Entitlement to Subsidised training Guideline - effective 18 March 2016 – Version 3.0 3 1. Purpose 1.1 The Skills for All Contract (Contract) is between the Minister for Higher Education and Skills (Minister) and a WorkReady Training Provider (“training provider”). The Contract contains the terms and conditions by which the training provider delivers training and assessment services to a high quality, consistent with the WorkReady policy. 1.2 This Guideline is published pursuant to clause 1.3.5 of the Contract and must be read in conjunction with the Contract. The Guideline is designed to expand on the obligations of training providers with respect to: 1.2.1 Entitlement to subsidised training 1.2.2 Conditions and endorsements 1.2.3 School enrolled student entitlement 1.2.4 Process to determine funded entitlement 1.2.5 Evidence and record keeping 2. Background 2.1 Training providers may only accept an enrolment into a course from a participant (and provide training services to that participant) if that person is eligible under the Contract (clause 15.1 of the Contract). 2.2 Training providers must undertake all reasonable investigation to authenticate that the participant is eligible under the Contract (clause 15.3 of the Contract). 2.3 Training providers must investigate the participant’s entitlement to subsidised training in accordance with Schedule 2 of the Contract. 3. Definitions 3.1 Unless stipulated otherwise, terms used in this Guideline have the same meaning as in the Contract. 3.2 In addition, the terms below have the following meanings: 3.2.1 A “participant” is an Eligible Student as defined in the Contract. 3.2.2 AVETMISS Data element definitions and associated rules as published in the AVETMISS Data Elements definitions Edition 2.2 January 2014 and as updated from time to time. 3.2.3 Enrolment Agreement is the written enrolment contract between the participant and the training provider for the delivery of the course. 3.2.4 Highest school level completed has the same meaning as published in the AVETMISS Data Elements definitions Edition 2.2 January 2014 and as updated from time to time. “Highest school level completed identifier” identifies the highest level of school that a client has completed (pp 92-93). This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Higher Eduction and Skills and the training provider. If there is any inconsistency between this Guideline and the Contract, the terms and conditions of the Contract prevail. Entitlement to Subsidised Training Guideline - effective 18 March 2016 – Version 3.0 4 The classification scheme is as follows: 02 08 09 10 11 12 did not go to school completed Year 8 or below completed Year 9 or equivalent completed Year 10 completed Year 11 completed Year 12 3.2.5 International Baccalaureate Diploma Program for the purposes of the Contract is “equivalent” to a Senior Secondary Certificate of Education. Successful completion means the certificate or record of achievement that demonstrates that the prospective student has completed and met all the requirements of the Diploma Program. 3.2.6 Prior educational achievement means the level of prior educational achievement successfully completed by a prospective student, as defined and identified in the AVETMISS Data Elements definitions Edition 2.2 January 2014 and as updated from time to time (see “Prior educational achievement flag” [p 123-124] and “Prior educational achievement identifier” [pp 125-127]). The classification scheme is as follows: 008 410 420 511 514 521 524 990 Bachelor degree or higher degree level Advanced diploma or associate degree Diploma level Certificate IV Certificate III Certificate II Certificate I Certificates other than above 3.2.7 Qualification means a qualification that is recognised within the Australian Qualifications Framework or a qualification issued overseas that is, or has been, recognised as an Australian equivalent (level or content). 3.2.8 SACE is the South Australian Certificate of Education issued by the SACE Board of South Australia. 3.2.9 Successful completion of the Senior Secondary Certificate of Education means a Senior Secondary Certificate of Education or record of achievement that demonstrates that the prospective student has completed and met all the requirements of a Senior Secondary Certificate of Education. The certificate or record of achievement will include the words “Certificate Title is a Senior Secondary Certificate of Education within the Australian Qualifications Framework”. 4. Entitlement to subsidised training 4.1 Course entitlement rules for enrolment of a participant and the creation of a training account were varied twice, with effect from 4 November 2013 and 1 October 2015, respectively. These entitlement rules are reflected in Schedule 2 of the Contract, as amended from time to time. 4.2 All participants enrolled before the effective date/s will continue to be eligible for subsidised training in the Courses in which they enrolled. These courses will impact on a participant’s entitlement to receive subsidised training if they seek to enrol in further courses. This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Higher Eduction and Skills and the training provider. If there is any inconsistency between this Guideline and the Contract, the terms and conditions of the Contract prevail. Entitlement to Subsidised Training Guideline - effective 18 March 2016 – Version 3.0 5 4.3 Courses completed before the effective date/s 4.3.1 do not count towards the number of courses for which a participant is entitled to receive subsidised training; but 4.3.2 Will count towards holding a qualification. 4.4 Courses commenced before the effective date/s and completed on or after the effective date/s will count towards the number of courses for which a participant is entitled to receive subsidised training. 4.5 Any training account, with the exception of those that have been closed (where the status in VETA is “Terminated Agreement”), counts towards the total number of courses: 4.5.1 for which a participant is entitled to receive subsidised training, and 4.5.2 that a participant may undertake concurrently. 