1. TITLE

3. SCOPE
3.1. This Agreement shall apply to The Smith’s Snackfood Company Limited located at
Bannister Road, Canning Vale in the State of Western Australia and all employees
covered in classifications listed at Appendix A – Classification Structure.
3.2.
Unless otherwise expressly provided for in this Agreement, no team member shall be
reduced in status or position or have their rate of remuneration reduced or any of their
conditions of employment adversely affected as a consequence of making this
Agreement.
4. PARTIES
4.1. The parties to this Agreement are:
4.1.1.
The Smith’s Snackfood Company Limited (hereinafter “the Company”);
4.1.2.
The Food Preservers’ Union of Western Australia, Union of Workers (hereinafter
“the FPU”);
4.1.3.
The Automotive, Food, Metals, Engineering, Printing and Kindred Industries
Union of Workers, Western Australia Branch (hereinafter “the AFMEPKIU”);
and
4.1.4.
Employees who are eligible to be members of The Food Preservers Union
Western Australia, Union of Workers, or The Automotive, Food, Metals,
Engineering, Printing and Kindred Industries Union of Workers, Western
Australia Branch.
4.2.
Except where agreed by the parties to this Agreement, the parties will oppose any
applications by any other party to be joined to this Agreement.
5. RELATIONSHIP TO PARENT AWARD & PRIOR AGREEMENTS
5.1. This agreement replaces and over rides all prior agreements including “The Smith’s
Snackfood Company Limited (Western Australia) Enterprise Agreement 2002”.
5.2.
In respect of the award referred to in this agreement-
5.2.1.
This Agreement shall be read in conjunction with the Food Industry (Food
Manufacturing or Processing) Award;
5.2.1.1.
where the terms of this agreement are inconsistent with the award, the
terms of this Agreement shall prevail; or
5.2.1.2.
where this Agreement is silent on any matter, the award provisions shall
apply.
6. TERM & OPERATION OF AGREEMENT
6.1. Term
6.1.1.
This Agreement shall come into operation on 10th May 2004 and shall remain in
force for a period of two years thereafter.
6.1.2.
All parties to this Agreement make a commitment to re-negotiate this Agreement
and apply for its replacement before 10th May 2006.
6.2.
Operation
6.2.1.
It is the intention of the parties to maintain this Agreement in its present form for
its full term except when changes become necessary so as to ensure the
Agreement’s effective and practical operation and such changes are consistent
with prevailing wage fixing principles.
6.2.2.
Notwithstanding subclause 6.2.1, during the term of this Agreement, the parties
will undertake to implement and participate in Continuous Improvement
activities.
7. LEAVE RESERVED
8. NO EXTRA CLAIMS
8.1. Except as provided for in Clause 7 – Leave Reserved, no extra claims will be made in
relation to wages or conditions, award or over-award, during the life of this agreement,
except in instances where the terms and conditions of this agreement fall below
minimum standards, as set by a State Wage Case decision of the Western Australia
Industrial Relations Commission.
9. OBJECTIVES
9.1. The parties acknowledge that the objective of this Agreement is to enhance business
improvements and productivity through teamwork and empowerment, while also
increasing team member remuneration over the term of the Agreement, leading to
enhanced employee and company security.
9.2.
The parties agree that the provisions of the Agreement are intended to support Canning
Vale’s stated Vision and Values through:
9.2.1.
the enhancement and utilisation of team member skills and abilities;
9.2.2.
team development and empowerment activities;
9.2.3.
training in continuous improvement;
9.2.4.
efficiency and flexibility of team structures and conditions; and
9.2.5.
provision of a healthy and safe working environment.
9.3.
The Company, Union and team members accept their joint responsibility to ensure that
this Agreement is effective. In the event of any ambiguity or dispute over
interpretation, the spirit and intention of this clause will be referred to for the proper
interpretation of the provision the subject of the dispute or question.
10. CONTRACT OF EMPLOYMENT
10.1. A team member may be engaged as:
10.1.1.
Full Time Team member
10.1.1.1. Means
an employee engaged to work 38 ordinary hours per week
(excluding overtime), as detailed in clause 18.1 or 19.1.
10.1.2.
Part Time Team member
10.1.2.1. Means
a team member engaged to regularly work for only part of any day
or week as may be agreed between the Company and the team member
concerned, provided such work is not less than 72 hours per four week
period.
employees will be paid for each hour worked at the rate of 1/38th
of the weekly rate prescribed in Clause 15 of this agreement.
10.1.2.2. Part-time
10.1.2.3. A
part time employee may work up to the daily ordinary hours or up to 38
ordinary hours per week before overtimes becomes applicable in
accordance with Clause 22 – Overtime of this agreement.
10.1.3.
Casual Team member
10.1.3.1. Means
a team member who is engaged by the hour and whose employment
may be terminated by either party giving one hour’s notice. On a daily
basis, the Company shall notify a casual team member of the next working
day or shift for which their services are required. A casual team member is
not entitled to the benefits of:
Clause 25 - Sick Leave;
Clause 26 - Annual Leave;
Clause 27 - Jury Service;
Clause 28 - Bereavement Leave;
Clause 29 - Parental Leave and Adoption Leave;
Clause 30 - Special Leave;
Clause 31 - Long Service Leave; or
those clauses otherwise prescribed by this Agreement.
10.1.4.
Fixed Term Team member
10.1.4.1. Means
a team member engaged to work for a fixed term, determined in
advance, on a full time or part time engagement basis. Fixed term
employment will not be for periods greater than twelve months per
engagement.

10.1.4.2. Such

acknowledge the right of the Company to engage a balanced workforce by
utilising the various types of hire available through the Agreement. In particular, the
right to engage part-time, fixed term and casual or temporary labour as necessary .
10.3. Employment
of Full Time Team members
10.3.1.
The Company reserves the right to select the best person, through consultation
with team members and team leaders, for any given full time employment
vacancy. In doing so however, where all things are equal, the Company will give
preference to part time and casual team members already employed by the
Company.
10.3.2.
In addition to any other chosen recruitment methods, the Company will internally
advertise all applicable vacancies, be they Team Member or Resource positions.
10.3.3.
Where it is necessary for the Company to provide an injured employee with an
ongoing role, other than their usual role, it may decide to refrain from the normal
recruitment practice and directly appoint the effected employee. This clause
shall take precedence over sub-clauses 10.3.1 and 10.3.2.
10.4. Termination
10.4.1.

