Lodgers Agreement
1.
Background
Welcome to The Royal Hotel Darlington Accommodation. This agreement sets out
the terms and conditions on which we will give you access to our services and
facilities and which describes our general principles. You hereby acknowledge you
are a lodger on our premises and that your accommodation at our Hotel is
governed solely by this agreement.
You confirm that you accept all of the terms and conditions contained in this
agreement, our rules and our privacy policy and agree to us holding a copy of
your photo on our system for our internal use by signing this agreement. You
must sign this agreement before you may become a lodger.
Our rules, our privacy policy and your accommodation summary form part of this
agreement and a breach of them is a breach of this agreement.
We may amend this agreement at any time, in our absolute discretion, by posting
the amended terms and conditions on our website or issuing a letter directly to
you. We operate the premises and have the right to enter any room for routine
inspections.
2.
Lodger Eligibility
You may only use our facilities or become a lodger if you are:
(a)
able to form a legally binding contract with us;
(b)
over 18 years of age with proper ID (i.e. Passport, Drivers license or ID
card) and
(c)
not temporarily or indefinitely suspended from using our services or
facilities or have been evicted from this or other hotels.
(d)
provide a reference from current place of employment with contact details
for us to contact.
(e)
provide a deposit of one weeks rent that will be kept should this
agreement be in breach.
If you do not qualify, please do not apply to use our facilities or to become a
lodger.
You promise to us when you sign this agreement that you meet the criteria in
clauses 2(a) – (e). We will require a copy of suitable ID.
3.
Accommodation agreement

We give you permission to:

(i)
occupy the specific bed that you book with us from the start date
and for the term of your booking as specified in your
accommodation summary from time to time, provided that you
have paid to us the deposit specified in your accommodation
summary; and
(ii)
use the common areas and the equipment provided by us in those
areas for common use, in the accommodation provided you keep
them clean.
You must pay for your accommodation one week in advance to the
manager on duty at main bar whilst the hotel is open. Rent is due
on or before Friday every week. It is your responsibility to obtain a
receipt from the manager as proof of payment. If you do not pay
your rent by 10pm Friday we reserve our right to cancel your
access card to the building. A $10 administration fee will then be
payable for late rent and the process of termination will be started.
Should you not pay the administration fee when requested, we
reserve the right to deduct an equivalent sum from the key deposit
paid by you at the commencement of your stay. The key deposit is
equivalent to one week’s rent and will be returned on check out
providing the keys are returned, correct notice given of departure
and the room is the state it was at the time of checked in with no
damage.
You must:
(i)
give us notice of your departure at least 14 days in advance, in
person & in writing, to the Duty manager at the main bar by filling
a departure notification form;
(ii)
fill in all details to apply to lodge including contact details and
reference details of current employer
(iii)
when you check out on your departure date you must complete
our departure check list before we will return your deposit to you.
The room must be left in the same state it was given to you. No
rubbish or belongings incl accumulated furniture should be left or
deposit will be forfeited.
If you do not provide us with notice of your departure in accordance with
paragraph (c) we:
(i)
will retain your deposit; and
(ii)
Will assume that you will remain a lodger in your particular bed
until you give us the required notice.
We may charge you a full day’s rent at the undiscounted rate if you check
out after the lodgers check out time of ___________on your departure
date.
4.
(f)
You must not change your bed or room without our prior written
permission.
(g)
You must not allow another person to occupy your bed if, for any reason,
you are not using it.
Contribution to your shared living community
We offer our lodgers a shared living community experience. You must do the
following as a part of your contribution towards our shared living community:
(a)
keep your bedroom clean and in good condition at all times, including
ensuring the bed linen is regularly changed;
(b)
store your personal belongings in the storage units provided by us and in
the area designated by us for storage;
(c)
carry out a task relating to maintaining a common area of the residence,
as directed by us;
(d)
(e)

(g)
comply with the rules, as amended from time to time;
keep clean the common areas especially the kitchen and toilet. Always
wash up and clean up after yourself when using the facilities.

