INVITATION FOR BID
The Advertised Bid to Lease Trust Restricted Indian Land to be conducted under the provisions of
Title 25 Code of Federal Regulations - Parts 162.212, and 162.203 under Leasiing and Permitlting.
The advertisement is limited to TRUST INTERESTS ONLY.
SEALED BIDS, SUBJECT TO THE TERMS AND CONDITIONS OF TI{IS IN\/ITATIONI, ITS
SCHEDULES AND STIPULATED PROVISIONS, MUST BE RECEIVED ATTHIS OFI:ICE UNTIL 4100
P.M., April 27th.2017. All bids must be enclosed in an envelope marked plarinly "FlD FOR LEASE
TO BE OPENED April 28. 2017", addressed to the Bureau of Indian Affairs, Clolviller Indian Agency,
Post Office Box 111, Nespelemo WA 99155. The openirnq of bids will be lheld at the GOLVILLE
INDIAN AGENCY, BIA BUILDING in the LARGE CONFERENCE Office at l:0t0 lP.M. on April 2E.2017_.
IMPORTANT TERMS:
It is the responsibility of the interested bidder(s) to sign in and be physically attending the opening
of the bids to be afforded the opportunity to match and/or offer the higherst bid. This includes
absolutely "NO REPRESENTATIVES" (Proxies) to be attending on part of a bidder. The bidder is
the sole person to be allowed to be involved in the bid process. The highest bidder will have until
4:00 P.M. on the same business day to provide the GOLVILLE AGENCY - BIA the arppropriate bid
funds
or the successful bid will go the next highest bidder that provides
rerquired
documents/funds.
Bids on Indian Land offered for lease must be accompanied by a cashier's check, c;ertified check,
postal money order, or United States Treasurer's check, payable to COLVILLE AGENCY - BlA, For
Not Less than 10%of the yearly/monthly cash offer, but not less than $10.00 on any one itern. (NO
PERSONAL CHECKS WILL BE ACCEPTED, and/or CASH, THEY WlLl- ElEi RETU]INED TO THE
BtDDER, NO EXCEPTTONS.)
Failure on the part of the successful bidder to deposit the initial year'si rental, plus the lease fee
and any other required lease supporting documents within thirty (30) days after the award wtll
constitute a forfeiture of the bid deposit. The terms and conditions of each lease can be inspected
at the Bureau of Indian Affairs, Colville Indian Agency, Nespelem, Washington, Monday through
Friday, between the hours of 7:30 a.m. to 4:00 p.m.
Award of a lease, pursuant to this notice, on tribal tracts are subject to relcommendation to the
Colville Business Council's Natural Resource Committee. Leases awarded on individually-owned
lands are subject to consent of the landowners or execution by the Superintendent of the Oolville
lndian Agency having jurisdiction over the land in accordance with applicable regulations. All
awarded leases are subiect to Fair Market Rental (FMR). which will be deterrrnined w'ithin the first
vears of the lease.

It is understood and agreed that fences shall be put up and maintained lby the lessee to goodl
stock-tight condition, using steel or treated wooden posts where posts are requil.ed throughoul:
the term of the lease and prior to AUM turnout. Fencing: The Ran1tre Depilrtment ii nol:
responsible for maintaining the fences on private or lease land unless perrnitted liverstock from the
range unit have damaged that fence and are trespassing. lf a parcel of private/leased land is
located entirely within the boundaries of a range unit, it is tltre responsibility of thal:
fandowner/lessee to "fence out" the range unit and/or livestock therein. Colville Trilbal Code: 4-11.,

Colville Tribal members, who have submitted a bid on a parcel of Tribal lLand miay be afforded
preference to meet the high bid on said parcel of land, provided the high bidder is a non-tribal
member.
Notice: All bidders must be in good standing with all Tribal and Burrsau of Indian Affairs (BlA)
programs and may be subject to additional lease requirements as deitermined by Tribal/BlA
review, i.e. (farm plan, conservation plan, and 3P/Cat Ex review). Ther suc;cessful bidder will be
required to furnish a cash bond or letter of credit from a financial institution as detrermined by the
Superintendent of the Colville Indian Agency within thirty (30) days from bicl date. 'fhe successful
bidder will also be required to provide insurance in an amount acle,quate to protect any
improvement on the leased premises. Any Additional Lease Requirements devreloped will be
attached to and made a part of the lease document.
Bids will only be accepted on the bid sheet form that is attached.
On those tracts in which an undivided interest is offered for lease, hids will be accepted and
considered for the undivided restricted trust interest onlv. The prosprective lessee will be
responsible for arranging rental payment to those non-trust owners (fen) of tlheir undivided
interests.
Bids may be officially withdrawn by written request received by the Colville Agency - BlA, PO Box
111, Nespelem, Washington,99155 from the bidder 24 hours priorto the bid date opening. There
will be no collusion in which the highest bidder withdraws after the opening of thrg bids to allow
the second highest bidder to get a lower rental value. Both the bidders will forfeit their bicl offers
to the Colville Agency and said pnoperty will re-advertised for birl; arrd this is subject to
Superi ntendent discretion.
The lands herein listed are to be leased subject to any or all valid existing enrcumbrances.
At the time fixed for the opening of the bids, the contents will be made putllic for the information
of the bidders and other interested persons who are present. All rillyelopes mrust be plainlv
marked.