10.4.1.1. In
order to terminate the employment of a team member, other than a
casual team member, the Company shall give the following notice:

10.4.2.
In addition to the notice in subclause 10.4.1.1, team members over forty-five
years of age at the time of the giving of notice with not less than two years’
continuous service shall be entitled to additional notice of one week.
10.4.3.
Payment in lieu of the notice prescribed in subclauses 10.4.1.1 and 10.4.2 shall
be made if the appropriate notice period is not given.
10.4.4.
The basis for calculation for any payment in lieu of notice shall be the wages a
team member would have received in respect of the ordinary time he or she
would have worked during the period of notice had his or her employment not be
terminated.
10.4.5.
The period of notice in this clause shall not apply in the case of dismissal for
conduct that at common law justifies instant dismissal or in the case of casual
team members where termination of employment may occur by either party
giving one hour’s notice.
10.5. Notice of

In order to terminate employment a team member shall give the Company the

Failure by a team member to give the required notice will entitle the Company to
withhold monies due on termination to the value of the number of days for which
notice has not been worked.
10.6. Time Off
During Notice Period
10.6.1.
During the period of notice of termination given by the Company a team member
shall be allowed up to eight ordinary hours time off without loss of pay during
each week of notice for the purpose of seeking of other employment.
10.6.2.
The time off shall be taken at times that are convenient to the team member after
consultation with the Company.
10.6.3.
If the team member has been allowed paid leave for more than one day for each
week of the notice period for the purpose of seeking other employment, the team
member shall, at the request of the Company, be required to produce proof of
attendance at an interview otherwise forfeit payment for the time absent. For this
purpose a statutory declaration will be sufficient.
10.7. Statement
of Employment
10.7.1.1. Upon
ceasing employment, the Company shall, upon request, provide to
the team member a written statement specifying the period of his or her
employment and the classification of or the type of work performed by the
team member.
10.8. Performance of
10.8.1.
Work
Each team member bound by this Agreement:
10.8.1.1. shall
perform such work as the Company may, from time to time
reasonably require;
10.8.1.2. may be directed
by the Company to carry out such duties and use such
tools and equipment as may be required, provided that such work is within
the limits of the team member’s skill, competence and training;
10.8.1.3. may be required
to work reasonable overtime;
10.8.1.4. shall
comply with all safety regulations determined by the Company or as
prescribed by Government regulation;
10.8.1.5. shall
use as directed by the Company all protective clothing and equipment
provided;
10.8.1.6. shall
observe all the Company regulations, policies and procedures in order
to maintain an orderly and safe workplace;
10.8.1.7. shall
at all times comply with the provision of Clause35 - Resolution of
Disputes of this Agreement.
10.9. Standing
10.9.1.
Down of Team members
The Company may deduct payment for any day or part of a day on which a team
member cannot be usefully employed arising out of any cessation of operations,
either whole or partially, due to industrial disputes including any strikes, bans or
limitations or any cause for which the Company is not reasonably responsible.
11. REDUNDANCY
11.1. “Redundancy” in this clause means the loss of employment due to the Company no
longer requiring the job the team member has been doing to be performed.
11.2. Discussions
11.2.1.
The Company will notify the Union and affected Team members as soon as is
practicable after a firm decision involving redundancy is made so as to allow
reasonable consultation prior to redundancies taking place. The subject of such
consultation will include but not be restricted to the reasons for redundancy,
methods of mitigating job losses, selection process for redundant Team
Members, outplacement support and the number and timing of redundancies.
11.3. Notification
11.3.1.
Before Terminations

Where a decision has been made to terminate the employment of team members,
on account of redundancy, the Company shall notify the CentreLink thereof as
soon as possible, giving relevant information including a written statement of the
reason(s) for the termination(s), the number and the categories of the team
members likely to be affected, and the period over which the termination(s) are
intended to be carried out.
11.4. Severance
Pay
11.4.1.
A minimum of four week’s notice will be given to redundant Team Members
prior to termination, or payment in lieu thereof. An additional week’s notice will
be given to Team Members aged 45 or over with not less than two years’
continuous service.
11.4.2.
Team Members will receive four weeks pay for each year of service up to and
including a maximum of 78 weeks’ pay. A pro rata payment will be made for an
incomplete year of service.
11.4.3.
A “week’s pay” is defined as the base rate for ordinary work for the particular
Team member and is exclusive of any allowances.
11.4.4.
The severance payment shall not exceed the amount that the team member would
have earned if employment with the Company had proceeded to the team
member’s 65th birth date.
11.5. Continuity
11.5.1.
of Service
For the purpose of this clause continuity of service shall not be broken on
account of:
11.5.1.1. any interruption
or termination of the employment by the Company if such
interruption or termination has been made merely with the intention of
avoiding obligations under this agreement;
11.5.1.2. any absence on
account of personal sickness or accident for which a team
member is entitled to claim sick pay as prescribed by this agreement or on
account of leave lawfully granted by the Company; or
11.5.1.3. any absence with
reasonable cause, proof whereof shall be upon the team
member.
11.5.2.
Provided that in the calculation of continuous service under this paragraph any
time in respect of which a team member is absent from work except time for
which a team member is entitled to claim annual leave, sick pay, long service
leave and public holidays as prescribed by this Agreement shall not count as time
worked.
11.6. Team Member Leaving
11.6.1.
A team member whose employment is terminated on account of redundancy may
terminate his or her employment during the period of notice and, if so, shall be
entitled to benefits and payments under this Clause 11 up to the date that the
person leaves the Company.
11.7. Written
11.7.1.
During Notice
Notice
In the case of redundancy the Company shall, as soon as practicable, but prior to
the termination of the team member’s employment, give to the team member a
written notice containing, among other things, the following:
11.7.1.1. the
date and time of the proposed termination of the team member’s
employment;
11.7.1.2. details
of the monetary entitlements of the team member upon the
termination of his/her employment including the manner and method by
which those entitlements have been calculated;
11.7.1.3. advice as
to the entitlement of the team member to assistance from the
Company, including time off without loss of pay in seeking other
employment, or arranging training or retraining for future employment; and
11.7.1.4. advice as
to the entitlements of the team member should he/she terminate
his/her employment during the period of notice.
11.8. Transfer to
11.8.1.
Other Duties
A team member whose job has become redundant may be offered alternative
work in a different department or on a different shift or at a lower level job and if
the rate of pay is less than the rate of pay for the former position, the team
member shall be entitled to the same period of notice of the date of
commencement of work in the new position as if his/her employment has been
terminated, and the Company may at its option, make payment in lieu thereof of
any amount equal to the difference between the former rate of pay and the new
lower rate for the number of weeks of notice still owing.
11.9. Team Members

