RESUMPTION ACT.
Act No. 13, 1915.
An Act to divest the promoters of certain railways,
and the Australasia Coal Mining Company and
t h e Waratah Coal Company, their repre­
sentatives and assigns, of their estates in
certain lands within the area known as the
Newcastle Pasturage Reserve ; to vest certain
portions of the said area in His Majesty and
declare the same to be Crown lands within
the meaning of the Crown Lands Consolidation
Act, 1913 ; to give effect to certain sales and
disposals of lands; and for purposes consequent
thereon or incidental thereto. [Assented to,

A n d w h e r e a s by a n A c t passed in t h e t w e n t y - s e v e n t h
y e a r of t h e said reign, a n d i n t i t u l e d " A n A c t to
establish a n d i n c o r p o r a t e a c o m p a n y to be called t h e
W a r a t a h Coal C o m p a n y , a n d to a u t h o r i s e t h e m a k i n g
of a R a i l w a y for t h e purposes of t h e said C o m p a n y , " a n d
b y a n A c t passed in t h e t h i r t y - e i g h t h y e a r of t h e said
reign, a n d i n t i t u l e d "An A c t to a u t h o r i s e t h e W a r a t a h
Coal C o m p a n y to e x t e n d t h e i r line of R a i l w a y by t h e
c o n s t r u c t i o n of b r a n c h e s , " c e r t a i n lands within t h e
b o u n d a r i e s of t h e said reserve were vested in t h e
W a r a t a h Coal C o m p a n y : A n d w h e r e a s p a r t s of t h e
railways c o n s t r u c t e d u n d e r t h e said A c t s on t h e said
l a n d s , a n d k n o w n as t h e N e w L a m b t o n , H a r t l e y Vale
Colliery, A u s t r a l a s i a Coal C o m p a n y ' s a n d W a r a t a h Coal
C o m p a n y ' s railways respectively, h a v e n o t been in use
for t h e purposes for w h i c h t h e y w e r e authorised to be
c o n s t r u c t e d u n d e r t h e said A c t s for several years a n d
a r e n o t now in u s e for t h e said purposes : A n d w h e r e a s
it is desirable to divest t h e said p r o m o t e r s a n d t h e
c o m p a n i e s of t h e i r respective estates, interests, powers,
r i g h t s , a n d benefits in respect of t h e said lands, a n d
t o discharge t h e m from a n y duties, liabilities, a n d
obligations imposed b y t h e said Acts, a n d to declare
those p o r t i o n s of t h e said lands w h i c h h a v e n o t been
r e s u m e d for public purposes to be Crown l a n d s : A n d
w h e r e a s certain portions of t h e l a n d s vested i n t h e said
p r o m o t e r s w e r e sold or otherwise disposed of by t h e
Crown, a n d it is desirable to remove c e r t a i n d o u b t s
w h i c h h a v e arisen as to t h e validity of s u c h sales a n d
disposals: Be it therefore e n a c t e d by t h e K i n g ' s M o s t
E x c e l l e n t Majesty, by a n d w i t h t h e advice a n d consent
of t h e Legislative Council a n d Legislative A s s e m b l y of
NEW S o u t h W a l e s i n P a r l i a m e n t assembled, a n d b y t h e
a u t h o r i t y of t h e same, as follows :—
1. This A c t m a y b e cited as t h e " N e w c a s t l e
P a s t u r a g e R e s e r v e (Railways) R e s u m p t i o n A c t , 1915)."

2 . T h e persons referred to in t h e first above recited
A c t as p r o m o t e r s , a n d t h e i r e x e c u t o r s , a d m i n i s t r a t o r s ,
a n d assigns, a n d t h e A u s t r a l a s i a Coal M i n i n g C o m p a n y ,
t h e W a r a t a h Coal C o m p a n y a n d t h e i r respective assigns,
a n d all o t h e r persons (if a n y ) h a v i n g or c l a i m i n g a n y
estate or i n t e r e s t in t h e l a n d s described i n t h e S c h e d u l e s
A , B , C, a n d D t o t h i s A c t , are hereby divested of all
estates a n d i n t e r e s t s vested in t h e m , a n d of all p o w e r s ,
r i g h t s , a n d benefits conferred u p o n t h e m , a n d discharged
from a n y d u t i e s , liabilities, a n d obligations imposed by
t h e said A c t s respectively in r e s p e c t of t h e said l a n d s ;
a n d t h e lands described in Schedules A , D , E , a n d F t o
t h i s A c t are h e r e b y vested in H i s M a j e s t y a n d declared t o
be Crown l a n d s w i t h i n t h e m e a n i n g of t h e C r o w n L a n d s
Consolidation A c t , 1 9 1 3 , a n d a n y A c t s a m e n d i n g t h e
same, free from all t r u s t s , conditions, duties, liabilities,
a n d obligations affecting t h e said lands a n d a n y p e r s o n s
i n r e l a t i o n t h e r e t o , b u t s u b j e c t to a n y sales or o t h e r
disposals given effect t o by section t h r e e of t h i s A c t :
P r o v i d e d t h a t n o t h i n g in t h i s A c t shall a n n u l t h e
r i g h t conferred u p o n t h e W a r a t a h Coal C o m p a n y b y
t h e above-recited A c t , passed in t h e t h i r t y - e i g h t h y e a r
of t h e r e i g n of H e r l a t e M a j e s t y Q u e e n V i c t o r i a ,
to cross t h a t p o r t i o n of t h e N e w L a m b t o n r a i l w a y
described in S c h e d u l e A to t h i s A c t a t t h e p r e s e n t
i n t e r s e c t i o n of t h a t r a i l w a y b y t h e W a r a t a h Coal
Company's railway.
3 . E v e r y sale or o t h e r disposal b y t h e C r o w n of
l a n d s w i t h i n t h e railway lands described i n Schedule A
t o this A c t , and p u r p o r t i n g to h a v e been m a d e u n d e r
or b y v i r t u e of t h e N e w c a s t l e P a s t u r a g e R e s e r v e A c t ,
shall be d e e m e d to h a v e h a d a n d to have effect as if t h e
A c t t h i r t y - f i r s t V i c t o r i a first recited i n t h i s A c t h a d
n o t b e e n passed.