4.6 A participant may only be enrolled and undertake training in two courses at any one time. 4.7 This means that a participant may have only two training accounts open (where the status in VETA is “Active With Activity”, “Active No Activity” or “Leave from Enrolment”) at the same time. 4.8 A Training Provider cannot accept an enrolment from a participant for a Course if completion of that Course would result in exceeding the number of courses for which the student is entitled to receive subsidised training. Foundation skills 4.9 A foundation skills course is a course on the Funded Training List/Subsidised Training List which is identified as a Foundation Skills Course by the Minister from time to time. 4.10 School-enrolled participants may not enrol in foundation skills courses. Priority courses 4.11 A priority course is a course on the Funded Training List/Subsidised Training List which is identified a Priority Course by the Minister from time to time. 4.12 All participants are entitled to subsidised training in an unlimited number of priority courses. 4.13 For the purposes of a participant’s entitlement to subsidised training, priority courses: 4.13.1 do not count towards the total number of courses for which a participant is entitled to receive subsidised training 4.13.2 count towards the number of courses in which a participant can be enrolled and undertake at any one time 4.13.3 once completed, count towards holding a qualification. This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Higher Eduction and Skills and the training provider. If there is any inconsistency between this Guideline and the Contract, the terms and conditions of the Contract prevail. Entitlement to Subsidised Training Guideline - effective 18 March 2016 – Version 3.0 6 5. Conditions and endorsements 5.1 The Minister may apply a condition or endorsement to a course (clause 13 of the Contract) by providing a training provider with at least five (5) days written notice. 5.2 A training provider may only deliver courses on its Schedule of Courses in accordance with any condition, endorsement or No New Enrolments Date applied to the course (clause 10 of the Contract). 5.3 The condition or endorsement is effective for any new enrolment agreement and training account created by a training provider after the effective dated published on the training provider’s Schedule of Courses. 5.4 If a course has a condition or endorsement, a training provider may only enter into an enrolment agreement and create a training account for the course where the participant meets the criteria of the condition or endorsement. 5.5 Participants on a Training Contract, as defined in Schedule 2 of the Contract 5.6 5.5.1 Course condition as it will appear on the Funded Training List/Subsidised Training List and the Schedule of Courses is “Training Contracts Only”. 5.5.2 Under this condition, a participant: (a) has an approved training contract (as defined in the Training and Skills Development Act 2008 (SA)) (b) is seeking to enrol in a course that is nominated in the training contract. 5.5.3 A training provider may only enter into an enrolment agreement and create a training account for a participant when the status of the training contract is “Approved”. 5.5.4 The training contract number must be entered in VETA in the appropriate format (e.g. 123456\3) in the Contract ID field and it must be the same training contract number identified in the training contract for the participant for this Course. School Based Training Contracts (Australian School Based Apprenticeships – ASBAs) 5.6.1 Course condition as it will appear on the Funded Training List/Subsidised Training List and the Schedule of Courses is “Training Contracts Only” with an additional condition of “ASBA” indicated under the number of places allocated for the course. 5.6.2 Under this condition, a participant: 5.6.3 (a) is enrolled in school (and may be under 16 years old) (b) has an approved training contract (as defined in the Training and Skills Development Act 2008 (SA)) (c) is seeking to enrol in a course that is part of the School Based Training Contract. The training provider may only enter into an enrolment agreement and create a training account for a participant when the status of the training contract is “Approved” and the training contract is designated as “School Based”. This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Higher Eduction and Skills and the training provider. If there is any inconsistency between this Guideline and the Contract, the terms and conditions of the Contract prevail. Entitlement to Subsidised Training Guideline - effective 18 March 2016 – Version 3.0 7 5.6.4 5.7 The following information must be entered in the creation of a training account: (a) The training contract number in the appropriate format (e.g. 123456\3) must be entered in the Contract ID field and it must be the same training contract number identified in the training contract for the participant for this course; (b) The answer to “Is the Student enrolled at school” must be “Yes”. (c) “School type” must be checked to “School Based Apprenticeship”. TGSS Student as defined in Schedule 2 of the Contract 5.7.1 Participants seeking to access subsidised training through TGSS can select from courses available on the Funded Training List/Subsidised Training List that are designated as “TGSS Approved”. 5.7.2 Course condition as it will appear on the Funded Training List/Subsidised Training List and the Schedule of Courses is “TGSS Enrolment Only”. Under this condition, a participant is: (a) enrolled in school and undertaking substantive VET within the South Australian Certificate of Education (SACE) as part of the TGSS. (b) 16 years or older (c) seeking to enrol in a course that is “TGSS approved” in a TGSS arrangement. 