with Less Than One Year of Service
This clause shall not apply to team members with less than one year’s continuous
service and the general obligation of the Company should be no more than to
give relevant team members an indication of the impending redundancy, at the
first reasonable opportunity, and to take such steps as may be reasonable to
facilitate the team members obtaining suitable alternative employment.
Long Service Leave
Full time team members with ten years or more continuous service will receive a
pro rata payment calculated according to the Long Service Leave provisions of
the Western Australian Long Service Leave Act 1958.
Team Members Exempted
This clause shall not apply where employment is terminated as a consequence of
conduct that justifies dismissal or in the case of casual team members.
12. PAYMENT OF WAGES
12.1. Payment of wages for all team members shall be by electronic funds transfer (EFT)
directly into a bank, building society, credit union or other recognised financial
institution account, on a day not later than Wednesday of each week, as notified in
writing to the Company.
12.2. Where the
Company and the majority of team members within a department or section
agree, wages may be paid fortnightly or four weekly.
12.3. The Company may deduct
from wages due to a team member such amounts as
authorised in writing by such team member on a Company approved authority form.
13. TIME AND WAGES RECORD
13.1. The provisions of this clause are subject to the following requirements:
13.1.1.
In accordance with the provisions of the Industrial Relations Act 1979, an
authorised Union Representative may inspect employee time and wages records,
subject to the following requirements.
13.1.2.
The power of inspection may only be exercised by a representative of an
organisation of employees authorised for the purpose in accordance with the
rules of the organisation.
13.1.3.
The Company shall keep, or cause to be kept, a record or records containing the
following particulars:
13.1.3.1. Full
name and last known residential address.
13.1.3.2. The classification
13.1.3.3. The starting
under which he/she is remunerated.
and finishing times and the hours worked each day and each
week.
13.1.3.4. The number of
ordinary hours and the number of overtime hours worked
each week.
13.1.3.5. The wages
and overtime (if any) paid each week, and any deductions made
therefrom.
13.1.4.
Any automatic recording by machines shall be deemed to comply with this
provision to the extent of the information recorded.
13.2. Subject
to this clause the time and wages record shall be open for inspection by a duly
accredited official of the Union during the usual office hours at the Company’s office
or other convenient place and the official may be allowed to take extracts therefrom.
13.3. Before an
inspection takes place a Union Official shall give reasonable notice of not
less than 24 hours to the Company.
14. WAGES
14.1. Wages Payable
14.1.1.
Progression to higher levels within Appendix A - Classification Structure and the
attraction of rates of pay at Clause 15 - Wage Rates in this agreement, shall be
subject to successful assessment of competency in accordance with Clause 16 –
Career Structures and Training.
14.1.2.
These payments are made in recognition of the right of the Company to pursue
the implementation of efficiencies under this Agreement so as to achieve targeted
improvements in the costs of manufacture.
14.2. Higher Duties
14.2.1.
Higher duties payments will be made when employees are rostered to cover
absences for complete shifts, or when a employee is engaged for less than a
whole shift they will be paid the actual hours, provided that the actual hours
exceed one hour per day.
14.3. Productivity
14.3.1.
Payment
During the life of the Agreement, the Company and Consultative Committee may
agree measures for the operation of a Productivity bonus to be paid to employees.
The nature of such measures and bonus will be subject to agreement of both
parties and will be self funding in nature.
15. WAGE RATES
15.1. Manufacturing & Engineering Weekly Rates of Pay
Subject to certification of this agreement by the Western Australia Industrial
Relations Commission, the wage rates payable under this agreement shall be
effective from the first pay period occurring on or after the effective dates
indicated below:

16. CAREER STRUCTURES AND TRAINING
16.1. General Conditions
The Company recognises and accepts its responsibility in the area of training and
development and is committed to the design, provision and implementation of
training programs to extend the knowledge and skills of its team members. The
overriding objective is to enable each team member to gain the competence to
perform, consistent with operational needs, all of the tasks and activities
associated with a particular job, to established performance criteria.
16.1.1.
16.2. Jobs
Matrix and Training
16.2.1.
The jobs matrix (Appendix A – Clause 1.1) of this Agreement sets out the
various position levels in the main streams of Processing, Raw Materials,
Engineering and Warehouse.
16.2.2.
Training modules will support the definition of each position at each level for
each of the tasks representing the positions together with the relevant required
levels of performance competency and assessment criteria.
16.3. Progression
and Selection
16.3.1.
Progression to a higher level in the matrix (other than 16.3.4 below) will only be
through successful application for a declared position vacancy.
16.3.2.
Employees for the positions will be selected from the applicants and according to
the following criteria:

successfully completed the competencies for a position in the level
immediately below.
16.3.3.
Training may be conducted full time in order that job knowledge and the desired
competency be attained in a specified time, that time will depend upon the
position.
16.3.4.
Relief personnel will be paid in accordance with sub-clause 14.2 for that higher
position for the time of that relief period and will return to their original position
and rate of pay at the cessation of that relief period.
16.4. Competency
Assessment
16.4.1.
Specific and objective knowledge and skill assessment will be carried out to
assess levels of competence. All skills acquired will require demonstration.
Specific Modules will not be regarded as complete until competency testing
requirements, including both theoretical and practical tests where appropriate
have been satisfied. No increase in level will be granted without having
successfully completed all of the modules of the appropriate position.
16.4.2.
All competency assessment will be conducted by either of the following methods
(can be chosen by the trainee or assessor):
16.4.2.1. a workplace assessor
who has been assessed as competent in the task and is
an expert in the task OR
16.4.2.2. a workplace assessor
who has been assessed as competent in conducting
assessments but who is NOT an expert in the task must have an
acknowledged expert in that skill to assist in assessing. In the event of a
disagreement, the appropriate Resource will review the assessment results.
If agreement is still not reached, the matter will be referred to the
Consultative Committee for recommendation.
16.5. Record
16.5.1.
of Training and Experience
Team members will each be issued with a team member Information and
Training Document which will be the team member’s endorsed record of skills
attained and other relevant work experiences whilst employed by the Company.
This statement will be updated on the completion of further training.
16.6. Utilisation
and Upkeep of Skills
16.6.1.
All employees’ will be required to work in all positions applicable to the
classification in which they are deemed competent. The allocation of work will
be subject to the operational needs of the business and follow up training may be
required from time to time.
16.6.2.
In the event that an employee cannot or will not perform the full range of duties
required of their classification, the following events shall occur:
16.6.2.1. Where necessary,
the employee will be provided opportunity to
demonstrate competence and capacity to meet the classification. Where
retraining is required, this will be provided.
16.6.2.2. If
the employee remains unable or unwilling to fulfil the full requirements
of the role, as and when directed to do so, they shall be reclassified to a
level in which they can fulfil the requirements and are deemed competent.
16.6.2.3. In
the event that an employee is reclassified, the classification shall change
immediately, however, changes to rate of pay shall be implemented four
weeks from the classification change.
16.6.2.4. Reclassification
under this clause will not limit an effected employee from
applying for future training or promotion opportunities.
16.6.2.5. Any changes
to classification or rate arising from this clause shall be
confirmed in writing to the employee prior to them taking effect.
16.6.2.6. Should
a dispute arise regarding the application of this clause, the matter
will be resolve in accordance with the Grievance Procedure of the
Agreement.
16.7. Payment
for Training
16.7.1.
It is agreed that additional training in accordance with this clause may be
undertaken either on or off the job.
16.7.2.
Where training is undertaken during ordinary working hours the team member
concerned shall not suffer any loss of pay. Where on-site job specific training is
undertaken outside ordinary working hours payment for such time shall be
according to Clause 22. – Overtime of this Agreement.
16.7.3.
The Company upon production of evidence of such expenditure and report of
satisfactory progress shall reimburse any costs incurred in connection with the
undertaking of such training. Textbooks paid for by the Company shall be
retained as Company property.
16.7.4.
Where employees undertake a course of study or training not specifically related
to daily work activities or proficiency, they may make application to the
Company for Education Assistance, in accordance with the published policy. In
granting support for Education, the Company retains discretion in all elements of
policy and its application to team members.
16.8. Travel
Costs
16.8.1.
Travel costs incurred by a team member undertaking training in accordance with
this clause, which exceed those normally incurred travelling to and from work
shall be reimbursed by the Company. The Company will require evidence of
such costs incurred by a team member.
16.8.2.
Team members who utilise their own vehicle for attendance at off site training
programs shall be reimbursed at the rate of $0.45 per kilometre, for travel in
excess of that normally incurred in travelling to work.
16.8.3.
The Company will retain discretion as to the suitability of providing taxis or
travel vouchers to employees attending off site training programs.
17. ALLOWANCES
17.1. Team Leader Allowance
17.1.1.
This allowance will be paid to employees designated by management to perform
in leadership roles, with added responsibilities in the areas of team leadership,
productivity requirements and continuous improvement.
17.1.2.
Employees qualifying for the payment of Team Leader Allowance shall be paid

