I understand that the seat I will be donating will be in an area selected from the list of
available sites in Poole. The specific positioning of the seat will be determined by a Poole
representative in consultation with me. The area chosen will determine the type of seat that
is available. I understand that the price for the seat includes full installation, 1 engraved
stainless steel or brass plaque and maintenance for a 10 year period.
I understand that on installation the bench becomes the property of the Borough of Poole
and that if I do not renew my donation after the initial 10 year period then the seat/location
may be offered to others for donation.
I understand that delivery and installation timescales will vary depending upon the style and
scheme.

Donated Public Seating Scheme - Terms and Conditions
Public Seating
1. The donation period is for ten years starting on the day the seating is installed. Charges will be based on
current rates at the start date.
2. The Borough of Poole will contact the Donor towards the end of the initial ten year period. After the ten years
the Donor has the option to renew their donation by way of a new seat or to have the existing seat refurbished
for a further five year period. Where the Donor does not respond or declines to renew their donation then the
seating and/or its location will be made available for other Donors. Any plaques or promotions on the seating
will be removed and if requested will be returned to the last address recorded for the Donor otherwise it will
be held by the Borough of Poole for a further 5 years before disposal.
2. It is the responsibility of the Donor to contact the Borough of Poole with any change of address otherwise the
last recorded address will be used. If the last recorded address proves to be incorrect, the Borough of Poole
is not duty bound to pursue the matter further.
3. Upon installation the donated seat immediately becomes the property of the Borough of Poole and will remain
so for the life of the seat.
4. The Borough of Poole through the use of public funds will take responsibility for the care and maintenance of
the seat for the donation period.
5. The Council will maintain and publish areas available for donated seating. The areas will be published via the
Council’s website and Donors have the option to apply for a seat in an area on the list. It is not possible to
reserve a specific location.
The type of seat and its positioning on site shall be at the final discretion of the Borough of Poole.
6. All requests to donate a seat are subject to approval by the Borough of Poole and suitable space and position
being available at the requested location.
7. Where applications are received for the same area or location the area or location will be assigned in the
order that acceptable applications are received. Where an area or location has been taken then the Council
may offer alternatives. This may include locations already occupied by a seat that the Council has determined
is to be replaced.
8. The Borough of Poole reserves the right to refuse to accept a donation request or to refuse any request that is
deemed inappropriate. The Council will not consider applications from organisations and businesses which it
reasonably considers do not share the Council’s core values.
The Council has absolute discretion over the organisations and businesses from which it will accept
donations and funding.
9. The Borough of Poole may carry out future works or planning alterations/changes to the site(s) or their
surrounding areas. In such circumstances the cost of repositioning a seat during the 10 year period, (if such
an option is deemed feasible by the Borough of Poole) – will be absorbed by the Borough of Poole.
10. The Borough of Poole reserves the right to transfer or assign ownership control or management of the
Donated Public Seating Scheme and any contracts entered into in relation to it at any time.
11. As part of future works including planning alterations/changes to site or the maintenance programme, seats
may be removed from their site for a short duration in order to be refurbished or to accommodate the works.
Notification will not be given to individual Donors.
Artistic or Community Seating
1. Subject to planning law requirements the Council welcomes donations for innovative Artistic and Community
seating. Artistic and Community seating shall be designed to create a waymark, signposting or centre-piece
feature or a community and family oriented setting in and around a gathering place where it creates an
inclusive community space.
2. Donors may offer a specific proposal for Artistic or Community seating for consideration under this scheme.
The proposal shall include; an artists or designers brief and dimensioned sketch, proposed location map,
relevant Planning opinion, photographs of the area, a timetable and details of who will manage the proposal
through to completion.
3. Proposals will need to show that they have consulted local residents and local businesses.
4. The designer/artist is required to have shown due regard to the on-going maintenance and robustness of the
seating. Seating shall have ‘inclusive features’ and avoid features that encourage monopoly by one or few
individuals.
5. The individual, business or organisation making the application has the responsibility to secure and deliver the
total funding for the Public Seating including its’ installation, insurance and 10 years maintenance.
6. The Council may determine that the scheme shall involve a community celebration and formal opening event
or ceremony.
7. Applications to donate Artistic and Community Seating have the option of proposing a new location for the
Council to consider.
Plaques & Promotions
1. The Borough of Poole has full control over the specification and design of all plaques and promotions and the
Donor shall adhere to any requirements of the Borough of Poole.
2.
Promotions and plaques with inscription on donated public seating shall comply with the Council’s current
‘Advertising and Sponsorship Policy’ available as a download from the Council’s website.
3.
Payment for a plaque with inscription on an individual bench or seat includes for a stainless steel or brass
engraved plaque of maximum size 15cm x 5cm.

Where Donors propose a promotion or inscription plaque that exceeds the maximum size then the
application shall include a fully dimensioned sketch of the plaque that includes details of materials, all text
and graphics and a sketch showing how and where it is to be affixed to the seating which must be approved
by the Council. The Council has absolute discretion over whether the text, graphics, nature, size and shape
of the promotion is appropriate and can be affixed to the seating. In this situation the Donor is responsible for
sourcing, funding and delivery of the approved promotion plaque.
5.
Promotions on artistic and community seating shall be of a size and design that is proportionate and
sympathetic to the scheme. Applications for artistic and community seating shall include details of the
proposed promotion or inscription for approval by the Council.
6.
Promotions and plaques with inscription shall not be representative of the individual amounts of contribution
in their wording, nature, size or design.
7.
Only plaques with inscription will be permitted on seating in some locations determined by the Council at
their sole discretion, this will include Cemeteries and other memorial sites
8.
The Donor shall provide the wording (text only) to be inscribed on the plaque but the Borough of Poole will
determine the size and font of the lettering according to the Borough’s specification.
8. The original donation includes the cost of the plaque, the inscription and its installation. If the Donor wishes
to make changes to the wording on the plaque after it has been produced and/or installed the Donor will be
responsible for the additional costs incurred and charges will be based on current rates at the time.
9. If a Donor wishes to add a further plaque(s) to their donated seat this will incur additional charge.
If the Donor adds a further plaque(s) to the seat after it has been installed the original donation period of ten
years will not be extended. A maximum of 3 plaques may be attached to one seat.
10. It is the Donor’s responsibility to ensure that their wording does not contravene the Trades Description Act
1968, or infringes any copyright or any other statutory control or regulation and the Borough of Poole reserve
the right to withdraw the offending text at the cost of the Donator.
Payment
1. The donation monies to be paid in full at time of booking. The Donor will receive an Official Receipt for the
payment made.
None of the above Terms and Conditions are intended to or will operate to confer any benefit (pursuant to the
Contracts (Rights of Third Parties) Act 1999) on a person who is not the named donor of the donated seat or
plaque.
