CONDITIONS
1.
BACKGROUND
As part of its ongoing plant and equipment renewal program East Gippsland Shire Council has various
used items for sale that have either been directly replaced or are no longer required for Council
operations.
Council is seeking to dispose of these assets via a public tender process and invites interested parties to
review this document and the attached schedules.
2.

CANVASSING
Canvassing of Councillors, the Chief Executive Officer, Council Staff or Council Representatives is not
permitted and will render any subsequent submission non-conforming.
4.
SUBMISSIONS
Schedule 1 includes a summary list of all items for sale at this time. Subsequent schedules document
each lot in more detail and provide space for individuals to submit their tender offers and contact details.

submit the completed schedules in accordance with the lodgement requirements;

LODGEMENT OF TENDERS
Interested parties shall submit ONE fully completed copy of the relevant tender schedule, for each lot
they are interested in purchasing.
Tender documents shall be enclosed in a sealed plain envelope and lodged in the tender box at the
following location:

273 Main Street (PO BOX 1618)
BAIRNSDALE, VIC 3875.
Envelope to be clearly marked: "Tender for Sale of Used Plant & Equipment: Contract RIFP
2015/12” and be addressed to: Procurement Department.
Tender closing time 12.00 noon Thursday 3 December 2015
No documents will be considered if received later than this time or if received by any other
means. Please allow sufficient time for documents to arrive if the tender is to be posted.
7.
WITHDRAWAL OF TENDERS
Any individual submitting a tender shall notify Council immediately should they wish to withdraw their
offer or their circumstances change which renders them ineligible to tender.

EVALUATION
Tenders will be evaluated primarily using the tender prices submitted, with the highest tender received
for each individual item accepted in the first instance.
During the evaluation period, individuals should be available to discuss their tenders and confirm their
winning bid. If Council cannot contact the individual within a reasonable time period (2 to 3 days) then
Council will offer the item to the next highest tenderer and so on.
9.
ACCEPTANCE OF TENDERS
Council is not bound to accept the highest priced tender or any tender for the equipment being sold,
especially if it considers that a fair market value has not been achieved.
Council reserves the right to enter into negotiations with the highest tenderer if they are planning to reject
it for not reaching market value. In the event of equally priced winning tenders each party will be given
one opportunity to resubmit a higher price or withdraw the offer.
Notification of acceptance of a submission by Council shall be given to the successful individual, firstly
via telephone and then formally in writing to the address listed within the schedules. All successful
tenderers are to collect their purchased items no later than Friday 18th of December 2015.
10.
DISPOSAL CONDITIONS
The successful tenderer must execute and return to Council a formal agreement, prepared by Council, in
relation to the equipment sale within seven (7) days of its receipt otherwise Council reserve the right to
offer equipment to other parties.
This document lists councils standard conditions of sale, detailing the fact that the equipment is sold ‘as is’ ‘where is’ with no warranty implied or offered. It also stipulates the terms of payment which must be
received in full before goods are able to be collected.