Contractor’s Licence Allowance
Employees nominated as the authorised holder of the Company’s Electrical
Contractor’s License will be paid a weekly allowance of $40.00.
Allowance
A team member entitled to a meal allowance in accordance with subclause 22.4
shall be paid a meal allowance of $8.50 per meal.
17.4. First
Aid Allowance
17.4.1.
A team member entitled to a first aid allowance in accordance with subclause
32.3 shall be paid a weekly allowance of $10.00.
17.4.2.
A team member possessing the certification of ‘Occupational First Aider’ in
accordance with subclause 32.3 shall receive a weekly allowance of $15.00.
17.5. Engineering
Higher Duties
Where a qualified tradesperson, classified at Levels 4 to 6, in Appendix A of this
agreement, performs the duties of a Planner, as detailed in Appendix A, they
shall receive an additional payment of $60.00 for each week performing that role.
17.5.1.
18. HOURS OF WORK
18.1. Ordinary Hours
Regardless of the status of employment, the ordinary hours of work shall be an
average of 38 hours per week over any five days of the week worked over any
one of the following cycles.
18.1.1.
18.1.1.1. 38
hours within a work cycle not exceeding 5 consecutive days.
18.1.1.2. 152
hours within a work cycle not exceeding 28 consecutive days provided
that this work cycle is subject to agreement as provided by subclause 21.2.
-Rostered Days Off of this Agreement.
18.2. Day Work
The ordinary hours of work for day workers shall be worked continuously except
for meal breaks between 6.00am and 6.00pm Monday to Friday, subject to
subclause 20.1. - Work on Public Holidays of this Agreement.
18.2.1.
18.3. Shift
18.3.1.
Work
The ordinary hours of shift work are provided for in subclause 19.2. - Shift Work
of this Agreement.
18.4. Changes
18.4.1.
to shifts
The time commencing and finishing shifts may be varied by the Company by the
giving of seven days notice to the team member/s concerned or a shorter period
of notice by agreement.
18.5. Implementation
18.5.1.
of 38 Hour Week
The ordinary hours shall be an average of 38 per week to be worked on the
following basis:
18.5.1.1. By team
members working less than eight ordinary hours each day; or
18.5.1.2. By fixing one weekday on
which all team members will be off during a
particular work cycle; or
18.5.1.3. By rostering team
members off on various days of the week during a
particular work cycle so that each team member subject to agreement as
provided by subclause 21.2 - Rostered Days Off, has one week day off
during that cycle.
18.5.1.4. By team
members working up to a maximum of 40 hours in any week
provided that over a period of six months the average weekly hours shall
not exceed 38 hours.
18.5.1.5. By team
members working ordinary hours in excess of eight but not
exceeding ten on any one day over a four day working week.
19. SHIFT WORK
19.1. Definitions
19.1.1.
For the purposes of the clause:19.1.1.1. “Afternoon
Shift” means any shift finishing after 6.00pm Monday to Friday
inclusive and at or before 12.30am Tuesday to Saturday inclusive.
19.1.1.2. “Night
Shift” means any shift finishing at or before 8.30am Monday to
Friday inclusive.
19.1.1.3. “Early Morning Shift” means
any shift starting between 4.00am and
6.00am Monday to Friday inclusive.
19.1.1.4. “Rostered
Shift” means a shift for which the team member concerned has
had at least two working days notice.
19.1.1.5. “Permanent
Night Shift” means a night shift which does not rotate or
alternate with another shift so as to give a team member at least 1/3rd of
their working time off night shift in each shift cycle.
19.2. Ordinary
Hours of Shift Work
19.2.1.
The ordinary hours for a shift worker shall not be worked in accordance with
subclause 18.5 - Hours of Work.
19.2.2.
Subject to the following conditions, a shift worker shall work shifts at such times
as the Company may require:
19.2.2.1. A
team member shall not be required to work more than one shift in each
24 hours.
19.2.2.2. Shift
rosters will specify the commencing and finishing times of ordinary
work hours of the respective shifts.
19.2.2.3. The method
of working shifts may in any case be varied as to all or a
section of the team members by agreement between the Company and the
majority of team members concerned and the Union. The agreement by the
Union will not be unreasonably withheld.
19.2.2.4. The time
of commencing and finishing shifts once having been determined
may be varied by the Company by the giving of seven days notice to the
team member/s concerned of a shorter period of notice by agreement.
19.2.2.5. Where an
employee is required to make an ongoing change of shift, at the
direction of the Company, at least seven days notice shall be provided,
unless a lesser period of notice is agreed to by the employee.
19.2.3.
Where a team member works a shift which continues beyond midnight or
commences before midnight on any day the team member shall be deemed to
have worked on the day on which the majority of hours were worked
19.3. Shift
Work Allowances
A shift worker shall be paid the following percentage allowances in addition to
their ordinary rate for the duration of work on a rostered shift on:

