Aeries Procedure for Documenting Reports of Harassment/Bullying Civil Rights Data Collection Key Definitions as of 2014 Harassment or bullying on the basis of sex includes sexual harassment or bullying and gender-based harassment or bullying. Sexual harassment or bullying is unwelcome conduct of a sexual nature, such as unwelcome sexual advances, requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature. Gender-based harassment or bullying is nonsexual intimidation or abusive behavior toward a student based on the student’s actual or perceived sex, including harassment based on gender identity, gender expression, and nonconformity with gender stereotypes. Harassing conduct may take many forms, including verbal acts and name-calling, as well as non-verbal behavior, such as graphic and written statements, or conduct that is physically threatening, harmful or humiliating. The conduct can be carried out by school employees, other students, and non-employee third parties. Both male and female students can be victims of harassment or bullying on the basis of sex, and the harasser or bully and the victim can be of the same sex. Bullying on the basis of sex constitutes sexual harassment. Harassment or bullying on the basis of race, color, or national origin refers to intimidation or abusive behavior toward a student based on actual or perceived race, color or national origin. Harassing conduct may take many forms, including verbal acts and name-calling, as well as non-verbal behavior, such as graphic and written statements, or conduct that is physically threatening, harmful or humiliating. The conduct can be carried out by school employees, other students, and non-employee third parties. Bullying on the basis of race, color, or national origin constitutes racial harassment. Harassment or bullying on the basis of disability refers to intimidation or abusive behavior toward a student based on actual or perceived disability. Harassing conduct may take many forms, including verbal acts and name-calling, as well as non-verbal behavior, such as graphic and written statements, or conduct that is physically threatening, harmful or humiliating. The conduct can be carried out by school employees, other students, and non-employee third parties. Bullying on the basis of disability constitutes disability harassment. Harassment or bullying on the basis of religion refers to intimidation or abusive behavior toward a student based on actual or perceived religion. Harassing conduct may take many forms, including verbal acts and name-calling, as well as non-verbal behavior, such as graphic and written statements, or conduct that is physically threatening, harmful or humiliating. The conduct can be carried out by school employees, other students, and non-employee third parties. Bullying on the basis of religion constitutes religious harassment. An allegation is a claim or assertion that someone has done something wrong or illegal, typically made without proof. 1.2 August, 2014 In order to comply with the reporting requirements for the Civil Rights Data Collection for Harassment or Bullying the District has created codes in 3 separate tables in Aeries CS and Aeries .net. ; The Assertive Discipline Table, the Counseling – Visitation Table and the Intervention Table. The following codes can be found in these 3 tables: Code BA BB BD BO BR BS Description Allegations of harassment/bullying based on sexual orientation Allegations of harassment/bullying based on religion Allegations of harassment/bullying based on disability Other allegations of harassment/bullying Allegations of harassment/bullying based on race, color or national origin Allegations of harassment/bullying based on sex For the purposes of reporting allegations of harassment or bullying for discipline reasons, it has been decided by the assistant principals of the District that the following procedure be followed in Aeries.net. 1. In Aeries.net go to the student’s Assertive Discipline screen. Input the Code/Description as 04 – Report of Bullying/Harassment. Enter all other details related to the harassment/bullying. 1.2 August, 2014 1. Click on the Additional Info tab 2. Click on Change, under the U5 field please choose the appropriate allegation of harassment/bullying. These fields in the Assertive Discipline screen can now be queried to help in the reporting of allegations of harassment/bullying by sex, race LEP, IDEA and Section 504 as requested by the US Department of Education for the Civil Rights Data Collection Report. A sample query to give you the information that you have inputted into the Assertive Discipline screen regarding your CRDC reports of harassment/bullying could be: LIST STU CSE STU.NM STU.GR STU.SX STU.LF STU.U5 STU.ETH STU.RC1 STU.RC2 CSE.DI ADS.CD ADS.U5 IF ADS.CD = 04 1.2 August, 2014 Entering Victim Reports of Harassment/Bullying in Aeries Aeries has created two new tables, VIC = Victims and WIT = Witness. These tables will allow you to store and track information for a student who was a victim of harassment/bullying. We are able to query the data from these tables to report incidents of harassment/bullying for the Civil Rights Data Collection report. Using these tables to record reports of harassment/bullying from the victim is optional. If you do not use this method of keeping records of victim reporting, your school must have another process in place. The Victims and Witnesses form has an Incident ID field. The Incident ID field will allow Victim or Witness records to be linked to Assertive Discipline records of the perpetrator, by populating the field with the same Incident ID number. This will enable schools to track multiple students involved in one discipline incident. The District Office has created four different Status types to track the reporting, investigating and resolution of the victims report. 1. You will make an initial entry with the Status Code of Alleged writing the incident as told to you by the victim in the Comments section. 2. You will than create a second entry with the Status Code of Confirmed or Not-Confirmed. You will indicate in the Comments section the results of your investigation. 3. If applicable you can then enter a third Status Code of Intervention noting any intervention procedures that have been put in place. All Assistant Principals, Assistant Principal Secretaries, Directors of Guidance, Counselors and Registrars have been given rights to the Victim and Witness screen. 1.2 August, 2014 To access the form: In Aeries .net 1. Click on Guidance under Student Data. Click on Victims 2. Click on Add New Record – the following screen will appear. 3. Input the Type 01 = Harassment 02 = Bullying 03 = Stalking 04 = Intimidation 4. Input the Status 01 = Alleged 02 = Confirmed 03 = Not Confirmed 04 = Intervention 5. Indicate the Basis of Harassment. Click on either Sex, Race Color Origin, Disability or Beliefs 6. Indicate the Incident ID number that would be connected to the perpetrator of the harassment/bullying if an entry was made on the perpetrator’s discipline screen. No Incident ID number is created through the Victims or Witness screens. 1.2 August, 2014 7. Indicate the School of Incident 8. Enter all information the victim has given. Witness information can be stored in the Witness table. This can be found in .net under Student Data, Guidance, and Witnesses. You can link the witness to the victim and the perpetrator by the Incident ID number if one is created in the discipline screen for the perpetrator. This table will not be used for the Civil Rights Data Reporting. It is another way to keep track of witness information. The use of this table is optional. You school might have another process in place for witness information. Aeries Client Server 1. Go to View all Forms – Filter for Victims – Click on Victims and Witnesses. You would enter the victim information as shown in the sample below using the same instructions contained in the .net information above.
