1. Slashed Insurance Premium Rate from Balens
Always good to be able to give out news that will save all members their hard earned money.
In June 2005 there will be a reduced annual rate of £49.50 for all levels of membership. In addition
to the existing cover this will offer the ASK member £2.5m Professional indemnity and public
liability cover, plus unlimited defence costs. ASK were able to negotiate this fantastic rate because
the quality of the ASK accredited tutors, schools and training courses produces quality practitioners.
Balens will be sending out further information to all ASK members who belong to the

2. Fantastic Day for Health Freedom
This information has previously been sent out to those members who have sent in their

The European Court of Justice's Advocate General Geelhoed has provided his opinion today. His opinion was
read out in the European Court in Luxembourg at 08.30 h this morning Please find our Press Release on the

ADVOCATE GENERAL FINDS FOOD SUPPLEMENTS DIRECTIVE INVALID UNDER EU LAW
ALLIANCE FOR NATURAL HEALTH SET TO WIN ITS LANDMARK CHALLENGE TO THE EU FOOD
SUPPLEMENTS DIRECTIVE
There was tremendous news today for the millions of people in Europe who choose to use food supplements.
Following a landmark challenge in the European Courts of Justice (ECJ) brought by the Alliance for Natural
Health and Nutri-Link Ltd to the contentious Food Supplements Directive, which effectively proposed to ban
75% of vitamin and mineral forms, Advocate General Geelhoed, the senior adviser to the ECJ, gave his
Opinion in favour of the Alliance’s case.
What does this mean? That the chances of consumers being able to continue using the natural food
supplements they believe are beneficial to their health are now greatly increased. There has been uproar
about the proposed EU ban, and maybe, against the odds, the consumer is going to come out on top in what
is a remarkable modern day case of David and Goliath.
Advocate General concluded that:


The Food Supplements Directive infringes the principle of proportionality because basic principles of
Community law, such as the requirements of legal protection, of legal certainty and of sound
administration have not properly been taken into account.
It is therefore invalid under EU law.
It should be stressed that the Advocate General’s pronouncement is not a ruling. That will come from the ECJ
judges, later - probably around June. But typically, in the vast majority of cases, the Court Judgment follows
the recommendations of the Advocate General.
If the Advocate General’s recommendations are adopted, in effect, the ban on vitamin and mineral forms not
included on the EU’s ‘Positive list,’ due to come into effect on 1 August 2005, will be declared illegal. In
essence, the positive list of allowable nutrient forms will be deemed to be too narrow, too restrictive, and
based on flawed science.

This would avoid the totally irrational situations that the Food Supplements Directive would otherwise create.
For example, synthetically produced selenium would have been allowed on the positive list, while the natural
source found in Brazil nuts would not; synthetic forms of Vitamin E (often used in ‘adverse’ vitamin studies
reported in the media) would be allowed, but the natural, most beneficial food forms would not.
An outstanding moment for the Alliance for Natural Health
The Alliance for Natural Health (ANH) is a Europe-wide professional organisation dedicated to ensuring that
good science and good law are applied to regulation affecting the leading edge of natural health. If the
Advocate General’s recommendations are endorsed by the ECJ judges, it will represent the culmination of
three years dogged determination, dedication and hard work on the part of ANH and its many supporters
around the world.
Supporting safe supplements
ANH supports many aspects of the Directive, and firmly endorses the banning of ingredients that are
patently not safe, stating that existing UK and EU food law already provides perfectly effective protection
from unsafe products getting onto the market. Furthermore, ANH says that it is not scientifically rational
to classify an ingredient as being unsafe without taking dosage levels into account, something that was
not a condition of being admitted onto the positive list.
ANH believes that a far more appropriate system for banning any substances that might pose a risk to
health would be to produce a ‘Negative list’ for ingredients where there was proper evidence of lack of
safety. The system proposed by the EU was going to ban ingredients on the basis that companies did
not have the financial capacity to meet the high data threshold required for the scientific dossiers
demanded by EU authorities. In this way, ingredients that have been part of the human diet for
thousands of years, and which are increasingly difficult to derive from conventional foods, would be lost,
and would not be able to be supplemented.