(i)
smoke in the residence, including any outdoor areas of the
residence and anywhere within its grounds;
(ii)
use any naked flames of any sort including candles, incense or oil
burners or any heaters or fans other than those provided by us
(iii)
tamper or interfere with the computers, your internet access or
your broadband connection; or
(iv)
bring your own furniture into the residence.
(v)
create disruption, noise and any means violence
(vi)
bring the hotel in to disrepute in anyway
please note that if you break your agreement within the 1st month of
your stay, a break fee of $150 shall be payable.
If the property or anything in it is damaged, you must contribute towards the cost
of the repairs of the damage, unless the person who caused the damage tells us
that he or she was responsible.
5.
Visitors
(a)
You may only have visitors within the residence between 12:00 noon and
8:00 pm (in order to respect all guest’s privacy and security). They must
report to the manager on duty to give a copy of ID and sign in.
6.
(b)
You must accompany any visitors you have when they are in the
residence. Unaccompanied visitors are considered to be a serious security
risk.
(c)
You must not have large social gatherings of visitors in the residence. We
consider large social gatherings to be a serious security risk to other
guests. All visitors must report to the Duty manager for ID verification
copy
(d)
You must not allow any visitor or any other person who is not a guest of
your residence to stay overnight in the residence.
(e)
You must not enter any other residence without the prior written approval
of the Duty manager of that hotel.
(f)
No guest may let any person into the hotel accommodation area should
they not have their access card to the front door incl another guest. It
may be the case a guest has not paid their rent and is seeking illegal entry
to the hotel. Always refer people to the Duty Manager at the bar. Never
ever let anyone in or you will be asked to vacate the accommodation
immediately and forfeit any bond.

You must not use areas that are marked This is not a common area.
We expect all guests to respect and consider their fellow housemates.
Accordingly, televisions and music must be turned off no later than
11:00 pm.
What happens if you do not comply with this agreement?
If you do not comply with:
(a)
clause 4(a) we can charge you $25.00 for each hour, or part of an hour it
takes to carry out your obligations for you. We can also issue you with a
written warning to carry out this task within a time frame or you will be
evicted.
(b)
clause 4 (f) and/or clause 5, we may attract you immediately and you will
forfeit your deposit to us. We will not make any exceptions to the rules
set out in clause 4(f) and clause 5.
We may terminate your agreement with us, without notice and may, in our
absolute discretion, retain all or part of your deposit if:
(i)
you breach this agreement;
(ii)
we are unable to verify or authenticate any information you
provide to us,;
(iii)
we believe that your actions may attract legal liability for you,
other guests, or us; or
(iv)
we suspect that you have engaged in fraudulent or criminal
activity while on our Premises.
If you break or damage furniture, fittings or any property owned or leased by us,
or another guest, you must pay for the repair or replacement (at our discretion)
of that item and your lodgers agreement will terminate immediately.

Indemnity and release
(a)
You indemnify and keep us and our related entities indemnified from and
against all damages, costs, losses, damage and expenses, including legal
fees incurred or suffered by us and/or the relevant related entity
consequent upon, arising directly or indirectly out of or relating to your
actions on our Premises or a breach or non-observance by you of this
agreement..
(b)
You release us from any responsibility for lodgers and their guests
personal belongings. Lodgers store their personal belongings at their own
risk.
Disputes
We can require any dispute, controversy or claim arising out of or in connection
with this agreement to be settled by arbitration by reference to a commercial
dispute centre located in the State in which the guest is located. Both of us will
be bound by the decision of the arbitrator. The party who is determined by the
arbitrator to be at fault in relation to the dispute, controversy or claim must pay
the costs of the arbitration.
10.
No transfer
We enter into this agreement with you personally. You are not entitled to assign
or transfer your rights and obligations under this agreement.
11.
Terms used in this agreement
The terms used in this agreement have the meanings given to them below except
where a different meaning is implied by the context in which it used:
we or us means The Royal Hotel or any assignee or successor in title;
lodger means a guest of a property owned or leased by us who has entered into
a contract for the provision of occupation of a bed in one of our facilities and they
are currently occupy that bed;
privacy policy means the document described on our website as our Privacy
Policy;
related entities means our parent entity, subsidiaries, affiliates, officers,
directors, agents and/or our employees;
rules means the documents described on our website as our Rules;
facilities means a property owned or leased by us and used for the purpose of
operating the business of The Royal Hotel Pty Ltd; and
you means the person who signs this agreement who is seeking to become a
lodger.
12.
Interpretation
The law of all States and Territories in which The Royal Hotel operates applies to
this agreement.
