WINTERANDALL-SEASONSRECREATIONALACTIVITIESWARNING,ASSUMPTIONOFRISK,
FULLRELEASEOFLIABILITY&INDEMNIFICATIONAGREEMENT
1.
The person for whom this Season Pass (“Pass”) is purchased shall be referred to hereinafter as
“Participant”.“TheUndersigned”meansonlytheParticipantwhentheParticipantisage18orolderORitmeans
boththeParticipantandtheParticipant’sparentorlegalguardianwhentheParticipantisundertheageof18.The
Undersigned agree and understand that participating in SKIING (on any type of device to slide on snow or ice),
SNOWBOARDINGandUSINGSKIAREAFACILITIES,includingtheLIFTS,TERRAINPARKSandRACECOURSESfor
anypurpose,andparticipatinginALLOTHERRecreationalactivitiesavailablethroughthePass,includingBUTNOT
LIMITED TO, riding a MOUNTAIN COASTER, ALPINE SLIDE, or ZIPLINE, biking on MOUNTAIN BIKE TRAILS and
DOWNHILL COURSES, CLIMBING, BUNGY JUMPING, TUBING and riding in RESORT VEHICLES (hereinafter all
named and unnamed referred to jointly as “ACTIVITY”) can be HAZARDOUS AND INVOLVES THE RISK OF
PHYSICALINJURYORDEATH.

TheUndersignedrecognizethatFALLSANDCOLLISIONSoccurandINJURIESareacommonandordinary
occurrenceoftheACTIVITY.RECOGNIZINGTHESERISKS,theUndersignedVOLUNTARILYCHOOSESTOTAKEPART
IN THE ACTIVITY. Additionally, because of the related risks, the Undersigned AGREES they are RESPONSIBLE for
obtaininglife,accidentandhealthINSURANCEBEFORETHEYoranyMINORPARTICIPATEintheACTIVITY.

InconsiderationofallowingParticipanttoparticipateintheACTIVITYtheUndersignedagreetoASSUME
ALLRISKSassociatedwiththeUndersigned’sparticipationintheACTIVITY.Additionally,theUndersignedhereby
agree to FULLY RELEASE, DEFEND AND INDEMNIFY Purgatory Recreation I, LLC and Purgatory Recreation
Management,LLC,(jointlyd/b/a“PurgatoryResort”),SipapuRecreationDevelopment,II,LLC,d/b/aSipapuSki&
SummerResort,PajaritoRecreation,LP,d/b/aPajaritoMountainSkiAreaandArizonaSnowbowlResort,L.P.,their
affiliated organizations and companies, the United States, its agencies, and all of their respective insurance
carriers, agents, employees, representatives, assignees, officers, directors, and shareholders (each and all
hereinafterjointlyandindividually“RELEASEDPARTY”)fromANYANDALLLIABILITIESand/orclaimsforINJURY
ORDEATHtopersonsordamagetopropertyarisingfromParticipant’sengagementintheACTIVITY,INCLUDING
THOSECLAIMSBASEDONANYRELEASEDPARTY’SALLEGEDORACTUALNEGLIGENCE,BREACHOFCONTRACTOR
STATUTEORBREACHOFANYEXPRESSORIMPLIEDWARRANTY.

