Other Terms and conditions of sale of Movable & Immovable properties
belonging to M/s. Maa Samaleswari Sponge Iron Ltd.under SARFAESI Act
2002. more particularly described in the Sale Notice & our website –

The sale shall be subject to the conditions prescribed in the Security Interest (Enforcement)
Rules 2002 and to the following further conditions.
1. Bidder's submission of tenders is subject to enclosing of above DD/PO in favour of ASRECPS 02/2013-2014 Trust, payable at Mumbai
2. Offers below the reserve price / without EMD / qualified but conditional shall be
disqualified.
3. ASREC (India) Ltd/ Authorised Officer reserves the right not to accept or reject all or any
one of the bids offered, even though higher than the reserve price without assigning any
reason. ASREC (India) Ltd / Authorised Officer also reserve the right to cancel, postpone
the bid / sale process without fixing any date and/or assigning any reason whatsoever. Any
dispute arising out of sale process the decision of the Authorised Officer shall be final &
binding upon the participants / bidders.
4. Successful bidder will have to deposit 25% of the total bid amount / purchase price
(adjusting EMD) immediately on the date of acceptance of bid and balance 75% of the bid
amount / purchase price within 15 days of sale process of the Property. On failure to
honour the terms and conditions of the tender by the successful bidder, the 25% of the offer
amount or EMD (as the case may be) deposited shall be forfeited.
5. Persons interested should make their own independent inquiries as to the title of the
property and claims/dues from Govt. Semi Govt. Department if any, affecting the property.
Any statutory or other dues payable and due on these properties shall have to be borne by
the purchasers/bidders only. All the expenses of whatever nature including stamp duty,
registration charges, transfer fee, etc. of getting property transferred shall be borne by the
purchaser and ASREC (India) Ltd. shall not in any way be liable for the same. Any fees,
charges, taxes including but not limited to transfer/conveyance charges, unpaid electricity
charges, Municipal/local taxes, any 'value added tax', Stamp duty & registration charges
shall have to be borne by the purchaser only.
6. Until the sale is confirmed, ASREC (India) Ltd. reserves the right to withdraw from the
process or any part thereof, to accept or reject any or all bids at any stage of the process
and/or modify the process or any part thereof or to vary terms at any time without
assigning any reason whatsoever. No financial obligation will accrue to ASREC (India) Ltd.
in such an event.
7. The sale shall be confirmed in favour of the purchaser who has offered / timely paid the
highest sale price in his bid to the ASREC (India) Ltd./ Authorised Officer and shall be
subject to the confirmation by the ASREC (India) Ltd./ Authorised Officer.
8. On confirmation of sale, a Sale Certificate shall be issued in terms of Rule 9(6) of the
SARFAESI Act 2002 and possession of the property will be delivered.
9. Purchaser has to pay the stamp duty registration charges and other dues as applicable.
10. The Purchaser shall be delivered physical possession of the property at the sites mentioned
above after receiving full purchase price and issuance of Sale Certificate .
11. Sale shall be without recourse to the ASREC (India) Ltd./ Authorised Officer.
12. Sale is on “AS IS WHERE IS BASIS ” AND " AS IS WHAT IS BASIS"
13. If the borrower deposits the dues before acceptance of bid, ASREC (India) Ltd. / Authorised
Officer reserves the right to cancel the bid/sale.
