Purpose This document is intended to define the Newly Qualified Teacher (NQT) Induction services provided by West Sussex as Appropriate Body (AB) and associated service levels to be provided by the council, as well as the corresponding obligations of the academy. The NQT Induction services defined in this Service Level Agreement (SLA) are outlined in section 4.0 below. The SLA is based on Statutory guidance Education (Induction Arrangements for School Teachers) (England) Regulations 2012 which broadly sets out the responsibilities of the Appropriate Body and the school. 2.0 PRE-REQUISITES All NQTs registered for induction with the council must: hold full Qualified Teacher Status. have been subject to an Enhanced Level Disclosure and Barring Service check If the academy does not meet the above pre-requisite(s), then the support service(s) defined within this SLA cannot be provided by the council and this SLA will be invalidated. 3.0 AGREEMENT PERIOD This agreement between the council and the academy covers the period 1st September 2017 to 31st July 2018 unless otherwise agreed. All changes to this SLA, including those introduced by projects, will be jointly negotiated and agreed between the council and the academy. The council will be responsible for updating and issuing the revised SLA. © West Sussex County Council 2017 – do not distribute without prior written consent from document owner Page 4 of 9 Title: NQT Appropriate Body SLA Owner: Carol Vigor Version: 1.0 4.0 SERVICES TO BE PROVIDED West Sussex County Council will carry out the AB responsibilities for the Purchaser in accordance with statutory requirements and guidance and subject to the Purchaser complying with the relevant statutory regulations and guidance. 4.1 Appropriate Body Service description West Sussex County Council will: Maintain records for the named NQT(s) in line with DfE requirements. Provide telephone and email support and advice for induction tutors/mentors and head teachers with regard to NQT induction regulations and the employment of NQTs Provide advice and guidance where an NQT is experiencing difficulties. Monitor the provision of NQT induction through the scrutiny of termly NQT Induction Assessment forms. Provide NQT Mentors with access to an Induction Handbook and guidance documents for Induction mentors. Provide advice and guidance regarding the calculation of induction periods for individual NQTs Make a decision about satisfactory completion of each NQT’s induction period and complete the relevant documentation as required by the legislation, within the required timescales. Write to each NQT when the final assessment form has been received confirming whether or not the AB will be recommending that he/she has successfully completed the induction period Inform the National College for Teaching and Leadership (NCTL), or such other national body as regulation requires, of the outcome of each NQT’s induction period Retain appropriate records for such time as legislation requires (currently 6 years). Provide the NQT, in accordance with DfE regulations, a named contact within the appropriate body with whom to raise concerns which cannot be resolved by the academy © West Sussex County Council 2017 – do not distribute without prior written consent from document owner Page 5 of 9 Title: NQT Appropriate Body SLA Owner: Carol Vigor Version: 1.0 5.0 SERVICE QUALITY AND REVIEW The council will carry out a sample quality assurance exercise on an annual basis. If required, a formal review of the services provided as part of this SLA will be undertaken between the council and the academy. Any subsequent changes will then be jointly agreed between the council and the academy. The council will be responsible for updating and issuing the revised SLA. 6.0 CHARGES The academy agrees to pay the council the sum of money defined in the schedule below: Induction Period Billing Date Price Individual assessment period or part thereof (where the NQT has already completed part of their induction) At the beginning of the NQT assessment period £103 per NQT per period of assessment tbc 3 full-time assessment periods (or equivalent where the NQT is employed part-time) At the beginning of the NQT assessment period £309 for the first NQT (i.e. £103 per assessment period) tbc £90 for each subsequent NQT (i.e. £30 per assessment period) tbc Note: The whole fee for the induction of part-time NQTs is not to exceed the equivalent full time NQT fee. The charges defined in section 6.0 will be invoiced to the academy by the council at the beginning of each NQT’s induction period. 7.0 RESOLVING ISSUES & DISAGREEMENTS Any issues or disagreements between the academy and the council relating to the level or quality of services provided as part of this SLA will at first attempt to be handled by the NQT Induction Co-ordinator. If not suitably resolved the issue will be escalated as per the subsequent (descending) order of contacts as shown in section 12.0. In the event that the issue cannot be resolved through the above approach, then section 11.0 of the contract will be invoked. 