FOR THE ASSIGNEMENT OF THE MANDATE OF THE MEMBER OF PARLIAMENT TO
THE CANDIDATE OF THE MULTIMEMBER LIST OF THE DEMOCRATIC PARTY IN THE
PREFECTURE OF SHKODRA, ON THE FILLING OF THE VACANCY ANNOUNCED BY
THE PARLIAMENT OF ALBANIA

On the assignment of the mandate of the member of the Parliament to
the candidate from the multimember list of the Democratic Party,
Shkodra Prefecture, for the filling of the vacancy announced by the
Parliament of Albania after the resignation of the Member of
Parliament mandate by Mrs. Voltana Ademi.
Legal Base:
Article 23, point 1, letter a, article 164 point 2 of law nr.10019, date
29.12.2008 “Electoral Code of the Republic of Albania”
The Central Electoral Commission after reviewing the documentation presented and heard
the discussion of the representatives of political Parties.

On the assignment of the mandate of member of parliament to the next candidate in rank in
the multi member list of the Democratic Party ,in the Prefecture of Shkodra, in the filling of
the vacancy announced by the Parliament of Albania.
Due to the resignation of the mandate of the member of the Parliament of Albania by
Mrs.Voltana Ademi, member of parliament in the electoral college of the Prefecture of
Shkodra, the C.E.C. in respect of the article 164 of the Electoral Code has decided on giving
the mandate to the subsequent candidate in the multimember list to the same political party
in the respective electoral district, registered according to article 67 of the Electoral Code.
With the decision nr 36, date 02.08.2013 has distributed the respective mandates according
to the electoral results of the elections for the Parliament of Albania in 2013 in the
Prefecture of Shkodra. According to the above mentioned decision, the Democratic Party
has won five parliamentary mandates for the electoral districts in the Prefecture of Shkodra
in the general election for the Parliament of Albania in 23 June 2015.
According to the above mentioned decission, the multimember list of the Democratic Party
in the Prefecture of Shkodra, approved by the C.E.C., the candidate ranked fifth is mr.
Gjovalin Bzhetaj. It results that the multimember list of the Democratic Party in the
Municipality of Shkodra does not fulfil the legal criterias indicated bu the article 67 of the
Electoral Code, including gender criterias. Under these circumstances, the filling of the
vacancy shall be mada according to article 164, point 2. We observe also that the vacancy
belongs to a mandate won according to the point 6 article 67 of the Electoral Code. Before
the creation of these vacancie the mandate belonged to Mrs.Voltana Ademi, which belong to
the gender less rappresented .Under these conditions in filling the vacancie the C.E.C. will
make exeption as stated in the article 164, point 2 of the Electoral Code.
The C.E.C. with the decission nr.340, date 11.05.2013 “On the approval of the multimember
list of the Socialist Party, member of the Coalition “The Alliance for Work, Welfare and
Integration” for the general elections for the Parliament of Albania 2013’, has also approved
the multimember list of the Democratic Party for the 12 electoral districts, together with the
declarations Model 03, for the seats distributed according to gender quotas in the multi
member list for each electoral district.
According to the declaration Model 03 “Declaration on the Seats Distributed under the
Gender Quota in the Multimember List” deposited by the D.P. in the documentation of the
multimember list in the electoral district in the Prefecture of Shkodra, the following
candidate in the list after Mrs. Voltana Ademi is the candidate ranked in number 10 (ten)
Mrs. Irma Musa Kopliku (Alushi). According to article 175, point 2 of the Electoral Code ,the
vacancy shall be filled by the first female candidate after Mrs. Voltana Ademi in the list, and
she is the candidate nr.10 Mrs. Irma Musa Kopliku (Alushi).
FOR THESE REASONS
The Central Electoral Commission, considering the article 23 point 1, letter a, article 85
point 1, article 85/1 law nr.10019, date 29.12.2008 “The Electoral Code of the Republic of
Albania’ amended :
DECIDED:
To give the mandate of the Member of the Parliament to the subsequent candidate in the
multimember list of the Democratic Party, Prefecture of Shkodra to Mrs. Irma Musa Kopliku
(Alushi).

On the assignment of the mandate of member of parliament to the next candidate in rank in
the multi member list of the Democratic Party ,in the Prefecture of Shkodra, in the filling of
the vacancy announced by the Parliament of Albania.
This decission enters in force immediately.
Against this decission there can be an appeal at the Electoral College, at the Court of Apeal
of Tirana, within 30 (thirty)days of this proclamation.
