“ADS-B OUT” RAFFLE TERMS & CONDITIONS Conducted by Idaho Aviation Foundation GENERAL Raffle proceeds to benefit the Idaho Aviation Foundation’s (IAF) efforts to rebuild historic Big Creek Lodge. The Idaho Aviation Foundation is a charitable non-profit 501(C)(3) organization. To be eligible, participants must be 18 years or older, a resident of the US, and abide by the terms and conditions listed in this document. Tickets will be sold for $20 each. A maximum of 1,000 tickets will be sold. Drawing date will be a date TBD in Fall 2017, but will be no later than December 22, 2017. The Prize is an ADS-B Out system and installation. This includes a Stratus ESG 1090 ES Transponder with built-in WAAS GPS; GPS antenna; and installation at Jackson Jet Center in Boise, Idaho (assumes a working Mode C transponder is installed) See website for details on the system www.appareo.com/stratus/ Winner will be selected by random drawing. All tickets sold have an equal chance to win. If any tickets are unsold, they will be withdrawn from the drawing. Drawing to be overseen by a Certified Public Accounting firm. In the event the winner forfeits the prize (see Winner Details below), a second name will be randomly drawn, and so forth until a Winner accepts the prize under the terms listed below. Winner need not be present to win WINNER DETAILS If multiple names are on the winning ticket, only the first name listed will be considered the Winner. Winner will be provided a Winner Notification Agreement (“WNA”) by Certified US Mail. Winner must notify IAF of accepting the prize by signing the WNA and returning it to the IAF via Certified US Mail or via email notification within 10 calendar days after the date the WNA was received. If the winner does not accept the prize, the prize is forfeited and no substitute prize will be provided to that person. Another name will be randomly drawn and that person will be given the opportunity to accept the prize as above. Should that person also forfeit the prize, then another random name will be drawn, and so on. Winner of the prize shall have no rights in or to the prize itself until he or she has executed the WNA and returned it to the IAF within the time indicated above and until delivery of the prize to the winner has been completed. Until that time, the prize remains sole property of Jackson Jet Center. Installation must be completed at Jackson Jet Center in Boise, Idaho by June 30, 2019. Acceptance of the prize constitutes permission for IAF and Jackson Jet Center to use the winner’s name, picture, video image, relevant quotes to promote Jackson Jet Center, Idaho Aviation Foundation and/or the Big Creek Lodge. Upon delivery, the prize will be installed in the aircraft designated by the Winner, and will have appropriate logbook documentation as an FAA-approved installation. Idaho Aviation Foundation ADS-B Out Raffle Terms & Conditions Page 1 NO WARRANTY Winner accepts the prize ‘as is’ and without recourse to the IAF or Jackson Jet Center with respect to any defect, damage, injury or other problem that may arise with respect to the prize. INELIGIBLE PARTIES Ineligible parties include members of the Board of Directors of the Idaho Aviation Foundation, and employees of Jackson Jet Center to include and immediate family members of either organization (defined as spouse, parents, brothers, sisters, children, grand-children, and ‘step’ and adoptive relationships) TICKETS A ticket represents a chance to win the opportunity to accept the specific prize listed above. A ticket is the official raffle entry that includes entry contact information which is provided by the entrant for the actual drawing. All sales of tickets are final, and no refunds will be paid. A ticket that was issued in exchange for a check returned for ‘insufficient funds’ or for a credit card that was ‘declined’ or invalid, stolen, or voided cannot be a winning ticket. TAXES & OTHER COSTS The IRS has ruled that a payment for a raffle ticket of this nature is a tax-deductible charitable contribution to the fullest extent of the law. In other words, the winner of the prize would not be eligible for a tax deduction, but non-winners would likely be able to do so. Consult your tax accountant. Winner is responsible for state taxes, and may be responsible for some extra costs if the avionics panel has space or power limitations, or has no transponder today. Jackson Jet Center will assess the aircraft and advise the winner of extra costs prior to commencing the installation. Winner is responsible for re-positioning the aircraft to and from Jackson Jet Center (KBOI) in Boise for the installation, and all costs associated (including but not limited to fuel, oil, etc). The value of the prize is includible in the winner’s gross income, and may be subject to reporting by the IAF to the IRS. Each winner is solely responsible for payment of all federal, state and/or local income, sales or use taxes due to his or her acceptance of the prize. The winner of the prize agrees that the value of the prize reported by the IAF for income tax and other purposes will be based on the value of the parts and labor provided by Jackson Jet Center.
