the ETB Training
Centre Learner Appeal Application Form for ETB Training Centre Training Programmes
2. ETB Training Centre Learner Appeal Application Form for ETB Training Centre Training
Programmes must be sent to the Kerry ETB Training Centre Manager with responsibility for the
course
3. The Kerry ETB Training Centre Manager with responsibility for the course/assessment, must be in
receipt of the completed ETB Training Centre Learner Appeal Application Form for ETB Training
Centre Training Programmes from the learner no later than 10 working days from the issuing of
the final approved results to the learner
4. The Kerry ETB Training Centre Manager on the basis of the application received from the learner
will, within 10 working days of receiving the written application, determine if the application
meets the criteria to activate the appeals process
5. If the application meets one of the criteria listed for activating an assessment appeals process,
the application is approved to proceed.
6. If the application does not meet one of the criteria listed for activating the assessment appeal
process, the application is not approved to proceed. The Kerry ETB Training Centre Manager will
inform the appellant in writing of the decision not to proceed with the appeal within 10 working
days of receiving the application. The appeal request is forwarded to the Training Standards
Office for recording on the appeals log.
Proceeding with an Assessment Appeal
1. The Kerry ETB Training Centre Manager will forward the appeal to the Training Standard Office,
for recording on the appeals log and QQI is notified of learner results under appeal (where
applicable).
2. From the date the Kerry ETB Training Centre Manager approves an Appeal to proceed to the date
the Chair of the Assessment Appeals Panel notifies the Kerry ETB Training Centre Manager of the
appeal outcome, this must be concluded within 20 working days.

3. The Kerry ETB Training Centre Manager in consultation with the Training Standards Officer will
determine the reviewer to be assigned to conduct the appeal. The Training Standards Officer
arranges for a reviewer to conduct the appeal.
4. The Appeal Reviewer must examine the application made by the learner and consider the
evidence in support of the grounds for appeal.
5. The Kerry ETB Training Centre Manager will ensure that all relevant information, documentation,
staff, project personnel and learners are made available to the Appeal Reviewer, including, if
required, arranging meetings between all relevant parties.
6. Once the Appeal Reviewer has considered all relevant information he/she must complete a
report on the process and issue to the Training Standards Officer. This report must outline:a. the criteria that the appeal application met
b. the outcome of the re-check and review where applicable
c. the method of consideration of evidence used e.g.,
d. who was interviewed
e. what documentation was reviewed, e.g., the Assessor/Supervisor report
f. the findings of the process, i.e. what was revealed
g. the recommended outcome of the appeal, i.e. whether or not it should be upheld
with clearly stated reasons for the decision
7. The Training Standards Officer will issue copies of the report to the Local ETB Training Centre
Assessment Appeals Panel as soon as possible
8. The Local ETB Training Centre Assessment Appeals Panel will review the report submitted and
will decide on the outcome of the appeal. The appeal outcome could be one of the following:
a. the grade/result awarded is upheld
b. the grade/result awarded is increased
c. the grade/result awarded is decreased
d. the learner is given the opportunity to (re)sit an alternative test/assessment (when
available), without the rules of repeats being enforced
e. award of pass by compensation (QQI HETAC awards only)
f. test/assessment event is declared null and void and/or -the decision is deferred
pending further enquiries by an External Verifier.
9. The Chairperson of the Local Kerry ETB Training Centre Assessment Appeals Panel will notify the
Kerry ETB Training Centre Manager with responsibility for the course/assessment of the panel
decision regarding the appeal.
10. The Kerry ETB Training Centre Manager with responsibility for the course/assessment will inform
the learner and the Instructor/Second Provider, of the appeal outcome, in writing, within 10
working days of being notified of the outcome of the appeals process.
11. If the learner does not accept the decision of the Kerry ETB Training Centre Assessment Appeals
Panel, s/he must communicate his/her non-acceptance of the decision within 10 working days of
the notification of the outcome of the appeal to the Kerry ETB Training Centre.
a. Where a learner does not accept the decision of the Assessment Appeals Panel, and
the appeal will be referred by the Kerry ETB Training Centre to the relevant Awarding
body for consideration.