5.7.3 A training provider may only enter into an enrolment agreement and create a training account for the TGSS participant in a course that is “TGSS approved” and after Forms A and B are complete, accurate and signed by each of the parties (school principal, parent and student). 5.7.4 The following information must be entered in the creation of a training account: 5.7.5 The answer to “Is the Student enrolled at school” must be “Yes”. “School type” must be checked to “Training Guarantee for SACE Students”. VETA will allow the creation of a training account where the participant is enrolling in the guaranteed “Post-School” Course after the participant has completed SACE and left school. 6. School enrolled participant entitlement 6.1 School enrolled participants in identified arrangements (TGSS, ASBA or ICAN) are, at first enrolment, eligible for: 6.2 6.1.1 One course at Certificate II level; 6.1.2 Two courses from the Certificate III to Advanced Diploma levels. Participants who are enrolled in school are eligible for subsidised training if: 6.2.1 they are a school-based apprentice/trainee undertaking a course available on the Funded Training List/Subsidised Training List that is part of their training contract; or 6.2.2 they are 16 years of age or over and undertaking substantive VET within the SACE (or equivalent) as part of the Training Guarantee for SACE Students (TGSS) scheme provided that the course is available on the Funded Training List/Subsidised Training List as “TGSS Approved”; or This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Higher Eduction and Skills and the training provider. If there is any inconsistency between this Guideline and the Contract, the terms and conditions of the Contract prevail. Entitlement to Subsidised Training Guideline - effective 18 March 2016 – Version 3.0 8 6.2.3 they are an Innovative Community Action Network (ICAN) Flexible Learning Option participant assessed by their ICAN Case Manager as capable of undertaking vocational education and training and are subsequently approved by the Minister’s delegate to access a subsidised course. 6.3 A participant who is enrolled in school must meet any relevant entry requirements of the course. 6.4 If at the time of enrolment a participant who is enrolled in school holds a qualification that has not been funded, the participant is entitled to two funded Certificate II level courses. 6.5 ICAN participants may choose a course from the Funded Training List/Subsidised Training List which is available for new enrolments except those courses which can only be undertaken through a training contract or Foundation Skills courses. 6.6 Prior to a training provider entering into an enrolment agreement or creating a training account for a participant enrolled in school, the training provider must be satisfied that: 6.6.1 each of the requirements for the enrolment of the school participant has been met and documents that evidence compliance with any requirement are complete, accurate and retained; and 6.6.2 any specific obligations of the training provider are met and will continue to be complied with. 6.7 Training providers are directed to the Training Guarantee for SACE Students Guideline for more detailed information and the requirements of an enrolment under the TGSS. 7. Process to determine subsidised training entitlement 7.1 For the purposes of establishing a participant’s entitlement to subsidised training, the training provider must determine, in the following order: 7.2 7.1.1 Whether at the time of enrolment, the individual is actively seeking work and registered with an Employment Service Provider. In the creation of the training account, both the name of the Employment Service Provider and the Job Seeker ID must be entered. 7.1.2 Whether at the time of enrolment the individual holds a qualification (from a Certificate I level up to and including a doctorate), whether funded or not. Evidence includes: documents provided by the student; and/or checking the student’s training history in VETA; and/or checking the training provider’s student records; and/or written declaration by the participant on the enrolment agreement. The training provider must then consider and take into account: 7.2.1 qualifications that the individual has attained through subsidised training after 1 October 2015 7.2.2 qualifications or Skill Sets that the individual is enrolled in at the time of enrolment (i.e. open training accounts) 7.2.3 whether enrolling the individual would result in the individual exceeding their entitlement for subsidised training. This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Higher Eduction and Skills and the training provider. If there is any inconsistency between this Guideline and the Contract, the terms and conditions of the Contract prevail. Entitlement to Subsidised Training Guideline - effective 18 March 2016 – Version 3.0 9 7.3 The participant’s training history in VETA will indicate to the training provider and the participant where a course: 7.3.1 has been completed and the “Qualification Issued” date is on or after 1 October 2015; and 7.3.2 any open training accounts where the “Training Account Date Created” is on or after 1 October 2015. 8. Evidence 8.1 Training providers are required to collect and keep records of evidence of eligibility (clause 22.1 of the Contract), including evidence to verify participant existence, to ensure that only persons who have a valid “identity” and who “exist” are accessing subsidised entitlements. 