Presentation to the Portfolio Committee on Women In the Presidency Quarter 1 (April- June 2016) 6 September 2016 7/29/2017 1 TABLE OF CONTENTS • Introduction • Overview of performance • Progress on APP • Reflections on SONA • Conclusion 7/29/2017 2 3 Introduction The current reporting period assess work undertaken by the organisation during the first quarter of the financial year as contained in the APP that was finalised and lodged with relevant authorities in the previous financial year. Primary focus for the quarter over and above implementation of APP, was to ensure drafting, finalisation and submission of the annual financial statements and draft annual report to the AGSA and NT. The report will therefore give a brief account and feedback on audit outcomes, highlight achievement or attainment of targets against what was planned for the period in the APP, interrogate spending patterns and trends as well as overall functions of the institutions. 3 4 Overview of function of organisation The current reporting period marks the beginning of the financial, it is during this period that planning and ground work takes place; holding meetings with prospective partners, selecting sectors that will be monitored and engaging with various stakeholders to set collaboration opportunities that will be implemented as the year progresses. In terms of internally audited outcomes on basis of evidence attached overall achievement for the quarter is 60%. This percentage of achievement is an improvement from last financial year’s one which was at 54% for the same period. Two resource books have been developed and officers together with provincial coordinators trained human rights based approach and on gendermainstreaming using the SDGs framework. The PEI unit continued to provide technical assistance and training TUT in GP; Limpopo and Mpumalanga on gender mainstreaming. The request for training and technical assistance came as part of process of the university working on the recommendations that emanated from the gender transformation hearings held in the previous financial year. Some of the programmes for this quarter concentrated on matters related to youth month, a PSA was flighted in various SABC stations with free airtime totalling R750 000.00 being utilised. 6 7 During the period under review, important stakeholder engagements focussing on local government elections and women’s representation in political parties took place as well as critical engagements with the justice cluster on findings and recommendations on the legal department monitoring of courts report. 22 resolutions were reached in this meeting which hopefully will address some of the issues and/ or findings on court monitoring; such as NPA relooking into withdrawal of domestic violence cases and looking into how to possibly effect non-withdrawals, revision of training manuals for equality court clerks, establishing victim support in domestic violence courts similar to those in the sexual violence courts etc 7 8 Key issues surfacing across provinces relate to Estate, domestic violence and substance abuse, unemployment, imbalance of work at home (time use) etc. Some of the provinces were able to hold stakeholder engagements which is a beginning of a series of consultations with various stakeholders in order to identify issues pertinent matter relating to gender equality that affect various provinces. This body of work will be utilised in September/October for strategic planning processes and long term planning that the Commission will be embarking on when current strategic plan document expires. As was indicated in the previous quarters there has generally been further systems improvement put in place in order to deal with weaknesses that were previously identified by the AGSA on the previous audit outcomes. These improvements will highlighted when the report is formally presented by AGSA. 8 Overview of Performance • It is imperative to highlight that communications unit has popularised the work of the commission through documentaries, PSAs flighted during 16 days and social media campaigns. These initiatives highlight the great work that can be achieved when strategic partnerships are entered into. ( there were no costs involved). 7/29/2017 9 1 7 /0 2 9 / 2 0 1 7 10 STRATEGIC OBJECTIVES STRATEGIC OBJECTIVE 1 SUB-STRATEGIES To ensure the creation and implementation of an enabling legislative framework that promotes the attainment of gender equality. 