8.0 COMMUNICATION Liaison between the academy and the council will normally be through the NQT Induction Co-ordinator. The academy will provide contact details of the NQT’s Mentor and/or Professional Tutor through the NQT Induction Registration form. Support and information for NQTs and mentors can be found on the NQT Support pages of WSSFS. © West Sussex County Council 2017 – do not distribute without prior written consent from document owner Page 6 of 9 Title: NQT Appropriate Body SLA Owner: Carol Vigor Version: 1.0 9.0 DIVISION OF RESPONSIBILITIES Legal and Statutory Responsibilities The Academy’s Responsibilities The Council’s Responsibilities Follow precisely the DfE requirements regarding the Recruitment and Induction of NQTs as defined by The Education (Induction Arrangements for School Teachers) (England) Regulations 2012 and the Induction for newly qualified teachers (England): Statutory guidance for appropriate bodies, head teachers, school staff and governing bodies (revised October 2014) and any subsequent amendments or revisions to the regulations, circular or guidance Support the academy in fulfilling its statutory duties regarding NQT Induction Designate appropriately qualified staff to be NQT Induction Mentors/Tutors as defined by The Education (Induction Arrangements for School Teachers) (England) Regulations 2012 and the Induction for newly qualified teachers (England): Statutory guidance for appropriate bodies, head teachers, school staff and governing bodies (revised October 2014) Monitor the provision of NQT induction through the scrutiny of termly NQT Induction Assessment forms Require appropriate staff to be familiar with the requirements for NQT Induction, the statutory regulations and guidance Provide up to date guidance on statutory requirements of induction. Provide sufficient accurate information to enable compliant and concise advice to be given regarding any issue, case or situation that may arise Provide accurate advice, support and guidance and suggestions of good practice. Confirm that each NQT has full Qualified Teacher Status Make a decision about each NQT’s induction period and complete the relevant documentation as required by the legislation within the required timescales. Ensure that before commencing induction each NQT: - has been subject to the mandatory and recommended pre-employment checks as defined by the Education (Teachers) Regulations and DfE Guidance 0278/2002 issued May 2002, ‘Child Protection: Preventing Unsuitable People from Working with Children and Young Persons in the Education service’. has been subject to an Enhanced Level Disclosure and Barring Service check - has full registration of any body as required by statutory regulations © West Sussex County Council 2017 – do not distribute without prior written consent from document owner Page 7 of 9 Title: NQT Appropriate Body SLA Owner: Carol Vigor Version: 1.0 The Academy’s Responsibilities The Council’s Responsibilities Provide names and other required details of the NQTs for whom they are requesting an Appropriate Body service Provide the NCTL with details of NQTs who have started an induction period Carry out termly Induction Assessments and forward the completed statutory termly Induction Assessment Reports within the timescales specified by the Appropriate Body Inform the NCTL (or such other national body as regulation requires) with details of NQTs who: Inform the AB where a NQT leaves the school or undergoes an alteration to their contract Make a recommendation to the appropriate body on whether the NQT’s performance against the standards is satisfactory or requires consideration of an extension have completed (satisfactorily or not) an induction period have left a school partway through an induction period Make a final decision on whether the NQT’s performance against the relevant standards is satisfactory and inform the relevant parties. Inform the NCTL (or such other national body as regulation requires) with details of NQTs who require an extension Retain all relevant documentation, evidence and report forms for such time as legislation requires (currently 6 years). Retain appropriate records for such time as legislation requires (currently 6 years). As required by the DfE Guidance, alert the AB to any potential difficulties the NQT may be experiencing, as soon as the difficulties are identified and in sufficient time for any additional support to be put in place and/or for the NQT to be made fully aware of the consequences of failure. Provide in accordance with DfE regulations a named contact with whom NQTs can raise concerns about provision relating to their induction which cannot be resolved by the academy Work in partnership with the NQT Induction Coordinator to ensure the effective delivery of NQT Induction Provide additional advice and guidance through resources such as handbooks for induction mentors and headteachers 10.0 SERVICE LEVEL PERFORMANCE Service level performance will be monitored through compliments and complaints and through customer survey feedback. © West Sussex County Council 2017 – do not distribute without prior written consent from document owner Page 8 of 9 Title: NQT Appropriate Body SLA Owner: Carol Vigor Version: 1.0 11.0 TERMINATION COSTS A termination clause exists in the form of the academy having the option to request a cessation of this service at any point within the period of this SLA. The termination costs are as follows: Where an NQT leaves the academy’s employment before completion of an induction period for which they have been registered, the charge will be rounded up to the nearest termly assessment period.
