Adoption Release and Waiver
I, _____________________________, the undersigned individual adopting the animal
described in Section 1 from PawsCo (hereafter, “Adopter”), hereby agree as follows:
SECTION 1: PET DESCRIPTION. PawsCo delivers to Adopter and Adopter hereby accepts from
PawsCo the animal described below (hereafter, “Pet”).

SECTION 2: ADOPTER’S COVENANTS TO CARE FOR PET. Adopter agrees to humanely take care of
Pet, including providing proper food, water, shelter and exercise, and to give Pet a reasonable amount of
time to adjust to new surroundings, and agrees as follows:











Adopter will comply with all applicable laws in caring for Pet;
If a dog, Pet will have indoor and outdoor access, will not be left alone in a backyard or kennel,
and will never be chained, tied out, or left in a crate for excessive periods of time;
If a cat, Pet will be kept indoors at all times and will never be declawed;
Adopter will provide preventative health care and any emergency medical treatment by a licensed
veterinarian when Pet becomes injured or ill;
Adopter will provide all of the necessary obedience training and behavior modification that Pet
may need throughout its life;
Pet will wear a name tag at all times;
Pet will never be transported, secured or unsecured, in the open bed of a pickup truck or left in a
vehicle in extreme heat or cold;
Adopter and members of Adopter household have agreed to house Pet and that all members of
Adopter household will abide by the terms of this Agreement;
Adopter will exercise prudence and caution in introducing Pet into the new situation until Pet has
become fully adjusted to its new environment and Adopter has had an opportunity to become
familiar with Pet’s unique personality;
Neither Adopter nor any member of Adopter household have ever been subject to legal action for
cruelty to Pets or neglect of Pets, or both, and have never owned an Pet which has been
confiscated by any Pet control or humane organization for violations of state or local Pet control
regulations or Pet adoption agreements during Adopter ownership;
Adopter understand that PawsCo may reclaim the Pet if, in its opinion, any of the above
conditions are not being met and that Adopter may be liable for any fees and costs incurred by
PawsCo for reclamation or arising out of the enforcement of any provision of this Agreement;

Adopter shall not offer Pet for sale or give Pet to any third party without the prior written consent
of PawsCo;
Adopter understand animals such as Pet are different from human beings in their responses to
human actions, may be unpredictable, may change their behavior after they leave the rescue or
accustom themself to a home or environment; and
Adopter will inform PawsCo if for any reason Adopter are unable to provide the care prescribed
herein.
SECTION 3: ADOPTER’S COMPLETE RELEASE AND WAIVER. Adopter agrees to accept the Pet as
is, including all known or unknown conditions, and assumes all risk of ownership, including the risk of
harm or injury to Adopter or others (such as animal bites) and assume liability for costs of all necessary
medical treatment of the Pet. On behalf of Adopter, Adopter’s heirs, personal representatives and assigns,
Adopter hereby releases, discharges, indemnifies and holds harmless PawsCo and its directors, officers,
employees, volunteers and agents from any claims, causes of action, and demands of any nature, whether
known or unknown, arising out of or in connection with Adopter’s adoption of Pet, care and ownership of
Pet, including without limitation any treatment or handling of Pet by veterinarian or other provider
recommended or referred by PawsCo. Adopter agrees that Adopter is fully aware of, understands, and
agrees to this RELEASE AND INDEMNIFICATION PROVISION, and that it is BINDING AND
ENFORCEABLE BY LAW.
SECTION 4: PAWSCO’S RIGHT TO ENFORCE. In the event of a breach of this Agreement by
Adopter, this Agreement may be specifically enforced by PawsCo through judicial proceedings, including
suit to enforce its terms or defend any claims hereunder. Adopter agrees to pay all court costs and
attorneys’ fees in connection with any suit by PawsCo pursuant to this Agreement.
SECTION 5: NO WARRANTIES OR REPRESENTATIONS BY PAWSCO. PawsCo makes no explicit or
implicit representations or warranties in reference to the health and/or temperament of Pet. Pet is
adopted “AS IS” and Adopter assume all responsibility for treatment of any and all existing conditions or
any other physical, medical or temperament changes that may occur in the future. PawsCo cannot
guarantee the health of any Pet and shall not be held responsible for any medical expenses which may be
incurred, hereby expressly excluding any implied or express warranties of merchantability or fitness for
any particular purpose, including, without limitation, any warranties regarding health, temperament or
whether Pet is housebroken.
SECTION 6: ADOPTER’S FURTHER ACKNOWLEDGMENTS. In signing this Agreement Adopter
acknowledges, represents, and agrees: that Adopter have read and understand this Agreement; Adopter is
at least eighteen years of age and fully competent; Adopter cannot, does not, and has not relied on any
oral representations, statements, or inducements that may have been made by PawsCo; this Agreement is
the complete agreement between the Parties on this matter; this Agreement cannot be amended except in
writing signed by both Parties; Adopter had adequate consideration for entering this Agreement; and,
Adopter is executing this Agreement voluntarily with the intent to be bound by it and the understanding
Adopter is giving up substantial rights by signing this Agreement.
