GENERAL INFORMATION These general terms and conditions apply to unaddressed mail. In addition to these general terms and conditions, the rules set out in ‘Post Danmarks Kundehåndbog for Adresseløse Forsendelser’ (Post Danmark’s Customer Guide for Unaddressed Mail) apply. Unaddressed mail may contain insert(s). Where inserts are not published for part of the sender’s business, the unaddressed mail may contain a maximum of five inserts, and enveloping is not allowed. 1 DEFINITION For further information about the conditions established for suitability for mechanical processing, reference is made to Post Danmark’s Customer Guide for Unaddressed Mail. Unaddressed mail is mail bearing no name or destination address, as well as mail bearing an address but no name. Unaddressed mail may take the form of e.g. advertising material, specimen copies of magazines etc. of uniform weight, format, contents and layout for distribution to a group of recipients in Denmark. Unaddressed mail is delivered in the ‘MED RUNDT’ wrapper. Unaddressed mail distributed to recipients who have registered for the “Reklamer – Nej tak” (Ads – no thanks) or “Reklamer og ugeaviser – Nej tak” (Ads and free newspapers – no thanks) schemes are delivered in a wrapper without advertising material. Unaddressed mail can be delivered in various variants, such as Household Direct, Unaddressed Mail PLUS, Segmented Unaddressed Mail, Distribution with Opt-out Scheme. For further information about these variants, reference is made to Post Danmark’s Customer Guide for Unaddressed Mail and ‘Retningslinjer for adressefiler’ (Guidelines for Submission of Electronic Address Files). 1.1 DIMENSIONS AND WEIGHT The unaddressed mail must comply with the following requirements as regards dimensions and weight. Paper quality (g/m2) * Weight (g) Minimum 100 g/m2 None Maximum g/m2 250 250 g Dimensions (height/spine x width x thickness) 14.5 x 9 x 0.03 cm 36 x 26 x 0.5 cm. * (1 m2 is equivalent to 16 A4 sheets). Unaddressed mail consisting of single sheets must be printed on paper with a minimum grammage of 100. To facilitate processing, unaddressed mail weighing more than 100 g must measure at least 27.0 x 18.9 cm. Unaddressed mail is packed mechanically by Post Danmark, and the unaddressed mail must be suitable for mechanical packing. Enveloped unaddressed mail must always be tested for mechanical packing and approved by Post Danmark before conclusion of a distribution agreement. Whether or not unaddressed mail is suitable for mechanical processing is always for Post Danmark to decide. 1.2 VERSION MAIL Version mail means mail advertising for a chain, but where the individual shop in the chain has a special marking such as, for example, a name, address or logo which is printed on the unaddressed mail, directing recipients to the nearest shop. Distribution of version mail, including distribution of more than one version in the same postcode area within the same distribution period, or of more than ten versions within the same distribution period is subject to the prior written approval of Post Danmark. 2 DISTRIBUTION 2.1 NOTIFICATION Regardless of the period of distribution, notification of unaddressed mail must be given by Monday three weeks before the first day of distribution. Post Danmark makes reservations for sold-out distribution periods. Customers who enter into an annual agreement with Post Danmark on the distribution of more than 500,000 pieces of unaddressed mail must, by the time of the agreement entering into force at the latest, submit a production plan setting out, as a minimum, orders in the form of requested distribution periods, distribution areas, impressions, weight and number of versions. A production plan template can be obtained from Post Danmark. 2.2 DISTRIBUTION PERIODS Unaddressed mail is distributed TuesdayWednesday or Thursday-Friday, however, subject to public holidays or other special days. See all details about the distribution periods in Post Danmark’s distribution and drop-off calendar, which can be found at www.postnord.dk/produktinformation. 2.3 RECIPIENT GROUPS Recipient groups are described in Post Danmark's Customer Guide for Unaddressed Mail. On Tuesday-Wednesday, distribution is made Households in multi-storey buildings Single-family and terraced houses Offices Shops Farmers Distribution to recipients registered for the ‘Nej tak’ schemes also takes place on Wednesdays. On Thursday-Friday, distribution is made to the following recipient groups: All households Households in multi-storey buildings Single-family and terraced houses Farmers 2.4 THE “REKLAMER – NEJ TAK” (ADS – NO THANKS) OR “REKLAMER OG UGEAVISER – NEJ TAK” (ADS AND FREE NEWSPAPERS – NO THANKS) SCHEMES By signing the customer agreement, senders declare that they will respect the wish of recipients that are registered under the “Reklamer – Nej tak” (Ads – no thanks) or “Reklamer og ugeaviser – Nej tak” (Ads and free newspapers – no thanks) schemes. The guidelines issued by the Consumer Ombudsman and applicable from time to time can be viewed at www.forbrugerombudsmanden.dk/Retningslin jer-og-lovgivning. 2.5 ORDERED VOLUMES As a basic rule, distribution requires a minimum net order volume of 5,000 pieces per order, however with the following exceptions: For version mail, the minimum net order volume is 5,000 pieces per version. For Household Direct and Unaddressed Mail PLUS, the minimum net order volume is 10,000 pieces. 2.5.1 DISTRIBUTION OF ORDER VOLUMES OF UNDER 5,000 PIECES OF MAIL Post Denmark offers distribution to small Danish island communities (Island Service), parishes (Parish Distribution) as well as a small number of whole postcodes (Local Distribution) even though the order volume is less than 5,000 pieces. Such distribution is subject to separate terms and conditions, which are available at www.postnord.dk/fb. to the following recipient groups: All households ________________________________________________________________________________________________ ________________________________________________________________________________________________ Page 2of 3 UNADDRESSED MAIL P O ST D ANM A R K A /S G E N ER AL T ERM S A N D C O N DI TI ON S VA LI D FR OM 1 J A N UA RY 20 17 3 DROP-OFF 3.1 DROP-OFF LOCATION Unaddressed mail must be dropped off at Distribution Services A/S, Borgmester Christiansens Gade 51, 2450 Copenhagen SV, Denmark. 