1. To monitor and evaluate the promotion of gender equality and any relevant policies and practices of the public and private sector and report to Parliament 2. To initiate and review for the improvement of the legislative framework in all spheres of government that impact on priority areas of gender equality 3. To conduct periodic performance assessments of priority Ministries, State institutions, Government departments, political parties and the private sector, on the implementation of applicable legislation and policies that impact on gender equality 4. To evaluate the implementation and effectiveness of the national justice facilities for gender discrimination 6. To convene direct dialogues with relevant policy makers at national and provincial level on recommendations to promote gender equality contained in research reports and research activities 7/29/2017 11 Progress on SO 1 Submissions made for legislative and policy enhancement • For the better part of the reporting period Parliament has rose for election processes. The PLU worked on 4 submissions to the SALRC on witch Craft, submission to DoJ on National Action Plan to Combat Racism, Racial discrimination and Xenophobia and related Intolerance. • SALRC submission on Family Disputes, which seeks to synergize dispute resolutions mechanisms on various statues such as Divorce Act, Children’s Act and Uniform Rules of Courts Auditing Implementation of the Victims Charter • The Commission in preceding years undertook assessment of this area of work and had made recommendations to departments that had specific obligations as far as victims of crime are concerned. Currently research department is assessing whether the recommendations that were highlighted have been taken forward and actioned by the DoJ; NPA and SAPS. The team has finalized draft plan outlining scope of assessments and finalized the audit tool to be administered in the second quarter . 12 Progress on SO 1 Gender barometer report that assess the status of gender policies and practices in private and public sector 7/29/2017 • The web based tool will continue to be administered within the mining sector to assess gender mainstreaming. In the last financial year assessments were done on Anglo American & Rainbow Minerals. • • For this financial year focus is on Sibanye Gold and Exxaro Resources Ltd. Field work has commenced on Sibanye Gold, with briefing sessions having been held with leadership in management and labour Unions • There has been delays with Exxaro as there seemed to be reluctance on management. 13 Progress on SO 1 Assessing 365 NAP on GBV and supporting structures Court monitoring Policy dialogues conducted on findings in research reports 7/29/2017 • The focus for this financial year is on SAPS; looking at programmes they have put in place to combat GBV and to get a sense of how their process of statistical review is undertaken in order to ascertain certainty of the stats that get reported at National Level. Three police stations have been selected for each of the following provinces: EC;NW,LP & GP • The Department held a meeting with various departments within the Justice Cluster to look into the findings of last financial year’s reports and recommendations. The meeting came up with resolutions which the CGE will monitor its implementation thereof. • The first quarter of the financial year is concerned with drafting Policy Briefs out of the finalised research reports of the previous financial year. The briefs make it easier to look at critical Policy issues during policy dialogues which are scheduled to start in the second quarter. 14 Progress on SO 1 Consultations with stakeholders on findings of provincial EE hearings held • EE hearing will be held with Companies within the private sector. Questionnaires have been dispatched to various companies soliciting relevant preliminary information that will help when they appear to account before the Commission. • The department drafted and dispatched questionnaires to Rhodes, UKZN, WITS and UCT. All entities have responded. The department will analyse the information in Q2. • A consultative forum with the Universities engaged with I the last FY was held on the 1 June 2016 to assess how they are doing on recommendations made Gender Transformation Investigation report • Assessment of Women’s Representation in political Parties 7/29/2017 • A consultative dialogue was held with Political parties sensitize and engage on gender mainstreaming and previous findings & recommendations on Commission’s report. • Political parties manifestos and party nomination processes and candidates list have been analysed and the second phase of elections monitoring will be finalized in the 2nd Q after August Polls 15 STRATEGIC OBJECTIVES STRATEGIC OBJECTIVE 2 SUB-STRATEGIES To protect and promote gender equality by engaging with relevant stakeholders to educate and raise awareness on issues of gender equality, challenge patriarchal perceptions and stereotypes and take action against infringements of gender rights through the implementation of appropriate redress. 