Bysigningthisagreement,theUndersignedAGREENOTTOSUEanyRELEASEDPARTYandagreetheyare
releasing any right to make a claim or file a lawsuit against any RELEASED PARTY. The Undersigned further
AGREE TO DEFEND AND INDEMNIFY each RELEASED PARTY for any and all claims of the Undersigned and/or a
THIRDPARTYarisinginwholeorinpartfromtheUndersigned’sparticipationintheACTIVITYandAGREETOPAY
allcostsandattorney’sfeesincurredbyanyRELEASEDPARTYindefendingaclaimorsuitrelatedinanywayto
Undersigned’suseofthePass.
5.
In consideration of using the Pass to access ski area facilities and participating in the ACTIVITY, the
UndersignedagreethatANYANDALLCLAIMSforinjuryand/ordeatharisingfromuseofthePassorparticipation
intheACTIVITYshallbeGOVERNEDBYTHELAWSOFTHESTATEINWHICHTHEPARTICIPANTISUSINGTHEPASS
atthetimeanyinjury,deathorotherclaimarisesandEXCLUSIVEJURISDICTIONofanyclaimorlawsuitshallbein
theSTATEDISTRICTCOURTOFTHECOUNTYWHEREtheaccident,injury,deathorotherCLAIMOCCURRED.
6.
InthecaseofaMINORParticipant,theUndersignedparentorlegalguardianacknowledgesthathe/sheis
alsosigningthisAgreementonbehalfoftheminorandthattheMINORSHALLBEBOUNDbyallthetermsofthis
Agreement,includingtheRELEASE.Additionally,BYSIGNINGTHISRELEASEASTHEPARENTORLEGALGUARDIAN
OFAMINORParticipant,THEPARENTORLEGALGUARDIANUNDERSTANDSTHATHE/SHEISWAIVINGCERTAIN
RIGHTSONBEHALFOFTHEMINORTHATTHEMINOROTHERWISEMAYHAVE.TheUndersignedparentorlegal
guardian agrees that, but for the foregoing, the minor Participant would not be permitted to participate in the
ACTIVITY accessed through the use of this Pass. By signing this Agreement without a parent or guardian’s
signature,theParticipantrepresentsthattheyareatleast18yearsofage,and,ifsigningastheparentorguardian
ofaminorParticipant,yourepresentthatyouaretheLEGALparentorguardianoftheminorParticipant.
7.
TheUndersignedunderstandandacknowledgethatthisAGREEMENTISACONTRACTandshallbebinding
tothefullestextentpermittedbylaw.IfanypartofthisAgreementisdeemedtobeunenforceable,theremaining
termsshallbeanenforceablecontractbetweentheparties.ItistheUndersigned’sINTENTthatthisAgreement
shall be binding upon the assignees, subrogors, family members, heirs, next of kin, executors and personal
representativesoftheUndersignedandthatitINCORPORATESalltermsoftheSEASONPASSHOLDERRULESAT
EACHRESORT.
8.
TheUndersignedacknowledgeandunderstandthatthedescriptionoftheRISKSLISTEDABOVEARENOT
COMPLETEandthatparticipatingintheACTIVITY,whetherornotdescribed,maybeDANGEROUSandmayalso
includeriskswhichareinherentand/orwhichCANNOTBEREASONABLYAVOIDEDwithoutchangingthenatureof
theACTIVITY.Bysigningthisdocument,theUndersignedrecognizeandAGREEthatpropertyloss,injury,serious
injuryanddeathareallpossiblewhileparticipatingintheACTIVITY.RECOGNIZINGTHERISKSANDDANGERS,the
Undersigned UNDERSTAND THE NATURE OF THE ACTIVITY AND VOLUNTARILY CHOOSE FOR Participant TO
PARTICIPATE AND EXPRESSLY ASSUME ALL RISKS AND DANGERS OF THE ACTIVITY, WHETHER OR NOT
DESCRIBEDABOVE,KNOWNORUNKNOWN,INHERENTOROTHERWISE.
9.
TheUndersignedAGREESthatthisAGREEMENTisEFFECTIVEduringEACHANDEVERYUSEofthePASS
granted herein UNTIL REVOKED IN WRITING BY THE UNDERSIGNED and COUNTERSIGNED by an AUTHORIZED
REPRESENTATIVEofEACHSkiAreaRELEASEDPARTY.
IHAVECAREFULLYREADTHEFOREGOINGSEASONPASSUSEWARNING,ASSUMPTIONOFRISK,FULL
RELEASE OF LIABILITY AND INDEMNIFICATION AGREEMENT FOR BOTH WINTER AND OTHER
RECREATIONALACTIVITIES.IUNDERSTANDTHEIRCONTENTS,ANDAMAWARETHATIAMRELEASING
CERTAINLEGALRIGHTSTHATIORANYMINORFORWHOMIAMSIGNINGOTHERWISEMAYHAVE.
2016-2017SEASONPASSHOLDERRULES
ThefollowingrulesandconditionsarethetermsforallPassuseandpurchases.Byreadingandacknowledgingthesame,the
purchaseragreesandacceptshis/hercontractualobligation.