19.3.2.
In the event that the Company directs a shift worker (other than a casual) to work
on an alternative shift, to meet a short term need, and such change requires
working on a shift that attracts a lesser shift loading, the employee shall not be
disadvantaged and the usual loading will be maintained.
19.3.3.
Where an employee (other than a casual) changes shift, in an ongoing capacity or
for a period of greater than four weeks, subject to the giving of notice required in
clause 19.2.2.4 or 19.2.2.5, the employee shall receive the shift loading specified
for the shift being worked, as stated in clause 19.3.1.
20. PUBLIC HOLIDAYS
20.1. All team members (other than casuals) shall be entitled to the following public
holidays, provided that another day may be taken as a holiday by agreement between
the Company and team member in lieu of any of the public holidays:
20.1.1.
New Year’s Day, Australia Day, Good Friday, Easter Saturday, Easter Monday,
ANZAC Day, Labour Day, Foundation Day, Queen’s Birthday, Christmas Day
and Boxing Day
20.2. Where a Public Holiday falls
on a Saturday or Sunday or on a day on which a team
member is not rostered to work ordinary hours, the public holiday shall be observed on
the next working day or on such other day as may be agreed by the Company and team
member.
20.3. All
work performed by team members on any of the public holidays listed above shall
be paid for at the rate of double time and a half.
20.4. Where a team
member (other than a casual) is required for work on a public holiday
the team member shall be paid for a minimum of four hours.
20.5. With
respect to shift workers this clause shall not apply to ordinary hours worked on a
shift of which the minor portion falls on a Public Holiday.
21. ROSTERED DAYS OFF
21.1. Where the ordinary hours of work for a team member are to be worked in accordance
with subclause 18.5.1.4 - Hours of Work of this Agreement such team member will
accrue credit of two (2) hours each week, which shall accumulate. Such accumulation
may be taken as a rostered day off duty at a time that is agreed between the Company
and the team member, or where appropriate, the Company and the majority of team
members in the enterprise, section or sections concerned.
21.2. Six
(6) RDO’s may be accrued by agreement between the Company and the team
member.
21.3. The taking of
RDO’s shall ordinarily be as whole days. Where approved by the
employee’s manager, prior to taking the leave, RDO hours may be used to cover
shorter absences, provided such absences are in units of whole hours.
22. OVERTIME
22.1. Payment For Overtime
22.1.1.
Subject to the provisions of this subclause, all work performed outside a team
member’s ordinary working hours as defined in Clause 18 - Hours of Work or
Clause 19 - Shift Work shall be paid for at the rate of time and one half for the
first two hours and double time thereafter, double time will apply for hours
worked on Sunday and for hours worked after 12.00 noon Saturday.
22.1.2.
In computing overtime each day shall stand-alone but when a team member
works overtime which continues beyond midnight on any day, the time worked
after midnight shall be deemed to be part of the previous days work for the
purposes of the subclause.
22.1.3.
By agreement between a team member and their manager, a team member may
volunteer to take time off in lieu of payment for overtime worked. Where time
off in lieu is taken, it shall be on the basis of an hour off for each hour worked.
22.2. Call
Out
Where a team member (except casuals) is recalled to work without prior notice
after leaving the Company premises they shall be paid for a minimum of four
hours’ work at the appropriate overtime rate.
22.2.1.
22.3. On
Call
A team member shall be paid at ordinary rates for all time required by the
Company to hold in readiness to work outside ordinary working hours until
release.
22.3.1.
22.4. Meal
Allowance
22.4.1.
A team member who works overtime in excess of two hours shall be entitled to a
paid meal break of not less than 20 minutes to be taken at a time agreed to
between the team member and the Company.
22.4.2.
Where a day’s prior notice of the requirement to work such overtime has not
been given an employee shall be paid a meal allowance as prescribed in
subclause 17.3.
22.5. Rest
Period After Overtime
22.5.1.
Where overtime work is necessary it shall, wherever reasonably practicable, be
so arranged that team members have at least ten consecutive hours off duty
between the work of successive days.
22.5.2.
A team member who works so much overtime between the termination of work
on one day and the commencement of ordinary hours on the next day, that the
team member has not had at least 10 consecutive hours off duty between those
times, shall, subject to this subclause be released after completion of such
overtime until the team member has had 10 consecutive hours off duty without
loss of pay for ordinary working time occurring during such absence.
22.5.3.
If, on the instructions of the Company, a team member resumes or continues
work without having had 10 consecutive hours off duty, the team member shall
be paid at double rates until the team member is released from duty for the rest
period and shall be entitled to be absent until having had 10 consecutive hours off
duty without loss of pay.
22.6. Travel
22.6.1.
Home After Overtime
Where a team member, except for a shift team member, is detained at work until
it is too late to travel by the last ordinary bus, train or other regular public
conveyance to his/her usual place of residence, the Company shall provide
transport to the team member’s usual place of residence, free of charge. This
clause shall not apply to any team members who have their own means of
transport.
22.7. Overtime
22.7.1.
Restrictions
The Union or any team member/s covered by this agreement shall not in any
way, whether directly or indirectly, be a party to or concerned in any ban,
limitation or restriction upon the working of reasonable overtime in accordance
with the requirements of this clause.
23. MEAL AND TEA BREAKS
23.1. The time of taking scheduled meal and tea breaks, once having been determined, may
be altered by the Company, if it is necessary to do so in order to meet the requirements
for continuity of production. The duration of the meal break shall be 30 minutes and
tea break 15 minutes.
23.2. No
team member shall be required to work more than six hours without a meal break.
No team member shall be required to work more than four hours without a paid tea
break.
24. SUPERANNUATION
24.1. The superannuation provisions contained herein operate subject to the requirements of
the hereinafter prescribed provision titled - Compliance, Nomination and Transition.
24.2. Contributions
24.2.1.
The Company shall contribute to the Fund a prescribed percentage of the team
member’s wage in accordance with the provision of the Superannuation
Guarantee Act 1992.
24.2.2.
The Company shall make such contributions monthly for pay periods completed
in such months, or at such other time and in such manner as may be agreed in
writing between the Trustees of a fund and the parties to this Agreement from
time to time.
24.2.3.
Notwithstanding the provisions of this clause, the Company is not obliged to
contribute to more than one Fund in respect of a team member unless ordered to
do so by an Order from any Industrial Tribunal or by legislation.
24.2.4.
If at any time the Company becomes bound by an order of any industrial tribunal
or by legislation to contribute to another superannuation fund in respect of a team
member, then the Company’s liability to make contributions in respect of that
team member pursuant to this clause will be reduced by the amount of the
contribution the Company is required by any order made by any Industrial
tribunal or by legislation to make from the date the Company becomes bound to
make such contributions.
24.3. Definitions
24.3.1.
For the purposes of this clause:
24.3.1.1. “Fund” means
the Australian Retirement Fund or The Smith’s Snackfood
Company Superannuation Plan which comply with the Australian
Government’s Operational Standards for Occupational Superannuation
funds.
24.3.1.2. “Wage” means
the ordinary periodic wage of an amount equal to or greater
than $450 per month paid by the Company to a team member and includes
other remuneration to be taken into account as “wages” under the
Superannuation Guarantee (Administration) Act 1992.
24.4. Compliance,
Nomination and Transition
24.4.1.
Notwithstanding anything contained elsewhere herein which requires that
contribution be made to a superannuation fund or scheme in respect of an
employee, on and from 30 June 1998:
24.4.2.
Any such fund or scheme shall no longer be a complying superannuation fund or
scheme for the purposes of this clause unless:
24.4.2.1. the
fund or scheme is a complying fund or scheme within the meaning of
the Superannuation Guarantee (Administration) Act 1992 of the
Commonwealth; and
24.4.2.2. under
the governing rules of the fund or scheme, contributions may be
made by or in respect of the employee permitted to nominate a fund or
scheme;
24.4.3.
The employee shall be entitled to nominate the complying superannuation fund or
scheme to which contributions are to be made by or in respect of the employee;
24.4.4.
The employer shall notify the employee of the entitlement to nominate a
complying superannuation fund or scheme as soon as practicable;
24.4.5.
A nomination or notification of the type referred to in paragraphs 24.4.2.1 and
24.4.2.2 of this subclause shall, subject to the requirements of regulations made
pursuant to the Industrial Relations Legislation Amendment and Repeal Act
1995, be given in writing to the employer or the employee to whom such is
directed;
24.4.6.
The employee and employer shall be bound by the nomination of the employee
unless the employee and employer agree to change the complying superannuation
fund or scheme to which contributions are to be made;
24.4.7.
The employer shall not unreasonably refuse to agree to a change of complying
superannuation fund or scheme requested by a employee;
24.4.8.
Until an employee nominates a complying superannuation fund or scheme, the
employer shall make contributions to a fund nominated in accordance with this
clause.
25. SICK LEAVE
25.1. Subject to the other provisions of this clause a team member, other than a casual,
unable to attend or remain at work because of personal illness or injury is entitled to be
absent from work without loss of ordinary pay (“sick leave”).
25.2. Sick
leave accrues at the rate of 1.46 hours per week for full time team members, and
on a pro rata basis for part time and fixed term team members.
25.3. Sick
leave entitlements not taken shall accrue from year to year.
25.4. Entitlement
Conditions
25.4.1.
A team member shall before or at the usual time of commencement (and in any
event not later than 24 hours after the commencement of absence unless
extraordinary circumstances apply) inform the Company of the nature of the
injury or illness and the estimated duration of the absence.
25.4.2.
A team member shall prove to the satisfaction of the Company their inability to
attend for duty on the day or days for which sick leave is claimed. Provided that
a team member will be allowed two single days absence each year without the
need for evidence to be provided.
25.5. Supplementary
25.5.1.
Sick Leave
It is recognised that team members may experience serious and long-term
illnesses resulting in disablement/disability. Team members may apply for
Supplementary Sick leave except in the following circumstances:
25.5.1.1. absences
of less than two (2) weeks duration after ordinary sick leave has
expired;
25.5.1.2. any deliberate self
25.5.1.3. any injury or
25.5.1.4. alcohol
inflicted injury or illness;
illness arising from an illegal act or activity;
or drug related illness/accident;
25.5.1.5. injury and
illness arising from professional or paid activity.
25.5.2.
In making an application for Supplementary Sick Leave, an employee shall give
the Company authority to contact the treating Doctor to assess the nature of the
injury, likely duration of absence and circumstances in which the injury was
incurred. Information gained in the process of such investigations is subject to
confidentiality by all parties involved.
25.5.3.
In determining a request for Supplementary Sick Leave, the Company may
amongst other things, review the file records of the applicant in relation to work
performance and sick leave. The Company, at its discretion, may refuse the
granting of Supplementary Sick Leave.
25.5.4.
In the event that the Company accepts a request for Supplementary Sick Leave,
the duration of the leave granted may not be to the full entitlement available
under this clause, nor for the whole period provided for under medical
certificates.
25.5.5.
Payment for supplementary sick leave requires medical certification for the
whole period off work, specifying the condition suffered by the team member.
Back dated certificates will not be accepted, and, in some cases the Company, at
its expense, may require a second opinion from a nominated Medical
Practitioner.
25.5.6.
A team member may make application for supplementary sick leave of up to
twelve (12) weeks in any continuous twenty-four (24) month period.
In determining the Supplementary Sick Leave available to an employee, the
following table will guide the amount of leave to which the employee is entitled,
based upon their length of service and sick leave history. This clause shall be
applied in conjunction with sub-clauses 25.5.2, 25.5.3 and 25.5.4.

