Terms and Conditions of Participation in Auditions and Questionnaire
Please read and complete the terms and conditions (at Part A below) carefully before answering the
questions and completing the questionnaire (at Part B below) (collectively, the “Audition Form”). Only one
Audition Form needs to be completed per Team, if applicable (as defined below). Each of the 2 (two)
eligible participants in the Team must sign and provide their personal details and/or answer the questions in
the questionnaire.
Completed Audition Forms are to be brought with you to the audition. Audition Forms will also be available
for completion at the venue of the audition, should it be required.
By completing and signing this Audition Form, each of the 2 (two) eligible participants in the Team and/or
individual participants hereby agree to be bound by the terms and conditions below applicable to the
audition and (if applicable) the KFC Taste Kitchen television show (“KFC Taste Kitchen”), which is being
run by Electronic Media Network (Pty) Ltd (M-Net) and its affiliates, Connect Channel (Pty) Ltd, KFC
Proprietary Limited, their staff, directors, affiliated companies and third party service providers (collectively,
the “Organisers”).

PART A: TERMS AND CONDITIONS
1. Eligibility Requirements
In order to participate at the audition and, if your audition is successful, in KFC Taste Kitchen, each
participant of the Team warrants that he/she:

is 19 (nineteen) years of age or older as on 1 April 2017;
is a South African citizen or has permanent residence status in South Africa at the time of the
audition and throughout the duration of KFC Taste Kitchen;
is available for the duration of the filming of KFC Taste Kitchen, being the period 28 April 2017 to
31 July 2017;
does not have a criminal record and has not been convicted of any criminal offence in a court of
law (save for minor traffic offences);
is willing to provide the Organisers with their personal information including, but not limited to,
full name/s and surname, identity number/passport number, age, physical residential address
and telephone numbers, certain medical information, etc.;
at the request of the Organisers, will provide proof that he/she meets any or all of the entrance
requirements set out in this clause 1 (Eligibility Requirements); and
undertakes to abide by these terms and conditions and complete the questionnaire truthfully and
to the best of his/her ability.
2. Participation in the audition

A group of 2 (two) eligible participants and/or individuals may participate in the audition.
Individuals who are selected will be provided with an opportunity to meet and pair up with other
selected individuals (after the auditions only if selected). After this time, only groups of 2 eligible
participants (“Team”) will be considered for further participation in KFC Taste Kitchen.
As part of the audition, individuals and/or both eligible participants of the Team will be required
to audition before a panel of judges whose decision as to whether or not the individual or Team
will proceed to KFC Taste Kitchen is final. No deliberations may be entered into and no
decisions may be taken on review.
No person will be considered to participate in KFC Taste Kitchen unless they have attended an
audition.