ThisPassshallremainthepropertyofeachinvolvedskiarea(identifiedasaReleasedPartyintheapplicableSeasonPass
Warning,AssumptionofRisk,ReleaseofLiabilityandIndemnificationAgreement)andisNOTTRANSFERABLEANDNONREFUNDABLE.

IFTHEPASSISUSEDBYANYONEOTHERTHANTHEPERSONNAMEDTHEREON,OR,IFTHEREISMISREPRESENTATIONOF
AGEORDEPENDENTSTATUSITWILLRESULTINTERMINATIONOFLIFT/PASSPRIVILEGESAND/ORPROSECUTIONUNDER
THEAPPLICABLESTATESTATUTES.

NOWARRANTYISEXPRESSEDORIMPLIEDASTOWEATHERCONDITIONSWHICHCANVARYGREATLYAND
AFFECTDAILYORSEASONALOPERATION.
4.
UNSAFEACTSWILLRESULTINPARTIALORPERMANENTLOSSOFLIFT/PASSPRIVILEGESWITHNOCOMPENSATION.DUE
TO PARKING CAPACITY LIMITS, PARKING PRIVILEGES AT THE SKI AREA ARE NOT GUARANTEED TO SEASON PASS
HOLDERS.
5. A SEASON PASS MAY BE USED ONLY BY THE RIGHTFUL OWNER. The Pass must be shown to the ticket checker or lift
attendant prior to boarding any lift in Winter or using any Recreational Activity. Refusal to comply will be considered
misuseofthePassandthePassmayberevokedwithoutrefund.BrokenorscratchedPasseswillnotbeaccepted.Ifthere
isanotablechangeinyourappearance(i.e.,shavedhead),youmaybeaskedtoreturntotheTicketOfficetohaveanew
phototaken.

