Make sure all sections of application are complete
paying special attention to the following:
 Enclose updated third party location registration
(issued by the AGCO yearly) or application to
renew
 Complete Section 6 a) ticket type (i.e. SP21) as
well as “total number of deals” to be approved
 Fill in the start date/end date (Maximum length
of license: 5 years) License deemed complete
when all tickets sold.
 Application must be signed by two (2) principal
officers from the organization
“ B reak Open Ticket Licenses may be issued for
a maximum of five years. After the expiry date
partially sold deals of break open tickets may be
carried over to a new license. Unopened deals
cannot be carried over.

Annual Review of
Organizations
The following documents must be submitted by the charitable organization to
the municipality each year:
Organizations are required to submit the
Break Open Ticket Report to the Municipality within 30 calendar days from the
completion of the license (when all tickets
sold or expiry date on license) and must
include the following documents:
 Current list of board of directors
 Copy of all deposit slips for boxes sold
 Current membership list
 Copy of all invoices
 Minutes from last general meeting
 Copy of all receipts
 Police clearances/criminal record
 Copy of bank statements and cancelled
checks for key officers if requested
 Letters Patent/Letters of Incorpora-
tion, by-laws and constitution
 Current year-end financial statement
cheques for the entire period of the
license
Interim Reports are required annually for
licenses that are issued for more than one
year to a maximum of five years.
Please bring these documents to the
Clerk’s Office following the organization’s Annual Meeting or at the time an
application is submitted. Letters may be
sent from the Municipality entitled
“Annual Review”.

Are you ready for a Break-Open Ticket Inspection?
To ensure compliance with the AGCO Break Open Ticket License Terms and Conditions
the Municipal By-law Inspector may perform a site inspection. Here’s a Check list to ensure compliance:
 Current Gaming Control Act Registration is posted (visible to the public)
 Current Municipal License issued to the licensee is posted (visible to the public)
 Ensure customers open tickets at time of purchase on the premises, and exchange all
winning tickets for cash on the day of the sale
 Signage is posed stating all players must be 18 years of or older to play
 Signage is posted stating winning tickets must be cashed on the day of sale
 The container is able to accommodate at least one and one half boxes (1 1/2) of tick-
ets
 The following information is printed on the ticket:
 License number (same as the posted lottery license number)
 Name or abbreviated name of Licensee
 Price of ticket
 Name of manufacturer
 Serial number of ticket
 Make sure customers do not remove tickets from the box themselves
 Ensure attendant defaces all winning tickets
 Ensure staff does not buy Break-Open tickets
 Ensure staff do not display number of unsold winning tickets remaining in the con-
tainer
Failure to abide by the Terms & Conditions
By completing and signing a lottery license application, the Principal Officers of the
organization are, on behalf of the organization agreeing that the Terms and Conditions
under which a lottery license is issued will be followed. Failure to abide by the Terms
and Conditions is cause for the denial of future applications, cancellation or suspension
of licenses and may result in civil liability for the criminal prosecution of the Principal
Officer, Designated Member in Charge and the organization by the Province.

This guide briefly explains some of the rules relating to
Break Open Tickets lottery licensing.
Applicants should refer to the Terms and Conditions that
govern each type of lottery license which is available at the
Clerk’s Department or from the Alcohol and Gaming
Commission of Ontario web site. (see below)

2005 outlines the policies and
procedures municipal and provincial officials must follow to
issue charitable gaming licenses
in Ontario. Each type of licensed lottery is governed by a
specific set of rules known as
terms and conditions.

Sec. 206 makes it an indictable offence to participate in a lottery scheme
Sec. 207 (1) (a) provides an exemption to 206 to allow provincial governments to conduct
and manage lottery schemes
Sec. 207 (1) (b) exempts charitable and religious organizations to allow them to conduct and
manage lottery schemes
Sec. 207 (a) (b) allows delegation of licensing authority by Lieutenant Governor-in-Council
Order-in-Council 2688/93 delegates licensing authority to the Registrar of the AGCO and
municipal councils