3.2 DROP-OFF TIME Unaddressed mail can be dropped off Monday-Friday from 8:00 to 15:30 hours at Distribution Services A/S. When the mail is dropped off, the driver must present a consignment note as well as a sample of the unaddressed mail. Payment cannot be made in cash. 0.50% Any surplus will be destroyed after end of production. For version mail, the number of extra impressions is based on the order volume for the individual versions and not the total order volume. Latest drop-off Post Danmark reserves the right to reduce the distribution area if the number of pieces of unaddressed mail dropped off is not sufficient, given the order volume. Wednesday at 15:30 hours in the week before distribution 4 RIGHT OF DISPOSAL Friday at 15:30 hours in the week before distribution The earliest and latest drop-off times may vary in connection with public holidays. For a complete overview of distribution periods and drop-off times, see ‘Post Danmark’s Omdelingog indleveringskalender’ (distribution and dropoff calendar) at www.postnord.dk/produktinformation. 3.3 PACKING OF PALLETS AND UNADDRESSED MAIL Pallets and unaddressed mail must be packed in compliance with Post Danmark’s guidelines as set out in Post Danmark’s Customer Guide for Unaddressed Mail. A receipt is given for unaddressed mail dropped off. If, in connection with processing of unaddressed mail dropped off, the mail is found not to be suitable for mechanical processing, this will result in either nondistribution of the mail or lower quality than otherwise possible of the processed mail. The sender will be invoiced for additional costs incurred when mail is unsuitable for mechanical processing. 3.4 EXTRA IMPRESSIONS To ensure that a sufficient number of pieces of unaddressed mail are available for distribution, when considering any waste and shrinkage in connection with the mechanical processing of the mail, senders must drop off a certain number of extra impressions as follows: An order is considered to have been placed upon receipt of an order confirmation from Post Danmark. Orders are not binding for Post Danmark until confirmed by Post Danmark. Only confirmed orders can be dropped off for distribution. Payment is always charged for cancelled orders, with different amounts being charged depending on whether cancellation is made before or after the deadline for notification of changes. For Unaddressed Mail PLUS, regardless of when an order is cancelled, payment is also charged for address scrubbing at the applicable rates if a scrubbed file has been delivered to the sender prior to the cancellation of the order. Address files provided by the customer may only be used to address the planned mailing, may not be disclosed or handed over to third parties and must be deleted after use. Senders may change their orders free of charge up until the deadline for notification of changes, and subject to payment of a fee after the deadline for notification of changes. Orders are changed upon written request to Post Danmark. 5 PRICE A list of the prices and fees payable from time to time for unaddressed mail, including cancellations/changes as well as the relevant supplementary services can be found at www.postnord.dk/erhverv/prices. Senders are invoiced for the final order volumes distributed. If the order volume is reduced from the time of the confirmation of the order and until the distribution period – for example due to an increase in the number of recipients registered for the “Reklamer – Nej tak” (Ads – no thanks) or “Reklamer og ugeaviser – Nej tak” (Ads and free newspapers 6 TERMS OF PAYMENT 7 COMPENSATION Post Danmark accepts no liability for any nondistribution or wrong distribution, loss, damage or delay of unaddressed mail for whatever reason, but compensation may be offered for any such incident. Compensation is paid in cash and to the extent following from the guidelines below: 7.1 NON-DISTRIBUTION OR WRONG DISTRIBUTION In the event of non-distribution or wrong distribution of a number of pieces of unaddressed mail, equating to more than 1.5% of the total number of pieces of mail for distribution, Post Danmark makes a refund of the price charged for distribution of the affected pieces of unaddressed mail. This also applies to wrong distribution (distribution to another distribution area) of version mail. No other forms of damages or compensation are offered in connection with non-distribution or wrong distribution 7.2 LOSS OR DAMAGE In the event of loss of or damage to a number of pieces of unaddressed mail, equating to more than 1.5% of the total number of pieces of unaddressed mail for distribution, Post Danmark will make a refund of the price charged for distribution of the lost or damaged pieces of unaddressed mail and also cover any reasonable costs incurred by the sender in connection with the production of new pieces of unaddressed mail. No other forms of damages or compensation are offered in connection with loss or damage. DELAY In the event of delayed distribution of a number of pieces of unaddressed mail, equating to more than 1.5% of the total number of pieces of unaddressed mail for distribution, Post Danmark will make a refund of the price charged for distribution of the delayed pieces of unaddressed mail as set out in the table below. No other forms of damages or compensation are offered in connection with delayed distribution. 7.4 FORCE MAJEURE Post Danmark offers no compensation if nondistribution or wrong distribution, loss, damage or delay is due to force majeure, including disruption to normal communication, or can be attributed to the sender's circumstances (including the circumstances of any subsuppliers or printing companies). 7.5 THE RECIPIENT'S CIRCUMSTANCES ETC. Post Danmark pays no compensation if nondistribution is due to distribution being hampered by the recipient’s circumstances, or if distribution is associated with physical or mental risk, for example due to untethered snappish dogs at delivery addresses, lack of clearing of snow/gritting, spiteful or otherwise offensive/threatening behaviour. 7.6 SENDER’S LIABILITY The sender is obliged to indemnify Post Danmark for any loss incurred by Post Danmark as a result of non-compliance with the requirements set out in these General Terms and Conditions regarding the contents and packing of pieces of unaddressed mail. Moreover, the sender is liable in damages in accordance with the general rules of Danish law. ________________________________________________________________________________________________