25.5.7.
Supplementary sick leave entitlement will only apply when a team member
exhausts sick leave and RDO entitlements.
25.5.8.
Each supplementary sick leave claim will stand alone.
25.5.9.
Should the team member qualify for future ordinary sick leave entitlements
during a period of supplementary sick leave, supplementary sick leave will be
suspended until ordinary sick leave entitlements have again expired.
25.5.10.
Payment will be made at the ordinary time rate immediately following the expiry
of ordinary sick leave.
25.5.11.
Payment for the first two weeks of supplementary sick leave will be made
retrospectively.
25.5.12.
Supplementary sick leave does not accumulate.
25.5.13.
Supplementary sick leave shall not affect continuity of service.
26. ANNUAL LEAVE
26.1. Entitlement/Period of Leave
26.1.1.
At the end of each 12 months’ employment with the Company, all team members
will be entitled to four (4) weeks annual leave, exclusive of Public Holidays, and
may be taken in any manner agreed between the Company and the team member.
No team member will accrue more than four (4) weeks without written approval
from management.
26.1.2.
The method of calculating annual leave entitlements for part time employees
shall be to provide pro-rata leave based upon the average hours worked in the
previous twelve month period.
26.2. Payment
26.2.1.
The following payments shall be made to each team member, immediately before
proceeding on annual leave:
26.2.1.1. Day Workers
- ordinary pay plus a loading of 17.5%; or,
workers - ordinary pay plus applicable “Shift Loading” (as provided
for in subclause 19.3 - Shift Work).
26.2.1.2. Shift
26.3. Taken
In Advance
26.3.1.
If the Company and the team member so agree, annual leave may be taken
wholly or partly in advance before the team member has become entitled to
annual leave.
26.3.2.
Unless a team member has taken all annual leave in advance for the current year,
the team member becomes entitled at the end of a year of employment, to that
part of the annual leave not already taken.
26.4. Termination
26.4.1.
of Employment
A team member whose employment is terminated shall be entitled to:
26.4.1.1. Payment
for their accrued annual leave entitlements inclusive of annual
leave loading in accordance with subclause 26.1 and 26.2; and
26.4.1.2. In
respect of their current year of employment, all accumulated pro rata
annual leave, exclusive of annual leave loading, in accordance with
subclause 26.1.
27. JURY SERVICE
27.1. A team member who is required to attend jury service during ordinary working hours
will be reimbursed by the Company an amount equal to the difference between the
amount paid in respect of the attendance for such jury service and the amount of
ordinary wages that would have been earned, had the team member not been on jury
service.
28. BEREAVEMENT LEAVE
28.1. In the event of death of the team member’s spouse, defacto spouse, child or stepchild,
parent or stepparent, brother, sister and grandparents, paid bereavement leave of up to
five (5) days will be granted. Where requested, the team member is to supply evidence
of the death and the relationship to the deceased. In this clause, spouse, defacto, parent
or stepparent shall be read to include ‘same sex’ relationships.
29. PARENTAL LEAVE AND ADOPTION LEAVE
29.1. Parental leave shall be granted in accordance with Schedule 14 of the Industrial
Relations Act 1988 (Cth).
30. SPECIAL LEAVE
30.1. A team member may be granted paid leave for emergency or compassionate reasons of
up to three days in a calendar year.
30.2. Examples
30.2.1.
of circumstances where leave may be granted include:
Family illness;
30.2.2.
Emergency domestic situations (eg. fire, theft, burst plumbing);
30.2.3.
Natural disasters (e.g. bush fires, floods).
30.3. Each
case will be considered on its merits and the Company will not unreasonably
refuse a team member’s application for such leave. Management may grant such leave,
as it considers necessary in the circumstance, and shall not necessarily grant the full
three days in each case.
30.4. The Company may,
in its sole discretion, grant special replacement leave where a team
member has, for reasons of sickness or accident, been prevented from enjoying the
benefits of annual leave. In exercising this discretion, the Company will have regard to
the duration of the illness/incapacity relative to the period of leave.
31. LONG SERVICE LEAVE
31.1. A team member shall be entitled to long service leave in accordance with the Long
Service Leave General Order as printed in Volume 78 of the West Australian Industrial
Gazette at page one.
32. PROTECTIVE CLOTHING AND EQUIPMENT
32.1. Personal Clothing
32.1.1.
Subject to the terms and conditions of this clause the Company will issue
uniforms to team members.
32.1.2.
An original issue of new clothing will be made to each team member on
commencement and individual garments will be replaced by the Company on a
reasonable wear and tear basis as determined between the team member and the
team member’s coordinator.
32.2. Protective Clothing/Equipment
32.2.1.
The Company will provide suitable gloves, goggles, protective-eye wear, masks
and other protective clothing and equipment for such work that reasonably
requires their use.
32.2.2.
A team member who is supplied with any of the clothing or equipment specified
will wear or use, as the case may be, this clothing and equipment.
32.2.3.
The Company requires, as a condition of employment of all team members, that
they wear safety shoes. The Company will provide team members with one pair
of shoes free of charge on commencing and replace these shoes on a reasonable
wear and tear basis.
32.2.4.
Team members supplied with clothing and protective clothing/equipment in
accordance with this clause will replace or pay for any such clothing so supplied
if lost or damaged through the team member’s negligence.
32.2.5.
All clothing issued to a team member will be returned to the Company on the
termination of employment in good condition, fair wear and tear excepted, or
paid for at replacement cost by the team member.
32.3. First
32.3.1.
Aid
The Company shall provide and maintain first aid kits in all sections of the
enterprise.
32.3.2.
The Company will nominate qualified team members to fulfil the role of site
‘first aiders’, these people shall maintain a recognised First Aid certification at all
times and shall undertake refresher training as necessary. Employees fulfilling
this role shall be paid an allowance as detailed in clause 17.4. Employees not
possessing a current certification or not fulfilling the role as designated by the
Company shall not receive the Allowance at clause 17.4.
32.3.3.
The Company will determine the requirement for Occupational First Aiders and
Senior First Aiders.
33. CONSULTATION AND TEAM MEMBER INVOLVEMENT
33.1. It is recognised by the parties that the key to productive and harmonious working
relationships lies in establishing effective consultative mechanisms at the workplace.
Effective consultation mechanisms will:
33.1.1.
ensure that the views of the team members are known and taken into account by
the Company;
33.1.2.
provide management with an informed basis upon which to make decisions.
33.2. To
this end, it is agreed that a Consultative Committee is maintained by charter as
provided for in Appendix B to this Agreement.
33.3. The Committee shall
consist of a minimum of six and a maximum to be determined by
the Consultative Committee. A meeting quorum shall be a minimum of five committee
members representing both team members and management.
33.4. Team
member representatives on the Committee shall be allowed reasonable time
without loss of pay to research or prepare for such committee meetings with full access
to all relevant information as necessary.
33.5. Team
member representatives on the Committee are required to keep their constituents
advised on matters arising at the meeting.
33.6. The Company will
consult with team member representatives on the Committee and
give prompt consideration to matters raised by team members:
33.6.1.
in order to encourage the involvement of all team members in the ongoing search
for measures to improve productivity and efficiency; and
33.6.2.
to otherwise foster a fully committed and informed workforce.
33.7. Introduction
of Change
33.7.1.
Where the Company has made a definite decision to introduce major changes in
production, program, organisation, structure or technology that are likely to have