1. To timeously investigate complaints of violations of gender rights and identify appropriate redress 2. To Initiate investigations of systemic violations of gender rights in the public and private sector and identify appropriate redress 3. To develop of a coordinated programme to promote equality 4. To initiate interventions for sustainable development and promotion of gender equality by addressing violations in the social cultural political economic security and human rights dimension 5. To collaborate with organs of state, civil society and other institutions for the effective development, protection, promotion and attainment of gender equality 7/29/2017 16 Progress on SO 2 180 complaints received and dealt with in terms of the complaints manual Legal outreach and clinics conducted 7/29/2017 •In the pervious FY, legal unit closed the year with 375 pending cases. For the current period 183 complaints against a target requirement of 180 files per quarter. It must be noted that there are recruitment processes underway for FS;KZN;NC offices. Currently head office and other provincial legal personnel are assisting these provinces. •For the reporting period in collaboration with public education and information, the department conducted 22 outreach and legal clinics. •There has been a slight decrease in number of outreach clinics conducted and this is due to vacancies in NC and KZN for legal officers. FS outreach were affected by political unrest in specific areas that were targeted for the quarter. This category includes walk-ins or telephonic complaints, where members of the public are given advise or intervention required is immediate and as such does not warrant opening of file and/ or prolonged investigations. Maintenance complaints are the highest dealt with for the period under review. And the NW province has opened the most of files related to maintenance issues. Gender discrimination, estates. Divorces and domestic violence matters also form part of the most cases dealt with. 21 2 2 2 3 As previously reported 22 outreach clinics were held out of a target of 27 for the quarter. This is against previous achievement of more than 27 for the previous period in the last financial year 60 50 40 30 Legal Clinics 20 10 0 1st Qtr 2nd 3rd 4th 23 2 4 There are various issues that come up or get identified as problems in various communities during the legal and outreach clinics, ranging from harassment of the elderly, hate crimes, substance abuse, domestic violence, high unemployment, early child marriages and processes to be followed for maintenance claims, protection orders and how SAPS executes them. A total of 53 files opened by the unit were opened during legal and outreach clinics. As much as opening of files is not dependent on the number of outreach clinics held, there seem to be improvement and this could be attributed to the new way and processes that must be followed before the outreach clinic is conducted. 24 Progress on SO 2 Systemic Investigations undertaken • Transformation of the judiciary: As was reported in the previous quarter JSC had requested an extension to submit their responses to the draft report in the first quarter of the FY. This submission has been submitted and analyzed. The report is currently being edited. • Decriminalisation of sex work: This matter is two pronged; looking into the abuse of sex workers at the hands of law enforcement officers and the DoJ paper on legislative reform that should be undertaken on this matter. The SALRC has submitted report on the suggested reform to DoJ and this has not yet been released for public engagement. In the last quarter for the Abuse case we had indicated that Information was awaited from SAPS, this information was submitted and the draft report has been finalized and currently serving on various committees within the Commission for quality assurance. Progress on SO 2 Systemic Investigations undertaken • Maternal Health: DoH has indicated that it will be undertaking its own investigation into coerced sterilization matters as was raised in the Commission’s draft report. The department has appointed an advocate to look into the matter and he has setup a meting with the Commission in the second quarter. • Uthukela Maiden Bursary matter: The investigation report was finalized and lodged with Parliament and disseminated to various stakeholders including the respondents. The Municipality has been given until the second quarter to implement and report on the recommendations highlighted. Progress on SO 2 Coordinated Programme with targeted stakeholders Campaign on Human Rights and gender equality campaign • Training manuals developed and education officers trained on train the trainer Local government programme, as highlighted in the overview. •A concept papers were developed to guide provinces in implementing the campaigns. •All provinces implemented both programmes •The Human Rights month programme was further supported by a comprehensive community radio programme 27 2 8 PEI The PEI Department carried out a number of APP activities in the provinces as outlined below, the unit worked collaboratively with legal on outreach legal clinics. Most of the work for the reporting period concentrated on training on the SDGs and local government programme and drafting resource books that will be utilised for this program. Various sessions were held with traditional leaders as a process to gather information that will be tested and engaged with when traditional leader’s hearings take place at a later stage. The unit partnered with Eskom and held roundtable discussions with the focus being on creating a conducive environment and identifying key and pertinent issues the Eskom’s Women Advancement Programme should take into account and work on in order to support and provide women with a conducive environment. •Critical gender