7.
This contract has no implications of renewal, promotion or permanent appointment. It is expressly agreed that
the Employee does not have any legitimate expectation of any renewal or extension of this Agreement and
his/her employment, notwithstanding any provision of this Agreement, act, expression or any statement by any
of the NUST’s officials in whatsoever capacity to the contrary; and that any renewals or extensions of term of
employment will not create any expectations or rights to permanent employment or further renewals or
extensions in the future.
8.
This contract is not valid without the signature of the Director: Human Resources and/or Deputy ViceChancellor: Academic Affairs. This Agreement and any amendment to the terms hereof are not valid unless the
signature of the Deputy Vice-Chancellor: Academic Affairs is appended thereto and the Employee
acknowledges that should he/she undertakes any duties without the signature of the Head of Department and/or
Deputy Vice-Chancellor: Academic Affairs being duly affixed hereto, he/she does so entirely at own risk.
9.
DISPUTES:
9.1
Should any difference or dispute arise between the parties under or in respect of this agreement or the
interpretation hereof or the performance by either party of its obligations hereunder, and whether during the
subsistence of this agreement or on the termination thereof provided that such dispute did not arise from the
date the cause of action arose as provided for under section 86(2) of the Labour Act, Act 11 of 2007, such
difference or dispute shall be submitted to arbitration, with both parties sharing the costs of the arbitrator, in
terms of the arbitration laws for the time being in force, unless otherwise expressly provided herein.
9.2
The Arbitrator shall be as agreed upon between the parties involved in the dispute and failing agreement in that
regard within seven days after the arbitration has been demanded, as appointment by the President of the
Namibian Law Society.
9.3
The conduct of the arbitration proceedings shall be as agreed between the parties, or failing agreement, as
determined by the arbitrator. The decision or award of the arbitrator shall be conclusive and binding upon the
parties and may be made an order of a court of competent jurisdiction.
9.4
In the event that any of the parties refer a dispute to the Office of the Labour Commissioner as provided for in
terms of the Labour Act, Act 11 of 2007, and the other party demands private arbitration as provided for under
11.1 to 11.3 above, both parties hereby agree and will confirm such agreement in writing after referral of the
dispute to the Labour Commissioner, that the conciliation and arbitration proceedings in terms of the Labour Act
will be postponed until finalisation of the private arbitration proceedings as agreed upon herein.
9.5
Both Parties agree to submit to the jurisdiction of the Magistrate’s Court of Namibia in respect of any legal
proceeding arising from the provisions of this Agreement.
10.
NOTICE PERIOD
10.1
Tutors must give 30 days’ notice to the Director: COLL of their intention to resign provided that the last day of
the notice period is at the end of an academic semester. Tutors who resign are required to submit a marking
scheme and/or memorandum in cases where they have compiled the first tutorial letter and set assignment
questions for the following semester.
10.2
Tutors must give 30 day’s notice to the Director: COLL, if s/he cannot present tutorials during the vacation
school.
10.3
Face-to-Face Tutors who cannot keep pre-arranging tutoring times must give 7 days' notice in advance to the
Regional Coordinator of the respective Regional Centre or COLL Coordinator: Academic Support.
10.4
Writers must give 30 day’s notice to the Director: COLL of their intention to resign provided that the last day of
the notice period is at the end of an academic semester.
10.5
Council or the Employee, as the case may be, may terminate employment without giving notice to the other
party, provided that the Council or the Employee, as the case may be, shall pay the other party the appropriate
remuneration which would have been payable had the required notice been given.
The Namibia University of Science and Technology will not be responsible or held accountable or liable for any
plagiarism, breach of copyright laws or illegal use of study material committed by any of its course compilers or writers.

11.
DEDUCTION OF COSTS FOR REPLACING OUTSTANDING MATERIALS
The Namibia University of Science and Technology reserves the right to deduct the cost of replacing material
originally borrowed from them and not returned on the finalisation of the contracted task. The cost will be
calculated as that which is needed to purchase a new item in replacement of that which is not returned.
12.
Both parties further agree to submit to the Jurisdiction of a Magistrate’s Court of Namibia in respect of any legal
proceeding arising from the provisions of this Agreement.

1.
Non-Namibian citizens should note that this contract shall be invalid without a work permit or proof of permanent
residence.

Forward completed and signed documents together with a completed APPLICATION FOR EMPLOYMENT
FORM or COMREHENSIVE CURRICULUM VITAE to the Director: Human Resources, for processing.
3.
All signatories of page 7 to this Agreement must initial pages 1, 2, 3, 4, 5, 6 and 8 thereof.
4.

5.
All Agreements must be accompanied by educational certificates and personal documents.
6.
Should it become known that the educational qualifications or personal documents presented by the employee
have been forged, his/her Agreement shall be terminated with immediate effect.