Attendance at the audition constitutes the individual and/or Team’s binding acceptance of the
terms and conditions contained in this document.
2.5.
The dates, venue and nature of the auditions will be broadcast on Mzansi Magic Channel (DStv
Channel 161) and indicated on the KFC Taste Kitchen “call to entry” advertisement.
2.6.
Individuals and/or Teams are required to provide further details by completing the questionnaire
(at Part B below) at the end of these terms and conditions. The further details will include full
names, identity number/passport number, contact details (e-mail and telephone numbers), next
of kin details, certain medical information, etc. Individuals and/or Teams will not be required to
provide any banking details at this stage, and will be contacted by the Organisers to furnish any
other information, as may be required from time to time. Individuals and/or both participants in a
Team must bring a head and shoulder photograph of themselves to the audition.
2.7.
Individuals and/or Teams are required to bring a hot or cold side dish that you have prepared at
home for the judges. The side dish should show off your cooking skills and individuals and/or
Teams must be prepared to discuss the dish and preparation with the judges. At the venue,
food warming facilities will be provided. The Organisers shall not be responsible for any
problems and/or faults that may result from heating and/or any failure of the equipment to
function properly or at all or as expected. All side dishes must be edible and the judges will have
the sole determination as to whether to taste a dish presented to them.
2.8.
By attending the audition, individuals and both eligible participants of the Team grant the
Organisers (together with the Organisers’ successors, assigns and licensees) the right to use all
footage, photographs and sound recordings featuring the participant and/or the Team that are
recorded during the audition for use in KFC Taste Kitchen (and to be broadcasted on television
and/or other media). This includes any cut-downs, variations, stills (complete or in parts) and all
use of the participant’s and/or the Team’s images, names, voices and other identifying
characteristics and both eligible participants of the Team agree that no amount will be paid to
them by the Organisers in respect of the aforesaid.
2.9.
Save as is otherwise expressly provided in this Audition Form, no person will be entitled to any
payment or counter-performance whatsoever by the Organisers in return of their participation in
an audition and, if successful, KFC Taste Kitchen.
2.10. The Organisers, their directors, members, partners, employees, agents, consultants, any other
person who directly or indirectly controls or is controlled by them or any supplier of goods and
services in connection with KFC Taste Kitchen and their spouses, life partners, parents, children,
siblings, business partners or associates are not eligible to participate in or enter the audition or
KFC Taste Kitchen.
2.4.
3. Selection for KFC Taste Kitchen
3.1.
After the audition, individuals and/or Teams will only be contacted by the Organisers if they are
shortlisted and/or selected to participate in KFC Taste Kitchen.
3.2.
Individual and/or Teams that have been selected to participate in KFC Taste Kitchen will be
contacted by the Organisers telephonically on or before 31 May 2017.
3.3.
Should an individual and/or Team not have heard from the Organisers by 31 May 2017, that
individual and/or Team can assume it has been unsuccessful.
3.4.
Should an individual and/or Team be selected to participate further in KFC Taste Kitchen, such
individuals and/or Team will be required to be available to the Organisers for the duration of the
filming of KFC Taste Kitchen, being the period 28 April 2017 to 31 July 2017, subject to any
early elimination of the Team from KFC Taste Kitchen, which may take place in terms of the
plot/nature of KFC Taste Kitchen. The individuals and/or Team will be required to be available
to the Organisers at all reasonable times during this period.
3.5.
Should an individual and/or Team be selected to participate in KFC Taste Kitchen, the
Organisers shall cover transport costs to get the individual and/or Team to Johannesburg
(including return back to each relevant participant’s place of residence). The mode of transport,
itinerary as well as any further travel arrangements shall be at the Organisers’ sole discretion.
3.6.
Teams will be required to reside in the communal house designated by the Organisers for the
duration of the filming of KFC Taste Kitchen, or such shorter time until eliminated. Board and
lodging in the aforesaid communal home shall be for the account of the Organisers.
3.7.
No fee, cost, remuneration or reward of any nature, whatsoever, shall be payable by the
Organisers to any participant in KFC Taste Kitchen directly or indirectly for whatsoever reason.
3.8.
It is the Team’s responsibility to ensure that any information provided is accurate, complete and
up to date and the Organisers shall not be liable for any errors and/or omission in any
information submitted by a Team.
4. Intellectual Property
4.1.
Each participant of a Team consents to the Organisers making a fixation of such Team’s
appearance and performance in the audition and, if relevant, KFC Taste Kitchen
(“Performances”), as well as any other images and/or sounds featuring the Team, in any media

(for example, television, film, photograph, video tape, etc.) in which the Performances have been
wholly or partly recorded or captured, including any reproduction or adaptation thereof, and the
broadcast thereof, as such terms are understood in terms of the Performers’ Protection Act 11 of
1967 (as amended from time to time), for the purposes of KFC Taste Kitchen, the promotion
thereof and the promotion of the participant/Team and/or KFC Taste Kitchen and/or the KFC
brand. Each participant of a Team further agrees that the Organisers and/or DStv Media Sales
Proprietary Limited may use his/her name, image, likeness, any photograph, voice, sobriquet
and signature in connection with his/her audition and/or participation in KFC Taste Kitchen for
any purpose whatsoever. Copyright and any intellectual property in the recorded Performance
shall be held by KFC Proprietary Limited.
Each participant of a Team agrees that the Organisers shall have the sole and exclusive right to
use, exploit, publish, reproduce, perform or otherwise deal with all material featuring the
Performances for or in connection with the exploitation, broadcast, exhibition, marketing,
promotion, distribution, production and sales of KFC Taste Kitchen, in perpetuity and throughout
the world.
Each participant of a Team waives any moral rights that he/she may have to the Performances
and any broadcasts thereof.
The Organisers are under no obligation to use or broadcast the whole or any part of the
Performances in the audition and/or KFC Taste Kitchen.
The Organisers may alter, adapt, make additions to or otherwise edit the Performances at their
sole discretion.
To the extent necessary, each participant of a Team hereby assigns, transfers and cedes all
his/her rights, title and interest in and to the Performances to the Producers, free of charge.
5. Non-Disclosure

Each participant hereby undertakes to treat as strictly confidential all information of any nature
whatsoever related to KFC Taste Kitchen and these auditions that has been obtained or may be
obtained, directly or indirectly, from participation in the auditions howsoever such information
may be disclosed including, without limitation, whether oral, visual, written, digital, electronic, or
any other form.
Each participant agrees that he/she will not disclose such said confidential information by any
means whatsoever, including verbal discussion, social and other media for a period of 12
(twelve) months from the date the last episode of KFC Taste Kitchen is aired by M-Net.
To give effect to the above, each participant hereby undertakes to use all reasonable steps to
keep any confidential information which is in physical form (including in electronic media) secure.
Each participant agrees that the above undertaking shall continue to be of full force and effect
regardless of whether he/she is selected for any audition or KFC Taste Kitchen.
6. General