significant effects on team members, the Company shall notify the team members
who may be affected by the proposed changes and their Union.
33.7.2.
“Significant effects”: include termination of employment, major changes in the
composition, operational size of the Company workforce or in the skills required;
the elimination or diminution of job opportunities, promotion opportunities or job
tenure; the alteration of hours of work; the need for retraining or transfer of team
members to other work or locations and the restructuring of jobs. Provided that
where the Agreement makes provisions for alteration of any of these matters
referred to herein an alteration shall be deemed not to have “significant effects”.
33.7.3.
The Company’s Duty to Discuss Change. The Company shall discuss with the
team members affected and the Union, the introduction of the changes referred to
in subclause 33.7.1. and among other things, the effects the changes are likely to
have on team members, measures to avoid or minimise the adverse effects of
such changes on team members and should give prompt consideration to matters
raised by the team members and/or their Union in relation to the changes.
33.7.4.
The discussion shall commence as soon as is practicable after a definite decision
has been made by the Company to make the changes referred to in subclause
33.7.1.
33.7.5.
For the purposes of such discussion, the Company shall provide in writing to the
team members concerned and their Union, all relevant information about the
changes including the nature of the changes proposed; the expected effects of the
change on team members and any other matters likely to affect team members
provided that the Company is not required to disclose confidential information
the disclosure of which would be inimical to the Company interests.
34. DISCIPLINARY PROCEDURE
34.1. The company may take one or any combination of the following kinds of disciplinary
action depending on the seriousness of the offence or situation:
34.1.1.
Verbal warning;
34.1.2.
Written warning;
34.1.3.
Final written warning;
34.1.4.
Suspension;
34.1.5.
Dismissal.
34.2. Verbal
34.2.1.
warning
A verbal warning is an informal warning that will not be recorded on the team
member’s personal file.
34.3. Written
warning
34.3.1.
A written warning may be given either when a verbal warning has failed or
where the offence is so serious that a verbal warning would not be adequate.
34.3.2.
A written warning shall stand for a reasonable period of time and will be placed
in the team member’s personal file.
34.4. Final
34.4.1.
written warning
A final written warning may be given either where a written warning is
considered inadequate because of the seriousness of the offence or when the
same or similar offence is committed within the time frame as specified in
subclause 34.3., of receiving the written warning. Failure to heed a final warning
may result in dismissal.
34.5. Suspension
34.5.1.
In special circumstances where serious misconduct is or appears to be involved, a
team member may be suspended with pay for a period specified in writing,
pending an investigation of the alleged offence. This suspension is without
prejudice to the team member whose conduct is subject to an inquiry or to future
employment of the team member concerned.
34.6. Dismissal
34.6.1.
In the case of serious and wilful misconduct or in the case of a team member
who, after having received a final written warning, commits an offence similar to
that which incurred the final written warning or unreasonably fails to implement
agreed changes to his or her work performance following a final written warning,
the Company shall convene a hearing. No team member shall be dismissed or
suspended without a hearing for disciplinary offences.
34.6.2.
The following persons shall be present at a dismissal hearing:
34.6.2.1. The team
34.6.2.2. a shop
member concerned;
steward or union official of his/her own choice; and
34.6.2.3. any witness
required.
34.7. When
all facts and surrounding circumstances have been heard, management shall
inform the team member and persons present at the hearing of its decision and the
disciplinary action intended to be taken, if any.
34.8. A
team member is entitled to elect to have either another team member or a Union
Representative present during any discussions with the Company’s Representative/s
concerning the team member’s performance which may lead to the disciplinary
procedure being used.
35. RESOLUTION OF DISPUTES
35.1. The following procedure shall be observed to deal with questions, disputes or
difficulties arising under the agreement:
35.1.1.
discussions between the team member/s concerned (and Union representative if
requested) and the immediate coordinator/s for the purpose of resolving the
question, dispute or difficulty;
35.1.2.
discussions involving the team member/s concerned, the Union representative
and the Company representative;
35.1.3.
discussions involving representatives from the Union concerned and Company
representatives;
35.1.4.
discussions involving senior Union officials (State Secretary) and senior
Company representatives;
35.1.5.
there shall be an opportunity for any party to raise the issue to a higher stage.
35.2. Sensible time
limits shall be allowed for the completion of the various stages of the
discussions.
35.3. In
order to allow for the peaceful resolution of grievances the parties shall be
committed to avoiding stoppages of work, lockouts or any other bans or limitations on
the performance of work, while the procedures of negotiation and conciliation are
being followed.
35.4. The Company shall
ensure that all the practices applied during the operation of the
procedure are in accordance with safe working practices and consistent with
established custom and practice at the workplace.
35.5. Notwithstanding the
procedure contained in subclause 35.1, there shall be commitment
by the parties that in the event of a dispute, team members will not withdraw labour
until all part processed materials have been processed throughout the production line to
a complete stage without wastage and all equipment has been cleaned. This procedure
shall be repeated each day of a dispute.
35.6. Emphasis
shall be placed on a negotiated settlement. However, if the negotiation
process is exhausted without the dispute being resolved, the parties may jointly or
individually refer the matter to the Western Australian Industrial Relations
Commission for assistance in resolving the dispute, provided that at all times persons
involved in the question, dispute or difficulty have conferred among themselves and
made reasonable attempts to resolve questions, disputes or difficulties before taking
those matters to the Commission.
36. UNION BUSINESS
36.1. Right of Entry
Shall be in accordance with the Industrial Relations Act, 1979.
36.2. Posting
36.2.1.
of Agreement
The Company shall ensure a copy of this Agreement is posted in a place easily
accessible to all team members.
36.3. Meetings
36.3.1.
A Union may, from time to time wish to convene meetings of team members
(being team members who are members or are eligible to become members of the
Union) on site and during ordinary shift hours. This may be done after
discussion between an official of the Union and an authorised Company
representative. The parties agree that every effort will be made to conduct such
meetings in such a way as to minimise disruption to the Company operations,
such that where meetings are agreed to take place outside normal hours, they
shall be paid at single time rates.
36.4. Union
36.4.1.
of Team members
Education
The Company will pay a Union representative’s ordinary weekly wage, as
prescribed by Appendix B of this Agreement whilst the representative is
attending a trade union training course.
36.4.1.1. Each
representative will first obtain permission from the Company. Such
permission will not be unreasonably withheld having in mind the
operational needs in the representative’s work area.
36.4.1.2. The State Secretary of
the Union must endorse each request for permission
to attend such course.
36.4.1.3. Each
representative will be entitled to a maximum of five days paid leave
in any one calendar year.
36.4.1.4. Such
leave will be granted subject to the Company being given at least two
weeks’ notice of the date upon which leave is to be taken together with
advice as to the nature of the course and the subject matter included
therein.