Further legislative proposals by the EU are due to be considered by the European Parliament later this
and next year. These include restrictions on maximum dosages of vitamins and minerals and restrictions
on health claims of foods. Again, the ANH is working to help positively shape such legislation using its
mantra of ‘good science and good law’.
Remember the day we marched from Hyde Park Corner to Trafalgar Square? It was a
beautiful day, wonderful atmosphere with lots of fun and good humour from the marchers and the
slightly bemused on looking public “Wotcha marchin’ for darlin – and when told got the reply
“goodonyer” was one of my many experiences.
Let’s hope common sense rules and we continue to achieve more positive outcomes.
3. Free Videos – Metabolics Seminars
Clive Bingham, the managing director of marketing for Metabolics, has kindly donated videos from
last years Metabolics’ seminars to be made available to ASK members. The titles we currently have
are:



If you would like to borrow any of the titles all you need to do is put in a request to the ASK office
and they will be sent to you directly. You may borrow them for a period of 4 weeks before needing
to return them to the ASK office.
4. ASK Day Events 11th June
Our two main speakers are:
 Dr Diana Samways the author of “I’m a Patient – Get Me Out of Here
Dr Diana Samways is a conventionally trained Doctor, in 1984 she changed track, from general
practice to Alternative and Holistic Medicine. She has a particular interest in bowel and allergy
problems and why many allergies mimic other conditions and some masquerade as addictions. Dr

Samways is a public speaker, broadcaster and writer on health matters, she has an interest in
dowsing, houses, earth energies and other ancient mysteries which may affect health. Her other
pursuits include personal growth and the journey of life, classical music, friends and bridge. She runs
a practice in Haslemere, Surrey. A flyer is enclosed containing details of her book and Diana will be
bringing copies to the ASK Day.

Antony Haynes the author of The Insulin Factor. Antony has sent us in this information re
his topic:

5. Professional Training Day Programme 12th June
Dr Richard Cook, our ASK Day Master of Ceremonies, is a diplomate of the International College of
Applied Kinesiology. He has a highly successful chiropractic practice in Middlesex and it is with
great pleasure that we can announce he will be taking the morning session.
Richard’s topic is:
 “A Question of Balance” when he will be exploring muscle balance and feed-back control,
involving new information from the Applied Kinesiology update seminars. Richard will be
illustrating this with many of his personal anecdotes, delivered in his own inimitable style –
and he promises us time to work-shop the material.
Trevor Gale, an ASK Trustee, a highly skilled and innovative kinesiologist and an ASK approved
tutor, will be making a welcome return for the afternoon session. This year, Trevor continues with
his exploration of the field of electromagnetic therapy. Trevor will be sharing his knowledge re:
 Cranial corrections using magnets

Reactive Muscles - locating and treatment from an electromagnetic perspective.

6. Health Show Update and Allergy Show June 17th 18th 19th 2005
Following on from this year’s highly successful Vitality Show, when Paz Fairbrother, the
ASK Show Representative, and all the helpers on the ASK stand, contributed to making it the best
show yet for Systematic Kinesiology, the Trustees have agreed that ASK will take a stand at
Olympia for the Allergy Show in June.
If you would like to help at the stand there are only a few places available so please apply to
the ASK office as soon as possible to avoid disappointment. Paz Fairbrother will be there again as
the ASK Show representative.
As ever, our grateful thanks to Paz and all the helpers who work so hard and have so much
fun on the stand.
7. ASK Accredited CPD Nutrition Seminar 17th July 2005

10. Free ASK Leaflets to Professional Members
A reminder that the ASK leaflet is available for free to all Professional members. All you need to do
is to order them via the ASK office and we will do the rest

11. ASK Withdrawal from British Complementary Medical Association (BCMA)
As agreed by the membership at last year’s AGM, ASK has not renewed it’s membership this
year with the BCMA. ASK, together with several other Associations and groups did try again to
persuade the BCMA to have a more flexible attitude, but they remained adamant that all members of
ASK would be required to be a member of the BCMA at a cost of £15.00 per person. The Trustees
may review the situation at a later date.
12. Continual Professional Development Courses (CPDs)
We will be giving you regular reminders that as per the ASK Code of Ethics and Practice, all
Professional members are now required to submit annually, details of CPDs they have attended
during the period Jan to 31st December. The requirement is four days attendance to an ASK
accredited CPD.
The Trustees have allowed a wide range of topics to cover the accredited CPDs. They do not
need to be kinesiology based the purpose is that the course will assist you to learn more in your field
as a health practitioner.
If you are in any doubt as to the validity of your course please contact the ASK office for
verification.
Copies of certificates of attendance need to be forwarded to the ASK office, where a database
has been established to record every Professional member’s compliance.
13. Change date for ASK Day? Have your say
Several ASK members have been unable to attend the ASK open day in June and have
suggested that it be changed to a date in the autumn. Whatever the date is it will never suit
everyone’s requirement but the Trustees feel that the membership need to be given the opportunity to
make a choice.
