1 Yorktown Stables Lesson Program Horse Riding & Lease Agreement THIS AGREEMENT entered into this ________ day of _____________, in the year_________, at Yorktown Stables, by and between Yorktown Stables Lesson Program/Kristen Paster, Trainer hereinafter referred to as “Lessor" and _________________________________________, hereinafter referred to as “Lessee”. "Lessor" hereby agrees to lease to "Lessee" said horse or pony subject to the following terms of this Agreement; and Whereas, Lessee warrants that s/he agrees to lease said horse subject to the following terms and conditions; The parties agree as follows: The parties agree to lease the horse or pony named, __________________________,hereinafter referred to as "Horse" and includes the following description: Name: ____________________________ Color:_________________________________ Breed: ____________________________ Sex:__________ Registration #:___________________________ DURATION AND TYPE OF THE LEASE: LEASE TERM Beginning Date Ending Date Monthly Full Lease Monthly Half Lease The term of this lease shall commence on ________________, 20____, and terminate on ____________________, 20___; unless the parties agree in writing to continue the term of this lease in which case the new term shall be attached hereto, signed and dated by both parties hereto, and these same terms and conditions shall apply thereto. The Parties agree that this Contract may be changed or terminated by the "Lessor" or the "Lessee" upon thirty (30) days notice, regardless of the leasing period. All notices must be issued in writing unless otherwise agreed upon by the parties. COST AND DESCRIPTION OF LONG-TERM LEASE: Full Lease Half Lease Includes 5 lessons/rides a week—combination at trainer’s discretion of jumping or flat lesson or trail work and ability to take horse to shows. All trail rides most be approved by trainer. Rider must also have trainer’s permission to do flat work outside of scheduled lesson times. Includes 3 regularly scheduled lessons a week and ability to take horse to shows. Lessor reserves the right to use horse in lessons or for another half-lease. USE AND CARE OF THE HORSE: $550 a month for 5 days a week. $350 per month for 3 days a week. 2 1. Lessor will be responsible for all board, blanketing, and farrier expenses if horse requires shoes. Lessee will not be required to maintain mortality or health insurance on Horse during the term of this lease. 2. All Lessees will be responsible to order Bug Off supplements from SmartPak through March-October. 3. All lease payments and additional charges are payable in advance and due on the first of the month. They are considered late if not received by the 5th. A $25.00 late fee will be charged for all payments received after the 5th of the month. Lessee shall have use of the horse according to the following terms of this agreement: 4. In the case of the full lease, Lessee will have exclusive use of “horse” on lease day, with the exception of schooling rider. In the case of half or partial leases, lessee’s will have exclusive use of “horse” on their lease day, with the exception of the schooling rider, provided their lease day is not shared with another lessee. Any lessee abusing the right of another lessee to enjoy the horse equally will have their lease terminated. 5. In the case of half or partial leases, lessees sharing a horse must work out lesson classes and horse show schedule classes with each other and trainer, in advance, so no conflicts of class entries arise. Lessees who choose to attend shows will be given priority to the horse over those lessees who do not attend the show. There are no make-up lessons when leasing. The lessee is responsible for the grooming and exercising of their horse on their lease days. If lessee is unable to groom and exercise their horse on lease day, then they must notify Kristen via text or phone call, so that she can arrange to have the horse properly cared for that day. Lessee will not be charged for any expenses incurred by trainer, due to lesson cancellation by either party. 6. 7. This agreement is non-transferable. 8. Both parties agree that the laws of the State of Virginia shall govern this lease. 9. The “Lessee” agrees that all riders with Yorktown Stables Lesson Program or on the property and/or using a horse owned by Kristen Paster, must sign the release forms. If the riders are younger than 18 years of age the rider’s parent or legal guardian must sign the release forms. 10. This contract represents the entire agreement between the parties. No other agreements, promises, or representations, verbal or implied, are included herein unless specifically stated in this written agreement. This contract is made and entered into in the state of the "Lessor's" stable, and shall be enforced and interpreted in accordance with the laws of the State of Virginia. 11. In the event one or more parts of this contract are found to be unenforceable or illegal, the other portions hereof shall be deemed in full force and effect. Specifics of a lease are determined on a case-by-case basis, but most lease arrangements follow the guidelines below: • • • • All lease prices include weekly group lessons, which will be scheduled as a lease day Lease terms must be pre-paid and are for contiguous months All leases include board, and veterinary care at no additional fee Lease prices are based on schooling level and ability of the horse and rider; ponies and horses have the same lease costs. When a horse is listed at two levels, the intended use will dictate the price of the lease. • Leased horses are also used in lessons, so regular ride days and times are scheduled at the beginning of the lease; any missed rides due to weather, illness, etc. are forfeited • If your leased horse is ill or unavailable for any reason, a replacement mount will be assigned until the leased horse returns for duty 4 • Lessees are not financially responsible if the horse becomes ill or is injured during an on-site ride • Reservations for outside rides and shows must be made separate from the lease – DO NOT ASSUME your leased horse will be available • Any show fees (transportation, off-site or full-day usage fees, accommodations) are additional to the lease cost • Changes to lease days/times can be requested in advance, but are not guaranteed and might require re-assignment of lease horse • Requests for a change in leased horse are granted at the discretion of the owner or barn manager • Leases are not guaranteed to be renewed at the end of the term and can be cancelled by the lessee or barn owner with 30-day notice Lease Types and Fees Full Lease: Lessee can ride any day of the week based on the schedule established in the lease, to include lesson days. Horses in full leases will not be used as school horses. Lease cost includes weekly group lessons and is $550 per month for a Beginner level horse and $625 per month for an Intermediate level horse. Half Lease: Lessee can ride 3 days per week based on the schedule established in the lease, to include lesson days. Only one weekend day is allowed for this lease type, whether that is a lesson day or not. Lease cost includes weekly group lessons and is $350 per month for a Beginner level horse and $450 per month for an Intermediate level horse.