Public vulgarity and/or threatening gestures to ANY employee or guest will result in LOSS of Pass privileges. The
Participant understands that entering or skiing in a “CLOSED” area IS ILLEGAL. The ski area operator at the involved ski
area shall have the right to confiscate or revoke the privileges conferred by the Pass where in the sole judgment of its
representative the Participant: 1) acts in any manner that endangers or may endanger the safety of Participant or any
other person; 2) violates the law; 3) provides ski lessons or related services for compensation without express
authorization;or4)engagesinmisconductorcreatesanuisance.Suchactsmayalsobeprosecutedasacriminaloffense.
ThePassmaybeconfiscatedwithnore-issue,ifinthesolejudgmentofarepresentativeoftheskiareaoperatoratthe
involvedskiarea,itisusedinafraudulentmanner.
7.DONOTFORGETTOBRINGYOURPASS.Ifyoudoforget,youwillbechargedafeeforadailyreplacementticketatthe
applicableskiarearate.LostorStolenPassesmustbereportedimmediatelytotheTicketOfficeoftheinvolvedskiarea.
Unlessreportedlostorstolen,theuseofthePassbyanindividualotherthantherightfulownerwillbeconsideredmisuse
andthePasswillberevoked.AlostorstolenPasswillbereplacedonetimeonly.AREPLACEMENTFEEwillbechargedat
thattime.
8. Members of the Patrol or other representatives of any Released Party may revoke the Pass if the passholder skis in
unauthorized areas or commits any act that endangers himself/herself or others. Also, this Pass may be revoked if the
passholderdamagesskiareapropertyorisanuisancetootherguestsand/orskiareastaff.Repeatedfailuretocomply
withthestandardsofskiing/ridinginSLOWZONESwillresultinthePassbeingrevoked.Otherviolationsmaybesubject
toForestServicerules,andmayinvolvefinesand/orlossofprivileges.TheParticipantisadvisedthatDURINGWINTER
ACTIVITIESsnowmobiles,snowmaking,andsnow-groomingequipmentmaybeENCOUNTEREDATANYTIME.
9.TheParticipantAGREESTOREADandCOMPLYWITHALLRULEScontainedinSIGNAGEattheLOCATIONoftheENTRYto
eachSKILIFTandEACHRECREATIONALACTIVITY.TheParticipantrecognizesthatHELMETSAREREQUIREDonziplines
and HIGHLY RECOMMENDED for skiing, snowboarding, mountain biking and diggler riding and that Participant should
considerwearingahelmetandbodyarmorATALLTIMESwhileparticipatingintheACTIVITY.TheUndersignedrecognize
thatwhenDOWNHILLBIKINGANDDIGGLERRIDING,bodyarmorisHIGHLYRECOMMENDEDandParticipantshouldwear
bodyarmorATALLTIMESwhileparticipating.TheUndersignedunderstandandagreethatahelmetand/orbodyarmorIS
INNOWAYAGUARANTEEOFSAFETY,andthatnohelmetorbodyarmorcanprotecttheweareragainstallforeseeable
impactstotheheadand/orbody,andthatmanyoftheeventsincludedintheACTIVITYandotherrelatedactivitiescan
exposetheusertoforcesthatexceedthelimitsofprotectionprovidedbyhelmetand/orbodyarmor.TheUndersigned
alsounderstandthatthehelmetand/orbodyarmorDOESNOTGUARDAGAINSTinjurytotheneck,spine,oranyother
partofthebody,andthattheselimitationsareINHERENTRISKSoftheACTIVITY.
10. ADDITIONALAGREEMENTWHENUSINGTHESEASONPASSINCOLORADO:Loadingaliftwhileintoxicated,leavingthe
sceneofacollisionofwhichyouareinvolved,duckingboundaryropesorskiingorsnowboardinginanyclosedareasare
violationsofPurgatoryResort’sregulationsandColoradoSenateBill90-80.SuchviolationsareaClass2pettyoffenseand,
uponconviction,maybepunishedbyaFINEOFUPTO$1000.Theaboveviolations,aswellasrecklessorcarelessskiingor
snowboardingandcuttingliftlines,willresultinthelossofyourseasonPasswithoutrefund.
ADDITIONALAGREEMENTWHENUSINGTHESEASONPASSINNEWMEXICO:AlluseofthisPassissubjecttoNMSA§2415-1etseq.(theNewMexicoSkiSafetyAct)andmaybesubjecttoCodeofFederalRegulations§261andTheSkier
ResponsibilityOrdinanceofTaosCounty.
ADDITIONALAGREEMENTWHENUSINGTHESEASONPASSINARIZONA:AlluseofthisPassissubjecttoA.R.S.§5-701et
seq.(2012).
11.TheParticipantgivesFULLPERMISSIONforanyReleasedPartytouseANYAUDIOORVISUALMATERIALSof
theParticipantoranyminor(s)takenattheresort,andbysigningbelow,releasetheuseofanyaudioorvisual
materialstaken,oronfile,foranyusesbyanyReleasedPartyofmeormychild(ren).Iunderstandthatall
saidimagesandsoundrecordingsshallconstitutethepropertyofanyReleasedParty,solelyandcompletely.
12.The Participant represents that he/she are in good health and there are no special problems associated with his/her
participation.TheParticipantauthorizeanyRELEASEDPARTYand/ortheirauthorizedpersonneltocallformedicalcare
for the Participant or to transport the Participant to a medical facility or hospital if, in the opinion of such personnel,
medical attention is needed. The Participant agrees that upon his/her transport to any such medical facility or hospital
thattheRELEASEDPARTYshallnothaveanyfurtherresponsibilityfortheParticipant.Further,theParticipantagreesto
payallcostsassociatedwithsuchmedicalcareandrelatedtransportationprovidedfortheParticipantandshallindemnify
andholdharmlesstheRELEASEDPARTYfromanycostsincurredtherein,oranyclaimsarisingtherefrom.
13.Thisyear’sSeasonPassexpiresonthelastdayofthe2016-2017Winterseason.EachinvolvedskiareareservestheRIGHT
TOREVOKEyourPassWITHOUTAREFUNDforviolationofanyoftheaboverulesandconditions.Anyviolationofthe
above rules may be subject to criminal penalties under applicable State and Federal laws. Use of the Pass by someone
otherthanthepassholdermayresultinarrestandlossofthePassfortheremainderoftheseason.