The Organisers will not be responsible, and disclaim any and all liability, for any loss, liability,
injury, expense or damage (including direct, indirect, incidental, punitive or consequential loss) of
any nature, whether arising from negligence or any other cause, which is suffered by any
participant or any other third party as a result of his/her participation in this call to entry and/or
participation in the audition and/or use by the participant, or the participant’s partner (if
applicable), of anything relating to this call to entry and/or audition and/or by any action taken by
the Organisers or any of its affiliates in accordance with these terms and conditions and/or
whether arising from the participant’s infringement or violation of any third party rights including
intellectual property rights.
The Organisers reserve the right to vary, postpone, suspend, or cancel this call to entry and/or
any audition and/or any aspect thereof, without notice, at any time, for any reason which the
Organisers deem necessary, in their sole determination. In the event of such variation,
postponement, suspension or cancellation, each participant agrees to waive any rights, interests
and expectations that he/she may have in terms of this call to entry or audition and acknowledge
that he/she will have no recourse against the Organisers.
Under no circumstances shall the Organisers and/or its affiliates be liable for, and each
participant indemnifies the Organisers and/or its affiliates against, any loss (including indirect
and consequential loss) howsoever arising which may be suffered in relation to participation in
an audition and/or the production of KFC Taste Kitchen, whether caused by any negligent act or
omission or any default on the part of any party or otherwise.
Each participant warrants that he/she has the capacity to agree to these terms and conditions
and further that, if successful, such participant is at complete liberty to participate in KFC Taste

Kitchen and to comply with these terms and conditions and that doing so will not infringe upon
the rights of any other person.
The Organisers reserve the right to disqualify any participant should the abovementioned
warranties not be complied with and/or if any other provision in the terms and conditions are not
complied with.
By attending the audition for KFC Taste Kitchen, each participant accepts and agrees to abide
by the terms and conditions set out herein and any other such rules and conditions that the
Organisers may issue in relation to further phases of KFC Taste Kitchen from time to time.
These terms and conditions are governed by South African law and the South African courts
shall have sole and exclusive jurisdiction in respect of all matters (including disputes) arising
these terms and conditions.
If any of these terms and conditions are not adhered to, your entry will be considered incomplete
and will be regarded as null and void.

7. Use of Personal Information

contribution to KFC Taste Kitchen whether now in existence or arising in the future, including without
limitation, my performance, any comments ascribed to me, as part of the audition or otherwise, any
psychological testing, any interview and any inclusion of my photographs, likeness, profile, voice, sound
effect, caricature, literary, artistic and musical materials and the like for purposes of KFC Taste Kitchen
and/or any related publicity, research and marketing, which the Organisers hereby accept. The Organisers
shall therefore be entitled to use and exploit and licence others to use and exploit such contributions, in
whole or in part, by all means and in all media, manner and formats whether now known or hereafter
invented throughout the world and in perpetuity.

8. Acknowledgements and Confirmation by the Participants
8.1.
I am aware that the Organisers will consider the information supplied by me in this document for
purposes of considering me as a participant in KFC Taste Kitchen.
8.2.
I have answered all the questions on the audition form fully, honestly and accurately and I
confirm that I have not misled or attempted to mislead the Organisers in any respect as to my
identity, experiences or in any other way;
8.3.
If any of the information I have provided in the questionnaire is found to be false, the Organisers
will be entitled to immediately exclude me from further participation in the auditions and/or KFC
Taste Kitchen.
8.4.
If I am short listed by the Organisers, I am prepared to undergo psychological and medical
screening. I understand that the full details of this will be explained to me in advance.
8.5.
If I am short-listed, I also agree to authorise the Organisers to conduct background checks to
verify any of the information I have supplied.
8.6.
I understand that consenting to these terms and conditions and completing the questionnaire
below is no guarantee that I will be chosen to participate further in KFC Taste Kitchen.
8.7.
If my audition is successful, the Organisers have no obligation to produce KFC Taste Kitchen
and, even if done so, there will be no obligation on the Organisers or any broadcaster to
broadcast it.
8.8.
All decisions by the Organisers concerning selection of the participants are final and no reasons
will be given. No deliberations may be entered into and no decisions may be taken on review.
8.9.
By participating in the audition and, if relevant, in KFC Taste Kitchen, I accept and agree to
abide by these terms and conditions set out herein and such rules and conditions that the
Organisers may issue in relation to the audition and all further phases of KFC Taste Kitchen
from time to time.
8.10. I hereby assign to the Organisers the right to use my photographs, likeness, profile, voice, sound
effect, caricature, literary, artistic and musical materials and the like for purposes of KFC Taste
Kitchen and/or any related publicity and marketing, which the Organisers accept.
8.11. I am not a disqualified person and am entitled to participate in the audition and, if selected, KFC
Taste Kitchen.