able to weld thin gauge stainless steel used throughout the complex, able to carry out
limited turning tasks on a the lathe; and
 Works on complex or intricate circuitry which involves examining, diagnosing and
modifying systems comprising interconnected units; or
 Competently operates production equipment and has completed all relevant modules
for level 1-3 in the production steam as outlined in the main matrix.
 Display required team skills by actively participating in designated CI team
meetings, planning processes etc.
Level 6  Persons with Electronic/PLC/Instrumentation qualifications to certificate level and
completion of all Engineering Modules*, and participates in most team skills.
 Able to diagnose faults on PLC installed within our plant over the network.
 Able to conduct minor PLC program changes such as “force on/off” of controls.

To facilitate the development of broader skills in the Engineering Trades team, team members may
be asked to perform Planning related activities, in addition to their ordinary function as a
tradesperson. The following list is indicative of the task that shall be deemed Planning activities:
 Using the Maximo and backlog report, schedule and issue PM tasks;
 Develop / alter / modify PM job tasks in Maximo;
 Supply purchasing officer with spare part allocation of account codes;
 Inventory stock search both locally and interstate;
 Organise contractor / temporary labour when required;
 Organise weekend labour requirements to meet PM schedule;
 Conduct induction training for contractors / temporary labour;
 Update Engineering KPI Scorecard weekly;
 Maintain files such as – Induction register, Calibration records, Condition monitoring
records.
Engineering Tradespersons performing the above Planning activities shall be entitled for payment
of a Higher Duties allowance as provided for in clause 17.5.

APPENDIX B - CHARTER OF THE CONSULTATIVE COMMITTEE
1. Members of this committee are committed to achieving improvements in productivity at the
same time providing more secure and rewarding employment through cooperation.
2. The Consultative Committee has the authority to make decisions within the scope as defined
by this charter.
2.1. The Consultative Committee members will be responsible for:
2.1.1. Attending all meetings and discussing all matters raised except any matter which
are likely to give rise to an industrial dispute or grievance or which is of a personal
nature.
2.1.2. Consulting with other team members in order to encourage their involvement in the
ongoing search for measures to improve productivity and efficiency and to foster a
fully committed and informed work place.
2.1.3. Reporting back regularly and representing team members.
2.1.4. Ensuring effective implementation of change through proper planning and
consultation.
2.1.5. Promoting to management and team members the importance and benefits of
systematic training, job satisfaction and personal development of all team members.
2.1.6. Assisting with the design, conduct and administration of the training syllabus.
2.1.7. Making recommendations to management as required regarding any objections or
protests lodged by a team member arising out of matters concerning training or
assessment (non-industrial disputes).
3. Decision making of the Committee shall be subject to the authority bestowed in the most
senior management representative of the Committee, subject to their agreement with the
decision to be taken.
4. The Committee shall have the right to present information and or seek advice from the Union
and or relevant bodies.
