OBJECTIVE
In this presentation students will be provided with a
better understanding of the law to avert them from
unlawful behavior.
TWO BASIC TYPES OF CRIMES
 FELONIES
 MISDEMEANORS
MISDEMEANORS
 Less serious
 Penalty:
 Probation / Fines / Court Costs
 Up to one year in county jail
Examples: Petit Theft, Simple
Battery/Assault, cyber bulling, Stalking,
Criminal Mischief (vandalism).
FELONY
 Most serious type of crimes
 Penalty:
 More than one year in a state penitentiary up to
Life in Prison.
 Examples – Murder, Rape, Grand Theft,
Sale/Delivery Controlled Substance
* Circumstances Juveniles can be charged as an adult
 Juvenile is 14 years or older charged with a violent felony
 Juvenile is 16 years or older charged with any felony
Assault – 784.011
An assault is an intentional,
unlawful threat by word or act to do
violence to a person, coupled with
an apparent ability to do so, creates
a well-founded fear in such person,
& such violence is imminent.
Aggravated Assault
Same as above but made while
displaying a weapon.
 Battery - F.S. 784.03
 Actually & Intentionally touches
or strikes another person against
the will of that person or
intentionally causes bodily harm
to another person.
 Aggravated Battery
 While committing battery,
causes great bodily harm,
permanent disability, or
permanent disability or
disfigurement.
 Uses a Deadly Weapon
PROPERTY CRIMES
 Criminal Mischief - Damaging others property
Damage over $1,000 is a FELONY
 Example: egging a car
 A paint job can easily exceed $1,000
 Grand Theft
 $300 or more
 3rd degree felony
 Stealing a car or being in a stolen car is Grand Theft

PRINCIPAL /ACCESSORY
 AKA: to aid and abet
 You do not have to be primary person in a crime to be
charged with the crime
 You only have to help
 Example: getaway driver, look out
 Florida Statute 777.011 – Whoever commits any
criminal offense, whether felony or misdemeanor,
or aids, abets, counsels, hires, or otherwise procures
such offense to be committed, is committed, or has
attempted to be committed, may be charged,
convicted & punished pursuant to this
Statute.

ALCOHOL
 Must be 21 years or older
 Illegal to attempt to purchase
 Once receive license cannot refuse drug test
 License will be suspended if refusal of test
 Legally BAC is .08, .02 if younger than 21
 DUI stays on your record for 75 years

Alcohol at School
 Suspension and Expulsion can result if you:
 Possess
 Drink
 Sell
 Give away liquor
 At school or on school grounds
 In Addition to facing criminal charges

 20 grams or less
 1st degree misdemeanor
 20 grams or greater

 Selling is a felony
 Possession of paraphernalia is a misdemeanor

Synthetic Marijuana
 AKA:
 K-2
 Spice
 3rd Degree FELONY to:
 Possess, Sell, Manufacture, or Deliver
 3 grams or more
 3rd degree felony
 Anything that mimics effects of drugs and alcohol can
impair driving

PRESCRIPTIONS
 Make or use false prescription
 Taking others prescribed pills
 Possession of psychotropic/painkillers without
prescription
 Oxycontin
 Percocet
 Hydrocodone
 Giving a pill is a second degree FELONY
 Maximum 15 year prison sentence

HOUSE PARTIES
 Open House Parties:
 Where alcohol or drugs are served to underage people
 2nd degree misdemeanor for adult in charge
 1st degree misdemeanor if:
 A person (adult) allows a house party for a 2nd time
 Minor who consumed alcohol is seriously injured or
killed
 Minor causes or contributes to injury or death of other
people

CYBER BULLYING
 Communicating threats of death or bodily injury is a
2nd degree felony
 Includes threats over social media
 Facebook

SEXTING
Florida Statute 847.0141 - Effective October 1, 2011
A MINOR commits the offense of sexting if he or she knowingly
uses a computer, or any other device capable of electronic data
transmission or distribution, to transmit or distribute to another
MINOR any photograph or video of any person which depicts
nudity & is harmful to minors.
Consequences:
-1st. Offense – non-criminal offense punishable by a teen court
appearance and judgment or up to 8 hours of community service
and or a $60.00 fine.
-- 2nd. Offense – Misdemeanor (arrest-able offense.)