issues highlighted by various engagements with vast stakeholders relate to 50/50, gender budgeting lack of commitment towards implementing EE, sexual harassment and bullying at schools. The media campaign that was running during this period took place through social media, community television, radio PSAs. For this media campaign the SABC availed free airtime and Nemisa made available their production resources in order to ensure that production occurs for the radio adverts that were flighted on SABC radio stations. The unit worked closely with GCIS in order to roll out a viral campaign which aimed to educate public and remind various stakeholders about solutions that are at their disposal to deal with sexual violence and rape. This was done through #didyouknow 7/29/2017 31 3 2 Communications •Part of the work undertaken by the Unit is to renew partnerships and form new ones. For this quarter the unit engaged with the existing strategic partners in order to ensure that new projects for the new financial year are agreed upon. •Swedish embassy was highlighted as one of prospective strategic partners after last financial year’s competition which they were running and had approached the CGE to be part of the judging process. Various meetings have been held to explore formal partnership. The Embassy had promised that when the competition is done they will be donating the paintings to the CGE as they relate to its mandate. •The Communications Unit has utilised various media and communications channels and strategies proactively to convey and disseminate critical messages to the general public, but also to respond to issues ongoing public related to gender equality. For the current reporting period (youth month) the unit partnered with SABC Foundation and Nemisa to produce a youth month PSA which was aired on SABC radio stations. The PSA highlighted the mandate of the Commission and encouraged use of the toll free number in order to report gender discrimination and abuse 3 3 Communications • During this quarter the CGE contributed to public debates and made comments on numerous issues of importance, ranging from virginity testing and awarding of bursaries virgins, elections and women political representation, gender based violence and sentencing of Oscar Pistorius. •The Communications Unit helped to ensure that CGE was present in debates on these issues, utilising a combination of media channels such as Press/Media Releases, Media/Press Invitations, Interviews with Radio and TV stations, published Opinions pieces/articles in newspapers and other electronic media. The Unit has also ensured that these contributions are made in different languages, thus ensuring that the CGE’s messages were conveyed to a potentially large audience of millions across the country and in various communities. •Media Coverage: There was a rise in coverage in the media as a result of the Uthukela report in the month June. In this month, there were recurring stories on the Maiden Bursary until the end of the month. Other stories linked to the work of the CGE included: Workshop on elections and political parties. 33 3 4 Communications Social media trends Trends on social media shows that the CGE still has a lot more conversations on Twitter as opposed to other mediums. The trend is adequate due to the fact that twitter allows for immediate response by the CGE to any issue that media or public might be commenting on. The number of new followers on Twitter has grown to about 90 new followers from the previous quarter. This means that there is continuous growth on the following. This growth comes as a result of the Uthukela report. In other words, there was a correlation between the growth of followers and the release of the report in the same month. Facebook has improved in terms of the number of page views in the previous quarter. The page views have grown by 35% from the previous quarter. The coverage trends according to countries show that South Africans are on top of the list of audiences, followed by the United States and United Kingdom. Amongst the African countries, Nigerians tops the list, followed by Kenya. In regards to sentiments expressed by social media users, there are more comments made by the public on issues related to CGE as opposed to other forms of activities. This means that there more social engagements rather than reviews or articles/blogs. This is good because it shows that audiences are talking about CGE work. 34 3 5 Communications Branding The EC office moved to the new premises and the unit has ensured that office branding is done which is in line with the CGE branding manual. The unit worked collaboratively with IT unit to create projects that relate to online branding. This project looked into branding email signatures, creating a link that will lead readers to the CGE website from emails, creating newsletter link and highlighting various campaigns for the quarters utilising email banner. Below is the sample for email signature and campaign banners: 35 3 6 3 7 Media Coverage of CGE During this quarter the CGE contributed to public debates and made comments on