AGREEMENT FOR EMPLOYMENT OF LEGAL COUNSEL
This Flat-Fee Separation Agreement Fee Agreement (hereinafter the "Agreement"), is
made by and between Congdon law (hereinafter "Firm"), and
(hereinafter the "Client").
I.
CONDITIONS.
This Agreement will not take effect, and Firm will have no obligation to provide legal
services under this fee agreement until Client returns a signed copy of this agreement.
II.
SCOPE.
Client hires Firm to provide legal services in the following matter: Representation of
Client in the drafting of a Separation Agreement only. Firm agrees to make minor
revisions at no extra cost to Client. Firm shall determine whether requested revisions
are minor revisions. Any revisions not deemed minor shall require additional funds
from Client. Client understands that Firm will not negotiate with Client's spouse or
his/her spouse's attorney without Client signing a fee agreement for said services.
This Agreement does not include representation in any domestic matter proceedings,
appeal or any other matter not listed specifically above. Services in those additional
proceedings or any matter not described above will require a separate agreement.
III.
CLIENT.
Firm is representing only the Client in this matter, regardless of who has paid the
fee. It is understood by Client that Firm’s duty is to act in the best interest of the
Client and Firm cannot share information about Client’s case with anyone other than
Client without Client’s express permission in accordance with the Rules of
Professional Conduct.
IV.
RESPONSIBILITIES OF THE PARTIES.
Client agrees to be truthful with Firm, to cooperate, to keep Firm informed of any
information or developments which may come to Client’s attention and to abide by
this Agreement. Further, while it is impossible to predict the course of a
representation, it may be important for Firm to contact Client immediately, or upon
short notice, to confer with Client regarding the status of Client’s case. An inability
to do so may result in Client’s case being prejudiced and may detrimentally affect the
outcome of the case. Accordingly, Client agrees to keep Firm informed of Client’s
current address, telephone number and whereabouts.
V.
LEGAL FEES.
Client agrees to pay Firm a flat fee of $750.00 to draft a separation agreement. This
separation agreement will include provisions for property settlement, alimony, child
custody and child support where applicable.
VI.
DISCHARGE AND WITHDRAWAL.
Client may discharge Firm at any time. Firm may withdraw with Client’s consent or
for good cause. Good cause includes Client’s breach of this Agreement; refusal to
cooperate or to follow Firm’s advice on a material matter or any fact or circumstance
that would render Firm’s continuing representation unlawful or unethical.
VII.
DISCLAIMER OR GUARANTEE AND ESTIMATES.
Nothing in this Agreement and nothing in Firm’s statements to Client will be
construed as a promise or guarantee about the outcome of the matter. Firm makes no
such promises or guarantees. However, Firm warrants that it will use its best efforts
on behalf of the Client.
VIII.
ENTIRE AGREEMENT.
This Agreement contains the entire Agreement of the parties and there are no oral
agreements or understandings other than that which is contained herein. All
amendments, additions or changes to this agreement shall be in writing and agreed to
and signed by the parties hereto.
THE PARTIES HAVE READ AND UNDERSTAND THE FOREGOING TERMS
AND AGREE TO THEM.