8.2 The test of identity includes evidence of: 8.2.1 8.3 8.4 existence; 8.2.2 use of identity; 8.2.3 residential address. Effective 10 February 2014, photographic identification of a participant’s existence is required to be collected and recorded by a training provider at each time of enrolment, and must be copied and retained by the training provider together with the enrolment agreement. The following are acceptable sources of evidence: 8.3.1 Current driver’s licence or learner’s permit 8.3.2 Current proof of age card (issued by Services SA) 8.3.3 Current Australian Passport in conjunction with evidence of residential address 8.3.4 Current School Student Card issued by the school where the student is currently enrolled (in conjunction with evidence of residential address if address in not identified on School Card) Other forms of acceptable evidence are listed in Attachment A. Data collection 8.5 8.6 The training provider must: 8.5.1 collect information and evidence from the participant to validate student and course eligibility 8.5.2 retain evidence and records to support the participant’s eligibility 8.5.3 use an AVETMISS compliant enrolment agreement that includes the “Standard Enrolment Questions” published in the AVETMISS VET Provider Collection Specifications. 8.5.4 ensure that the participant accurately completes the enrolment agreement. In addition to all other AVETMISS requirements, for each participant the training provider must accurately complete the Client (NAT00080) file and the Prior educational achievement (NAT00100). This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Higher Eduction and Skills and the training provider. Entering into the enrolment agreement 9.1 Once the training provider is satisfied that the course is available for enrolment by the participant, the training provider may enter into an enrolment agreement with the participant and create the training account. Training providers should refer to the Enrolment and Training Account Guideline on the WorkReady website. . This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Higher Eduction and Skills and the training provider. Entitlement to Subsidised Training Guideline - effective 18 March 2016 – Version 3.0 11 Attachment A - Acceptable forms of evidence In addition to the forms of evidence identified in section 8 of this Guideline, the following forms of evidence can also be used as proof of identity. (1) Evidence of existence South Australian or Federal Police officer photo identity card Australian full birth certificate showing parental details (a commemorative certificate, certified copy or extract is not acceptable) overseas birth certificate showing parental details provided a passport or an official Australian travel document is also shown current Australian passport or one that has expired within the last two years current overseas passport (with or without visa) or an overseas passport that has expired within the last two years (provided it is accompanied by a current Australian visa). Electronic visas are not acceptable as evidence of identity. Australian naturalisation or citizenship document or immigration papers issued by the Department of Immigration and Citizenship (DIAC). A person under the age of 18 who is naturalised along with their parents may not necessarily be issued with an individual citizenship document - they may instead appear on the parents' citizenship papers Department of Immigration and Citizenship (DIAC) Certificate of Evidence of Residence Status Department of Immigration and Citizenship (DIAC) travel document (valid up to five years after issue). A person under the age of 18 who immigrates to Australia with his/her parent(s) will generally be included on the immigration paperwork of their parent(s) Department of Immigration and Citizenship (DIAC) Visa Evidence Card (PLO56)(must be current or accompanied by supporting documentation from DIAC) A current Department of Immigration and Citizenship (DIAC) ImmiCard (either Evidence of Immigration Status (EIS) or Permanent Resident Evidence (PRE)) community detention - letter of introduction, issued by the Department of Immigration and Citizenship (DIAC) or the Australian Passport Office Extract from Register of Citizenship by Descent (issued by an Australian embassy where the parent(s) are Australian-born) This Guideline must be read in conjunction with, and is subordinate to, the Contract between the Minister for Employment, Higher Eduction and Skills and the Training Provider. Entitlement to Subsidised training Guideline - effective 18 March 2016 – Version 3.0 12 (2) Evidence of residential address The participant will need to supply one of the following documents if their residential address was not included on the evidence of existence listed above: current South Australian vehicle registration certificate South Australian driver's licence or vehicle registration renewal for the coming period contract of sale, lease arrangement or rental receipt for your place of residence up to two years old last or current financial year Australian Taxation Office tax assessment (please black out the Tax File Number (TFN)) a letter signed by the principal/deputy principal/head of school or a person with authority to sign for the principal/deputy principal/head of school of a recognised educational institution, on the institution's letterhead, which verifies your address (up to one year old) In the case of TGSS students, a completed Form A, signed by the principal/deputy principal/head of school of a recognised educational institution. In the case of an ICAN student, a completed ICAN Referral and Application for Exemption to be signed by the School Flexible Learning Options (FLO) Coordinator. statement or letter from a bank, building society or credit union (up to one year old) which verifies your residential address. Note: ‘Screen dumps’ from financial institutions are not acceptable, with or without financial institution branch stamps. (3) Evidence of change of name The following documents must be presented to record a change of name: full evidence of identity in the current or former name (or an Australian driver's licence or a South Australian proof of age card issued after 9 October 2006). AND one of the following: birth certificate with an endorsement from an Australian registrar of births, deaths and marriages (BDM) marriage certificate issued by an Australian BDM (commemorative certificates issued by a religious leader or celebrant are not acceptable) change of name certificate issued by an Australian BDM deed poll certificate (previously issued by Lands Title Registration Office).