numerous issues of importance, ranging from virginity testing and awarding of bursaries virgins, elections and women political representation, gender based violence and sentencing of Oscar Pistorius. The Communications Unit helped to ensure that CGE was present in debates on these issues, utilising a combination of media channels such as Press/Media Releases, Media/Press Invitations, Interviews with Radio and TV stations, published Opinions pieces/articles in newspapers and other electronic media. The Unit has also ensured that these contributions are made in different languages, thus ensuring that the CGE’s messages were conveyed to a potentially large audience of millions across the country and in various communities. The graphic below shows the level of coverage that CGE received/generated during the period under review, through articles, opinion pieces and related activities. It shows that June had the highest level of coverage this is due the press briefing on the release of the maiden salary report from legal department. Generally there has been improvement of media coverage when compared with results for last quarter. 37 3 7 / 9 2 9 / 2 0 Information Technology 1 7Key Project elements have been completed successfully in line with the project deliverables, with the exception of a formally documented hand over to the commission. This will however be scheduled in the second quarter which will include some detailed post project engagements, experience, lessons learned as well as improvement areas for the current financial year which are detailed in the five (5) year IT strategy. Generally, quality of service, network performance, inter branch connectivity and internet access has considerably improved with capability of accessing resources securely through any device connected to the internet, faster access to information and keeping critical business services operational at all times. National Treasury SCM circular No 6 of 2016/17 (Fixed line and Pbx Cost Containment Project) All departments and constitutional bodies are requested to halt fixed line procurement, as cost containment measures are undertaken by national treasury to reduce excessive government fixed line costs through transversal contracts. ( this will therefore affect PBX: Voice over internet protocol; VOIP) 4 7 /0 2 9 / 2 0 1 7 PROVINCIAL REPORTS Introduction During this reporting period, the Provincial offices formed partnerships as vastly as possible to ensure that promotion of gender equality is disseminated even at the grassroots where the information is needed. The highlights worth mentioning, relate to the Free State which formed partnership with PanSALB, among other departments, to ensure the appropriate gender equality terminology, in translating the CGE Mandate in the dominant vernacular so that the message does not get distorted during dissemination. Most of the offices that still have vacant positions such as Free State, KZN and Northern Cape are complaining that lack of capacity derail them from being fully functional in implementing the APP. They however appreciate the assistance and support they get from the Head Office and other Provinces. 40 4 7 /1 2 9 / 2 0 1 7 This reporting period also marks the beginning of consultations with the two Organisations to be monitored this financial year. Most of the Provinces have already identified and sent out the invitations and questionnaires out to the Private Sector organisations that have are invited for the Employment Equity hearings. Some provinces have received confirmations from such organisations, while others still await confirmations. Northern Cape took initiative of enforcing proactive measures of fighting gender based violence as one of the Provinces that range predominantly high on GBV. North West on the other hand should be commended with their idea of Stakeholder engagement and rolling it out across the Province, which will popularise CGE hence, and increase the number of cases reported. Collaboration with ESKOM is also acknowledged as it is a right step forward and assists mainstreaming gender within Science and 41 Technology. 4 7 / 2 2 9 / 2 0 1 7 Progress on SO 3 Assessment Reports • Still awaiting the State CEDAW report in order to finalise it Report on the African Gender Development Index- status report • The final report has been submitted to UNECA and still awaiting indication for final printing. The first quarter mainly is concerned with forging partnerships as a measure for augmenting the funding difficulties and therefore various stakeholders are met with a view to ensure collaborations etc There is further a clear improvements on control issues and all the previous audit issues have been dealt with. This will further be highlighted when the AGSA presents the audit outcomes for the Commission. The work of the Commission has steadily moved to level of excellence, and use of innovation and media to run some of the programmes has been a highlight and signifies an improvement in utilisation of media as a medium to educate and create a platform for engagement. 45 Thank you for your time HAVE A GENDER RELATED COMPLAINT ????
