ANNEXURE TO BIDDING FORM
Terms and Conditions of sale of moveable property more particularly described in the
sale notice belonging to “Ushakant Steels Pvt. Ltd.” under SARFAESI Act 2002.
The sale shall be subject to the conditions prescribed in the Security Interest (Enforcement)
Rules 2002 and to the following further conditions.
1.
The subject property shall not be sold below the ‘Reserve Price’ and sale is subject to the
confirmation by ASREC.
2. The bids/offers must be in sealed cover super scribing “offer for purchase of
property of M/s. Ushakant Steels Pvt. Ltd.” along with earnest money deposit
(EMD) amount.
3. Bid Form shall be available upon payment of Rs. 1,000/- per tender form (nonrefundable). Bid form are also available on www.asrecindia.co.in. Bid forms can also be
collected from above mentioned office of the ASREC or from M/s. JVD Recovery Agency
Ltd, 32/A, Mezzanine Floor, Vyapar Bhavan, 49, P. D'Mello Road, Masjid Bander (E),

4. KYC compliance:- self attested photocopies of Proof of identification viz. Voter ID
Card/PAN Card/Driving License etc. along with admissible residence proof should be
attached by all the bidders along with the letter of offer/bid.
5. EMD should be paid by way of Demand Draft/Pay order payable at Mumbai in favour of
“ASREC (India) Ltd.” which is refundable without interest to unsuccessful bidders.
6. Offers / Bids below the reserve price / without EMD / conditional shall be disqualified.
7. ASREC (India) Ltd/ Authorised Officer reserves the right not to accept or reject all or any
one of the bids offered, even though higher than the reserve price without assigning any
reason. ASREC (India) Ltd / Authorised Officer also reserves the right to cancel, postpone
the bid / sale process without fixing any date and/or assigning any reason whatsoever.
Any dispute arising out of sale process the decision of the Authorised Officer shall be
final & binding upon the participants / bidders.
8. Property will be sold to the bidder quoting the highest bid amount innter-se bidding at
the sole discretion of Authorised Officer. However, the Authorized Officer has the
absolute right to accept or reject any tender/bid or adjourn/ postpone the sale without
assigning any reason thereof.
9. All dues including any fees, charges, MIDC, Labour / workmen’ dues / compensation if
any, taxes including transfer fees, unpaid electricity charges, Municipal taxes, sales tax,
or other dues, statutory or otherwise on the secured assets shall be borne by the
purchaser only.
10. Successful bidder shall pay initial deposit being 25% of the total bid amount / purchase
consideration after adjusting EMD amount within 48 hours from getting declared as
successful bidder and balance 75% of the bid amount / purchase consideration within 15
days from the date of confirmation of sale. On failure to pay the sale amount as stated
herewith all deposits including EMD shall be forfeited without further notice. However,
extension of further reasonable time to make the balance payment in exceptional
situations shall be at sole discretion of authorized officer.
11. Persons interested should make their own independent inquiries as to the title of the
property and claims/dues from Govt., Semi Govt. Department if any, affecting the
property. Any statutory or other dues payable and due on these properties shall have to
be borne by the purchasers/bidders only. All the expenses of whatever nature including
stamp duty, registration charges, transfer fee, etc. of getting property transferred shall
be borne by the purchaser and ASREC (India) Ltd. shall not in any way be liable for the
same.
12. Until the sale is confirmed, ASREC (India) Ltd. reserves the right to withdraw from the
process or any part thereof, to accept or reject any or all bids at any stage of the process
and/or modify the process or any part thereof or to vary terms at any time without
assigning any reason whatsoever. No financial obligation will accrue to ASREC (India) Ltd.
in such an event.
13. On confirmation of sale, a Sale Certificate shall be issued in terms of Rule 9(6) of the
SARFAESI Act 2002 and possession of the property will be delivered.
14. Purchaser has to pay Stamp duty & Registration charges and other dues as applicable by
the purchaser separately.
15. The Purchaser shall be delivered physical possession of the property at the sites
mentioned above after receiving full purchase price and after obtaining permission from
Hon’ble DRT since the said property is in possession of Hon’ble DRT.
16. Sale shall be without recourse to the ASREC (India) Ltd./ Authorised Officer.
17. Sale is on “AS IS WHERE IS BASIS ” AND " AS IS WHAT IS BASIS"
18. If the borrower deposits the dues before acceptance of bid, ASREC (India) Ltd./
Authorised Officer reserves the right to cancel the bid/sale.
19. The particulars given by the Authorised officer are stated to the best of his knowledge,
belief and records. Authorised officer shall not be responsible for any error, misstatement or omission etc.
